MUNICIPAL ACTS PERTAINING TO
PUBLIC HEALTH
In order to carry out objectives
&functions of Public Health Departments,
officers needs executive powers under
Rule, Bylaws Acts.
Powers are ;- 1.SATUTERY POWER
2. DELIGATED POWERS
OBJECTIVES
1.Maintenance of Vital statistics.
2.Prevention and control of
communicable Diseases.
3.Medical Relief and measures to promote
public health.
4.Food Sanitation and control on food
establishment and Vendors.
5.Vector and pest control
6.Control of offensive trades and
abatement nuisance.
7.Regulation of places for disposal of
dead.
8.License to Nursing Homes.
9.License to Cinema and entertainments
Maintenance of Vital Statistics
RBD Act 1969 ( Registration of Birth & Death )
 Under Section 61(f) of BMC act health department has
been made mandatory work.
 Still birth are also to be recorded.
PROVISION and CONTROL OF COMMUNICABLE
DISEASES.
 under BMC act-61(g) – Obligatory duty.
oSection 421 – every medical practitioner has to notify
the modifiable diseases.
oSection 422 . - public health official has right to
inspect the place day & night .
oSection 423 - Removal of water source or stop use of
water.
oSection 424- power to Remove patient.
oSection 425 - Owner of house has to clean or remove /
vacate .
oSection 426 – Destruction of house/ hut after giving
notice.
oSection 427 – Destruction of any article
oSection 428 – to Prevent Entry.
oSection 429.- to provide carriage.
oSection 433 No room for letting without disinfection.
oSection 434. special measure to be taken if any
threatening of dangerous diseases .
3.Medical Relief and measures to
promote public health.
61(g) provide / maintenance public hospital
63(K) for measure to promote public safety &
health convenience , to promote MCH services
MTP act 1971 & Rules 1975.

Who can perform
The place where can be

PNDT Act 1994- Regulates the “ Prenatal
Diagnostic Techniques regulation and
prevention of misuse Act “ – prevents sex
determination of child.
Food Sanitation and control on food
establishment and Vendors.
Activities controlled under section 394 of BMC.
Food adulteration Act 1954 - Rule 1955.
Section 412 A empowers to destruction ,seizure of
articles , also deals with licensing of milk & milk
products
Section 414 deals with seizure of marketing place if
any nuisance
Section 415 deals with to take to the police station.
 section 416 deals to destroy for safety of public for
consumption
Section 417 to impose penalty on vendor
5. Vector and Pest control .
Under section 391 A of BMC no well, tank ,
pond cistern of fountain shall dug or construct
without permission.
Under section 381B no person shall in any land
owned by him keep or collection of flowing
water in the premises. To avoid any
mosquitogenic condition
 For Rabies any nuisance dog can be seized
under section 191BA.
License under 191 B
6.Control of Offensive trades and abatements of
nuisance
 keeping cattle , horses etc have license under
section 394(1) ( c ) (d).
Can be seized under section 394(4)
 The Tethering of animal in public is prohibited
U/S 316 the can be impounded U/S 441 ( c ) of BMC
Any one creating nuisance , collection of grass,
animal urine dung etc can be taken U/S 384(1).
 For swine found straying is forthwith destroyed
U/S 384(2).
Regulation Of places for disposal of Dead
As per Section 61( e ) of BMC act it obligatory to provide the
place.
Place has to be registered U/S 435
Place can be ordered to close U/S 438 and can be reopened U/S
439.
No one built and grave, porch plinth or varandha U/S 438
Can be punished U/S 440.
Permission to exhume any body can be given U/S 176.of IPC
1973.
Commissioner has special powers to allow burial at the place of
worship other wise Cognizable offence U/S 149, 150 & 151 of IPC.
For corpse act is under 441
The removal of body out side / or bring from out side the
municipal limits permission is necessary as per Govt. resolution
1928 or 1988.
 For laundering , hair, saloon dressing or lodging house these
are licensing U/S 394.
Grant of License for Nurses
establishment
Under section of Bombay nurses Midwives
and Health visitors act 1954 , 58 , 1960 .
Control is by Maharashtra Nursing Council but
public health is to provide license
Cinema houses
 Is granted permission U/S Maharashtra Cinema regulation Rules
1966.
As per the Rule 100(s) provision of following are required;-
Seating capacity not more than 20 person per 9 Square
meter excluding passage .
Distance between screen and front row should to be less
than half of the width of screen. However in 70mm screen it
can be 1/4th.
Proper ventilation windows, doors and ventilators shall
not be less than 1/5th of floor area.
Exhaust fan should expel the air @ 14 to 15 cubic meters
at least 3 times in one hour.
There has to be a separate sanitary conveniences for male
& female . Urinal should not be less than 2% of sitting
capacity. And latrine not less than 15.
Minimum width of Cinema screen should be 3.05 meter.
 Contd;-
Distance between the back seat and front should be at least
30cms.
 Provision of revival of person suffering from electric shock to be
established in the operator’s room.
There Should be mosquito proof
Clean storage of drinking water.
Fire safety Equipments
Spittoon containing strong disinfectant.
Utmost cleanliness is to be maintained
Refuse bins etc.
NOC is required for any entrainments
`Under Rule for Licensing and controlling places of public
amusements other than cinema houses including tamashas melas etc
1960.
Registration of Nursing Homes
 Bombay Nursing Home registration BNHR Act 1949
Rule 1973, Bye-laws 1954.
Modifications in 1956,1959, and 1960 .
Epidemic Disease Act 1897.
Notification
Violation of this act is punishable u/s 188of IPC.
Pre-Conception & Pre-Natal Diagnostic techniques
Act ( 20th September 1994)
An act to provide for prohibition of Sex determination before or
after conception and for regulation of prenatal diagnosis of any
chromosomal , metabolic or genetic disorders
It has following components;-
1. Regulation of genetic counseling centers, genetic laboratories
and clinics.
2. Regulation of pre – natal diagnostic techniques.
3. Central Supervisory Board.
4. Appropriate authority and Advisory committee.
5. Regulation of Genetic counseling centers , Laboratories & clinics
6. Offences and penalties.
The Protection of Women from Domestic Violence Act ( 13th
September 2005)
Definition of Domestic Violence;- Any act omission or
commission or conduct of respondent shall constitute domestic
violence in case it.
a. Harms or injures or endanger the health, safety , life, limb or
wellbeing ( Mental Or Physical)of aggrieved person or tends to
do so and includes causing physical / sexual abuse verbal or
emotional / economic abuse.
b. Harasses harms injures or endangers with a view to coerce her
or any other person related to her to meet any unlawful demand
for dowry or property or valuable security
c. Has the effect of threatening the aggrieved person or any
person related to her by any conduct mentioned in above clause
d. Otherwise injuries or causes harm physical or mental to the
aggrieved person

