Copyright in Distance Education
 The student will be able apply copyright laws and the fair use policy toward the creation of a
distance education curriculum for an online class correctly.
 The student will be able to describe how the TEACH act relates to a distance education curriculum
and demonstrate how it is used in a distance education course with 100% accuracy.
 The student will be able to develop a Copyright Training Program demonstrating the use of
distance education with a rubric score of 90% or greater .
What is Copyright?
 The legal rights to an original work
 Right granted to authors to reproduce, distribute and sell their work
 Created to protect the flow of creative work
 No Protection, No Compensation, No New Materials
What is Copyright?
 Assume any work created after 1978 is copyrighted unless otherwise noted
 protected for author’s life + 70 years
5 Rights of Copyright Holders
 Reproduce the Material
 Create a derivative work
 Sell the Material
 Perform the work publicly
 Display the work publicly
What is Fair Use?
 Fair Use grants certain types of conditional rights to use or reproduce limited amounts of certain
copyrighted materials as long as the reproduction meets defined guidelines
 Not all copying for the purpose of teaching is considered Fair Use
Fair Use for Images and Graphics
 Single works may be used in their entirety, but no more than 5 images by a single artist or
photographer
 From a collection, no more than 15 images or 10 percent may be used
 Images from internet may be downloaded for student projects & teacher lessons
Fair Use for Printed Materials
 250 words or less of a poem
 Articles, stories, or essays less than 2,500 words
 1000 words or 10% of a longer work
 One chart, picture, diagram or cartoon per book or periodical issue
 Two pages from an illustrated work less than 2,500 words (e.g. children’s book)
 A chapter of a book
Fair Use for Printed Materials
 Teachers may make multiple copies for classroom use
 Students may incorporate text into multimedia projects
 Copies can only be made from legally acquired originals
 Usage must be “at the instance and inspiration of a single teacher”

 Non-Profit Educational use rather than Commercial Use
 Nature of Copyrighted Work
1. Published or unpublished
2. Out of Print
 More artistic less likely to be considered Fair Use
