Legal, Ethical and
Permission Report
Unit 17: Lo2: Pre-Production
What Who owns it? Legal Impact Any impact on use?
Your filmed footage Myself My footage may need to be copyright so that if
other people want to use it, they need to ask my
permission.
I have written a permission letter and a
parental consent form. All my actors
have given their permission to be in my
film and both the parents/ carers and
actors know where the film be shown.
Studio title logo sequence I will make the title logo myself and use my own studio. It does
not have any trademarks because I would have created it
myself.
There will be no legal impact unless I use a title or
logo that is copyright. However I plan to create my
own, which will not require permission for.
There is no impact as the logo is my
own.
Additional video footage
found online
There will be no footage from online. I will film all the
appropriate scenes myself. I will not use anyone else’s footage
except my own.
My film does not require any online footage.
However if I did need to use footage I would try and
use copyright free footage to ensure that it was
easily available to use.
I will not use online footage. There is
no legal impact.
Special effects I have not included any special effects. However if I was to use
special effects I would create and edit them myself.
My film does not require special effects. Therefore I
do not to ask permission to use it.
I will not use special effects. There is
no legal impact.
Sound effects/musical score I will use Bensound tracks from their royalty free website for
most of film. This will not require asking permission to use
them, however I may need to credit them in the film. Also I
have chose the song ‘Bang Bang’, by Jessie J, Nicki Minaj and
Ariana Grande. This will require asking the permission for.
Bensound tracks are copyright free, I won’t have to
ask for permission but will have to credit them in my
film.
For the song ‘Bang Bang’ I will need to write a letter
to the producer of the song Max Martin of MXM
Productions (Kobalt)
I will need to credit Bensound in my
film.
I will need to write a letter asking the
permission to use the song ‘Bang Bang’
in my film. This will be sent to the
production company.
What What is the impact on your film Legal impact
Your certificate
would you rate
your short film?
For my short film I have rated it PG. It does not contain any inappropriate
behaviour, language or drug references. It deals with themes such as
relationships, school life, appearances and status.
As my film is rated a PG, it has to be suitable for children under the age of 12.
It cannot contain, dangerous behaviour, discrimination, nudity, sex, drugs,
violence or severe poor language. It can refer to mild swear words only.
BBFC, British Board of Film Classification, control the age rating for films.
Film makers must adhere to their requirements because BBFC protect people
from viewing unsuitable content.Additionally, they rate films in terms of their
themes and material to determine who it is appropriate for.
For example, if a film is rated 15, it is a guide to notify audience that the film is
only suitable for people aged 15 and over. Those who are younger are not
permitted to view the content.
Children can be easily influenced, so they are protected from certain content as
they may copy violent or dangerous behaviour in their real lives
Content
considerations
It should not upset anyone as it deals with mild subjects. I chose these
subjects, of relationships and status to send a positive message to my target
audience. Therefore, my content will be appropriate and hopefully portray the
correct message.
My script is unoffensive and it does not contain direct or specific insults to the
audience.
There is no legal impact on my film as it is a PG.
However, issues may arise if I was to class my film as a PG, and include
unsuitable content because young viewers may be exposed to upsetting or
distressing content.
Your film is going
to be shown
online
Their rules consist of:
- The film duration needs to be 5-10 minuets long.
- There encourage creating something different and new
- They ask that the film is not in the format of a music video, advert,
timelapse or sketch.
In my film I plan to use the song ‘Bang Bang’.This is a copyright song which
means that I need to write a letter to the production company asking for the
permission to use it and allow it to be shown publicly.
As my actors are under 18, I will need to produce a parental permission letter
and an actor permission letter. This letter will notify the cast and their parents/
carers that the film is going to uploaded onto public websites such asYouTube.
I have also mentioned in the letter the General Data Protection Regulation.
Copyright
How does it
affect my film?
What? Who owns it? Legal impact Impact on use
Copyright: It is a
legal right that
owners can use
to protect their
products from
being used by
others.
Copyright will
affect my film
because I plan to
use a copyright
song ‘Bang
Bang’ and I will
have to ask the
owner of the
song the
permission to
use it in my film.
Musical Score Bensound: Some scenes will have background music,
this will be uploaded from Bensound.
MXM Production (Kobalt) and Max Martin: ‘Bang
Bang’, Jessie J, ArianaGrande, Nicki Minaj.
Is it copyright free or did you have to
ask permission to use it?
Bensound: All the music from
Bensound is royalty-free that is
available for anyone use.
