الدورة التدريبية الإقليمية السنوية في مجال حقوق الإنسان "عنبتاوي 25 " يشرّف المعهد العربي لحقوق الإنسان إعلامكم بأنه يعتزم تنظيم الدورة التدريبية الإقليمية عنبتاوي 25 بمرحلتيها، التدريب عن بعد والتدريب بالحضور المباشر في تونس. تعقد دورة عنبتاوي هذه السنة تحت عنوان "إستراتيجيات تعليم حقوق الإنسان والتربية عليها: المناصرة من أجل التغيير" وذلك بهدف تمكين وتعزيز قدرات 30 ناشط/ة من المنظمات الحقوقية المتخصصة في مجال التربية على حقوق الإنسان ومناصرة قضايا التربية والتعليم في المنطقة العربية وقد تم اختيار هذا الموضوع لدورة عنبتاوي الإقليمية احتفالا بمرور ربع قرن على بداية تنظيمها ونظرا لأن المناصرة الإستراتيجية لقضايا تعليم حقوق الإنسان والتربية عليها من ضمن أهداف خطته الإستراتيجية الحالية 2014- 2016 وقد عمل المعهد العربي على بناء نماذج عمل وتجارب ناجحة حولها أثبتت فعّاليتها كأداة قادرة على إيصال حقوق الإنسان لجميع الناس وعلى تحقيق التغيير داخل المجتمع خطابا وممارسة وعلى التأثير في السياسات.

تطورت الاحتجاجات الاجتماعية خلال شهر سبتمبر 5102 فلقد تم تسجيل 893 تحركا احتجاجيا فرديا وجماعيا مقابل
575 تحركا خلال شهر جويلية و 572 تحركا خلال شهر أوت أي بزيادة في حدود 52 في المائة عن الشهرين الماضيين ولعل
السبب في ذلك يعود الى بداية السنة التربوية والسنة الرياضية وكذلك السنة السياسية التي استهلت بجملة من
الاحتجاجات حول قانون المصالحة وما أثاره هذا القانون من ردود فعل مختلفة وكذلة موجة الاضرابات التي شملت
بالخصوص القطاع التربوي وتحديدا التعليم الاساسي والاحتجاجات الاجتماعية التي تم تسجيلها في عديد المناطق حول
هذا الاضراب الذي تزامن مباشرة مع انطلاق السنة الدراسية وكذلك الاحتجاجات التي تم رصدها في كل الجهات دون
استثناء حول الاضراب الذي تم اعلانه لسائقي البضائع والمحروقات قبل يومين من عيد الاضحى هذا علاوة على
الاحتجاجات المتعددة أيضا في عديد الجهات حول قانون المصالحة في المجال الاقتصادي والمالي ، احتجاجات أخذت
في عديد الجهات أشكالا عنيفة .
تطورت اذن حركة الاحتجاجات الاجتماعية في فترة لا تزال فيها تونس تواجه الارهاب والانكماش الاقتصادي والبطالة
وعديد الاشكالات الاجتماعية بالخصوص بعد فترة صيف وشبه هدنة اجتماعية كانت فرصة للسلطة لمعالجة العديد من
الملفات العالقة وتقديم خطاب يبلور جملة من المشاريع القادرة على تطوير الأمل والثقة والانخراط في نهج الفعل والعمل
من أجل اجتثاث أصول الارهاب وبناء الديمقراطية الاجتماعية التشاركية الصمام القادر على فتح مسالك التنمية في
صيغتها المواطنية .
A l’occasion du 13 août 2014, Journée Nationale de la Femme, qui marque la date anniversaire de la promulgation du Code du Statut Personnel (CSP) ayant doté la femme tunisienne d’un statut unique et privilégié dans le monde arabe, l’Union européenne est heureuse de publier le "Profil Genre de la Tunisie".
Ce document, préparé dans le cadre de la coopération de l’Union européenne avec le Gouvernement de la République tunisienne, a pour objectif de mieux prendre en considération les questions liées au genre.
ي أوائل القرن العشرين، كانت الديمقراطية تبنى على نظاميكم ال ثالث لهما: النظام البرلماني، والنظام الرئاسي. إل أنكالهما شهد تطورا ملحوظا على مدار هذا القرن لدرجة دفعت العلماء إلى الاعتراف ببروز نظام حكم ثالث، أال وهو النظام شبها لرئاسي. ارتكز هذان النظامان على سلطتين سياسيتين، البرلمان والرئيس أو البرلمان والحكومة التي يرأسها رئيس الوزراء، قبلأن يأتي النظام شبه الرئاسي ليمنح جهات الحكم الثالث أدوارا رئيسية، وسلطات كبيرة، ويساوي بينها في الشرعية الديمقراطية.
ومع قيام ثورات الربيع العربي، تسعى كل من تونس، ومصر،وليبيا لوضع دساتير جديدة، وقد تتبعهم بلدان أخرى. ومع تناول
مسألة شكل نظام الحكم في المستقبل، يكثر الحديث في تلك الدول عن النظام شبه الرئاسي لسببين: الأول هو خشية شعوب تلك الدول من الرجوع إلى الحكم الاستبدادي مرة أخرى في حالة اعتماد النظام الرئاسي، والثاني هو عدم ارتياح الكثيرين للنظام البرلماني نظرا لما يحمله من عدم استقرار أومآ يمنحه من سلطات زائدة لأحزاب الأغلبية. وال تسعى تلك الورقة إلى الترويج لنظام معين، بل تعمل جاهدة على شرح النظام شبه الرئاسي الأقل وضوحا وربما الأقل بديهية. وهي بذلك تسعى لإثراء الجدل الدائر بالتحليلات والمقارنات المفيدة.
إلجماع الدولي: العناصر األساسية للديمقراطيةJamaity
يطالب متظاهرو الربيع العربي بالديمقراطية في منطقة خضعت لعقود لحكم نظم مستبدة ورغم وضوح ذلك المطلب، إال أنه ال يتضح بنفس الدرجة نوع الديمقراطية التي تنادي بها تلك الشعوب، فبينما يؤيد الجميع إجراء انتخابات شفافة وتنافسية، فثمة مخاوف من فرض الغالبية المستبدة لرؤيتها لشكل الدولة والمجتمع على من ال يحظون بتمثيل في الحكومة.
والتساؤلات حول حدود حكم الأغلبية قديمة قدم مفهوم الديمقراطية ذاته، وليست لها إجابات فورية أو قوية. وال يوجد بالفعل مفهوم متفق عليه بشكل عام لما يصنع حكما ديمقراطيا. فالإجابات الأكاديمية على هذا التساؤل تتراوح ما بين التعريفات التي تضع الحد الأدنى للديمقراطية )التنافس المتكافئ على الأصوات(، والأخرى واسعة النطاق )المساواة أو الرفاهة الاقتصادي(. ولكن النظر إلى الدول التي توصف بالديمقراطية ال يساعد في هذا الصدد، حيث تشهد تلك الدول أنظمة وأنشطة سياسية متنوعة

