Small businesses have long struggled with access to affordable health care coverage. The Affordable Care Act aims to address this issue by lowering premium costs for small businesses and increasing their access to quality, affordable plans. Beginning in 2014, small businesses will be able to purchase coverage for their employees through the new Small Business Health Options Program Marketplaces. These SHOP Marketplaces will offer small businesses a choice of plans and increase transparency. Employers with 50 or more full-time employees may face penalties if they do not offer affordable coverage to employees beginning in 2015, but over 96% of businesses are exempt from these employer responsibility provisions.

– nearly 96 percent of all firms in the United States or 5.8

• Full-Time Equivalent (FTE) Employee: a combination of employees,

31. Self-Employed Business Owners
and Health Insurance Coverage
• Starting in January 2014, the individual shared responsibility provision calls
for each individual to have minimum essential health coverage for each
month, qualify for an exemption, or make a payment when filing his or her
federal income tax return.
• Minimum essential coverage includes employer-sponsored coverage
(including COBRA; retiree coverage; employer coverage through spouse),
coverage purchased in the individual market, Medicare, Medicaid coverage,
Children's Health Insurance Program (CHIP) coverage, Veteran’s health
coverage, TRICARE, and others as identified by the Department of Health and
Human Services.
• Sole proprietors (business owners without a common law employee), though
not eligible for SHOP coverage, may purchase coverage through the new
individual Health Insurance Marketplaces which will open in January 2014,

Non-profit employers are also eligible for the tax credit. For 2010 – 2013, it’s a credit of up to 25% for eligible non-profit employers. Starting in 2014, the credit rises to 35% for non-profits who are otherwise eligible and purchase coverage through SHOP.

SHOP isopen to small employers for coverage effective January 2014---including non-profits and religious organizations—with 50 or fewer full-time equivalent employees. In most states, the SHOP must use the full-time-equivalent counting method to determine whether an employer is eligible. However, as a transitional measure, in states that are running their own SHOP Marketplace, insurers can continue to use the State’s established method of counting “full-time” employees to determine which employers are eligible for SHOP, for plan years beginning in 2014 and 2015. Sole proprietors and shareholders of more than 2% of an S corporation with no common law employees, as well as the spouses of such business owners or shareholders, are considered individuals and may buy insurance through the Marketplace, but not through the SHOP.
You can start enrolling in SHOP coverage now.You have until December 23 to enroll in coverage that takes effect as early asJanuary 1. This means that employees who accept your offer of coverage must submit their enrollment forms to the agent, broker or insurer by that date.You can also offer your employees coverage through the SHOP Marketplace at any time during the year:If your employee enrollments are submitted between the 1st and 15th day of the month, your group coverage begins the first day of the next month. For example, if your employee enrollments are submitted on February 10, 2014, your group coverage begins March 1, 2014.For enrollments submitted after the 15th of the month, coverage begins the second following month. So, if employee enrollments are submitted on February 18, your group coverage will begin on April 1. For 2014, if you’re seeking SHOP coverage for your employees in a state using the Federally Facilitated SHOP Marketplace you’ll purchase that coverage directly from an agent, broker or insurance company that offers a SHOP Qualified Health Plan. This process is referred to as “direct enrollment.”Online enrollment is not available in the Federally Facilitated SHOP in 2014, but will be available in November 2014 for coverage taking effect in 2015.A state that runs its own SHOP Marketplace will have its own enrollment process, and may be offering online enrollment this year. If you’re not sure which type of SHOP marketplace your state is using, you can find out from your agent, broker or insurance company, from HealthCare.gov or by calling the SHOP Employer Call Center.
Direct enrollment in a Federally Facilitated SHOP plan in 2014 is pretty similar to how many small employers enroll in coverage today.You work directly with an agent, broker or an insurance company that offers a SHOP Qualified Health Plan. You can start by learning about the SHOP plans available in your area from your agent, broker, or insurance company, You can also learn about these plans on HealthCare.gov which has detailed information about each SHOP plan in your area, and a new premium estimation tool that you can without having to log into an account or fill out an application. A Marketplace Navigator or other assister can also help you learn about available plans and use the website, but can’t advise you on choosing a plan or enroll your employees in a plan.After you’ve selected a plan, your agent, broker or insurance company will give you an exact price quote. If you decide to take this plan, you’ll offer it to your employees. Those that accept will enroll with the insurance company directly, or through an agent or broker. After your employees enroll, you’ll pay the insurance company directly, or through an agent or broker. You don’t need to apply or wait for SHOP eligibility before your employees enroll in a plan. We’ll explain more about SHOP eligibility, what it means and how to apply for it on the next couple slides.
To be considered eligible for the Federally Facilitated SHOP, you must have submitted an application and have been by the SHOP Marketplace to meet the requirements to purchase SHOP coverage. States running their own SHOP Marketplace may have a different eligibility determination process.The main reason to get an eligibility determination from the Federally Facilitated SHOP in 2014, is so that you can take advantage of the expanded Small Business Health Care Tax Credit – if you also meet all the other requirements for the tax credit. If you want to have access to the expanded Small Business Health Care Tax Credit in 2014, you must receive an eligibility determination from the SHOP Marketplace before you file your business tax returns for the 2014 tax year. Your employees must also be enrolled in a SHOP Qualified Health Plan, so check with your agent, broker or insurance company when selecting a plan, to make sure that’s what you’re getting. By using “direct enrollment” you can choose not to wait for an eligibility determination from the SHOP Marketplace before enrolling in a SHOP qualified health plan. This may allow you to get coverage for your employees more quickly and to take full advantage of the tax credit sooner. You can claim the tax credit for the entire time your employees were enrolled in SHOP coverage during the tax year, as long as you get your eligibility determination sometime before you file your tax returns, If the SHOP Marketplace determines you weren’t eligible to participate in the SHOP after you’ve already enrolled, you would not be able to claim the Small Business Health Care Tax Credit, but your insurance company is not required to terminate your coverage.
As an employer, you file an application for SHOP eligibility, not your employeesIn the Federally Facilitated SHOP Marketplace, an agent, broker, or insurer can help you get, fill out and mail in the paper application. A Marketplace Navigator or other assister can also help you do this.Or you can fill out and download the paper application from HealthCare.gov. The website has instructions for completing the form and the mailing address, which is also listed on application.Finally, you can complete the application by phone through the SHOP Employer Call Center. The Federally Facilitated SHOP Marketplace will notify you of your eligibility to participate in the SHOP by phone and e-mail, as well as by mail, if requested. If you’re found eligible, the SHOP will also send your employee enrollment information to the IRS to ensure that, if you meet all the other requirements, you can claim the tax credit for tax year 2014. Youshould get a SHOPeligibility determination 3-5 days after the SHOP Marketplace receives your fully completed application.
One of the goals of the SHOP is to give small employers more options for their employees—including the option to offer employees a choice of health plans.The SHOP in each state has some flexibility to decide which options it will make available to employersIn 2014, small employers in states with a Federally Facilitated SHOP Marketplace will be able to select only one of the available plans for their employees. On July 2, 2013, Treasury issued transitional relief to employers covered by these rules indicating that the employer shared responsibility provisions will not take effect until 2015, and no shared responsibility payments will apply until 2015.