MXM Production (Kobalt) and Max
Martin: I will have to write a letter
seeking permission to the label that
the song is signed to, so that I am
able to use the song in my film.
Bensound: Bensound is
available for anyone to use
their music, however they may
ask for me to credit them in
my work.
MXM Production (Kobalt) and
Max Martin:They may reply
and deny me permission to
use that piece of music,
therefor having to find
something else.
Logos I am yet to produce a title logo, but I will own it
because I will make it myself. The logo won’t consist
of any copyright material, therefor not needing any
permission to use.
- Where did you get it from?
It will be creative on a logo-making programme,
either Photoshop or by website.
- Does it have any trademarks?
It won’t have any trademarks.
If I was to use someone else's logo, I
would have to check if it was
copyright, or otherwise ask for
permission to use that logo or title.
The company I borrow from
may require me to credit them
in my work, disclaiming that I
have used their logo.
Copyright
What? Who owns it? Legal impact Impact on use
Copyright: It is a
legal right that
owners can use to
protect their
products from
being used by
others.
Footage Myself If I don’t copyright my
work, then others can
use it as their own. If I
do, they would need
to ask for my
permission.
If someone was to use my work, I might ask them to credit me in their project/piece.
Have you asked permission from all your actors to be in the film?
A permission letter has been written and informs all my actors about the film requirements. Including
GDPR and where the film is going to be uploaded.
I am the only member of crew.
I have written a parental consent form as all my actors are under the age of 18.The letter notifies the
parents/ carers about the film content, costume and makeup requirements, the filming locations and
when the filming is due to start.
In the parental consent form and the actor permission letter I have mentioned that it will be uploaded
to the Ringwood School officialYouTube channel.
Sound
effects
If I want to include
sound effects I can
use a website call
Freesound. It provide
royalty free sound
effects.
Freesound is royalty
free and does not
require me to ask
permission to use
them, therefore there
is no legal impact.
There is no impact on the use of royalty free sounds however I may want to credit them in the film to
ensure that Freesounds know that I have used their sound effects appropriately.
Type What is it? How does it affect your film?
Intellectual
Property Rights
Intellectual property rights are the
rights for a creator to own their work,
whether it is in the form of a musical
score, book, painting or film.
This affects my film because I can claim intellectual property
rights for my film. However I can only gain intellectual property
right if I patent, copyright or trademark my work. Otherwise,
anyone can use it.
I may not be able to have intellectual property rights if my film
contains copyright music, such as ‘Bang Bang’ by Jessie J, Nicki
Minaj and Ariana Grande.
Slander and libel Slander and libel is claiming false
information against someone
causing issues to that person's life
and reputation.
It does not affect my film because no false accusations are
communicated through my script. There is no information about
real issues and it does not name anyone within real-life
situations.
Type What is it? How does it affect your film?
Filming
permission
Filming permission is the
permission to film on the
preferred location. For
example, I need to ask for
permission to film in a
restaurant.
The majority of my film is based in school. I am allowed to film in
school. I will ask the site manager to film outside of school hours.
As I do not require extra’s, my film will only contain the actors who
have given their permission.
I am also filming at home, there is evidence of my asking the
permission of my parent to use out home to film in.
Royalties Royalties is a sum of money
given to the owner of a
product that is being used
or bought. For example, if
an artist releases a new
song and it is bought and
listened to, royalties are
rewarded to the artist.
This will affect my film because if I am granted the permission to use
the song ‘Bang Bang’, each time someone watches my film,
royalties will be given to the artists.
Type What is it? How does it affect your film?
Violence,
offensive
language/
behaviour.
Violence is a physical form of
expressing anger and torment towards
someone. It usually causes pain and
injuries and can be upsetting to
younger views.
Offensive language and behaviour can
influence younger children and they
may copy or imitate what they see or
hear, such as swearing.
There is no violence, offensive language or behaviour in my
film. I have decided my film is a PG, because the themes in my
film are mild and appropriate for this age group. My film is a
PG because I wanted it to be accessible to all ages because of
the message I want to send out in my film. I did not want it to
portray a negative or hostile tone, I wanted to make it light-
hearted and entertaining.
Public Interest Public interest is the interest of the
general public in terms of their well-
being.
This does not affect my film because it is a PG. It does not
include any offensive topics or distressing or upsetting scenes.
Performance
Rights
Performance rights are the rights that
the owner achieves that determines
how they want their music to be
played publicly.
It affects my film because I would like to use copyright music.
Max Martin and MXM Production (Kobalt) may not grant me
permission to use that song because it is not being performed
the way that they would allow.
