This article discusses lawyers' increasing use of emerging technologies based on the results of the 2011 ABA Legal Technology Survey. It finds that lawyers are more open to technologies like cloud computing, mobile devices, and social media. Specifically:
- Cloud computing is used by lawyers for document sharing (23%), communication (23%), billing (17%), and scheduling (15%). Convenience of access from anywhere drives adoption.
- Smartphone use rose dramatically, with the iPhone seeing the largest gains. Tablet use is also rising, with the iPad dominating.
- LinkedIn is the most popular social media site for lawyers, used for networking and career development.
- Technologies are making lawyers' jobs easier and more flexible

In order to better distinguish the issues of data ownership in e commerce platforms, this article starts with the basic theory of data rights on e commerce platforms, studies the current status of e commerce legal regulations, and explains relevant data rights regulations from the aspects of legislation, law enforcement, and justice Practice and analyze how to scientifically allocate rights, obligations and responsibilities in practice based on classic cases of data rights protection on e commerce platforms. Through the research on the existing data of e commerce platform data rights, the comparative analysis method is used to analyze the main problems in the development. The e commerce platform data rights protection legal system, law enforcement protection methods, and judicial relief systems still need to be improved. Finally, corresponding perfect countermeasures are proposed for the above problems. China should further improve the e commerce platform data rights legal system, law enforcement mechanism, and judicial relief channels, improve the self discipline mechanism of industry associations, improve the internal data governance capabilities and levels of e commerce platform enterprises, and provide a comprehensive and systematic legal protection for the protection of e commerce platform data rights. The study we present aims to explore several factors pertaining to Consumer Acceptance of business technology as it related to Blockchain. Identifying and developing the relevant measures is of importance to business technology managers and software development managers today. We ask the important question of “what measures best represent the established constructs of the technology acceptance model?” In order to address this issue, it is important to identify the key measurements that help us to understand the proposed constructs as they relate to blockchain technology as well as confirm their validity in isolation and in combination with each other. In this study, the factors we explore are perceived reputation, risk, and usefulness and transaction intentions. A survey was used whereby the methodology adapted previous measurements from related works and new measurements pertaining to usefulness and risk were developed in order to adhere to blockchain’s consumer acceptance framework. 268 students completed the questionnaire and an exploratory factor analysis was used in order to analyze the constructs and their measurements. Through the results we were able to identify and validate the relevant measurements as well as the proposed constructs.

Around the turn of the century, the FBI [Federal Bureau of Investigation] was pursuing a case against a suspect—rumored to be Las Vegas strip-club tycoon Michael Galardi, though documents in the case are still sealed—when it hit upon a novel surveillance strategy.
The suspect owned a luxury car equipped with an OnStar-like system that allowed customers to "phone home" to the manufacturer for roadside assistance. The system included an eavesdropping mode designed to help the police recover the vehicle if it was stolen, but the FBI realized this same antitheft capability could also be used to spy on the vehicle's owner.
When the bureau asked the manufacturer for help, however, the firm (whose identity is still secret) objected. They said switching on the device's microphone would render its other functions—such as the ability to contact emergency personnel in case of an accident—inoperable. A federal appeals court sided with the company; ruling the company could not be compelled to transform its product into a surveillance device if doing so would interfere with a product's primary functionality.
The specifics of that 2003 ruling seem quaint today [in 2012]. The smartphones most of us now carry in our pockets can easily be turned into surveillance and tracking devices without impairing their primary functions. And that's not the only privacy risk created as we shift to a mobile, cloud-based computing world. The cloud services we use to synchronize data between our devices increase the risk of our private data falling prey to snooping by the government, by private hackers, or by the cloud service provider itself. And we're packing ever more private data onto our mobile devices, which can create big headaches if we leave a cell phone in a taxicab.

Exploring new mobile and cloud platforms without a governance strategy can
have consequences.
At the beginning of my IT career, I witnessed a number of decisions and project management practices which, at the
time, just didn't seem to make sense. But I was young, and I often thought to myself that the people involved must have
some other reasoning, some justification for their actions that I was just not privy to.
In short, I remained quiet when I should have spoken up. What two decades of experience has taught me is that there
is rarely reasoning or justification behind actions that, at a gut-level, are clearly bad IT practices. We inherently
recognize when common sense has taken a back seat.
There is most definitely a dark side to BYOD. For the most part, I am an advocate for the consumerization of IT (using
non-standard apps and tools as a way to increase end user engagement and productivity) and support the bring-your-
own-device model.
However, as a seasoned manager and IT operations leader, I recognize the risks that come with the model if
organizations do not properly plan out their strategies, putting sufficient protections and governance practices in place
to manage the potential risks that could come from these unsupported devices and applications. End users often want
what’s NEW, but there are valid reasons for imposing and enforcing safeguards when giving mobile business users
access to your otherwise secure, scalable, and compliant systems.
Some people equate governance with bureaucracy and hierarchical systems, but those perceptions often come from a
lack of appreciation for the potential risks involved. Governance is about checks and balances -- supporting the tools
and systems your end users want, but in a way that is manageable and which follows defined protocols.
