HUMN 305 Week 2 Assignment Human Rights
Purpose
• To assessyourabilitytoanalyze a humanrightsissue eitherfromyourassignedcountryor
anotherarea of the worldand consideritina global context.
Overview
Cultural Relativismhasbeenexplainedasthe "argumentthatbehaviorinone culture shouldnotbe
judgedbythe standardsof anotherculture"(Kottak(2008).How doesthisconceptthenrelate tothe
issue of a global systemof humanrights? The line betweencultural traditionandhumanrightsisnot
alwayseasilydistinguishednorcanconsensusalwaysbe reachedaboutwhatconstitutesaviolationof
rights.
Throughoutthe world'shistoryaswell,societiesovertime have changedattitudesaboutwhatpractices
are consideredaviolationof humanrights.Today,some actions,suchas genocide,seemclearlytofall
undera violationof humanrights.
However,fromaculturallyrelativisticstandpoint,otherpracticeslikefemale circumcisionthathave
developedwithinacultural contextovermanygenerationscanbe understoodandperhapseven
acceptedif examinedincontext.
Thisdoesnot meanthat all behaviorshouldbe excusedortoleratedjustbecauseitcanbe definedasa
cultural custom;insteaditdemonstratesthatethnocentrismmaymake itdifficulttodefine clearlyin
everycase and foragreementtobe reachedabout what istrulya humanrightsviolation.Eveninour
ownwesternculture,male babiesare routinelycircumcisedforreligious,cultural and/orhygienic
reasonsandfor many itis a practice that makessense withintheirculture andupbringing.
The male baby inthisinstance, however, doesn'thave achoice in the matteranymore thana younggirl
beingcircumcised.Althoughthe healthandothercomplicationsandriskstothe surgeryare much
higherforfemale circumcisioninmanyculturesof the world, how differentisthe practice really?
Throughoutthe world,the same questionsare beingplayedoutwithrespecttoveilingsuchas
controversyoverbanningthe veil inpublicplacesinFrance (Erlanger2011). What isthe real issue in
questionhere?Shouldwomenhave the righttobe veiledif theychoose?Isbanningthe veil actuallya
violationof humanrights,orisit liberationof women?Whodecides?
Some practicessuchas the sex-selectedabortionsforfemalesanddowrydeathsinIndia(Roy2011) can
be explainedandunderstoodfromacultural relativisticviewpointof helpingtomaintainlongstanding
cultural traditions.Yetthese practicesusuallyare muchmore easilyacceptedbymostasa true violation
of humanrightsand discriminationagainstwomen.
Eventhoughthe distinctionof whichbehaviorsandcustomsare not alwaysclearlydetermined,
increasingly,withmore global awareness,integrationandtransnational migrationof peoplesacrossthe
world,all peoplesare demandingrecognitionof rights.Humanrightshas
become the majorglobal approachto social justice.Since the 1980's, humanrightsconceptshave
gainedincreasinginternational credibilityandsupportatthe same time as a growingbodyof treaties
and resolutionshave strengthenedtheirinternationallegal basis.
The Global humanrightssystemisnowdeeplytransnational,nolongerrootedexclusivelyinthe West.
It takesplace inglobal settingswithrepresentativesfromnationsandNGO'saroundthe world.Activists
frommany countriesenthusiasticallyadoptitslanguage andtranslate itforgrassrootspeople (Merry,
2006).
Thus,the definitionoroutliningof aninternational guideline forbehaviorinsocietyisbecomingmore
and more necessaryespeciallywhenissues,like healthandwell being,enterintothe question.The
debate,however,remainsbetweenwhatisoftenpresentedasthe polaroppositesof local culture
versusglobal humanrights.
One importantkeytonegotiatingbetweenthe twosidesistorecognize cultureasdynamicand
changingand notstatic.Local culture,inthisunderstanding"doesnotserve asabarrierto humanrights
mobilizationbutasa contextthat definesrelationshipsandmeaningandconstructsthe possibilitiesof
actions"( p.9). The verydefinitionof humanrightsisongoingandevolvingaswell.
Education,awarenessandunderstandingof cultural diversityinthe worldare keytoaddressthese
issues.Thismeansremovingourblindersandcultural baggage thatdefineshow we view the world.