Permission Letter for the use of copyright
content.
Dear Kobalt,
I am a Media student and I am currently
producing a film for my final unit. I would like to
use the song ‘Bang Bang’ by Jessie J, Nicki Minaj
andAriana Grande in my film. The film would be
uploaded to the schoolsYouTube channel in order
for my teachers and the exam board to view it.
The film will be removed fro0mYouTube once the
exam period is over, August 219.
If I do not hear back from you by the 1st of April, I
will assume that it is available to use for my film.
Thank you,
Elfie Cheetham, Media student.

Legal, ethical and permission report done

  • 1. Legal, Ethical and Permission Report Unit 17: Lo2: Pre-Production
  • 2. What Who owns it? Legal Impact Any impact on use? Your filmed footage Myself My footage may need to be copyright so that if other people want to use it, they need to ask my permission. I have written a permission letter and a parental consent form. All my actors have given their permission to be in my film and both the parents/ carers and actors know where the film be shown. Studio title logo sequence I will make the title logo myself and use my own studio. It does not have any trademarks because I would have created it myself. There will be no legal impact unless I use a title or logo that is copyright. However I plan to create my own, which will not require permission for. There is no impact as the logo is my own. Additional video footage found online There will be no footage from online. I will film all the appropriate scenes myself. I will not use anyone else’s footage except my own. My film does not require any online footage. However if I did need to use footage I would try and use copyright free footage to ensure that it was easily available to use. I will not use online footage. There is no legal impact. Special effects I have not included any special effects. However if I was to use special effects I would create and edit them myself. My film does not require special effects. Therefore I do not to ask permission to use it. I will not use special effects. There is no legal impact. Sound effects/musical score I will use Bensound tracks from their royalty free website for most of film. This will not require asking permission to use them, however I may need to credit them in the film. Also I have chose the song ‘Bang Bang’, by Jessie J, Nicki Minaj and Ariana Grande. This will require asking the permission for. Bensound tracks are copyright free, I won’t have to ask for permission but will have to credit them in my film. For the song ‘Bang Bang’ I will need to write a letter to the producer of the song Max Martin of MXM Productions (Kobalt) I will need to credit Bensound in my film. I will need to write a letter asking the permission to use the song ‘Bang Bang’ in my film. This will be sent to the production company.
  • 3. What What is the impact on your film Legal impact Your certificate would you rate your short film? For my short film I have rated it PG. It does not contain any inappropriate behaviour, language or drug references. It deals with themes such as relationships, school life, appearances and status. As my film is rated a PG, it has to be suitable for children under the age of 12. It cannot contain, dangerous behaviour, discrimination, nudity, sex, drugs, violence or severe poor language. It can refer to mild swear words only. BBFC, British Board of Film Classification, control the age rating for films. Film makers must adhere to their requirements because BBFC protect people from viewing unsuitable content.Additionally, they rate films in terms of their themes and material to determine who it is appropriate for. For example, if a film is rated 15, it is a guide to notify audience that the film is only suitable for people aged 15 and over. Those who are younger are not permitted to view the content. Children can be easily influenced, so they are protected from certain content as they may copy violent or dangerous behaviour in their real lives Content considerations It should not upset anyone as it deals with mild subjects. I chose these subjects, of relationships and status to send a positive message to my target audience. Therefore, my content will be appropriate and hopefully portray the correct message. My script is unoffensive and it does not contain direct or specific insults to the audience. There is no legal impact on my film as it is a PG. However, issues may arise if I was to class my film as a PG, and include unsuitable content because young viewers may be exposed to upsetting or distressing content. Your film is going to be shown online Their rules consist of: - The film duration needs to be 5-10 minuets long. - There encourage creating something different and new - They ask that the film is not in the format of a music video, advert, timelapse or sketch. In my film I plan to use the song ‘Bang Bang’.This is a copyright song which means that I need to write a letter to the production company asking for the permission to use it and allow it to be shown publicly. As my actors are under 18, I will need to produce a parental permission letter and an actor permission letter. This letter will notify the cast and their parents/ carers that the film is going to uploaded onto public websites such asYouTube. I have also mentioned in the letter the General Data Protection Regulation.
