Purpose
This policy defines conduct unbecoming a police officer. This policy supplements the ethical standards contained in the International Association of Chiefs of Police's Law Enforcement Code of Ethics, a copy of which has been included following this policy.
Policy
Law enforcement effectiveness depends upon community respect and confidence. Conduct which detracts from this respect and confidence is detrimental to the public interest and should be prohibited. The policy of this Department is to investigate circumstances suggesting an officer has engaged in unbecoming conduct, and impose disciplinary action when appropriate.
Scope
This policy applies to all officers of this agency engaged in official duties, whether within or outside of the territorial jurisdiction of this agency. Unless otherwise noted, this policy also applies to off duty conduct as well. Conduct not mentioned under a specific rule, but which violates a general principle is prohibited. This policy is organized into eight principles governing conduct unbecoming an officer. The rationale explaining the principle and a set of rules follow each principle.
Principle One
Police officers shall conduct themselves, whether on or off duty, in accordance with the Constitution of the United States, the Florida Constitution, and all applicable laws, ordinances and rules enacted or established pursuant to legal authority.
Rationale
Police officers conduct their duties pursuant to a grant of limited authority from the community. Therefore, officers must understand the laws defining the scope of their enforcement powers. Police officers may only act in accordance with the powers granted to them.
Rules
1.1 Police officers shall not knowingly exceed their authority in the enforcement of the law.
1.2 Police officers shall not knowingly disobey the law or rules of criminal procedure in such areas as interrogation, arrest, detention, searches, seizures, use of informants and preservation of evidence.
1.3 Police officers shall not knowingly restrict the freedom of individuals, whether by arrest of detention, in violation of the Constitutions and laws of the United States and the State of Florida.
1.4 Police officers, whether on or off duty, shall not knowingly commit any criminal offense under any laws of the United States or any state of local jurisdiction in which the officer is present, except where permitted in the performance of duty under proper authority.

2. A. Historical Background
Internal Affairs Service was created pursuant to the provisions of
Title V, Republic Act 8551, otherwise known as the Philippine National
Police Reform and Reorganization Act 1998 approved on February 25,
1998. This is based on the study by Congress that the most effective
and successful mechanism in disciplining of police officers used in other
countries is the creation of a police within the police.
On May 7, 1999, President Joseph Estrada issued Executive
Order NO. 101 entitled “ Providing for the Immediate Organization and
Operationalization of the Interim Internal Affairs Service of the Philippine
National Police.” Executive Order No. 101 provided for the immediate
organization and operationalization of an Interim IAS pending the
approval of its manning and staffing pattern. It empowered IAS to
inquire into the state of discipline, efficiency, economy, training, morale
and readiness of the PNP.

To secure for the nation the evolvement of a well-disciplined, effective,
efficient and service-oriented Philippine National Police.

We envision the Internal Affairs Service (IAS) to be truly independent

The Internal Affairs Service (IAS), although a part of the PNP has the
attribute of an independent and autonomous unit which empowers it to act
on matters within its jurisdiction without having to wait for instructions from
the Chief, PNP. Pursuant to Section 39, Republic Act 8551, such powers
are:
•Pro-actively conduct inspection and audit of PNP personnel and units;
•Investigate complaints and gather evidence in support of an open
investigation;
•Conduct summary hearings on PNP members facing administrative
charges;
•Submit a periodic report on the assessment, analysis and evaluation of the
character and behavior of PNP personnel and units to the Chief, PNP and
the Commission;
•File appropriate criminal cases against PNP members before the court as
evidence warrants and assist in the prosecution of the case;
•Provide assistance to the Office of the Ombudsman in cases involving the
personnel of the PNP.
5. The Internal Affairs Service (IAS) also conducts motu proprio, automatic
investigation of the following cases:
a) Incidents where a police personnel discharges a firearm;
b) Incidents where a death, serious physical injury or any violation of
human rights occurred in the conduct of police operation;
c) Incidents where evidence was compromised, tampered with,
obliterated or lost while in the custody of police personnel;
d) Incidents where a suspect in the custody of the police was seriously
injured; and
e) Incidents where the established rules of engagement have been
violated.
Finally, the IAS shall provide documents or recommendations as regards
to the promotion of the members of the PNP or the assignment of PNP
personnel to any key position.

on the impiementation of the PNP Code of Ethics
and Code or Frofessional Conduct and Ethical
Standards.
2. Monitor and review the systems and
procedures in the conduct of police operations
and make necessary recommendations to improve
police service and to meet ccmmunity expectations.
3. Examine police practices and procedures in
the conduct of investigation of erring PNP
Personnel.
4. Prepare and submit pertinent reports to the
Chief, PNP(thru. lG IAS).
The Regional, lDUs shall perform the following functions within their area of
iurisdiction:
1. lmplement strategies and programs to strengthen systems, improve ethical
andprofessional standardsandreduce the level ofvulnerabilitytocorruption
or serious misconduct of PNP Personnel;
2. Conduct value development programs for PNP personnel in order to
