OBJECTIVE
• Able to apply copyright laws and fair use toward the creation of a
distance education curriculum
• Able to describe how the TEACH act relates to a distance education
curriculum

• Rights granted to authors
• Protect the flow of creative work
COPYRIGHT
• Any work created after 1978 is copyrighted unless otherwise noted
• Protected for author’s life plus 70 years
5 RIGHT OF COPYRIGHT HOLDERS
• Reproduce the material
• Create a derivative work
• Sell the material
• Perform the work publicly
• Display the work publicly
FAIR USE
• Grants certain types of conditional rights to use or reproduce limited
amounts of certain copyrighted materials as long as reproduction meets
defined guidelines
• May be quoted verbatim for purposes such as criticism, news reporting,
teaching, and research
FAIR USE
• Single works may be used in their entirety
• No more than 15 images or 10 percent may be used from a collection
• Images may be downloaded from the internet for student projects and
lessons
FAIR USE AND PRINTED MATERIALS
• 250 words or less of a poem
• 2,500 words or less for articles, stories, or essays
• 1,000 words or 10% of a longer work
FAIR USE FOR PRINTED MATERIALS
• Teachers may make multiple copies for classroom use
• Students may incorporate text into multimedia projects
• Copies can only be made form legally acquired originals
FAIR USE 4 CRITERIA
• Purpose and character of use
• Non-profit educational use
• Nature of copyrighted work
• More artistic less likely to be considered Fair Use