  • 4. Copyright How does it affect my film? What? Who owns it? Legal impact Impact on use Copyright: It is a legal right that owners can use to protect their products from being used by others. Copyright will affect my film because I plan to use a copyright song ‘Bang Bang’ and I will have to ask the owner of the song the permission to use it in my film. Musical Score Bensound: Some scenes will have background music, this will be uploaded from Bensound. MXM Production (Kobalt) and Max Martin: ‘Bang Bang’, Jessie J, ArianaGrande, Nicki Minaj. Is it copyright free or did you have to ask permission to use it? Bensound: All the music from Bensound is royalty-free that is available for anyone use. MXM Production (Kobalt) and Max Martin: I will have to write a letter seeking permission to the label that the song is signed to, so that I am able to use the song in my film. Bensound: Bensound is available for anyone to use their music, however they may ask for me to credit them in my work. MXM Production (Kobalt) and Max Martin:They may reply and deny me permission to use that piece of music, therefor having to find something else. Logos I am yet to produce a title logo, but I will own it because I will make it myself. The logo won’t consist of any copyright material, therefor not needing any permission to use. - Where did you get it from? It will be creative on a logo-making programme, either Photoshop or by website. - Does it have any trademarks? It won’t have any trademarks. If I was to use someone else's logo, I would have to check if it was copyright, or otherwise ask for permission to use that logo or title. The company I borrow from may require me to credit them in my work, disclaiming that I have used their logo.
  • 5. Copyright What? Who owns it? Legal impact Impact on use Copyright: It is a legal right that owners can use to protect their products from being used by others. Footage Myself If I don’t copyright my work, then others can use it as their own. If I do, they would need to ask for my permission. If someone was to use my work, I might ask them to credit me in their project/piece. Have you asked permission from all your actors to be in the film? A permission letter has been written and informs all my actors about the film requirements. Including GDPR and where the film is going to be uploaded. I am the only member of crew. I have written a parental consent form as all my actors are under the age of 18.The letter notifies the parents/ carers about the film content, costume and makeup requirements, the filming locations and when the filming is due to start. In the parental consent form and the actor permission letter I have mentioned that it will be uploaded to the Ringwood School officialYouTube channel. Sound effects If I want to include sound effects I can use a website call Freesound. It provide royalty free sound effects. Freesound is royalty free and does not require me to ask permission to use them, therefore there is no legal impact. There is no impact on the use of royalty free sounds however I may want to credit them in the film to ensure that Freesounds know that I have used their sound effects appropriately.
  • 6. Type What is it? How does it affect your film? Intellectual Property Rights Intellectual property rights are the rights for a creator to own their work, whether it is in the form of a musical score, book, painting or film. This affects my film because I can claim intellectual property rights for my film. However I can only gain intellectual property right if I patent, copyright or trademark my work. Otherwise, anyone can use it. I may not be able to have intellectual property rights if my film contains copyright music, such as ‘Bang Bang’ by Jessie J, Nicki Minaj and Ariana Grande. Slander and libel Slander and libel is claiming false information against someone causing issues to that person's life and reputation. It does not affect my film because no false accusations are communicated through my script. There is no information about real issues and it does not name anyone within real-life situations.
  • 7. Type What is it? How does it affect your film? Filming permission Filming permission is the permission to film on the preferred location. For example, I need to ask for permission to film in a restaurant. The majority of my film is based in school. I am allowed to film in school. I will ask the site manager to film outside of school hours. As I do not require extra’s, my film will only contain the actors who have given their permission. I am also filming at home, there is evidence of my asking the permission of my parent to use out home to film in. Royalties Royalties is a sum of money given to the owner of a product that is being used or bought. For example, if an artist releases a new song and it is bought and listened to, royalties are rewarded to the artist. This will affect my film because if I am granted the permission to use the song ‘Bang Bang’, each time someone watches my film, royalties will be given to the artists.
  • 8. Type What is it? How does it affect your film? Violence, offensive language/ behaviour. Violence is a physical form of expressing anger and torment towards someone. It usually causes pain and injuries and can be upsetting to younger views. Offensive language and behaviour can influence younger children and they may copy or imitate what they see or hear, such as swearing. There is no violence, offensive language or behaviour in my film. I have decided my film is a PG, because the themes in my film are mild and appropriate for this age group. My film is a PG because I wanted it to be accessible to all ages because of the message I want to send out in my film. I did not want it to portray a negative or hostile tone, I wanted to make it light- hearted and entertaining. Public Interest Public interest is the interest of the general public in terms of their well- being. This does not affect my film because it is a PG. It does not include any offensive topics or distressing or upsetting scenes. Performance Rights Performance rights are the rights that the owner achieves that determines how they want their music to be played publicly. It affects my film because I would like to use copyright music. Max Martin and MXM Production (Kobalt) may not grant me permission to use that song because it is not being performed the way that they would allow.