L’adoption d’une Constitution en Tunisie garante des droits et libertés et consacrant les principes de gouvernance démocratique constitue une étape importante en vue de l’instauration d’une démocratie, mais n’est pas suffisante. La mise en oeuvre des dispositions constitutionnelles et la matérialisation des garanties constitutionnelles demeurent nécessaires en vue de l’instauration d’une gouvernance démocratique.
Democracy Reporting International (ci-après DRI) publie le présent rapport afin de faire un suivi périodique de la mise en oeuvre de la Constitution tunisienne, et ce, au niveau du cadre juridique.
الربط بين المنظومة الدستورية السابقة والمنظومة الدستوريةJamaity
عند صياغة دستور جديد، يدرك واضعو النص الدستوري أنّه من غير الممكن تطبيق جميع أحكام الدستور الجديد منذ اليوم الأوّل لإصداره.
لذا، نراهم يعملون على وضع أحكام انتقالية بهدف ضمان المرور من مرحلة تطبيق القواعد الدستورية القديمة إلى مرحلة تطبيق القواعد جديدة.
الأحكام الانتقالية هي مجموعة من القواعد المؤقتة والرامية إلى ضمان الانتقال في أفضل الظروف من إطار دستوري إلى آخر ومن نظام قانوني سابق إلى نظام قانوني جديد.
إنّ هذا الباب الأساسي من أي دستور جديد يمكّن من معالجة التعقيدات التي قد تنجرّ عن النّفاذ الفوري والكامل للقواعد الدستورية الجديدة وذلك بتأجيل تطبيق بعض الموادّ التي لا يمكن أن تدخل حيز التطبيق مباشرة إثر إصدار الدستور. ومن بين المسائل التي تتناولها هذه الأحكام، مسألة مآل كلّ من النص الدستوري السابق والقوانين السابقة، وكذلك مصير الوكالات والمناصب السياسية التي تعود إلى المنظومة الدستورية السابقة. يمكن أيضا أن تكون الأحكام الانتقالية أداة في يد السلطة التأسيسية لملء الفراغ في الفترة السابقة لإنشاء و تركيز المؤسسات الديمقراطية الجديدة المنصوص عليها في النص الدستوري الجديد. أخيرا، قد تُمكّن الأحكام الانتقالية من تنظيم بعض المسائل الخاصّة، كالتنصيص على حكومة وحدة وطنية أو على مسار للعدالة الانتقالية أو إدراج خارطة طريق خاصّة بالانتخابات صلب نصّ الدستور.

