• Local exhaust ventilation

• Environmental monitoring
• Statistical monitoring
• Research
3. LEGISLATION
THE FACTORIES ACT ,1948
• Factory using power - ≥10 workers & not using power - ≥20 workers
• Worker - contract labourer employed in manufacturing process
• No worker shall carry load likely to cause him injury
• ≥1000 workers – appoint Safety Officers
• ≥250 workers – provide canteen
• Adolescent(15 -18 years) fitness by Certifying Surgeons ; 4.5 hours per day
• Maximum 48 working hours per week (not exceed 60 hours- overtime)
• 9 hours per day with rest for atleast ½ hour after 5 hours continuous work
• Spread over period of work(includes rest interval) – 12 hours
• Leave with wages after 12 month continuous service
adult: 1 day for 20 day work; child: 1 day for 15 day work
• A schedule of notifiable diseases
• Enquiry in every case of fatal accident
• Safety and occupational health surveys
• Employment in hazardous processes – Site Appraisal Committee
consists of Chief Inspector and other members, not >14 members
THE FACTORIES ACT ,1948
• Power using factories other than seasonal factories ≥10 employed
• Medical facilities - ESI dispensaries, panel clinics, 307 diagnostic centres, ESI
hospitals
• Super-speciality care – tie-up arrangements with advanced medical institutions
• Employer contributes 3.25% &employee 0.75% of total wage bill
• Share of medical care expenditure:
State govt 1/8 & ESI Corporation 7/8 of total cost
EMPLOYEES STATE INSURANCE ACT, 1948
1. MEDICAL BENEFIT
• Outpatient care
• Drugs & dressings supply
• Specialist services
• Pathological &radiological investigations
• Domiciliary services
• Antenatal, natal, postnatal services
• Immunization services
• Family planning services
• Emergency services
• Ambulance services
• Health education
• IP treatment
• Dentures, spectacles, hearing aids
• Artificial limbs
• Special appliances –walking callipers,
spinal braces
2. SICKNESS BENEFIT
• Periodical cash payment to an insured person, sickness certified by an
Insurance Medical Officer.
• Benefit payable for max 91 days, daily rate 70% of daily wages
EXTENDED SICKNESS BENEFIT
• Insured persons suffering from 34 long term diseases benefit payable for
maximum period of 2 years.
3. MATERNITY BENEFIT
• Benefit allowed at full wages
• Confinement-for 26 weeks
• Miscarriage-for 6 weeks
• Sickness-for 30 days
• Rate of confinement expenses Rs 5000 per confinement
4. DISABLEMENT BENEFIT
• Cash payment + free medical treatment if disablement due to employment injury
• Temporary disablement benefit is 90% of wages
• Total permanent disablement – life pension
• Partial permanent disablement – portion of life pension
5. DEPENDANT’S BENEFIT
• Death of an insured person, pension at rate of 90% wages payable shared by
dependants in fixed ratio (child- upto 18 years)
6. FUNERAL EXPENSES
Not exceeding Rs 10,000 towards funeral expenses
7. REHABILITATION ALLOWANCE
Monthly payment of Rs 10, insured person & family members
continue to get medical treatment after disablement

  • 3. PREVENTION OF OCCUPATIONAL DISEASES 1. MEDICAL MEASURES: • Pre-placement examination • Periodical examination • Medical and health care services • Notification • Supervision of working environment • Maintenance and analysis of records • Health education and counselling

ENGINEERING MEASURES • Design of the building • Good house-keeping • General ventilation • Mechanization • Substitution of harmful material • Dusts control • Enclosure of harmful material • Isolation of offensive process • Local exhaust ventilation • Protective devices • Environmental monitoring • Statistical monitoring • Research

LEGISLATION THE FACTORIES ACT ,1948 • Factory using power - ≥10 workers & not using power - ≥20 workers • Worker - contract labourer employed in manufacturing process • No worker shall carry load likely to cause him injury • ≥1000 workers – appoint Safety Officers • ≥250 workers – provide canteen • Adolescent(15 -18 years) fitness by Certifying Surgeons ; 4.5 hours per day • Maximum 48 working hours per week (not exceed 60 hours- overtime) • 9 hours per day with rest for atleast ½ hour after 5 hours continuous work
  • 6. • Spread over period of work(includes rest interval) – 12 hours • Leave with wages after 12 month continuous service adult: 1 day for 20 day work; child: 1 day for 15 day work • A schedule of notifiable diseases • Enquiry in every case of fatal accident • Safety and occupational health surveys • Employment in hazardous processes – Site Appraisal Committee consists of Chief Inspector and other members, not >14 members THE FACTORIES ACT ,1948
  • 7. • Power using factories other than seasonal factories ≥10 employed • Medical facilities - ESI dispensaries, panel clinics, 307 diagnostic centres, ESI hospitals • Super-speciality care – tie-up arrangements with advanced medical institutions • Employer contributes 3.25% &employee 0.75% of total wage bill • Share of medical care expenditure: State govt 1/8 & ESI Corporation 7/8 of total cost EMPLOYEES STATE INSURANCE ACT, 1948

MEDICAL BENEFIT • Outpatient care • Drugs & dressings supply • Specialist services • Pathological &radiological investigations • Domiciliary services • Antenatal, natal, postnatal services • Immunization services • Family planning services • Emergency services • Ambulance services • Health education • IP treatment • Dentures, spectacles, hearing aids • Artificial limbs • Special appliances –walking callipers, spinal braces
  • 9. 2. SICKNESS BENEFIT • Periodical cash payment to an insured person, sickness certified by an Insurance Medical Officer. • Benefit payable for max 91 days, daily rate 70% of daily wages EXTENDED SICKNESS BENEFIT • Insured persons suffering from 34 long term diseases benefit payable for maximum period of 2 years.
  • 10. 3. MATERNITY BENEFIT • Benefit allowed at full wages • Confinement-for 26 weeks • Miscarriage-for 6 weeks • Sickness-for 30 days • Rate of confinement expenses Rs 5000 per confinement 4. DISABLEMENT BENEFIT • Cash payment + free medical treatment if disablement due to employment injury • Temporary disablement benefit is 90% of wages • Total permanent disablement – life pension • Partial permanent disablement – portion of life pension
  • 11. 5. DEPENDANT’S BENEFIT • Death of an insured person, pension at rate of 90% wages payable shared by dependants in fixed ratio (child- upto 18 years) 6. FUNERAL EXPENSES Not exceeding Rs 10,000 towards funeral expenses 7. REHABILITATION ALLOWANCE Monthly payment of Rs 10, insured person & family members continue to get medical treatment after disablement
