The Legal Profession And Legal Education
Introduction This essay outlines two of the most important problems and/or challenges facing
lawyers and the legal profession in regard to access to justice for all Australians. The essay will look
at how the profession and legal education should respond to these challenges. In society today many
industries are facing challenges and problems, including lawyers and the legal profession. The legal
profession, in general, is now finding itself having to adapt to changes at a faster rate at any time in
its history. The profession faces many challenges such as adapting to the new age with advances in
technology, being forced to adapt and develop of face a downward slop. It also faces problems such
self litigation by clients thus loosing money. This essay is broken up into two sections, both sections
will examine a problem or a challenge that lawyers or legal professions faces, it will then analyze
how to overcome such issue if at all possible. The first section of this essay is on the new era, how
lawyer and legal practices have to adapt to the new technology that has advanced in the twenty–first
century. The second section is on self representation litigation as more people are actively
representing themselves in court or tribunal proceedings on their own behalf. The new age
technology Technology is one way legal professions can improve efficiency and reduce cost. It has a
profound impact on the legal profession, particularly in the areas of increasing efficiency and

Adversarial Approach To The Legal Profession
Lawyers encounter difficult ethical situations within their profession. A lawyer's obligation to the
legal profession lies not only with their duty to the client but also to the court. Hence, duty must be
given to the administration of justice by allowing for the legal system to determine a client's claim,
regardless of their moral worth. The responsible lawyering approach effectively caters to this and
thus, this paper will analyze the advantages of this approach and its position within the legal
profession, while also identifying its conflicting position within the framework of justice.
An ethical perspective plays a vital role in understanding the duties and responsibilities required by
lawyers in their profession, but is also necessary as stated by Parker and Evans "to judge what rules
should be made (on a professional level) and also to decide (on a personal level) what the rules
mean, how to obey them..." The four main approaches to legal ethics include adversarial advocacy;
responsible lawyering; moral activism; and ethics of care, each of which identify different standards
and values used to resolve issues. The adversarial approach, often referred to as the 'amoral' one ,
remains the predominant approach and conception of a lawyer's role and ethics in Australia. As well
as through these approaches, a lawyer's obligations are demonstrated in ... Show more content on

Instead, it upholds ethics inherent in the role as officers of the court and the law itself. Thus, it does
not impose personal morals on prospective clients. Yet, this approach still maintains advocacy to the
client, through which lawyers pursue those actions that seem likely to promote 'legal justice' and
assisting clients to pursue justice according to law. Lawyers apply their skills and legal obligations
as well as the pursuit of a client's interests, while effectively still appreciating the system's

My Reflection On The Court Trip
This is a report of my reflection on the court trip that my class, CLU 3M attened on May 18, 2016.
This report contains my reflection on what I did that day, what I saw, and my opinion on our judicial
system. In this report some of the terms that I recognized during the trips are bolded, and I have
elaborated on the meanings of the terms. I will conclude this report with my opinion the court
process. Brad and I walked into the provincial court on Wyndham street at approximately 8:40 am.
Provincial courts are the lower courts in the jurisdiction. As soon as I noticed 4 clipboards that had
pages with a list of names and timing on them, this was also referred as a docket. The names were
the offenders of the case, and there time represented their trial time. An offender is the person who
had committed the illegal act. As I walked down the narrow hall I joined in with the rest of the class.
We were sitting in the waiting area, and near the sign that said duty counsel. Duty counsels are
lawyers that can give the accused advise on what they should when the accused do not have a
lawyer. As we waited a lawyer came outside of the office and yelled, "If anybody needs duty
counsel". I noticed there were two court rooms, both had their own dockets. The court room was
separated by the waiting area, and the vending machine. As I waited for Mr. Fast to come, I looked
around and saw some really sketchy looking people, I even recognized two from my elementary
school. There were allot of

Legal Advice For A Solicitor
A solicitor may give legal advice when it comes to buying a house or renting a flat etc. they also
deal with divorce, probate, marriage etc. they also give legal advice based around these areas. A
solicitor may even represent their client in court to maximise their chance of being declared as
innocent. A solicitor is also responsible for calling in any paper work to help with any case.
Solicitors also help deal with any accident that may occur. The Law Society sets down rules and
regulations about how solicitors may conduct their business. There is a Disciplinary Tribunal, which
can investigate any allegations of misconduct made against a solicitor. Solicitors also help people
get mortgages if their credit rating is lower than the required rate to get a mortgage. As a solicitor
there is no uniform so they are free to wear whatever they like. If you are involved in a court case,
your solicitor will manage the case and represent you when dealing with the other party. For
example, your solicitor will send letters to the other side on your behalf.
Barristers are engaged by solicitors to work on a case. Barristers must wear white collars and a black
gown when in a court case. In certain courts the barrister is also expected to wear a wig. All
barristers are self–employed and work as individuals. When a person is being trailed in court, it's a
barrister that speaks for them and presents all evidence to the judge. Barristers are not contacted

Understanding Of The Contemporary Legal Profession
In light of the diversification of the female supply in recent years, does engagement with gender still
add relevance to understanding of the contemporary legal profession?
In recent years, we have seen an increase in diversification in regards to the supply of female
lawyers. We have also seen legal improvements such as antidiscrimination legislation which
prevents any business operating to directly discriminate and deny access to the legal profession
based on sex. However, we still see minimal diversification at managerial positions. Gender has and
continues to be a contentious issue within the legal profession. Despite Anti–Discrimination
legislation and diversification of the supply side, women still account for only one–fifth of ... Show

