2. Appeal is a petition filed by one of the parties
involved in the case, so that the determination or
verdict handed down by the Religious Courts shall be
re-examined in the appeal examination by the
Religious High Court, as it is not satisfied with the
decision of the first instance of the Court.
3. Steps to be taken by the Appellant
• 1. The appellant must be submitted in writing or orally to
the Religious Court / Syari'ah Court within the grace
period:
• a. 14 days, starting from the next day from the date of
pronouncement of the decision, the announcement of
the decision to the interested parties;
• b. 30 days for applicants who are not located at the
residence in the jurisdiction of the Religious Courts /
Syari'ah Courts who decide upon the first level
• 2. Pay the appeal fee
• 3. The Clerk shall notify the appeal
4. • 4. The appellant may file an appeal brief and the
Respondent may appeal counter appeal brief
• 5. At the latest 14 days after the request is notified
to the opponent, the Registrar gives the two sides a
chance to see the case files at the office of the
Religious Court / Syari'ah Court
• 6. The case file shall be sent to the High Court of
Religion / Provincial Syari'ah Court by the Religious
Courts / Shariah Court no later than 1 month after
the acceptance of the appeal case.
5. 7. A copy of the appeal is sent by the Provincial High Court of Religion /
Provincial Syari'ah Court to the Religious Courts / Syari'ah Courts which
examines the case at the first level to be submitted to the parties.
8. The Religious Courts / Syari'ah Court shall deliver copies of the decisions
to the parties.
9. After the verdict has obtained a permanent law then the Registrar:
a. For divorce divorce cases:
1) To inform the stipulation of the day of the hearing of witnessing the
pledge of talak by summoning the Petitioner and the Respondent;
2) Giving Deed of Divorce as dividend certificate not later than 7 day.
b. For divorce case:
Providing Deed of Divorce as a divorce document within 7 days.
6. PROCESS OF DISPUTE
SETTLEMENT
• 1. Appeal case files are recorded and registered numbers.
• 2. Chairman of the Religious High Court / Provincial Syari'ah
Court makes the Stipulation of the Panel of Judges who will
examine the file.
• 3. The clerk appoints a substitute clerk who will assist the High
Council of Judges.
• 4. The substitute clerk hands over the file to the Chief Judge.
• 5. The substitute clerk distributes the case files to the High
Court of Justice.
• 6. The High Court of Justice adjudicated the appeal.
• 7. Copies of the verdict are sent to both parties through a
Court of First Instance.