Lors de la rédaction d'une nouvelle Constitution, les rédacteurs du texte constitutionnel réalisent que toutes les dispositions de la nouvelle Constitution ne peuvent pas être appliquées dès le premier jour de sa promulgation. Ils envisagent dès lors de mettre en place des règles transitoires afin d'assurer le passage de l'application de l'ancienne norme constitutionnelle à l'application de la nouvelle.
Les dispositions transitoires constituent un ensemble de règles temporaires servant à assurer le passage dans les meilleures conditions d’un cadre constitutionnel à un autre et d’un régime juridique antérieur à un régime juridique nouveau.
Ce chapitre essentiel dans toute nouvelle Constitution permet de palier les complications d’une entrée en vigueur immédiate et intégrale de la nouvelle norme suprême en permettant de retarder la mise en application de certains articles qui ne peuvent l’être immédiatement après la promulgation de la Constitution. Ces dispositions traitent entre autres du statut du texte constitutionnel antérieur, du statut des lois antérieures aussi bien que du sort réservé aux mandats et postes politiques datant de l’ancien ordre constitutionnel.
Les dispositions transitoires peuvent également représenter un instrument aux mains du constituant permettant de combler le vide précédant la création et la mise en place des nouvelles institutions démocratiques prévues par le nouveau texte. Enfin, elles peuvent aussi servir à régir des situations particulières, tels que la mention d’un gouvernement d’union nationale, d’un processus de justice transitionnelle ou de l’intégration dans la Constitution même d’une feuille de route pour des élections.
Normes internationales relatives à lindépendance de la justiceJamaity
L’indépendance de la justice est l’expression concrète de deux éléments essentiels de la démocratie, à savoir l’Etat de droit et la séparation des pouvoirs. Dans une démocratie constitutionnelle, le processus politique et toutes les fonctions de l’Etat doivent s’inscrire dans les limites prévues par la loi. Les juges sont tenus de respecter l’Etat de droit. Pour s’assurer qu’ils le fassent à l’abris d’influences abusives, ils doivent être indépendants des branches exécutive et législative du pouvoir. Leur rôle dans la démocratie est particulièrement important pour la sauvegarde des droits de l’Homme.
ن يعبّر استقال القضاء في شكل ملموس عن عنصرين أساسيين يمث الديمقراطية هما سيادة القانون والفصل بين السلطات. ففي الديمقراطية الدستورية، ينبغي أن تندرج العملية السياسية وأي وظيفة تقوم بها الدولة ً ضمن نطاق القانون. ومن واجب القضاة أن يدعموا سيادة القانون. وسعيا إلى ضمان سيادة القانون من دون ممارسة أي تأثير غير سليم، على القضاة ّين عن الفرع التنفيذي والتشريعي من السلطة. ويضطلع أن يكونوا مستقل دور القضاة في النظام الديمقراطي بأهمية كبيرة من حيث صون وحماية حقوق االنسان