marriages )

  • 2. MUNICIPAL ACTS PERTAINING TO PUBLIC HEALTH In order to carry out objectives &functions of Public Health Departments, officers needs executive powers under Rule, Bylaws Acts. Powers are ;- 1.SATUTERY POWER 2. DELIGATED POWERS
  • 3. OBJECTIVES 1.Maintenance of Vital statistics. 2.Prevention and control of communicable Diseases. 3.Medical Relief and measures to promote public health. 4.Food Sanitation and control on food establishment and Vendors. 5.Vector and pest control 6.Control of offensive trades and abatement nuisance. 7.Regulation of places for disposal of dead. 8.License to Nursing Homes. 9.License to Cinema and entertainments
  • 4. Maintenance of Vital Statistics RBD Act 1969 ( Registration of Birth & Death )  Under Section 61(f) of BMC act health department has been made mandatory work.  Still birth are also to be recorded.
  • 5. PROVISION and CONTROL OF COMMUNICABLE DISEASES.  under BMC act-61(g) – Obligatory duty. oSection 421 – every medical practitioner has to notify the modifiable diseases. oSection 422 . - public health official has right to inspect the place day & night . oSection 423 - Removal of water source or stop use of water. oSection 424- power to Remove patient. oSection 425 - Owner of house has to clean or remove / vacate . oSection 426 – Destruction of house/ hut after giving notice. oSection 427 – Destruction of any article oSection 428 – to Prevent Entry. oSection 429.- to provide carriage. oSection 433 No room for letting without disinfection. oSection 434. special measure to be taken if any threatening of dangerous diseases .
  • 6. 3.Medical Relief and measures to promote public health. 61(g) provide / maintenance public hospital 63(K) for measure to promote public safety & health convenience , to promote MCH services MTP act 1971 & Rules 1975. Conditions for MTP. Who can perform The place where can be performed PNDT Act 1994- Regulates the “ Prenatal Diagnostic Techniques regulation and prevention of misuse Act “ – prevents sex determination of child.

