THAT IT HAS NOT BEEN CERTIFIED. THERE ARE SEVERAL REASONS WHY RESIDENTS DO NOT REGISTER THEIR LAND TO OBTAIN A
CERTIFICATE. BASED ON THE RESULTS OF THE PRELIMINARY SURVEY, IN BUTUH VILLAGE, PURWOREJO REGENCY, THERE IS STILL LAND
THAT HAS NOT BEEN REGISTERED SO THAT IT HAS NOT BEEN CERTIFIED. ACCORDING TO THE SECRETARY OF THE BUTUH VILLAGE,
PURWOREJO REGENCY, IN 2008 A MASS CERTIFICATION WAS HELD, BUT THERE ARE STILL MANY RESIDENTS WHO HAVE NOT PARTICIPATED
IN THE MASS CERTIFICATION PROGRAM. THE REASONS ARE:

4. 1. LACK OF COMMUNITY KNOWLEDGE ABOUT LAND CERTIFICATION
MANY PEOPLE OF BUTUH VILLAGE COMMUNITY WHO DO NOT KNOW ABOUT THE PROCEDURES AND
REQUIREMENTS THAT MUST BE MET IN LAND CERTIFICATION. THE LACK OF PROOF OF LAND
OWNERSHIP IS ONE OF THE CAUSES OF THE LACK OF LAND RIGHTS REGISTRATION PROCESSES IN
ADDITION TO THE LACK OF PUBLIC KNOWLEDGE OF THE IMPORTANCE OF PROOF OF LAND RIGHTS
OWNERSHIP. FOR THE PROCESS OF MAKING CERTIFICATES, THEY MUST HAVE COMPLETE DOCUMENTS
FOR THE LAND THEY OWN, BUT IN REALITY, THE LANDS OWNED BY INDIGENOUS PEOPLES HAVE BEEN
PASSED DOWN FROM GENERATION TO GENERATION, SO THAT LAND OWNERSHIP CERTIFICATES ARE
VERY MINIM AND SOME DO NOT EVEN HAVE THEM.

5. 2. THE BOUNDARY MARKERS HAVE NOT BEEN INSTALLED
MANY PEOPLE IN THE COMMUNITY DID NOT SET THE STAKES AT THE TIME OF MEASUREMENT. MOST
OF THEM ASSUMED THAT THE STAKES WERE SET WHEN PBN OFFICERS WERE IN THE FIELD WHEN
TAKING MEASUREMENTS. WHEREAS THE STAKES SHOULD HAVE BEEN INSTALLED FIRST AND THEN
MEASUREMENTS WERE MADE BY BPN OFFICERS. DUE TO THE ABSENCE OF LIMITING STAKES, BPN
OFFICERS HAVE DIFFICULTY IN MEASURING SO THAT THE MEASUREMENT PROCESS CANNOT BE
CARRIED OUT. THIS CAUSES THE MEASUREMENT PROCESS TO RUN SLOWLY.

6. 3. DIFFICULTY PRESENTING BOUNDARY NEIGHBOURS
SOMETIMES THERE IS NO AGREEMENT BETWEEN THE LAND OWNER AND HIS NEIGHBOURS REGARDING
THE BOUNDARIES OF THE LAND. THIS HAPPENS IN THE MEASUREMENT OF LAND THAT DOES NOT YET
HAVE A PEG LIMIT. THE ABSENCE OF AGREEMENT BETWEEN THE OWNER AND THE NEIGHBOURING
BOUNDARY CAUSES THE MEASUREMENT PROCESS TO RUN SLOWLY.

8. THE LEGAL CONSEQUENCE OF LAND THAT IS NOT REGISTERED AT THE BPN OF PURWOREJO REGENCY IS
THAT THE LAND CANNOT BUT HAVE STRONG LEGAL FORCE, SO IT CANNOT BE USED AS COLLATERAL
(COLLATERAL) IN GRANTING MORTGAGE RIGHTS. LIKEWISE IN THE TRIAL, LAND THAT HAS NOT BEEN
CERTIFIED DOES NOT HAVE STRONG LEGAL FORCE SO IT CANNOT BE ACCEPTED BY THE JUDGE AT
TRIAL. THIS IS IN LINE WITH ARTICLE 19 PARAGRAPH 1 OF THE BAL WHICH READS "TO ENSURE LEGAL
CERTAINTY BY THE GOVERNMENT, LAND REGISTRATION IS HELD THROUGHOUT THE TERRITORY OF THE
REPUBLIC OF INDONESIA ACCORDING TO THE PROVISIONS STIPULATED IN GOVERNMENT
REGULATIONS."