Empowering Women : Legal Rights and Economic Opportunities in AfricaJamaity
This book looks at the effect of legal and economic rights on women's economic opportunities. It focuses on entrepreneurship because women in Africa are active entrepreneurs, and the links between property rights and the ability to enter contracts in one's own name affect entrepreneurial activities. The laws that are the focus of this book are not business laws and regulations, which are generally gender blind and presuppose that individuals can own property or enter into contracts. Instead, the book examines family, inheritance, and land laws, which oft en restrict these rights in ways that hurt women. This book surveys constitutions and statutes in all 47 countries in Sub-Saharan Africa to document where gender gaps in these laws impinge on women's legal capacity, property rights, or both. The book also looks at some labor law issues, such as restrictions on the types of industries or hours of work in which women may engage and provisions for equal pay for work of equal value. These laws affect women as employees and influence the attractiveness of wage employment versus entrepreneurship. They were also selected because they affect the choice of enterprise women may run. The equal pay for work of equal value provisions are also of interest as an indicator of the recognition of women's broader economic rights. This book provides a series of indicators that show whether a country does or does not provide particular legal provisions. Several points are worth emphasizing in interpreting these indicators. First, the indicators are binary; there is no attempt to differentiate between small and large gender gaps. Second, the indicators are not used to generate an index or otherwise aggregate the indicators; no weights are given to differentiate the relative importance of different sets of laws. Third, the indicators reflect whether certain legal provisions are recognized in a country or not; because the link between the indicator and gender gaps is not always straightforward, care must be taken in making value judgments. Although some indicators reveal that women are treated equally or identify gender differences in treatment, others do not. Although recognition of these sources of law can have implications for women's rights, it does not necessarily imply that women's rights are stronger or weaker. Conversely, the inclusion of some protections for women's rights may reflect not the strong standing of women but rather the fact that gender equality is not seen as axiomatic and needs to be explicitly stated. Second and third chapters focus on formal rights and how they have been upheld in court decisions. Fourth chapter examines the gap between laws on the books and practice on the ground. Fifth chapter looks at how both the substance of law and women's access to justice issues can be improved to expand women's ability to pursue economic opportunities.

ي أوائل القرن العشرين، كانت الديمقراطية تبنى على نظاميكم ال ثالث لهما: النظام البرلماني، والنظام الرئاسي. إل أنكالهما شهد تطورا ملحوظا على مدار هذا القرن لدرجة دفعت العلماء إلى الاعتراف ببروز نظام حكم ثالث، أال وهو النظام شبها لرئاسي. ارتكز هذان النظامان على سلطتين سياسيتين، البرلمان والرئيس أو البرلمان والحكومة التي يرأسها رئيس الوزراء، قبلأن يأتي النظام شبه الرئاسي ليمنح جهات الحكم الثالث أدوارا رئيسية، وسلطات كبيرة، ويساوي بينها في الشرعية الديمقراطية.
ومع قيام ثورات الربيع العربي، تسعى كل من تونس، ومصر،وليبيا لوضع دساتير جديدة، وقد تتبعهم بلدان أخرى. ومع تناول
مسألة شكل نظام الحكم في المستقبل، يكثر الحديث في تلك الدول عن النظام شبه الرئاسي لسببين: الأول هو خشية شعوب تلك الدول من الرجوع إلى الحكم الاستبدادي مرة أخرى في حالة اعتماد النظام الرئاسي، والثاني هو عدم ارتياح الكثيرين للنظام البرلماني نظرا لما يحمله من عدم استقرار أومآ يمنحه من سلطات زائدة لأحزاب الأغلبية. وال تسعى تلك الورقة إلى الترويج لنظام معين، بل تعمل جاهدة على شرح النظام شبه الرئاسي الأقل وضوحا وربما الأقل بديهية. وهي بذلك تسعى لإثراء الجدل الدائر بالتحليلات والمقارنات المفيدة.
إلجماع الدولي: العناصر األساسية للديمقراطيةJamaity
يطالب متظاهرو الربيع العربي بالديمقراطية في منطقة خضعت لعقود لحكم نظم مستبدة ورغم وضوح ذلك المطلب، إال أنه ال يتضح بنفس الدرجة نوع الديمقراطية التي تنادي بها تلك الشعوب، فبينما يؤيد الجميع إجراء انتخابات شفافة وتنافسية، فثمة مخاوف من فرض الغالبية المستبدة لرؤيتها لشكل الدولة والمجتمع على من ال يحظون بتمثيل في الحكومة.
والتساؤلات حول حدود حكم الأغلبية قديمة قدم مفهوم الديمقراطية ذاته، وليست لها إجابات فورية أو قوية. وال يوجد بالفعل مفهوم متفق عليه بشكل عام لما يصنع حكما ديمقراطيا. فالإجابات الأكاديمية على هذا التساؤل تتراوح ما بين التعريفات التي تضع الحد الأدنى للديمقراطية )التنافس المتكافئ على الأصوات(، والأخرى واسعة النطاق )المساواة أو الرفاهة الاقتصادي(. ولكن النظر إلى الدول التي توصف بالديمقراطية ال يساعد في هذا الصدد، حيث تشهد تلك الدول أنظمة وأنشطة سياسية متنوعة