This essay will focus on commercial solicitors as gender inequality is most evident in this area. On
May 25, 2016 at 12:00 pm at the Tyne Bar in Newcastle, I sat down with corporate city lawyer, Amy
Fenny, to help reframe the existing discussion on gender equality by assessing gender bias and its
impact on those who seek and attain positions of power within the legal profession. We conducted
the interview at There are several reasons why I chose to speak to Ms. Fenny in particular, and one
of which is because she has experience in a non–typically female job. Also, she is someone with
understanding of sexism and gender inequality which allows her to be able to recognize and analyse
her surrounding situations. Those who have not been exposed to such information are participants in
the current society, and some are so engrained that it is hard for one to notice the issues at hand as
they do not have the skills to recognize it.
1) Why do you think that it is important to have a diverse and equal workforce?
The benefit of promoting equality within the workplace is extremely beneficial. It is important that
as a society, we are seen to be representative and inclusive. Without equality, society lacks
legitimacy and therefore undermines public confidence in our institutions. A more diverse workforce
ensures the diversification of market insights and viewpoints enabling better problem

The Impact Of Technology On The Legal Profession Essay
Technology has changed the way we live our lives in pretty much every way imaginable. In the past,
the common belief was that only manual work would be greatly affected by the rise of technology.
However, service professions such as the legal profession have certainly seen a change as well.
There are discussions what this will mean in the future and whether it will go beyond the current
aiding role. If that is so, it could potentially change the current legal framework and question the
role of lawyers themselves. There are also issues in relation to the protection of clients through data
protection, confidentiality and accountability to look out for. This essay will focus on four main
points. Firstly, it will discuss the overall impact of technology on the legal profession, while
discussing the potential and feared threat of this. Secondly, exploring the lawyer's responsibility to
offer quality and proper service while relating this to accountability of technology. Thirdly, it will
discuss issues relating to confidentiality and the overall role of the lawyer to ensure confidentiality
is kept a priority while balancing out the cost reducing and more efficient technologies. Lastly, it
will discuss the educational position in relation to technology and the changes that need to happen to
prepare future lawyers for their careers. The legal profession has been around for a long time, as it is
one of the oldest information professions . The service it provides is essential, as it

Living Self–Funded Workers' Compensation Program (MAL W.C. Fund). Our group program was
established to provide outstanding coverage and services along with the opportunity for generous

Rising workers' compensation premiums inspired a group of providers to band together and form a
self–governing, self–insured workers' compensation fund as an alternative to purchasing traditional
insurance. Since its inception in 2003, our group has grown to more than 120 member companies,

The Criminal Justice System
Within Canada, the central purpose of the Criminal Justice system is to implement social control,
prevent and identify crime and to prosecute those who breach the law. However, though the criminal
justice system deals with all of these various components as a whole, the responsibility of each is
divided between a variety of authority. The court is an area of the justice system that a significant
weight of responsibility is placed upon, as the court essentially plays a multifaceted role in
determining the innocence or guilt of a subject. (Griffiths, 147) Furthermore, one of the most
difficult tasks asked of the courts is the principle of judicial independence. Essentially, judicial
independence ensures that citizens are given the absolute right to have their cases tried by tribunals
that are fair, impartial, and immune to any from of political interference. (Griffiths, 147) Therefore,
through primary analysis of the criminal justice system, many observations were made of the
various processes and structures of the courts. The criminal justice system, being quite complex, was
difficult to analyze but within a day of court, the practices and procedures of the system were
outlined with clarity. Despite the justice system containing an array of components, three main
elements stood out that were actively exercised in the courthouse. These various elements include
professionals known as the courtroom work group who actively facilitate all aspects of trial, the

Questions On The Criminal Code Act
1. Which court did you attend and what was the date of your attendance?
On the 2nd of October 2014, I attended the Magistrates Court in Holland Park.
2. What kind of hearing did you attend?
The hearing that I attended was a summary. I was able to tell that the hearing I attended was a
summary as the magistrate listened to submissions from the prosecutor and the defense lawyer then
decided on the penalty. (Summary hearing. (n.d.). Retrieved October 22, 2014)
3. What were the charges against the defendant? Were these summary or indictable offences? How
did you know this?
The charges against the defendant were proving false or misleading statements and providing false
or misleading documents. According to the Criminal Code Act 1995 a person is guilty of an offence
if: the person produces a document to another person; and the person does so knowing that the
document is false or misleading; and the document is produced in compliance or purported
compliance with a law of the commonwealth. These offences were summary offences as there was
no jury present in the courtroom.
4. Who was present in the courtroom? Identify the positions of all the people present (i.e. judge,
prosecutor, bailiff, defendant, jury, etc) and give a brief description of their role and what you
observed them do in the courtroom during your visit.
The people present in the courtroom was the Judge, defense lawyer, defendant, Police prosecutor,

Introduction. Women In The Legal Profession Today Do Not
Introduction Women in the legal profession today do not encounter most of the challenges that they
were facing 50 years ago. However, gender–based issues still exist that females in the legal
profession have to face in today's world. According to the American Bar Association's Market
Research Department women comprised only 36 percent of legal professionals in the country in
April 2016 (Smithey, 2017). The number of women in the legal profession has been growing in last
few decades, but even though it grows in private law firms as well as the judiciary, unfortunately
women do not have equal access to senior positions. In the top law firms in the United States,
women account for only 17 percent of law firms' equity partners (those who ... Show more content

As previously mentioned, this issue is common in the legal profession. There are many incidents
when not only the male peers, but also the clients make assumptions about female lawyers based on
their gender. They might make assumptions that a female lawyer is too delicate or too soft to
manage straight talk, aggressive negotiation or a complex litigation. Sometimes it could happen that
a male attorney who desires to get an advantage in his case, not by arguing facts or the law, but by
using "bully tactics" (Wareing, 1999). While it is not unique only to women to face an aggressive
opponent in the law court, but it causes more difficulties for female lawyers. For example, it could
happen that a male client may form an opinion regarding the ability of a female lawyer working on
his case solely by observing her interaction with opposing counsel. If opposing counsel is
unnecessarily argumentative, the female associate may be judged by the tone of her response, but
not by her arguments. According to the survey conducted by the Women in Law Committee of the
State Bar of California, 85% of the women lawyers think that they perceive a subtle but pervasive
gender bias within the legal profession and almost two thirds of them agree that women lawyers are
not accepted as equals by their male peers(lectlaw.com). Women have reported that there have been

