Public hearing, consideration, and action regarding a request to rezone a portion of the
property identified as CB 4050, BLK 63, LOT 22, also known as 5936 Broadway St,
and CB 4050, BLK 63, LOT E 80FT of 23 & 24, also known as 516 Circle St, from
Business District (B-1) to Two-Family Dwelling District (2F-C).

SUMMARY
The applicant is requesting to rezone a portion of the properties in conjunction with a recently approved
replat for future development.
BACKGROUND INFORMATION
The properties are located on the east side of Broadway. There are no proposed improvements to the
commercial property. The west half of 516 Circle St is zoned B1 (Business District) due to a request that
was approved in 1973 for the improvements of the grocery store that existed on the site.
2. POLICY ANALYSIS
The proposed change in zoning would be more restrictive and in keeping with surrounding properties to
the east. The rezone would be returning the property to its original zoning designation.
There are no proposed improvements on either site at this time.
On June 23, 2022, the Planning & Zoning Commission considered the request and voted unanimously to
recommend approval of the rezone as requested.
FISCAL IMPACT
No projected fiscal impact from this project has been calculated.

Take notice that a special Planning & Zoning Commission Meeting of the City of Alamo Heights will be
held on Thursday, June 23, 2022 at 5:30pm in the City Council Chamber, located at 6116 Broadway,
San Antonio, Texas, 78209, to consider and act upon any lawful subjects which may come before it. Per
Governor’s Order GQ-36, attendees are not required to wear facial covering (mask) but are
encouraged. The City will continue to practice social distancing, and seating will be limited to
capacity limits.

AN ORDINANCE AMENDING ORDINANCE NO. 374 PASSED AND
ENROLLED ON AUGUST 19, 1963, THE ZONING ORDINANCE OF
THE CITY OF ALAMO HEIGHTS, BY REZONING THE PROPERTY
KNOWN AS LOT E 80FT OF 23 & 24, BLOCK 63, COUNTY BLOCK
4050, WHICH IS THE PROPERTY KNOWN AS 516 CIRCLE ST
FROM BUSINESS DISTRICT (B-1) TO TWO-FAMILY DWELLING
(2F-C); AND LOT 22, BLOCK 63, COUNTY BLOCK 4050, WHICH IS
THE PROPERTY CURRENTLY KNOWN AS 5936 BROADWAY ST
FROM BUSINESS DISTRICT (B-1) TO TWO-FAMILY DWELLING
(2F-C) AND SETTING AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission, after a public hearing was held by it
on June 23, 2022, recommended that the application by Margaret Hale, represented by Eric and
Delaine Keller, to rezone the property known as Lot E 80ft of 23 & 24, Block 63, County Block
4050, which is the property currently known as 516 Circle St, from Business District (B-1) to
Two-Family Dwelling (2F-C), be approved by the City Council of the City of Alamo Heights;
and
WHEREAS, the Planning and Zoning Commission, after a public hearing was held by it
on June 23, 2022, recommended that the application by Margaret Hale, represented by Eric and
Delaine Keller, to rezone a portion of the property known as Lot 22, Block 63, County Block
4050, which is the property currently known as 5936 Broadway St, from Business District (B-1)
to Two-Family Dwelling (2F-C), be approved by the City Council of the City of Alamo Heights;
and
WHEREAS, the City Council at a public meeting held by it on June 27, 2022 received
said recommendation from the Planning and Zoning Commission and, after considering said
recommendation and hearing the proponents and opponents to said recommendation, is of the
opinion that the health, safety, morals, convenience and general welfare of the city would be
enhanced by changing the zoning of portions of such properties to Two-Family Dwelling (2F-C)
and that such portions of properties should be so zoned.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ALAMO HEIGHTS, TEXAS:
THAT, the ordinance passed and enrolled on August 19, 1963, commonly referred to as
the Zoning Ordinance of the City of Alamo Heights, being Ordinance No. 374, be and the same
is hereby amended so as to rezone Lot E 80ft of 23 & 24, Block 63, County Block 4050, which is
the property currently known as 516 Circle St, from Business District (B-1) to Two-Family
Dwelling (2F-C); and
THAT, the ordinance passed and enrolled on August 19, 1963, commonly referred to as
the Zoning Ordinance of the City of Alamo Heights, being Ordinance No. 374, be and the same
is hereby amended so as to rezone a portion of the property known as Lot 22, Block 63, County
Block 4050, which is the property currently known as 5936 Broadway St, from Business District
(B-1) to Two-Family Dwelling (2F-C) and

THAT, the proposed zoning change would be more restrictive and in keeping with
surrounding properties to the east. The rezone would also be returning the property to its original
zoning designation; and
THAT, the official Zoning District Map provided for in Section 4 of the Zoning
Ordinance No. 374, filed with and maintained by the Community Development Director, shall be
amended and posted by the Community Development Director to show the zoning amendment
provided for in this Ordinance; and
THAT, a copy of this Ordinance be filed in the Bexar County Real Property Records;
and
THAT, in the event that any provision of this Ordinance is held to be invalid, it is the
intention of the City Council that this Ordinance be of no force and effect whatsoever; and
THAT, this Ordinance shall become effective immediately upon its passage.