10. THERE ARE SEVERAL EFFORTS MADE TO OVERCOME THE OBSTACLES IN THE IMPLEMENTATION OF
LAND REGISTRATION IN THE BUTUH VILLAGE, PURWOREJO REGENCY, AS FOLLOWS:
1. LACK OF COMMUNITY KNOWLEDGE ABOUT LAND CERTIFICATION
DUE TO THE LACK OF PUBLIC KNOWLEDGE, THE REGISTRATION PROCESS IS SLOW. FOR THIS REASON,
BPN OFFICERS CARRY OUT SOCIALIZATION TO THE COMMUNITY THROUGH THE KELURAHAN/VILLAGE
RELATED TO THE LAND REGISTRATION PROCEDURE, INCLUDING THE REQUIREMENTS THAT MUST BE
MET BY THE APPLICANT. IN THE EVENT THAT THE FILES HAVE BEEN SUBMITTED AND ARE STILL
INCOMPLETE, THE OFFICER WILL RETURN THEM TO THE APPLICANT BY PROVIDING AN EXPLANATION
SO THAT THEY ARE COMPLETED.

11. 2. THE BOUNDARY MARKERS HAVEN'T BEEN INSTALLED YET
IN THE ABSENCE OF BOUNDARY MARKERS, BPN OFFICERS CANNOT TAKE MEASUREMENTS. FOR THIS
REASON, THE OWNER IS ASKED TO IMMEDIATELY INSTALL BOUNDARY MARKERS. IF POSSIBLE,
MEASUREMENTS ARE MADE BY PRESENTING THE OWNER AND NEIGHBORS OF THE BOUNDARY IN THE
FIELD TO SHOW THE BOUNDARIES OF THE LAND.
3. DIFFICULTY PRESENTING BOUNDARY NEIGHBORS
THIS OBSTACLE IS RELATED TO THE NON-INSTALLATION OF BOUNDARY MARKERS. WHEN A
MEASUREMENT IS TO BE TAKEN WITHOUT THE INSTALLATION OF STAKES, THE OWNER AND
NEIGHBORS OF THE BOUNDARY MUST BE PRESENT. WHEN THERE IS NO BOUNDARY NEIGHBOR, THE
MEASUREMENT IS POSTPONED BY WAITING FOR THE PRESENCE OF A BOUNDARY NEIGHBOR.

13. Based on the results of research in the Butuh Village, Purworejo Regency, it is known that until 2015 as
many as approximately 500 village land parcels out of a total of 3776 SPPT have been certified. There are
several reasons that underlie the residents of Need Village, Need District, Purworejo Regency to carry out
land registration, among others as proof of ownership, public awareness of the importance of
certificates, as well as to be used as collateral for bank loans. in Perkaban No. 1 of 2010 concerning
Service Standards and Land Regulations, namely:
1. Fill out and sign the application form (identity, area, location and use of the land requested, statement
of no dispute and physical possession of the land)
2. Power of attorney if authorized
3. Photocopy of identity (KTP and KK) of the applicant or proxy if authorized
4. Proof of land ownership
5. Photocopy of the current year's PBB SPPT
6. Attach SPP/PPh in accordance with the provisions
14. THUS, IT CAN BE CONCLUDED THAT THE LAND REGISTRATION PROCESS FOR THE FIRST TIME IN BUTUH
VILLAGE, BUTUH DISTRICT, PURWOREJO REGENCY HAS BEEN IN ACCORDANCE WITH THE PROVISIONS
OF THE APPLICABLE LAWS AND REGULATIONS, SO IT CAN BE SAID THAT THE IMPLEMENTATION OF
LAND REGISTRATION IS EFFECTIVE. ALTHOUGH NOT ALL RESIDENTS KNOW THE PROCEDURE FOR
REGISTERING LAND FOR THE FIRST TIME.
