HIGHER COURTS
1. THE COURT OF APPEALS (COA)
is the second highest tribunal in the
country, which was established on
February 1, 1936 by virtue of
Commonwealth Act No. 3.

1. Original jurisdiction to issue writs of mandamus, prohibition,
certiorari, habeas corpus, and quo warranto, and auxiliary writs
or processes, whether or not in aid of its appellate jurisdiction;
2. Exclusive original jurisdiction over actions for annulment of
judgements of Regional Trial Courts; and
3. Exclusive appellate jurisdiction over all final judgements,
resolutions, orders or awards of Regional Trial Courts and
quasi-judicial agencies, instrumentalities, boards or
commission.

2. COURT OF TAX APPEALS (CTA),
which is of the same level as the
Court of Appeals, was created by
virtue of Republic Act No. 1125,
which was signed into law on
June 16, 1954.
The CTA is composed of ONE PRESIDING JUSTICE AND 8
ASSOCIATE JUSTICES, all of which are appointed by the
President from a shortlist submitted by the Judicial and Bar
Council. The qualifications for the justices of the Court of
Appeals also apply to members of the CTA.

3. SANDIGANBAYAN
A special graft court
This court was formally established through Presidential
Decree No. 1606, which was signed into law on
December 10, 1978

MANDATE
SEC. 5. The Batasang Pambansa shall create a special court, to be known as
Sandiganbayan, which shall have jurisdiction over criminal and civil cases
involving graft and corrupt practices and such other offenses committed by
public officers and employees, including those in government-owned or
controlled corporations, in relation to their office as may be determined by law.
(Art. XIII), 1973 Constitution.

3. SANDIGANBAYAN
SEC. 4. The present anti-graft court
known as the Sandiganbayan shall
continue to function and exercise its
jurisdiction as now or hereafter may
be provided by law. (Art. XI), 1987

5. SHARI’A DISTRICT COURTS
•Etablished in certain specified provinces in Mindanao
where the Code of Muslim Personal Laws of the
Philippines is being enforced.
•Cases falling within the exclusive jurisdiction of the
Shari'a District Courts primarily pertain to family rights
and duties as well as contractual relations of Filipino
Muslims in the Mindanao.
