5. Employment Tribunal Claims
• Latest figures (Jul-Sep 2018) show 31% increase in
single ET claims compared to same period in 2017
• 9020 receipts in Q2 (Jul-Sep) compared to 10,996
in Q1 (Apr-Jun)
• Receipt of multiple claims decrease by 37%
compared to same period in 2017 (though
instances actually increase)
• Refunds now amount to £15,825,000 – 20,000
successful applications

6. Disposals
• 57% increase in disposal of single claims
• 28% of these come as a result of Acas conciliated
settlement; 24% withdrawn; 10% struck out pre-
hearing and 8% successful at ET
• Claims relating to Unlawful Deduction of Wages
still most commonly disposed

7. Dealing with Delays
• Both single and multiple claims
seeing significant increase in
outstanding caseload (77% and
30% respectively)
• Statistics suggest mean lifetime
of ET claim is still 28 weeks
• However, ET National User Group
indicate that some claims may
not be heard until 2020

9. Increase in Aggravated Breach Penalties
• £5000 maximum ‘aggravated breach’ penalty to
increase to £20000 as of April 2019
• Since April 2014, ET has had power to impose a
penalty to those employers it feels had
aggravating factors in their breach of the
employee’s rights
• Max. penalty = 50% of awarded sum (£100
minimum if award below £200) or £20,000

• Live and breathe (and perhaps create!)
important policies
• Look at current recruitment practices – are you
bringing in the right people?
• Foster good relations – invest in creating a culture
of open and honest communication

• Use probation periods effectively
• Have a clear Performance Management system
and strategy
• Encourage open, honest conversations
• Challenge inappropriate behaviours
• Be consistent!