Legal Services And The Legal Profession
The Legal Services Board was created under the Legal Services Act 2007 to promote particular
principles within the legal profession, one of these being to 'encourage an independent, strong,
diverse and effective legal profession'. An important aspect of this is the idea of a 'diverse'
profession; is this really an issue which can be resolved within the profession, or does the
encouragement of diversity have to begin right at the start of a person's legal education? In this

the legal profession and how effective these have been. I will then discuss the importance of law

It cannot be denied that the situation has improved drastically, for instance, between 1978 and 2008
there was an increase of 332% in the number of female solicitors. However there is still a long way
to go to achieve a truly diverse legal profession, for example, in 2008, a study found that out of
solicitors who had entered the profession 10–19 years ago, 77% of men had reached partner whereas
only 48% of women had. This is not a problem limited to England and Wales, and the President of
the American Bar Association has argued that the first step towards a more diverse legal profession
is to develop our understanding of the 'roots of discrimination'. According to feminist scholar Carrie
Menkel– Meadow, 'unless we can radically alter legal education, we will not be able to reconstruct
our legal system or our society'. The parity in numbers of male and female solicitors that become
partners mentioned above is often explained away, and there is a common refusal to accept that this
is a result of in–house discrimination. Instead, 'male domination of the more lucrative specialties...so
important for promotion' is said to be due to the discriminatory behaviour of clients (though why
such requests are endorsed remains to be seen). Sommerlad and Sanderson have argued that even
today the legal profession remains a masculine domain.

Texas Commissioners Court
The counties in Texas have an odd relationship with the state government and the Texas constitution.
The counties are under the state and they are required to handle duties that the state rants them.
However, the counties are strongly against the involvement of the state government. Brown (2014)
states that "both county officials and county residents see them as local governments and resent any
state 'interference'" (p.110). The counties are charged with the responsibilities of collecting taxes on
both urban and rural property, issues state automobile licenses, enforce state laws, register voters,

Summary Of Robert Arnold's Widespread Corruption
In late May, a county sheriff in Tennessee was brought up on public corruption charges. Sheriff
Robert Arnold, county chief administrative deputy Joe Russell and John Vanderveer have been
charged in the case. Arnold faces a 14–count indictment for selling electronic cigarettes to prisoners
in the jail that he runs.
While the majority of sheriffs and public officials are not guilty of corruption, Arnold is the latest
instance of official misconduct and corruption. Instead of serving the community, he chose to pursue
self–serving actions to make money in the prison. According to the indictment, Arnold used his
capacity as sheriff to promote the sale of electronic cigarettes in prisons. In return, he received
bribes and bonuses from Vanderveer and Russell.
According to one of Arnold's defense attorney's, he will be entering a plea of not guilty and expects
that the jury will acquit him. In response, acting United States attorney Jack Smith said, "We never
want to allow the illegal and self–serving actions of a few to unfairly brand the unsung heroes who
every day place the safety and security of their communities."

all the way into law school which he said was about a good 10 years. I also learned that even in the

Diversity In The Legal Profession: A Case Study
Developing a career in the legal profession has proven to be difficult in terms of the obvious;
achieving the grades, obtaining work experience, completing a Bar or LPC etc. However what most
people disregard are the barriers that most underrepresented groups face that prevent the
advancement of them being able to succeed in developing a legal career. Succeeding the legal
profession for the minority of people proves to be difficult as the legal field is considered to
discriminate on the basis of gender, ethnicity, sexual orientation, disability etc. White, male lawyers
who are from high socio economic backgrounds continue to dominate the majority of top law firms
although one might say it has become diverse over the years. The purpose of this essay is to examine
how diverse the legal profession has become by critically evaluating the measures taken in the legal
system to promote diversity in England and Wales. In the recent years the legal field has become
more diverse in England and Wales. The percentage of female solicitors in England and Wales has
increased tenfold since 1987; Law society statistics reveal that in 2013 there was 158,644 solicitors

The Legal Profession Of A Lawyer
On December 8th, after a slight struggle to conduct an interview, I was able to get in contact with
Matthew Resch for an interview over the phone, through the help of my classmate Selene. Matthew
is currently an in–house counsel. He is required to serve a wide variety of legal matters for the
company. I was happy when I heard this because coincidencedently I also hope to pursue a career in
corporate law. However prior to being an in–house counsel he practiced law at a private firm for
several years. Because of this he has a fairly large view of the legal field, and thus understands the
pros and cons of many aspects of the legal profession. Initially I began the interview with some
basic questions that anyone in the legal profession would be able to answer. In my first question I
asked Matthew, what made him want to become a lawyer. He responded by telling me that he
wanted to be able to help people. More specifically, he thought that by becoming a lawyer he would
have a figurative toolbelt that he could use to help people in need of legal assistance. There are a lot
of reasons that someone shouldn't become a lawyer, but I thought that this was actually one of the
noble reasons. Next, I asked him, if law school adequately prepared him to practice law in his field.
He responded by telling me that any law school will get you part of the way there, but none of them
will make you completely prepared for the first client that you need to handle. One important thing

How To Get Away With Murder, also known as HTGAWM, is an American legal drama television
show created by Pete Nowalk and produced by Shonda Rhimes, who you may know from her many
other successful TV shows like Grey's Anatomy, and ABC productions. The show first aired on the
25th of September 2014 and has developed a huge fan–base since then. Viola Davis stars as
Annalise Keating, a law professor at a prestigious university in Philadelphia, Middleton university.
Keating is also a prominent criminal defense attorney. She selects five of her first–year law students
to intern at her firm: Wes Gibons (Alfred Enoch), Connor Walsh (Jack Falahee), Michaela Pratt (Aja
Naomi King), Asher Millstone (Matt McGorey) and Laurel Castillo (Karla Souza), who we get to
know as the "Keating 5". They get a chance to work with Annalise's employees Frank Delfino and

when it was airing its third season after I have heard the endless positive feedback the show was
getting. You may have guessed it already but I am not a fan of spoilers as I love the anticipation and
the rush of adrenaline this show gives me! I was worried that I would have to hide away from any
possible spoilers for months until I caught up, now you may be shocked, but every episode had me
hooked and wanting more that it took me two weeks to catch up to the third season. That is saying a

