This document discusses Ohio laws regarding fertilizer applicator certification and restrictions. It notes that under Senate Bill 150, any applicator applying fertilizer to more than 50 acres of agricultural production grown primarily for sale will need certification by September 2017. Applicators must recertify every three years by attending training. Uncertified applicators may apply fertilizer under instruction and control of a certified applicator. The document also provides information on the definition of fertilizer and exceptions to the certification requirements.

Fertilizer Certification is Required
by September 2017 if you:
• SB 150
• Apply fertilizer to more than 50 acres of agricultural
production grown primarily for sale
• CCAs and CLMs need only provide evidence of
credentials with certificate application, exempt from
the education requirement
• No difference between commercial and private
fertilizer applicators

• Contains a recognized plant nutrient element……. which is
used for its plant nutrient content or for compounding mixed
fertilizers. Has a guaranteed analysis = fertilizer under this law
• Does not include lime, limestone, marl, unground bone, water,
residual farm products, animal or vegetable manures unless
mixed with fertilizer materials or distributed with a guaranteed
analysis

Uncertified applicators may apply fertilizer if acting under instruction and control
of a certified fertilizer applicator
The applicator must be:
• Within 25 miles or 2 hours travel of certificate holder
• Employed by the same business or farm as the certificate holder, or an
immediate family member
• Instructed where, when, and how to apply the fertilizer

We have these concerns about nutrient loss from agricultural areas, and we are monitoring in order to determine the levels of nutrient runoff
Monitoring is done through automatic samplers which collected on a timed interval basis when a water event occurs. These samplers are running 24 hours a day, 7 days a week and 52 weeks of the year. An insulated box with supplemental heat allows for winter operation.
An area of concentrated flow of surface water is identified. A flume that can be used to measure the water leaving is set with a wing wall added to direct all surface water through the flume.
Tile water leaving the site is measured through an notched weir and stilling well installed directly in the tile line. The left side picture shows a monitoring system for tile.
Through monitoring the total volume of water leaving the site is measured as well as the nutrient concentration so total loading per acre can be determined. Nitrogen and phosphorus are measured on all samples with some samples used to determine suspended solids (sediment flows).
50 acres combined production – so if you grow multiple crops add total production. Procedures for Commercial and private fertilizer applicators the same – but if they are pesticide applicators – the fertilizer recertification cycle deadline will differ depending on whether they are private or commercial pesticide applicators
Any type of crop – even greenhouse crops, however, there are probably only 1 or 2 greenhouse growers in Ohio exceeding 50 acres.
Recognized plant nutrient, e.g., N, P, K or other plant essential element – containing materials. If a material has a guaranteed analysis it is considered a fertilizer under this law!!!! A compost or manure-based product with a guaranteed analysis would be considered a fertilizer by this definition
The certified applicator who is directly supervising a uncertified applicator must either directly employ the applicator, be an immediate family member, or work in the same business supervising them. Immediate family member = spouse, parents, children, grandparents, siblings, grandchildren, in-laws (brother-, sister-, son-, mother-, father-in-law); step-children, step-siblings, step-parents, or a legal guardian.