Food Sanitation and control on food establishment and Vendors. Activities controlled under section 394 of BMC. Food adulteration Act 1954 - Rule 1955. Section 412 A empowers to destruction ,seizure of articles , also deals with licensing of milk & milk products Section 414 deals with seizure of marketing place if any nuisance Section 415 deals with to take to the police station.  section 416 deals to destroy for safety of public for consumption Section 417 to impose penalty on vendor
  • 8. 5. Vector and Pest control . Under section 391 A of BMC no well, tank , pond cistern of fountain shall dug or construct without permission. Under section 381B no person shall in any land owned by him keep or collection of flowing water in the premises. To avoid any mosquitogenic condition  For Rabies any nuisance dog can be seized under section 191BA. License under 191 B
  • 9. 6.Control of Offensive trades and abatements of nuisance  keeping cattle , horses etc have license under section 394(1) ( c ) (d). Can be seized under section 394(4)  The Tethering of animal in public is prohibited U/S 316 the can be impounded U/S 441 ( c ) of BMC Any one creating nuisance , collection of grass, animal urine dung etc can be taken U/S 384(1).  For swine found straying is forthwith destroyed U/S 384(2).
  • 10. Regulation Of places for disposal of Dead As per Section 61( e ) of BMC act it obligatory to provide the place. Place has to be registered U/S 435 Place can be ordered to close U/S 438 and can be reopened U/S 439. No one built and grave, porch plinth or varandha U/S 438 Can be punished U/S 440. Permission to exhume any body can be given U/S 176.of IPC 1973. Commissioner has special powers to allow burial at the place of worship other wise Cognizable offence U/S 149, 150 & 151 of IPC. For corpse act is under 441 The removal of body out side / or bring from out side the municipal limits permission is necessary as per Govt. resolution 1928 or 1988.  For laundering , hair, saloon dressing or lodging house these are licensing U/S 394.
  • 11. Grant of License for Nurses establishment Under section of Bombay nurses Midwives and Health visitors act 1954 , 58 , 1960 . Control is by Maharashtra Nursing Council but public health is to provide license
  • 12. Cinema houses  Is granted permission U/S Maharashtra Cinema regulation Rules 1966. As per the Rule 100(s) provision of following are required;- Seating capacity not more than 20 person per 9 Square meter excluding passage . Distance between screen and front row should to be less than half of the width of screen. However in 70mm screen it can be 1/4th. Proper ventilation windows, doors and ventilators shall not be less than 1/5th of floor area. Exhaust fan should expel the air @ 14 to 15 cubic meters at least 3 times in one hour. There has to be a separate sanitary conveniences for male & female . Urinal should not be less than 2% of sitting capacity. And latrine not less than 15. Minimum width of Cinema screen should be 3.05 meter.  Contd;-
  • 13. Distance between the back seat and front should be at least 30cms.  Provision of revival of person suffering from electric shock to be established in the operator’s room. There Should be mosquito proof Clean storage of drinking water. Fire safety Equipments Spittoon containing strong disinfectant. Utmost cleanliness is to be maintained Refuse bins etc. NOC is required for any entrainments `Under Rule for Licensing and controlling places of public amusements other than cinema houses including tamashas melas etc 1960.
  • 14. Registration of Nursing Homes  Bombay Nursing Home registration BNHR Act 1949 Rule 1973, Bye-laws 1954. Modifications in 1956,1959, and 1960 . Epidemic Disease Act 1897. Notification Violation of this act is punishable u/s 188of IPC.
  • 15. Pre-Conception & Pre-Natal Diagnostic techniques Act ( 20th September 1994) An act to provide for prohibition of Sex determination before or after conception and for regulation of prenatal diagnosis of any chromosomal , metabolic or genetic disorders It has following components;- 1. Regulation of genetic counseling centers, genetic laboratories and clinics. 2. Regulation of pre – natal diagnostic techniques. 3. Central Supervisory Board. 4. Appropriate authority and Advisory committee. 5. Regulation of Genetic counseling centers , Laboratories & clinics 6. Offences and penalties.
  • 16. The Protection of Women from Domestic Violence Act ( 13th September 2005) Definition of Domestic Violence;- Any act omission or commission or conduct of respondent shall constitute domestic violence in case it. a. Harms or injures or endanger the health, safety , life, limb or wellbeing ( Mental Or Physical)of aggrieved person or tends to do so and includes causing physical / sexual abuse verbal or emotional / economic abuse. b. Harasses harms injures or endangers with a view to coerce her or any other person related to her to meet any unlawful demand for dowry or property or valuable security c. Has the effect of threatening the aggrieved person or any person related to her by any conduct mentioned in above clause d. Otherwise injuries or causes harm physical or mental to the aggrieved person
  • 17. OTHER ACTS of Importance. The Hindu marriage Act 1955 ( registration of Hindu marriages ) The Right to information Act( 15 June 2005).