Court Of Limited Jurisdiction ( 320-321 )
For my court observation I visited the Frank A. Sedita City Court, which is a court of limited
jurisdiction (320–321). The cases were on April 7th at 2 p.m. to 4:45 p.m. with Judge Betty Calvo–
Torres. The court was a very crowed and defense attorneys congregated in the front section trying to
discuss their cases with the prosecution. When the court proceedings began it became silent as the
Judge came in and sat down, but went back to being as loud a few minutes later. The noise
continued, at this point it was only Defense Attorneys that were still in the front, but Judge Torres
finally got annoyed a told everyone that there shouldn't be any speaking during proceedings. The
DAs quickly filed out of the front section and went to their ... Show more content on

The case was brought up later on because the students' father showed up and the Judge decided he
could be released on the condition that he stayed with his parents.
One offender was non–compliant with the terms of their parole. They had not been showing up to
whatever treatment they were supposed to receive, so they were called in (542–544). The offender
claims there was some kind of mix up with the dates of the appointments that were set and that it
was the office's fault for not changing them. This offender was released under supervision, but the
Judge threatened to revoke their parole if they continued to not keep up with the treatment. She
explained that ultimately it was up to the offender to make sure appointments were changed and that
everyone that needed to be notified was made aware.
Another case dealt with a man, whose identity was stolen, and someone using his name when they
were arrested. The man was fired from his three jobs and went down to the courts to find out what
the issue was. He made the mistake of immediately getting on Judge Torres' bad side by asking her
to "be quiet" as he talked to his attorney. The court reporter explained that this man was already in
custody for stolen property, but this was clearly not the case. There was also an inconsistency with
the picture on his ID and with the social security number he presented

Emperor Claudius And The Legal Profession
having a friend that was better at publicly speaking and/or more experienced with the law and the
courts to speak on your behalf and present your defense for you. Not a while after, the Greeks
banned the right to request a "great speaker" and furthermore made it a rule that no one could accept
a fee to plead the case of another. This stopped the orators form being able to present themselves as
legal professionals or experts. The new rules also made it impossible to establish organized and
professional lawyer services, like those that are available today, and, therefore, slowed the
progression of the legal profession almost to a stop. It was Emperor Claudius who legalized

One way for lawyers to ensure objectively fair fees is to enter into a fee agreement with their client.
This way the client is, as is required, fully explained about how and what he/she is being charged for
the legal services being provided. The lawyers that worked during the time of Emperor Claudius,
and the judges before which these lawyers debated, were not extensively trained in law. They were,
instead, educated in rhetoric by mentors. Eventually Rome began to develop a class of specialists
who were trained in the law. By the start of the Byzantine Empire the legal profession was becoming
well established and heavily regulated. Lawyers were more commonly studying law, along with
continued studious study of rhetoric. It soon became a requirement for new advocates seeking
admission into the court to produce testimonials from their teachers verifying their education.
(Wikipedia). Shortly after, a course of legal study, lasting about four years, became mandatory for
anyone pursuing a profession in law. The effects of such educational requirements can be seen in the
educational requirements of today's lawyers. In America, prospective lawyers must fulfill several
educational requirements in order to practice law.

The Issue Of Term, Legal Profession
The issue of term "Legal profession" insists of people who work in legal environmental or in the
Government . As a first year Law student, I am learning about an overview of the legal profession;
for instance, Legal method and Skills or Legal Systems that definitely influence my career in the
future. After two first weeks studying, my plan future is becoming a solicitor right after I get the
Law Degree. The thing that affected my prompt decision in studying Law is my motivation. Last
year, I was attending to Business Law that was one of the units in my Business Diploma course.
During that semester, the Business Law was deeply attracted to me with not only knowledge about
contract law or tort law but it also explained the Australian legal hierarchy or how I can solve the
case law or legal matter in real life. All of that made me identified how important of the law in this
current society. To archive my target, I should repair carefully for my knowledge and other skills to
become a solicitor. First of all, knowing clearly all the term that related to the legal profession is
very important. If I want to study about the law, I have to know what law is, according to Gibson
and Fraser 'law is rules, developed over a long period of time to control people's interaction with
each other and set the standard of regulation between single individual with other or individuals and
government' . Additionally, it is very necessary for me to distinctly knowing about the legal

The Legal Profession Of England And Wales
Traditionally, legal services at the highest levels and in the most reputable firms are dominated by
white, male lawyers from the highest socio–economic groups. Being diverse means showing a great
deal of variety; but due to various factors, underrepresented groups have faced barriers when
pursuing a career in the legal profession. One of the many barriers that underrepresented groups
faces when developing a career in the legal profession is their socio–economic background. The
social background of an individual can hinder them from educational success and their ability to
gain legal work experience. Furthermore, despite the growth of female lawyers, the legal profession
maintained its rigidity. As a result of the perceived lack of ... Show more content on Helpwriting.net

Achieving a quality education is essential for aspiring lawyers. However children from lower socio–
economic backgrounds have been found to achieve less educationally than their more advantaged
peers from a privileged background. Children from lower socio–economic backgrounds tend to
achieve less educationally may in part be attributed to the drive and support of their parents, as
parents in professional occupations are twice as likely to expect their children to go to university.
The expectations of parents seem to impact on their children's desire to aspire to be a professional.
Statistics revealed that 1 in 8 young people from poorer backgrounds, and 1 in 5 young people from
average backgrounds, currently aspire to be a professional. This is three times fewer than young
people from professional backgrounds. This shows that parental interest in their child's career can
have an impact of their child educational success. They would encourage their child to succeed in
education in order to get into the profession. Apart from having a stellar academic performance; it is
requisite to have legal work experience before entering into the legal profession. Work experience
enables the individual to hone key skills and to gain a better understanding of the profession.
However, such opportunities may not be accessible to all students. Students from a privileged