A l’occasion du 13 août 2014, Journée Nationale de la Femme, qui marque la date anniversaire de la promulgation du Code du Statut Personnel (CSP) ayant doté la femme tunisienne d’un statut unique et privilégié dans le monde arabe, l’Union européenne est heureuse de publier le "Profil Genre de la Tunisie".
Ce document, préparé dans le cadre de la coopération de l’Union européenne avec le Gouvernement de la République tunisienne, a pour objectif de mieux prendre en considération les questions liées au genre.
L’adoption d’une Constitution en Tunisie garante des droits et libertés et consacrant les principes de gouvernance démocratique constitue une étape importante en vue de l’instauration d’une démocratie, mais n’est pas suffisante. La mise en oeuvre des dispositions constitutionnelles et la matérialisation des garanties constitutionnelles demeurent nécessaires en vue de l’instauration d’une gouvernance démocratique.

عند صياغة دستور جديد، يدرك واضعو النص الدستوري أنّه من غير الممكن تطبيق جميع أحكام الدستور الجديد منذ اليوم الأوّل لإصداره.
لذا، نراهم يعملون على وضع أحكام انتقالية بهدف ضمان المرور من مرحلة تطبيق القواعد الدستورية القديمة إلى مرحلة تطبيق القواعد جديدة.
الأحكام الانتقالية هي مجموعة من القواعد المؤقتة والرامية إلى ضمان الانتقال في أفضل الظروف من إطار دستوري إلى آخر ومن نظام قانوني سابق إلى نظام قانوني جديد.
إنّ هذا الباب الأساسي من أي دستور جديد يمكّن من معالجة التعقيدات التي قد تنجرّ عن النّفاذ الفوري والكامل للقواعد الدستورية الجديدة وذلك بتأجيل تطبيق بعض الموادّ التي لا يمكن أن تدخل حيز التطبيق مباشرة إثر إصدار الدستور. ومن بين المسائل التي تتناولها هذه الأحكام، مسألة مآل كلّ من النص الدستوري السابق والقوانين السابقة، وكذلك مصير الوكالات والمناصب السياسية التي تعود إلى المنظومة الدستورية السابقة. يمكن أيضا أن تكون الأحكام الانتقالية أداة في يد السلطة التأسيسية لملء الفراغ في الفترة السابقة لإنشاء و تركيز المؤسسات الديمقراطية الجديدة المنصوص عليها في النص الدستوري الجديد. أخيرا، قد تُمكّن الأحكام الانتقالية من تنظيم بعض المسائل الخاصّة، كالتنصيص على حكومة وحدة وطنية أو على مسار للعدالة الانتقالية أو إدراج خارطة طريق خاصّة بالانتخابات صلب نصّ الدستور.

Lors de la rédaction d'une nouvelle Constitution, les rédacteurs du texte constitutionnel réalisent que toutes les dispositions de la nouvelle Constitution ne peuvent pas être appliquées dès le premier jour de sa promulgation. Ils envisagent dès lors de mettre en place des règles transitoires afin d'assurer le passage de l'application de l'ancienne norme constitutionnelle à l'application de la nouvelle.
Les dispositions transitoires constituent un ensemble de règles temporaires servant à assurer le passage dans les meilleures conditions d’un cadre constitutionnel à un autre et d’un régime juridique antérieur à un régime juridique nouveau.
Ce chapitre essentiel dans toute nouvelle Constitution permet de palier les complications d’une entrée en vigueur immédiate et intégrale de la nouvelle norme suprême en permettant de retarder la mise en application de certains articles qui ne peuvent l’être immédiatement après la promulgation de la Constitution. Ces dispositions traitent entre autres du statut du texte constitutionnel antérieur, du statut des lois antérieures aussi bien que du sort réservé aux mandats et postes politiques datant de l’ancien ordre constitutionnel.
Les dispositions transitoires peuvent également représenter un instrument aux mains du constituant permettant de combler le vide précédant la création et la mise en place des nouvelles institutions démocratiques prévues par le nouveau texte. Enfin, elles peuvent aussi servir à régir des situations particulières, tels que la mention d’un gouvernement d’union nationale, d’un processus de justice transitionnelle ou de l’intégration dans la Constitution même d’une feuille de route pour des élections.

