Sciences Pty Ltd (2004) FCA 403. In this case Caltex had obtained development consent from the
local council to decommission a suburban service station and remediate it to residential standards. A
condition of the consent was that an auditor accredited by the EPA would sign off the completed
decontamination.
A consultant issued a report to Caltex stating that the former service station site was suitable for
residential use, and the sale of the service station was completed relying on the report. The contract
of sale contained a condition that the site would be suitable for purposes permitted by its current

availability of reliable and authentic environmental data has been a major bottle neck in achieving