The Legal Profession At The Washington College Of Law
The legal profession in itself can be evaluated as abstract; the duties and responsibilities of the
members of the legal profession belong to a plethora of options. The profession can be approached
in several ways, but the overarching goal is to practice law in one way or another. Observing legal
processes has truly been an eye–opening experience. It is much easier to say I want to be an attorney
than actually be informed about the process. I had the pleasure of sitting in on a law school class at
the Washington College of Law, speaking to very successful lawyers and observing the inner
workings of a law firm. I have been interested in the legal profession since I was in middle school,
but whenever I mention attending law school, people slightly sigh and tell me that it wouldn't be
worth it– or I get the exact opposite and be told I will make a lot of money. Coming from a
background where I am a first generation college student, pursuing any goal is to benefit society and
leave my mark, not necessarily for the money. I am still considering law school many years later and
I have been exposed to the profession both in practice and in theory. I have read books about law
school and heard both positive and negative comments. Sitting in on a class was both nerve
wrecking and exciting. I registered to sit in on a first year torts class taught by Professor Popper. He
has a lengthy experience in the legal field and I would've liked to speak to him, but unfortunately he
had an ABA

to mind are men. When you think of famous or popular movies that feature lawyers, you think of 'A

leads. When you think of popular movies that feature female lawyers those that come to mind are
'Legally Blonde ' or 'Erin Brockavich, ' and Brockavich was a paralegal, not a lawyer. But when you

It says a lot about how female lawyers are portrayed in films that in one of the most famous legal
films starring a woman, she is working for a man and not even a lawyer. Another film that comes to
mind when one thinks about famous legal films starring women is 'Legally Blonde. ' This film star
Reese Witherspoon who plays the ditzy blonde Elle Woods who decides to go to Harvard Law
School simply to follow her ex–boyfriend who is going there. The very premise of the movie does
nothing to present the female lead as a strong character because she wears pink and is part of a
sorority and the only reason she is going to Harvard Law School is because she wants to win back
her well off ex–boyfriend. This completely under plays how intelligent one has to be to get into
Harvard Law School because you need a 172 or more on the LSAT and that fact that she is able to
get such a score suggests that she is intelligent, but she is presented as an air head. Not a very
powerful female model to follow. Yet some how, this movie and Erin Brockavich are presented as
some of the movies that young professional women need to watch by Levo.com. There is also
sometimes the situation in moves like 'A Few Good Men ' in which Lieutenant Commander Joanne

The Legal Profession Of England And Wales
One of the largest issues in developing a career in the legal profession is diversity as there is a
perceived image of the legal sector being a traditionally "white, male, middle class" profession.
Harold Patrick and Vincent Kuman argue, "the concept of diversity includes acceptance and respect.
It means understanding that each individual is unique and recognizing our individual differences" .
This essay will examine the social class, educational and gender barriers underrepresented groups
face in developing a career in the legal profession. The effectiveness of measures taken to promote
diversity in England and Wales will then be evaluated. This essay will go on to ultimately conclude
that the legal profession in England and Wales has become increasingly diverse over the years,
although a significant lack of diversity does still exist within the upper tier of the profession.
The case in favour of diversity within the legal profession is incredibly strong. As Robert J. Grey JR,
a partner at law firm Hunton & Williams argues, "diversity is a critical element of our society" . The
reasoning for this has been illustrated in a blog post published by 'Aspiring Solicitors'. It states how
"diversity in the legal profession plays a very important role in regard to formulating new
approaches and tactics". This suggests that by bringing individuals together from different
backgrounds and with diverse views, it could lead to more innovative ways of thinking. As a result,
it may

The Three Types Of Court Management In The Criminal...
In the criminal justice system, there are three types of important court managers. Without one of
these court managers the court would be working slower than what it needs to work. The three types
of the curt managers are the clerk of court, the judge, and the court administrator. Each of these
managers have a very important role they have to play to ensure that the court would run smoothly
while is in session. The clerk of court is "An elected or appointed court officer responsible for
maintaining the written records of the court and for supervising or performing the clerical tasks
necessary to conduct judicial business" (Neubauer & Fradella, 2014, p.535). For example,
sometimes people might confuse what a clerk of the court does with what a law clerk does or even a
court reporter. The clerk of the court does take another role while trial is going on, they "maintain
court calendars and handle and assemble documents such as subpoenas, judicial orders, writs,
injunctions, and judgments" (Krow, 2017). They review law suits and motions that are submitted to
the court. The second important court manager is the judge. Many people put judges as the highest
part of the criminal justice system. This is because of the power that they have. It all start "From
arrest to final disposition, the accused face judges whenever decisions affecting their futures are
made" (Neubauer & Fradella, 2014, p.199). Some of the things that a judge can do is set bail for
you, revoke your bail, and

The Legal Profession Of The Gilded Lawyers
Trial Lawyer Did you know that at present, there is only one lawyer for every 247 Americans in the
Unites States? A lawyer is "a person trained in the legal profession who acts for and advises clients
or pleads in court" (Webster's Dictionary and Thesaurus). According to about careers, there are
many different types of lawyers, among the top five highest paying legal professionals around the
globe are trial lawyers. The first lawyers, also known as the "Gilded Lawyers" arranged the United

defending the rights given to us by the First Amendment and suffused the work of the business in
later years. Today, trial lawyers must meet specific job requirements and qualifications such as
working under stressful conditions for long periods of time, making a profitable salary, and keeping
up with the ever changing future needs for the career. Career Requirements and Qualifications Trial
lawyers are required to work efficiently under stressful conditions for long periods of time.

