4. WHAT IS LAND
ACQUISITON?
It is explained in Law No. 2 of 2012 that land
acquisition is an activity to provide land by giving
proper and fair compensation to the entitled party,
the Entitled Party is the party who has the right to
control or own the object of land acquisition.
Land Procurement Objects are land, above-ground
and underground spaces, buildings, plants, objects
related to land, or other things that can be valued.

Land Procurement for Public Interest aims to
provide land for the implementation of development
in order to improve the welfare and prosperity of the
nation, state and society while still guaranteeing the
legal interests of the Entitled Party.

8. The need for transportation facilities is very important for the sustainability of various
sectors of people's lives. Changes in people's preferences in using long-distance
transportation modes that make air transportation the main choice - with various
advantages including time efficiency, convenience, and competitive prices with land
transportation - are increasingly encouraging the construction or development of airports
in Indonesia. This is shown by the construction of 4 new airports which are included in 17
lists of national strategic projects. The new airport construction project consists of Kertajati
Airport, Karawang Airport, International Airport in the Special Region of Yogyakarta (DIY),
and South Banten Airport. The total population of Indonesia until 2017 was around 264
million people and more than 100 million of them made domestic and international air
trips. This fact makes Indonesia one of the very large aviation markets where the growth
rate of air traffic is among the highest in the world.
9. Yogyakarta as a student city and a city that is visited a lot for sightseeing makes many tourists come to
Yogyakarta because of that the government made efforts to improve the quality of the airport by
expanding the airport land in 2004 to an area of
77,200 m2 for parking development. Continued in
2005 covering an area of
25,189 m2 and in 2006 covering an area of
11,600 m2 to the north of the rail
which is also for the expansion of the airport parking area. With a capacity of only 1.2 million
passengers, Adisutjipto Airport began to experience a decline in service quality because the number of
passengers served was not proportional to the availability of existing facilities.
Seeing the condition of Adisutjipto Airport which was no longer possible to be developed, it gave rise to
a discourse against PT. Angkasa Pura I to build a new airport in Yogyakarta
nitially, there were 7 areas in Yogyakarta that were studied as locations for the construction of a new
airport, namely Adisutjipto Airport, Gading-Gunungkidul Airport, Selomartani-Sleman, Gadingharjo-
Bantul as well as Bugel, Bulak Khayangan, and Temon in Kulon Progo. Of the 7 prospective airport
locations that are considered to meet the technical and operational requirements for the construction of
a new airport, only the Gadingharjo and Temon areas.
11. Problems

12. SOLUTION
The government as well as Angkasa Pura I
have taken various approaches to the
community who refused it as a form of
effort to get the community to want their
land to be measured, assessed and
compensated
For residents' lands that refuse to be
measured or appraised by the National
Land Agency as the development
implementing team, compensation based
on the appraisal team's assessment will be
entrusted to the District Court or called the
Consignment Process.

SOLUTION
Since the enactment of Law No. 5 of 1960 or
what is called the UUPA in the Special Region of
Yogyakarta, the provision also applies that all land
that cannot be proven legally by other parties is
the domain of the Yogyakarta Palace and Puro
Pakualaman. The palace gave Anggadoh rights
from generation to generation to the people which
were actually used by the people and Land
Administration Books began to appear in each
kelurahan. This land is included in the class of
palace land that is still being worked on by the
community, there are no buildings, either with
permission or not.
Hundreds of former Pakualaman land
cultivators who have been working on it
for generations, using the land for
generations and making the land their
only main source of livelihood. The
farmers who cultivate the kukualaman
ground do not receive compensation or
compensation for non-physical losses
that arise because they do not have legal
rights in ownership of the land.
15. As an effort to resolve the land acquisition dispute on the object of the Yogyakarta
International Airport construction, the government and Angkasa Pura I have made
various efforts that lead to a settlement that meets the values
of justice and benefit,
including, providing compensation with a value above the market price and
providing free relocation houses for several underprivileged residents in an area not
far from the previous settlement. However, the dispute resolution efforts still have
several records and have not fully met the values
of social justice and benefits,
including the disconnection of electricity and road access restrictions for people
who still occupy their land because they refuse to build an airport is a form of
dispute resolution that does not reflect the value of justice and benefit value. The
basis for the termination of the electric current connection is a Court Decision
which states that the land in question will be resolved by a consignment procedure.
