Where does a judge find the rules? The judicial imagination is not sufficient authority, even though some judicial decisions seem to suggest otherwise. There are several sources of the law, the primary ones being the Constitution, legislation, and prior judicial decisions. This last is the subject matter of this session.
In the past two decades, the legal profession has expended great effort to define and refine the principles governing the ethical conduct of attorneys and judges. Sanctions for an attorney violating ethics rules can be private (letter of warning, private reprimand, admonition) or public (public reprimand, probation, suspension, disbarment). More than any other profession, the legal profession has embarked on a campaign to identify and police unethical conduct and fulfill its primary duty of serving the public and the legal system.
This short information session will cover the fundamentals of legal ethics.

William Jefferson Clinton, the defendant, was elected President of the United States in 1992. In 1991, William Jefferson Clinton was the Governor of Arkansas. In 1991, Paula Corbin Jones was an employee of the Arkansas Industrial Development Commission. The defendant attended a conference that year at a hotel staffed by the plaintiff. Jones claims that she was summoned by Danny Fergson, a state trooper, to go to the Defendant’s suite. Jones claims that while in that room the defendant made sexual advances toward her which she rejected. She also claims that her supervisors consequently changed her duties and treated her unfairly because she rejected the defendant’s sexual advances. Plaintiff Paula Jones filed a civil action against defendant (sitting) President Bill Clinton, alleging that he made “abhorrent” sexual advances. She sought $75,000 in actual damages and $100,000 in punitive damages. Defendant Clinton sought to dismiss the claim on the ground of presidential immunity, or, alternatively, to delay the proceedings until his term of office had expired.
Procedure
The district court denied the motion to dismiss and ordered discovery to proceed, but it also ordered that the trial be stayed until the end of Clinton’s term. The court of appeals affirmed the denial of the motion to dismiss and reversed the stay of the trial. President Clinton appealed to the U.S. Supreme Court.

The doctrine of separation of powers calls for Congress, the legislative branch, to enact legislation and appropriate funds. The president is commander-in-chief of the armed forces and is also charged with ensuring that the laws are faithfully executed. The judicial branch is charged with interpreting the laws in the course of applying them to particular disputes. No member of one branch owes his or her tenure in that position to a member of any other branch; no branch can encroach on the power of another. This system is often referred to as being a system of checks and balances; that is, the powers given to each branch operate to keep the other branches from being able to seize enough power to dominate the government (Kubasek, ch.5, pg. 107).
The first charges that petitioner, acting under color of state law, deprived her of rights protected by the Constitution, in violation of Rev. Stat. §1979, 42 U.S.C. § 1983. The second charges that petitioner and Ferguson engaged in a conspiracy to violate her federal rights, also actionable under federal law. See Rev. Stat. §1980, 42 U.S.C. § 1985 (Cornell Law).
Holding
The Constitution does not protect the President from federal civil litigation involving actions committed before entering office. There is no requirement to stay the case until the President leaves office. In.

This was the presentation for the paper “Modeling Authority Commitments in Two Search and Seizure Cases,” at the 13th International Conference on Artificial Intelligence and Law (ICAIL ’11). It deals with legal knowledge representation. In particular, it tries to describe the aggregate effects of conflicting holdings from different courts.
Although the prohibition on taking of organizational opportunities is well established, the standards applied to this problem in corporate law disputes are vague and imprecise. Corporate directors and officers lack clear guidance as to when a business venture may be taken for themselves or must first be offered to the corporation. This article reviews the relevant Delaware case law, focusing on the ambiguities inherent therein. It then offers a proposed alternative regime, providing greater certainty and predictability.
The article then turns the question of why Delaware courts have resisted adopting a more determinate standard, such as the one offered here. It argues that — at least in this context — Delaware judges are concerned neither with maximizing the number of Delaware incorporations or promoting the interests of the Delaware bar. Instead, mandatory indeterminacy with respect to corporate opportunities is driven by the Delaware courts’ self-interest in maximizing their reputation.

3. Judicial power in s 51 powers
• Lane vMorrison(B&W p 619) Brian Lane charged
for an act of indecency against a superior officer.
• He brought proceedings in the High Court that
the Australian Military Court was invalid on the
grounds that its jurisdiction granted by s 51(vi)
offended the judicial power in s71.
• The Court found that the AMC was independent,
was not an inquest, and could punish.
4. Concept of Persona Designata
• A judge may act in their personal capacity in
an office performing administrative or
executive functions including quasi-judicial
functions: Drake v Minister for Immigration
(1979).
• In Drake a judge was appointed to the AAT (an
executive body) but it was found that the
appointment was in a personal capacity, i.e.
persona designata.
5. Persona Designata
• The Commonwealth can confer non-judicial
functions on a federal court judge if they are
appointed in a personal capacity, i.e. detached
from the court they sit in: GrollovPalmer
(1995).
• A judge may exercise their non-judicial
functions in their chambers with assistance of
their staff, as opposed to operating in an open
court: Hilton vWells (1985).
6. Presumption of Persona Designata
• If the Commonwealth confers a non judicial
power then it is presumed that the judge is
acting persona designata: Hilton vWells
• If the legislation specifies that the
appointment is “persona designata” then this
militates heavily toward being legitimate
• After Hilton v Wells, the legislation (TIA) was
amended to remove any doubt as to whether
the appointment was persona designata.

found that s 20 of the Telecommunications
(Interception) Act was valid.

independence, nor inconsistent with judicial
power.
