Right to Education
The Constitutional Amendment of 2002 that included the Article 21A in the Indian constitution making Edu- cation a fundamental Right. A rough draft of the bill was composed in year 2005.
The Right of Children Free and Compulsory Education Act was pro- posed on 4th August, 2009. It came into effect on 1st April, 2010, except in the state of Jammu and Kashmir.
On 7 May 2014, the Supreme Court of India ruled that Right to Education Act is not applicable to Minority institutions.
Main Provisions
It lays emphasis on the development of both scholastic and coscholastic areas.
It is obligatory for the Government to provide free and compulsory elementary education, up to Class 8th, to each and every child in India in a neighbourhood school within 1 km.
RTE Act lays down norms and standards relating to relating to PupilTeacher Ratios (number of children per teacher), classrooms, separate toilets for girls and boys, drinking water facility, number of school-working days, working hours of teachers, etc. Each and every elementary school (Primary School + Middle School) in India has to comply with these minimum standards set by the RTE Act.
RTE Act mandates that an out of school child is admitted to an age appropriate class and provided with special training to enable the child to come up to age appropriate learning level.
RTE Act prohibits physical punishment and mental harassment; discrimination based on gender, caste, class and religion; screening procedures for admission of children; capitation fee; private tuition by teachers and running of schools without recognition.
RTE Act provides for development of curriculum, which would ensure the all-round development of every child by building child's knowledge, human potential and talent.
The Act has mandated the Continuous Comprehensive Evaluation (CCE) method to ensure grade ap- propriate learning outcomes.
RTE Act is justiciable and is backed by a Grievance Redressal (GR) mechanism that gives opportunity to people to take action against non-compliance of various provisions of the Act.
RTE Act mandates all the private schools to reserve 25 per cent of the seats for children belonging to socially disadvantaged and economically weaker sections. This provision of the Act is aimed.at furthering social inclusion for a better India.

The implementation of the RTE Act has faced several challenges, particularly in terms of ensuring access to education for all children, particularly those from marginalized and disadvantaged communities. Despite efforts to improve access to education, many children in India are still out of school, particularly in rural areas and among lower-caste and tribal communities.

In July 2020, the Union Cabinet of India approved the New National Education Policy (NEP) with the aim to bring modern reforms in the Indian education system from the school to the college level.
The examination reveals that the policy document focuses on the development of introductory courses, professional courses, and vocational courses for the students. The objective of developing courses is to develop a student's attitude and aptitude. It also focuses on creating industry-ready and entrepreneurial orientation among the students. The NEP aims to increase the use of technology in education. There is a provision in the policy, technology or e-learning is the need of the hour (Kaurav, Rajput, & Baber, 2019). The policy also mentions that a National Education Technology Forum needs to be formed so that it could act as a podium where there can be the exchange of ideas on the use and development of technology. Previously, the education policies were offering exposure to the students which, in turn, would help the student to evolve. The current education policy focuses on a student exchange program that provides students with multiple exit points. It is visible from the examination in this study that the effort has been made to evolve the Indian education system and offer students international level pedagogy. 3. NEP Implementation Review 2022 By PM Modi:
Prime Minister Modi chaired a key review meeting
on the implementation of New Education Policy
NEP 2020. The meeting to review the
implementation on NEP was held on 7th May
2022.
4. Since the country's independence in 1947, the Indian government
sponsored a variety of programmes to address the problems of illiteracy in
both rural and urban India. Maulana Abul Kalam Azad, India's first
Minister of Education, envisaged strong central government control over
education throughout the country, with a uniform educational system.
The Union government established the University Education Commission
(1948–1949), the Secondary Education Commission (1952–1953),
University Grants Commission and the Kothari Commission (1964–66) to
develop proposals to modernise India's education system. The Resolution
on Scientific Policy was adopted by the government of Jawaharlal Nehru,
India's first Prime Minister. The Nehru government sponsored the
development of high-quality scientific education institutions such as
the Indian Institutes of Technology. In 1961, the Union government formed
the National Council of Educational Research and Training (NCERT) as
an autonomous organisation that would advise both the Union and state
governments on formulating and implementing education policies.[

6. The Government aims to make schooling available to everyone with the help of NEP 2022.
Approximately two crore school students will be able to come back to educational institutes
through this new approach.
According to the national education policy 2022, the 5+3+3+4 structure will replace the
existing 10+2 structure. This structure is focused on student’s formative years of learning.
This 5+3+3+4 structure corresponds to ages from 3 to 8, 8 to 11, 11 to 14 and 14 to 18. 12 years
of schooling, 3 years if Anganwadi and pre-schooling are included in this structure.
For children up to the age of 8, a National Curricular and Pedagogical Framework for Early
Childhood Care and Education will be designed and developed by NCERT.
According to the national education policy 2022, the Education Ministry is to set up a
National Mission on Foundational Literacy and Numeracy. The responsibility for successful
implementation for achieving the foundation of numeracy and literacy for all students till
class three falls upon the states of India. This implementation is scheduled to be done by
2025.
7. In the National Education Policy 2022, language is a negative factor as there is a
problematic teacher to student ratio in India, thus introducing mother languages for
each subject in academic institutes is a problem. Sometimes, finding a competent
teacher becomes a problem and now another challenge comes with the introduction of
the NEP 2022, which is bringing study material in mother languages.
According to the national education policy 2022, students willing to complete their
graduation have to study for four years while one can easily complete his/ her diploma
degree in two years. This might encourage the pupil to leave the course midway.
According to the national education policy 2022, students of the private schools will
be introduced to English at a much earlier age than the students of the Government
schools. The academic syllabus will be taught in the respective regional languages of
the Government school students. This is one of the major new education policy
drawbacks as this will increase the number of students uncomfortable in
communicating in English thus widening the gap between sections of the societies.