L’indépendance de la justice est l’expression concrète de deux éléments essentiels de la démocratie, à savoir l’Etat de droit et la séparation des pouvoirs. Dans une démocratie constitutionnelle, le processus politique et toutes les fonctions de l’Etat doivent s’inscrire dans les limites prévues par la loi. Les juges sont tenus de respecter l’Etat de droit. Pour s’assurer qu’ils le fassent à l’abris d’influences abusives, ils doivent être indépendants des branches exécutive et législative du pouvoir. Leur rôle dans la démocratie est particulièrement important pour la sauvegarde des droits de l’Homme.

Empowering Women : Legal Rights and Economic Opportunities in AfricaJamaity
This book looks at the effect of legal and economic rights on women's economic opportunities. It focuses on entrepreneurship because women in Africa are active entrepreneurs, and the links between property rights and the ability to enter contracts in one's own name affect entrepreneurial activities. The laws that are the focus of this book are not business laws and regulations, which are generally gender blind and presuppose that individuals can own property or enter into contracts. Instead, the book examines family, inheritance, and land laws, which oft en restrict these rights in ways that hurt women. This book surveys constitutions and statutes in all 47 countries in Sub-Saharan Africa to document where gender gaps in these laws impinge on women's legal capacity, property rights, or both. The book also looks at some labor law issues, such as restrictions on the types of industries or hours of work in which women may engage and provisions for equal pay for work of equal value. These laws affect women as employees and influence the attractiveness of wage employment versus entrepreneurship. They were also selected because they affect the choice of enterprise women may run. The equal pay for work of equal value provisions are also of interest as an indicator of the recognition of women's broader economic rights. This book provides a series of indicators that show whether a country does or does not provide particular legal provisions. Several points are worth emphasizing in interpreting these indicators. First, the indicators are binary; there is no attempt to differentiate between small and large gender gaps. Second, the indicators are not used to generate an index or otherwise aggregate the indicators; no weights are given to differentiate the relative importance of different sets of laws. Third, the indicators reflect whether certain legal provisions are recognized in a country or not; because the link between the indicator and gender gaps is not always straightforward, care must be taken in making value judgments. Although some indicators reveal that women are treated equally or identify gender differences in treatment, others do not. Although recognition of these sources of law can have implications for women's rights, it does not necessarily imply that women's rights are stronger or weaker. Conversely, the inclusion of some protections for women's rights may reflect not the strong standing of women but rather the fact that gender equality is not seen as axiomatic and needs to be explicitly stated. Second and third chapters focus on formal rights and how they have been upheld in court decisions. Fourth chapter examines the gap between laws on the books and practice on the ground. Fifth chapter looks at how both the substance of law and women's access to justice issues can be improved to expand women's ability to pursue economic opportunities.

Financial viability is one of these challenges threatened by the lack of fundraising expertise, and access to available opportunities.
This guide aims to inform community-based organizations, grassroots organizations, and social impact businesses about available funding and technical opportunities and equip them with data and tools to better secure funds.

In 2021, countries in the Middle East and North Africa (MENA) began to chart their path toward recovery from the myriad impacts of the COVID-19 pandemic. Yet, the process of recovery—social, economic, and political proved to be both gradual and halting. Over the course of the year, CSOs in the region faced not only the ongoing impact of the pandemic, but also political unrest and financial uncertainty, yet continued to adapt to the difficult and shifting environment. The 2021 CSO Sustainability Index for MENA, which reports on the state of CSO sectors
in Egypt, Iraq, Jordan, Lebanon, Libya, Morocco, Tunisia, and Yemen, outlines CSOs’ successes and obstacles in carrying out their missions.
L’intervention de l’UICN a également permis d’accompagner les partenaires dans la mise en oeuvre
de leurs Plans d’Actions Stratégiques.
Les résultats et réalisations présentés dans ce rapport donnent une photographie de la dynamique
de l’UICN dans la région et de sa contribution à la conservation, gestion durable du capital naturel et
aux objectifs du développement durable.