American Legal Profession Book Review
In the reading, "The Transformation of the American Legal Profession," Abel Richard explores how
the stratification of the legal profession has changed throughout the years. Richard shares that
during the 1870s and 1950s American Lawyers "developed local, state, and national bar association;
promulgated ethical codes, and established disciplinary procedures" (Richard). In other words, they
started to restrict the requirements to become a lawyer in order to protect the "legal knowledge."
Richard also addresses the issue of competition within the lawyers. He claims that due to the high
competition, solo practice started to decline and many lawyers started to work in larger firms.
Similar to this reading, in "Chicago Lawyers: The Social Structure of The Bar," the authors John
Heinz and Edward Laumann focus on the contemporary ... Show more content on Helpwriting.net ...
Students have better chances of finding job opportunities if they go to a prestige law school. As

The Importance Of Being A Prosecutor Is An Important...
Being a prosecutor is an extremely important responsibility. Prosecutors are supposed to be the
moral compass in the judicial process because they are the ones who decide whether or not a person
deserves to be charged with a crime and how much they should be charged. While it is a good thing
to demand justice it isn't right to take advantage of one's position. There are responsibilities that
need to be carried out. The Orange County office had been allegedly involved in years of
misconduct involving jailhouse informants. The prosecutors had also failed to turn over exculpatory
evidence. It was a defense lawyer that brought attention to about the alleged misconduct. In March
2014 Judge Thomas Geothale issued an order that the entire Orange County District attorney office
were ineligible to work on a significant death penalty case. The Orange County district attorney's
office was no small office. It had around 250 prosecutors. 250 prosecutors were disqualified because
they had no respect for the law. They did what they wanted without thinking of the consequences
their decisions would lead to. They didn't think about the people who they put behind bars who
might have been innocent. All they cared about was winning and if winning meant not handing over
exculpatory evidence so an innocent person had to go to jail then so be it. As long they won. The
alleged misconduct of the Orange county district attorney's office goes all the way back to the

Observation Of A Courtroom
Courtroom Workgroup
The courtroom workgroup consists of a Judge, Prosecutor, Defense attorney, Bailiff, Clerks, Court
reporters and the public. There can be three types of clerks present at court the law clerk, clerk of
court, and the docket clerk. During my court observation I observed the judge, prosecutor, and the
defense attorney. The Prosecutor and Judge were observed more during my court observation. The
Defense attorney wasn't observed as much because the defendants waived the right to an attorney on
some cases.
The judge, prosecutors, and defense attorneys all have detailed qualifications. The most noted
qualification is the actors must have completed law school. They must be educated in Legal ethnics
to even take the bar to get out of law school. After completing law school, the actors can become
attorneys or prosecutors. To become a state judge, one must be appointed to that position by the
merit system. And to become a federal judge an individual must be nominated. Also, an actor who is
a practicing attorney whether it be defense or persecution to move up in rank the individual must be
promoted. But to be a chief prosecutor one must have to be elected locally. All federal attorneys
roles are given by appointment.
Roles & Duties Prosecutors have the duty of prosecuting criminal cases. A prosecutor holds the most
critical role in the criminal courts system because of its central position. Prosecutor role bridges all
other roles. The reason why is because the

Pros And Cons Of Hiring A Lawyer
Choosing and employing a criminal defense lawyer early on in any case is the best way to increase
one's probability of success in any criminal trial. Many of the more prominent people in society
already have a battery of lawyers at their behest that spring into action whenever any legal problem
arises.
You may not be one of these high profile people, and you may not have employed an attorney as of
yet because a) you do not really have a need for them yet or b) they are, of course, too expensive to
just have on hand. But even given this you will have to keep in mind that in the case of an
impending criminal trial, choosing and hiring a good lawyer early on is your top priority.
In fact, the outcome of your entire case may even hinge on whether this single matter alone. If you
hire a lawyer early on, there is a chance that, due to his or her timely actions, there will be no need
for any case and trial at all. You might just be able to dodge the bullet on time. ... Show more

This alone is reason enough to hire good lawyers with good grasp of such kinds of investigation
practice. If you have been watching enough trial TV, you will notice that many trials drag on
endlessly only to argue whether an evidence is acceptable in the court of law.
This is important because some cases decisions all depend on sometimes just one piece of crucial
evidence in a case. If you do not have expert advice this early in the ball game then you might have
just lost your case right on the outset.

  • 7. Adversarial Approach To The Legal Profession Lawyers encounter difficult ethical situations within their profession. A lawyer's obligation to the legal profession lies not only with their duty to the client but also to the court. Hence, duty must be given to the administration of justice by allowing for the legal system to determine a client's claim, regardless of their moral worth. The responsible lawyering approach effectively caters to this and thus, this paper will analyze the advantages of this approach and its position within the legal profession, while also identifying its conflicting position within the framework of justice. An ethical perspective plays a vital role in understanding the duties and responsibilities required by lawyers in their profession, but is also necessary as stated by Parker and Evans "to judge what rules should be made (on a professional level) and also to decide (on a personal level) what the rules mean, how to obey them..." The four main approaches to legal ethics include adversarial advocacy; responsible lawyering; moral activism; and ethics of care, each of which identify different standards and values used to resolve issues. The adversarial approach, often referred to as the 'amoral' one , remains the predominant approach and conception of a lawyer's role and ethics in Australia. As well as through these approaches, a lawyer's obligations are demonstrated in ... Show more content on Helpwriting.net ... • 9. My Reflection On The Court Trip This is a report of my reflection on the court trip that my class, CLU 3M attened on May 18, 2016. This report contains my reflection on what I did that day, what I saw, and my opinion on our judicial system. In this report some of the terms that I recognized during the trips are bolded, and I have elaborated on the meanings of the terms. I will conclude this report with my opinion the court process. Brad and I walked into the provincial court on Wyndham street at approximately 8:40 am. Provincial courts are the lower courts in the jurisdiction. As soon as I noticed 4 clipboards that had pages with a list of names and timing on them, this was also referred as a docket. The names were the offenders of the case, and there time represented their trial time. An offender is the person who had committed the illegal act. As I walked down the narrow hall I joined in with the rest of the class. We were sitting in the waiting area, and near the sign that said duty counsel. Duty counsels are lawyers that can give the accused advise on what they should when the accused do not have a lawyer. As we waited a lawyer came outside of the office and yelled, "If anybody needs duty counsel". I noticed there were two court rooms, both had their own dockets. The court room was separated by the waiting area, and the vending machine. As I waited for Mr. Fast to come, I looked around and saw some really sketchy looking people, I even recognized two from my elementary school. There were allot of ... Get more on HelpWriting.net ...

