SUBJECT: A Resolution to authorize a grant application with the Office of the Governor,
Public Safety Office, to fund the purchase of rifle resistant ballistic shields.

SUMMARY
Staff is requesting consideration of a Resolution authorizing the filing of a grant application with
the Office of the Governor, Public Safety Office, for an equipment grant to purchase rifle
resistant ballistic shields for the police department and authorizing the Chief of Police to act on
behalf of the City of Alamo Heights in all matters related to the application. The proposed
Resolution also pledges the Chief Executive Officer and Chief of Police for the City of Alamo
Heights will comply with the grant requirements of the Office of the Governor Public Safety
Office, and applicable federal regulations.
BACKGROUND
On June 28, 2022, Texas Governor Greg Abbott issued a Budget Execution Order ratifying a
proposal by the Legislative Budget Board to transfer $100,579,000 from appropriations to the
Texas Education Agency to the Trusteed Programs within the Office of the Governor in the
amount of $50,000,000 for the purchase of rifle resistant ballistic shields. The three eligible
entities authorized to apply for rifle resistant shield grants are prioritized 1) police officers
directly employed by school districts, 2) police officers contracted by school districts, and 3)
other law enforcement officers that may respond to school safety emergencies.
The remaining funds will be distributed to the Texas Child Mental Health Care Consortium,
Health Education Coordinating Board, Health and Human Services Commission, available
funding for officers to attend the Advanced Law Enforcement Rapid Response Training
(ALERRT), and the Texas Education Agency for on-site assessments to evaluate campus access
control measures and the purchase of silent panic alarm technology.
Currently, the police department has ten (10) bullet resistant ballistic shields capable of stopping
all modern handgun ammunition with the exception of armor piercing ammunition. The rifle
resistant shields are capable of stopping the calibers of rifle ammunition most commonly used in
assault rifles.
The police department is currently in the process of applying for a grant from the Office of the
Governor Public Safety Office. Deputy Chief Pruitt has completed the grant application on behalf
of the Alamo Heights Police Department for four (4) rifle resistant ballistic shields for a total cost
of $17,022.40. The period will be September 1, 2022 through August 31, 2023. A qualifying

component for the grant application is a resolution from the City of Alamo Heights governing
body addressing the following four (4) items:
Authorization from the governing body for the submission of the grant application;
commitment to provide any applicable matching funds;
designation of an authorized official having the authority to apply for, accept, reject, alter,
or terminate a grant; and
written assurance that, in the event of loss or misuse of grant funds, the governing body
will return all funds.
Once the resolution is passed, the grant will be forwarded to the Office of the Governor for
review and approval before the deadline of September 19, 2022.
POLICY ANALYSIS
The City Council has the authority to pass Resolutions authorizing grant applications made in the
name of the City of Alamo Heights and designate an authorized official to act on its behalf to
meet the requirements of the grant application process.
FISCAL IMPACT
Approval of the grant would have a positive fiscal impact of $17,022.40 in capital improvements
resulting in no additional expense to the City for the purchase of the rifle resistant ballistic
shields. If approved, funding for the purchase of the rifle resistant ballistic shields is from the
Office of the Governor Public Safety Office.
COORDINATION
Deputy Chief Cindy Pruitt has accomplished the pre-requisite grant requirements and has
prepared the grant application. City Manager Buddy Kuhn has been briefed on the grant
application and City Attorney Frank Garza has prepared the Resolution.

THE CITY OF ALAMO HEIGHTS IN ALL MATTERS RELATED TO THE
APPLICATION; AND SETTING AN EFFECTIVE DATE
WHEREAS, the City of Alamo Heights (“City”) is a Home Rule City governed by the laws
of the State of Texas; and
WHEREAS, On June 28,2022 the Governor issued a Budget Execution Order ratifying a
proposal by the Legislative Budget Board to transfer funds to the Texas Education Agency of which
$50,000,000 is committed to a grant program for the purchase of rifle resistant ballistic shields; and
WHEREAS, the City of Alamo Heights through its Police Department has an Interlocal
Agreement with the Alamo Heights Independent School District to provide Campus School
Resource Officers for their school campuses; and
WHEREAS, historically attacks on school campuses are committed bypersons using assault
style rifles capable of penetrating standard body armor and ballistic shield; and
WHEREAS, the Alamo Heights Police Department is in need of rifle resistant ballistic
shields to protect students, teachers, School Resource Officers and other responding police officers
from the heightened threat of attackers using assault style rifles; and
WHEREAS, the Budget Execution Order provides relief from the costs of rifle resistant
ballistic shields to a law enforcement agency providing School Resource Officers and emergency
responding officers to school campuses through a grant program offered by the Office of the
Governor to defray the cost of rifle resistant ballistic shields; and,
WHEREAS, the City Council has determined that the grant submission is appropriate,
follows good governance of the City, and is fiscally responsible.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ALAMO HEIGHTS, TEXAS:
SECTION 1. The City Council of the City of Alamo Heights hereby authorizes the filing of
a grant application with the Office of The Governor, Criminal Justice Division, for an equipment
grant to purchase rifle resistant ballistic shields for the Police Department and authorizing the Chief
of Police to act on behalf of the City of Alamo Heights in all matters related to the application. The
City hereby further commits to provide all applicable matching funds when due pursuant to the
Grant, and will return all funds in the unlikely event of loss or misuse of grant fund.