Étant donné que le plaidoyer constitue l’une des grandes missions des coalitions dans leur travail quotidien, l’équipe du
projet a pensé à créer ce document d’une manière simple et pratique, permettant aux membres d’enrichir leurs bases de
connaissance mais aussi pouvoir pratiquer et appliquer ce qui est mentionner dans leurs activités ainsi que leur vie
associative quotidienne.
La levée des fonds ou la recherche de financements dénommé en anglais « Fundraising » consiste en un processus de
collecte de contributions sous forme d’argent ou d’autres ressources en sollicitant des dons à des particuliers, des entreprises,
des fondations caritatives ou des agences gouvernementales.
La levée des fonds est l’une des pièces les plus importantes du puzzle organisationnel, en effet en l’absence de financement,
une organisation ne pourra pas servir efficacement la cause qu’elle défend et répondre aux besoins de la communauté et
elle serait amenée à terme à disparaître.
La levée de fonds est une démarche stratégique à long terme laquelle engage l’ensemble de l’organisation, administrateurs,
permanents et bénévoles autour d’un projet.
En substance, le fundraising n’est pas une finalité en soi mais plutôt un moyen pour concrétiser des idées/ actions.
تسلط هذه الدراسة الضوء على الحق في السكن في تونس من خلال النظر في واقع وظروف عيش
المهاجرين من جنوب الصحراء في تونس. تعتمد الدراسة على مقاربة أنثروبولوجية وتستقي معطيات
الميدانية من جملة من المقابلات شبه المهيكلة مع عدد من المهاجرين المقيمين في احياء تونس
العاصمة، ما ساعد على استخلاص مادة كيفية للإجابة على الأسئلة التي تضعها الدراسة.
وتنظر الدراسة الى ديناميكيات السكن الخاصة بالمهاجرين سعيا الى مناقشة حدود وصولهم إلى هذا
الحق على مستويات مختلفة )سياسية، مؤسساتية، اجتماعية، شخصية، إلخ(، من خلال تحليل سرديات
فردية لفهم ظروف السكن وعوامل اختياره، بما في ذلك المحيط العمراني المباشر للمسكن. وتعتمد
الدراسة أساسا على مقاطعة مسارات البحث عن مسكن والولوج الى هذا الحق مع مسارات الهجرة
والعلاقة بين المهاجر والمجتمع المحلي، وصولا الى تقاطع الهامش الذي يشغله المهاجرون مع
الهوامش الاجتماعية المحلية والدور الذي تلعبه شبكات الأمان المجتمعي.
يمهد هذا العمل الى نشر نسخة أشمل للدراسة والتي ستجمع عملا ميدانيا موسعا )ولايتي صفاقس
ومدنين الى جانب تونس الكبرى(، ويضع في مرحلة اولى جملة من التوصيات كما يلي:

تحسين وتعميم آليات وبرامج ادارة المساعدات المالية التي تقدمها المنظمات الإنسانية
دعم المبادرات المجتمعية في الأحياء المستهدفة
تحسيس الرأي العام لتعزيز التضامن مع وبين التونسيين والمهاجرين واللاجئين وطالبي اللجوء
مراجعة القانون رقم 7 المؤرخ في 8 مارس 1968 والمتعلق بوضع الأجانب في تونس )قانون
تصريح الإقامة( لجعله متوافقًا مع المعاهدات الدولية
إعادة النظر في شروط إيواء الأجنبي واجبارية اعلام أقسام الشرطة بذلك
دعم واسناد دور جمعيات المجتمع المدني في توفير المرافقة القانونية للمهاجرين بما في ذلك
الأطر المتعلق بحقهم في السكن ومرافقة توقيع العقود )فحص البنود التعاقدية مع صاحب
المسكن( والمبادرة باقتراح نموذج عقد موحد خاص باللاجئين والمهاجرين
تسهيل اجراء ات منح تصريح الإقامة وإزالة العقوبات المتعلقة بانقضاء مدتها
ضمان الوصول إلى العدالة فيما يتعلق بالحق في السكن في حالة التجاوز
مراعاة الوضع الهش للمهاجرين في كافة برامج وزارة الشؤون الاجتماعية
مراجعة محتوى البرامج التعليمية لجعلها أكثر شمولية واحترامًا للمهاجرين
دعم عمل منظمات المجتمع المدني على تسليط الضوء على مسألة الوصول إلى العدالة فيما
يتعلق بالحق في السكن للمهاجرين وإدراج هذه النقطة ضمن أوليات ومخاوف المنظمات عند
اصدار تقاريره
La présente étude a été conduite par Maram Tebbini pour le FTDES, membre du Arab Hub for Social Protection, et ce dans le cadre du projet de recherche « Social Protection in (post)Covid MENA ».
Il s’agit de la première partie d’un travail plus élaboré qui couvrira d’autres villes Tunisiennes à paraître en septembre 2022.
Rattaché au principe de la dignité, avoir droit à un logement signifie protéger la dignité et l’intégrité physique et psychique de l’individu. Ce droit implique l’accès à un logement sécurisé, habitable, doté de services nécessaires et situé à proximité des possibilités d’emploi, des services de santé, des écoles, des moyens de transports, etc. Le logement doit aussi être adapté à l’expression de l’identité culturelle des habitants. Ces conditions sont pourtant difficilement réunies même pour une bonne partie de Tunisiens marginalisés. La situation empire clairement pour d’autres groupes marginalisés, à savoir les migrants « subsahariens ». La visée de cette étude serait de décrire et de discuter les conditions de l’habitat de ces derniers.