Understanding Of The Contemporary Legal Profession In light of the diversification of the female supply in recent years, does engagement with gender still add relevance to understanding of the contemporary legal profession? In recent years, we have seen an increase in diversification in regards to the supply of female lawyers. We have also seen legal improvements such as antidiscrimination legislation which prevents any business operating to directly discriminate and deny access to the legal profession based on sex. On May 25, 2016 at 12:00 pm at the Tyne Bar in Newcastle, I sat down with corporate city lawyer, Amy Fenny, to help reframe the existing discussion on gender equality by assessing gender bias and its impact on those who seek and attain positions of power within the legal profession. We conducted the interview at There are several reasons why I chose to speak to Ms. Fenny in particular, and one of which is because she has experience in a non–typically female job. Also, she is someone with understanding of sexism and gender inequality which allows her to be able to recognize and analyse her surrounding situations. Those who have not been exposed to such information are participants in the current society, and some are so engrained that it is hard for one to notice the issues at hand as they do not have the skills to recognize it. 1) Why do you think that it is important to have a diverse and equal workforce? The benefit of promoting equality within the workplace is extremely beneficial. It is important that as a society, we are seen to be representative and inclusive. In the past, the common belief was that only manual work would be greatly affected by the rise of technology. However, service professions such as the legal profession have certainly seen a change as well. There are discussions what this will mean in the future and whether it will go beyond the current aiding role. If that is so, it could potentially change the current legal framework and question the role of lawyers themselves. There are also issues in relation to the protection of clients through data protection, confidentiality and accountability to look out for. This essay will focus on four main points. Firstly, it will discuss the overall impact of technology on the legal profession, while discussing the potential and feared threat of this. Secondly, exploring the lawyer's responsibility to offer quality and proper service while relating this to accountability of technology. Thirdly, it will discuss issues relating to confidentiality and the overall role of the lawyer to ensure confidentiality is kept a priority while balancing out the cost reducing and more efficient technologies. The Criminal Justice System Within Canada, the central purpose of the Criminal Justice system is to implement social control, prevent and identify crime and to prosecute those who breach the law. However, though the criminal justice system deals with all of these various components as a whole, the responsibility of each is divided between a variety of authority. The court is an area of the justice system that a significant weight of responsibility is placed upon, as the court essentially plays a multifaceted role in determining the innocence or guilt of a subject. (Griffiths, 147) Furthermore, one of the most difficult tasks asked of the courts is the principle of judicial independence. Essentially, judicial independence ensures that citizens are given the absolute right to have their cases tried by tribunals that are fair, impartial, and immune to any from of political interference. (Griffiths, 147) Therefore, through primary analysis of the criminal justice system, many observations were made of the various processes and structures of the courts. The criminal justice system, being quite complex, was difficult to analyze but within a day of court, the practices and procedures of the system were outlined with clarity. Despite the justice system containing an array of components, three main elements stood out that were actively exercised in the courthouse. • 28. Introduction. Women In The Legal Profession Today Do Not Introduction Women in the legal profession today do not encounter most of the challenges that they were facing 50 years ago. However, gender–based issues still exist that females in the legal profession have to face in today's world. According to the American Bar Association's Market Research Department women comprised only 36 percent of legal professionals in the country in April 2016 (Smithey, 2017). The number of women in the legal profession has been growing in last few decades, but even though it grows in private law firms as well as the judiciary, unfortunately women do not have equal access to senior positions. In the top law firms in the United States, women account for only 17 percent of law firms' equity partners (those who ... Show more content on Helpwriting.net ... As previously mentioned, this issue is common in the legal profession. There are many incidents when not only the male peers, but also the clients make assumptions about female lawyers based on their gender. They might make assumptions that a female lawyer is too delicate or too soft to manage straight talk, aggressive negotiation or a complex litigation. Sometimes it could happen that a male attorney who desires to get an advantage in his case, not by arguing facts or the law, but by using "bully tactics" (Wareing, 1999). While it is not unique only to women to face an aggressive opponent in the law court, but it causes more difficulties for female lawyers. For example, it could happen that a male client may form an opinion regarding the ability of a female lawyer working on his case solely by observing her interaction with opposing counsel. If opposing counsel is unnecessarily argumentative, the female associate may be judged by the tone of her response, but not by her arguments. According to the survey conducted by the Women in Law Committee of the State Bar of California, 85% of the women lawyers think that they perceive a subtle but pervasive gender bias within the legal profession and almost two thirds of them agree that women lawyers are not accepted as equals by their male peers(lectlaw.com). • 30. Legal Services And The Legal Profession The Legal Services Board was created under the Legal Services Act 2007 to promote particular principles within the legal profession, one of these being to 'encourage an independent, strong, diverse and effective legal profession'. An important aspect of this is the idea of a 'diverse' profession; is this really an issue which can be resolved within the profession, or does the encouragement of diversity have to begin right at the start of a person's legal education? In this essay I will discuss different ways in which attempts have been made to improve diversity within the legal profession and how effective these have been. I will then discuss the importance of law school in shaping the attitudes and values of the legal minds in this ... Show more content on Helpwriting.net ... It cannot be denied that the situation has improved drastically, for instance, between 1978 and 2008 there was an increase of 332% in the number of female solicitors. However there is still a long way to go to achieve a truly diverse legal profession, for example, in 2008, a study found that out of solicitors who had entered the profession 10–19 years ago, 77% of men had reached partner whereas only 48% of women had. This is not a problem limited to England and Wales, and the President of the American Bar Association has argued that the first step towards a more diverse legal profession