repeal of the draft. Since this event Schenck was charged because of the recently enacted Espionage
Act. This act made any utterance that was considered disloyal toward the U.S. government, the
Constitution, or the military completely illegal. Schenck responded that the Espionage Act violated the
First Amendment of the Constitution. The Constitutional issue within this court case was that it

female surfers at Rockaway Beach.