Whateverthe answermaybe determinedonsome of these andotherissues, itisone thathasto be
carefullyexploredfrombothsidesandasethnocentricallyfree aspossible.

Overview Cultural Relativismhasbeenexplainedasthe "argumentthatbehaviorinone culture shouldnotbe judgedbythe standardsof anotherculture"(Kottak(2008).How doesthisconceptthenrelate tothe issue of a global systemof humanrights? The line betweencultural traditionandhumanrightsisnot alwayseasilydistinguishednorcanconsensusalwaysbe reachedaboutwhatconstitutesaviolationof rights. Throughoutthe world'shistoryaswell, societiesovertime have changedattitudesaboutwhatpractices are consideredaviolationof humanrights.Today, some actions, suchas genocide, seemclearlytofall undera violationof humanrights. However, fromaculturallyrelativisticstandpoint, otherpracticeslikefemale circumcisionthathave developedwithinacultural contextovermanygenerationscanbe understoodandperhapseven acceptedif examinedincontext. Thisdoesnot meanthat all behaviorshouldbe excusedortoleratedjustbecauseitcanbe definedasa cultural custom;insteaditdemonstratesthatethnocentrismmaymake itdifficulttodefine clearlyin everycase and foragreementtobe reachedabout what istrulya humanrightsviolation.Eveninour ownwesternculture, male babiesare routinelycircumcisedforreligious, cultural and/orhygienic reasonsandfor many itis a practice that makessense withintheirculture andupbringing. The male baby inthisinstance, however, doesn'thave achoice in the matteranymore thana younggirl beingcircumcised.Althoughthe healthandothercomplicationsandriskstothe surgeryare much higherforfemale circumcisioninmanyculturesof the world, how differentisthe practice really? Throughoutthe world, the same questionsare beingplayedoutwithrespecttoveilingsuchas controversyoverbanningthe veil inpublicplacesinFrance (Erlanger2011). What isthe real issue in

Some practicessuchas the sex-selectedabortionsforfemalesanddowrydeathsinIndia(Roy2011) can be explainedandunderstoodfromacultural relativisticviewpointof helpingtomaintainlongstanding cultural traditions.Yetthese practicesusuallyare muchmore easilyacceptedbymostasa true violation of humanrightsand discriminationagainstwomen. Eventhoughthe distinctionof whichbehaviorsandcustomsare not alwaysclearlydetermined, increasingly, withmore global awareness, integrationandtransnational migrationof peoplesacrossthe world, all peoplesare demandingrecognitionof rights.Humanrightshas become the majorglobal approachto social justice.Since the 1980's, humanrightsconceptshave gainedincreasinginternational credibilityandsupportatthe same time as a growingbodyof treaties and resolutionshave strengthenedtheirinternationallegal basis. The Global humanrightssystemisnowdeeplytransnational, nolongerrootedexclusivelyinthe West. It takesplace inglobal settingswithrepresentativesfromnationsandNGO'saroundthe world.Activists frommany countriesenthusiasticallyadoptitslanguage andtranslate itforgrassrootspeople (Merry, 2006). Thus, the definitionoroutliningof aninternational guideline forbehaviorinsocietyisbecomingmore and more necessaryespeciallywhenissues, like healthandwell being, enterintothe question. The debate, however, remainsbetweenwhatisoftenpresentedasthe polaroppositesof local culture versusglobal humanrights. One importantkeytonegotiatingbetweenthe twosidesistorecognize cultureasdynamicand changingand notstatic.Local culture, inthisunderstanding"doesnotserve asabarrierto humanrights mobilizationbutasa contextthat definesrelationshipsandmeaningandconstructsthe possibilitiesof actions"( p.9). The verydefinitionof humanrightsisongoingandevolvingaswell. Education, awarenessandunderstandingof cultural diversityinthe worldare keytoaddressthese issues.Thismeansremovingourblindersandcultural baggage thatdefineshow we view the world. Whateverthe answermaybe determinedonsome of these andotherissues, itisone thathasto be carefullyexploredfrombothsidesandasethnocentricallyfree aspossible. References Erlanger,S.(2011).