is to develop our understanding of the 'roots of discrimination'. According to feminist scholar Carrie Menkel– Meadow, 'unless we can radically alter legal education, we will not be able to reconstruct our legal system or our society'. The parity in numbers of male and female solicitors that become partners mentioned above is often explained away, and there is a common refusal to accept that this is a result of in–house discrimination. Instead, 'male domination of the more lucrative specialties...so important for promotion' is said to be due to the discriminatory behaviour of clients (though why such requests are endorsed remains to be seen). • 34. Summary Of Robert Arnold's Widespread Corruption In late May, a county sheriff in Tennessee was brought up on public corruption charges. Sheriff Robert Arnold, county chief administrative deputy Joe Russell and John Vanderveer have been charged in the case. Arnold faces a 14–count indictment for selling electronic cigarettes to prisoners in the jail that he runs. While the majority of sheriffs and public officials are not guilty of corruption, Arnold is the latest instance of official misconduct and corruption. Instead of serving the community, he chose to pursue self–serving actions to make money in the prison. According to the indictment, Arnold used his capacity as sheriff to promote the sale of electronic cigarettes in prisons. In return, he received bribes and bonuses from Vanderveer and Russell. According to one of Arnold's defense attorney's, he will be entering a plea of not guilty and expects that the jury will acquit him. He spent a lot of his time doing mock trials from high school all the way into law school which he said was about a good 10 years. Diversity In The Legal Profession: A Case Study Developing a career in the legal profession has proven to be difficult in terms of the obvious; achieving the grades, obtaining work experience, completing a Bar or LPC etc. However what most people disregard are the barriers that most underrepresented groups face that prevent the advancement of them being able to succeed in developing a legal career. Succeeding the legal profession for the minority of people proves to be difficult as the legal field is considered to discriminate on the basis of gender, ethnicity, sexual orientation, disability etc. White, male lawyers who are from high socio economic backgrounds continue to dominate the majority of top law firms although one might say it has become diverse over the years. The purpose of this essay is to examine how diverse the legal profession has become by critically evaluating the measures taken in the legal system to promote diversity in England and Wales. The Legal Profession Of A Lawyer On December 8th, after a slight struggle to conduct an interview, I was able to get in contact with Matthew Resch for an interview over the phone, through the help of my classmate Selene. Matthew is currently an in–house counsel. He is required to serve a wide variety of legal matters for the company. I was happy when I heard this because coincidencedently I also hope to pursue a career in corporate law. However prior to being an in–house counsel he practiced law at a private firm for several years. Because of this he has a fairly large view of the legal field, and thus understands the pros and cons of many aspects of the legal profession. Initially I began the interview with some basic questions that anyone in the legal profession would be able to answer. In my first question I asked Matthew, what made him want to become a lawyer. He responded by telling me that he wanted to be able to help people. More specifically, he thought that by becoming a lawyer he would have a figurative toolbelt that he could use to help people in need of legal assistance. There are a lot of reasons that someone shouldn't become a lawyer, but I thought that this was actually one of the noble reasons. Next, I asked him, if law school adequately prepared him to practice law in his field. He responded by telling me that any law school will get you part of the way there, but none of them will make you completely prepared for the first client that you need to handle. • 56. The Legal Profession At The Washington College Of Law The legal profession in itself can be evaluated as abstract; the duties and responsibilities of the members of the legal profession belong to a plethora of options. The profession can be approached in several ways, but the overarching goal is to practice law in one way or another. Observing legal processes has truly been an eye–opening experience. It is much easier to say I want to be an attorney than actually be informed about the process. I had the pleasure of sitting in on a law school class at the Washington College of Law, speaking to very successful lawyers and observing the inner workings of a law firm. I have been interested in the legal profession since I was in middle school, but whenever I mention attending law school, people slightly sigh and tell me that it wouldn't be worth it– or I get the exact opposite and be told I will make a lot of money. • 60. The Legal Profession Of England And Wales One of the largest issues in developing a career in the legal profession is diversity as there is a perceived image of the legal sector being a traditionally "white, male, middle class" profession. Harold Patrick and Vincent Kuman argue, "the concept of diversity includes acceptance and respect. It means understanding that each individual is unique and recognizing our individual differences" . This essay will examine the social class, educational and gender barriers underrepresented groups face in developing a career in the legal profession. The effectiveness of measures taken to promote diversity in England and Wales will then be evaluated. This essay will go on to ultimately conclude that the legal profession in England and Wales has become increasingly diverse over the years, although a significant lack of diversity does still exist within the upper tier of the profession. The case in favour of diversity within the legal profession is incredibly strong. As Robert J. Grey JR, a partner at law firm Hunton & Williams argues, "diversity is a critical element of our society" . The reasoning for this has been illustrated in a blog post published by 'Aspiring Solicitors'. • 62. The Three Types Of Court Management In The Criminal... In the criminal justice system, there are three types of important court managers. Without one of these court managers the court would be working slower than what it needs to work. The three types of the curt managers are the clerk of court, the judge, and the court administrator. Each of these managers have a very important role they have to play to ensure that the court would run smoothly while is in session. The clerk of court is "An elected or appointed court officer responsible for maintaining the written records of the court and for supervising or performing the clerical tasks necessary to conduct judicial business" (Neubauer & Fradella, 2014, p.535). For example, sometimes people might confuse what a clerk of the court does with what a law clerk does or even a court reporter. The clerk of the court does take another role while trial is going on, they "maintain court calendars and handle and assemble documents such as subpoenas, judicial orders, writs, injunctions, and judgments" (Krow, 2017). They review law suits and motions that are submitted to the court. The second important court manager is the judge. Many people put judges as the highest part of the criminal justice system. This is because of the power that they have.