تنطلق هذه الدراسة من جملة من الاستفهامات النظرية والميدانية التي لا نروم الإجابة عليها بقدر ما نروم استحثاث التفكير فيها. أمّا هويّتها التحرّرية المواطنية وخلفيتها الحقوقية باعتبار الإطار الجمعياتي الذي أنجزت فيه فانّه يجعل الغاية كذلك من هذا البحث هو تزويد القارئ عموما والفاعلين الاجتماعيين بشكل خاص بأليّات تفكير مختلفة ليكونوا خاصة أكثر وعيا بالقضايا وأكثر نجاعة في طرحها واستشراف نتائجها

Normal life came to an abrupt halt in the first quarter of 2020 as the COVID-19 virus spread around the globe. Confronted by myriad unprecedented challenges, including political and economic unrest, the closure of civic space, and a decline in financial viability, CSOs in the Middle East and North Africa (MENA) demonstrated remarkable resilience. They reacted quickly to the constantly changing circumstances by providing critical services, thereby demonstrating their value to the societies in which they are based. In addition, CSOs increasingly adopted new technologies, allowing them to develop new ways of working, providing services to their constituents, and increasing their own capacities. The pandemic thus served as a litmus test, both exposing CSOs’ vulnerabilities and highlighting their resilience. This year’s CSO Sustainability Index for MENA, which reports on the state of CSO sectors in Egypt, Iraq, Jordan, Lebanon, Libya, Morocco, Tunisia, and Yemen, describes both these opportunities and challenges.

How has the Tunisian diaspora responded when COVID-19 hit their country of origin? How did they support and engage with families, communities back in Tunisia? And did they coordinate with the wider humanitarian system when delivering humanitarian aid?
DEMAC has conducted a Real-time review between July and September 2021, providing a rapid analysis of the humanitarian response of Tunisian diaspora organizations to the fourth and most severe wave of the COVID-19 pandemic.

Le droit d’asile constitue un droit fondamental consacré tant par la Charte des droits fondamentaux de l’Union
européenne15 que par le droit italien.
Cependant, force est de constater la multiplication des obstacles pour limiter l’accès aux procédures d’asile.
Le concept de « pays d’origine sûr » permet ainsi de déclarer irrecevable une demande d’asile et de renvoyer le demandeur vers l’Etat concerné, sous prétexte que ce pays est sûr pour lui. Or, la Tunisie ne peut être
considérée comme absolument « sûr » pour toutes et tous ses ressortissants. Ce concept est donc incompatible avec le droit d’asile et les garanties à fournir à la population migrante.
L’utilisation de la notion de « sûreté » pour justifier la mise en place d’une procédure accélérée d’examen d’une demande d’asile implique non seulement un abaissement des garanties procédurales indispensables pour
assurer la qualité de cet examen, mais méconnait également la réalité de la situation particulière de nombreux tunisiens demandeurs d’asile.
En outre, l'instrumentalisation de ce concept permet une certaine standardisation des rapatriements vers la Tunisie – 1.997 Tunisiens en 2020 et 1.655 jusqu'à mi-novembre 2021 – qui reste le pays vers lequel l'Italie effectue le plus d'opérations de rapatriement.
Les organisations signataires entendent souligner la gravité de la situation vécue par de nombreux tunisien.ne.s victimes de violations graves de droits humains et appellent le gouvernement italien à renoncer à la notion de « pays d’origine sûr » qui vide le droit d’asile de sa substance.
