Confidentiality protects the amount of a
patient’s personal information that can be
disclosed.
 All staff must maintain the confidentiality of our
patient’s personal information.
 Maintaining the patient’s confidentiality is
important in making sure that sensitive
information is not made available for public use.
 Helps to prevent identity theft.

 Privacy

is a patient right
 As employees we are to maintain the
patient’s right to privacy with respect to
individually identifiable health information
 The patient has the right to decide when
health information should be disclosed
 PRIVACY = CONFIDENTIALITY
 This

facility has guidelines for the use and
disclosure of identifiable health information
that is in compliance with the Health
Insurance Portability and Accountability Act
(HIPAA)
 The

U.S. Department of Health and Human
Services (HHS) issued the Privacy Rule in
order to implement the requirement of the
Health Insurance Portability and
Accountability Act(HIPAA) of 1996. The
Privacy Rule standards addresses the use and
disclosure of individual’s health information
by organizations subject to the Privacy rule
as well as standards for individuals’ privacy
rights to understand and control how their
health information is used.
 HIPAA

is a federal regulation that most
healthcare providers have to comply with
that protects the privacy, security, and
confidentiality of a patient’s health
information.
 It

is necessary that all healthcare personnel
receive mandatory education on the proper
procedures in regards to confidential
information and how it should be used
 Protected

health information (PHI) is
individually identifiable health information
 Identifies the individual where there is a
reasonable basis to believe that the
information can be used to identify the
individual
 Transmitted or maintained in any form or
medium
 HIPAA’s

security rules require organizations
that handle electronic health data to utilize
interventions to control access to
confidential health information and to
protect the data against misuse and
compromise.
 The

privacy, security, and confidentiality of
patient information is important and it is
important that you know the rules regarding
patient confidentiality.
 The

“need to know” is defined as Minimum
Necessary Information.
 “need

to know” is when you need
information to;
1. Document the patient’s treatment
2. Facilitate communication between
healthcare providers contributing to the
patient’s care
3. Provide continuity of patient care
4. Provide a basis for review, study, and
evaluation of patient care processes
5. Provide clinical data for approved research,
study and education for legitimate purposes

 Discuss

patient information privately, NEVER
in elevators, lobbies, cafeterias, or hallways
 Make sure that requisitions, forms and
computer screens with patient names and
information are not easily viewed by others.
 Dispose of unnecessary patient information
in proper receptacles for shredding, not
ordinary trash bins.
 The

United States Department of Health &
Human Services (HHS) could impose civil
monetary and criminal penalties on a health
care provider that fails to comply with
Privacy Rules requirements.

Confidentiality

  • 2. Confidentiality protects the amount of a patient’s personal information that can be disclosed.  All staff must maintain the confidentiality of our patient’s personal information.  Maintaining the patient’s confidentiality is important in making sure that sensitive information is not made available for public use.  Helps to prevent identity theft. 
  • 3.  Privacy is a patient right  As employees we are to maintain the patient’s right to privacy with respect to individually identifiable health information  The patient has the right to decide when health information should be disclosed  PRIVACY = CONFIDENTIALITY
  • 4.  This facility has guidelines for the use and disclosure of identifiable health information that is in compliance with the Health Insurance Portability and Accountability Act (HIPAA)

  • 6.  The U.S. Department of Health and Human Services (HHS) issued the Privacy Rule in order to implement the requirement of the Health Insurance Portability and Accountability Act(HIPAA) of 1996. The Privacy Rule standards addresses the use and disclosure of individual’s health information by organizations subject to the Privacy rule as well as standards for individuals’ privacy rights to understand and control how their health information is used.
  • 7.  HIPAA is a federal regulation that most healthcare providers have to comply with that protects the privacy, security, and confidentiality of a patient’s health information.
  • 8.  It is necessary that all healthcare personnel receive mandatory education on the proper procedures in regards to confidential information and how it should be used
  • 9.  Protected health information (PHI) is individually identifiable health information  Identifies the individual where there is a reasonable basis to believe that the information can be used to identify the individual  Transmitted or maintained in any form or medium
  • 10.  HIPAA’s security rules require organizations that handle electronic health data to utilize interventions to control access to confidential health information and to protect the data against misuse and compromise.
  • 11.  The privacy, security, and confidentiality of patient information is important and it is important that you know the rules regarding patient confidentiality.
  • 12.  The “need to know” is defined as Minimum Necessary Information.
  • 13.  “need to know” is when you need information to; 1. Document the patient’s treatment 2. Facilitate communication between healthcare providers contributing to the patient’s care 3. Provide continuity of patient care 4. Provide a basis for review, study, and evaluation of patient care processes 5. Provide clinical data for approved research, study and education for legitimate purposes
  • 14. Our policy also guides us on, when and where we can discuss patient information
  • 15.  Discuss patient information privately, NEVER in elevators, lobbies, cafeterias, or hallways  Make sure that requisitions, forms and computer screens with patient names and information are not easily viewed by others.  Dispose of unnecessary patient information in proper receptacles for shredding, not ordinary trash bins.
  • 16.  The United States Department of Health & Human Services (HHS) could impose civil monetary and criminal penalties on a health care provider that fails to comply with Privacy Rules requirements.
