The Mekong River is essential to the livelihoods of more than 260 million people in China and Southeast Asia and supports plentiful and varied ecosystems. However, Southeast Asia’s decades long period of economic growth has increased the demand on water and energy resources in the region. This has put the Mekong River on the spot as a primary water and hydropower source in the region. Consequent construction of dams and other interventions in the river’s ecosystem has led to physical changes in the Mekong River Basin over the last five to ten years. These Interventions in the river system has raised various concerns for policy makers and environmental conservationists alike. However, there is little agreement among experts and policy makers on the primary causes of these changes and the transboundary nature of the Mekong River complicates the search for sustainable solutions. This report aims to shed light on the impact of the changing Mekong River on Thailand and the intricate causes for its change through interviews with experts and locals in affected areas. Based on this analysis the report further makes recommendations for ways forward that ensure the inclusive and sustainable development of the Mekong River basin.

1989 ญี่ปุ่ นได้เป็นเจ้าภาพในการจัดประชุม the UN Conference on Disarmament Issue ซึ่งเป็น
จุดเริ่มต้นที่ทาให้ญี่ปุ่ นสนับสนุนการอบรมบุคลากรในประเทศกาลังพัฒนาเพื่อทางานควบคุมการ
จากัดอาวุธและยับยั้งการแพร่ขยายของอาวุธนิวเคลียร์
กลไกทำงกฎหมำยและกำรเมืองของญี่ปุ่ น
ต้นแบบด้านการเมืองภายในประเทศเสนอว่าการตอบสนองผลประโยชน์เฉพาะอย่างในทาง
การเมือง โครงสร้างการเมือง และกฎหมายภายในประเทศ ก็สามารถเป็นเหตุผลหนึ่งที่ทาให้แต่ละ
ประเทศดาเนินการสร้างหรืองดเว้นโครงการอาวุธนิวเคลียร์ ด้วยการสร้างเงื่อนไขทางการเมืองที่
ส่งเสริมให้เกิดการพัฒนาอาวุธนิวเคลียร์อย่างในกรณีของอินเดียที่มีคาสั่งพัฒนาโครงการอาวุธ
นิวเคลียร์ในสมัยรัฐบาล Indira Gandhi เมื่อปี 1974 มีการวิเคราะห์ว่าการตัดสินใจพัฒนาอาวุธ
นิวเคลียร์มาจากการที่นาง Gandhi ได้รับคาแนะนาจากกลุ่มที่ปรึกษาและนักวิทยาศาสตร์กลุ่มเล็กๆ
ว่าโครงการดังกล่าวจะใช้ต้นทุนต่าและมีประโยชน์ต่ออินเดีย โดยก่อนหน้านี้กลุ่มคนดังกล่าวได้
แนะนาให้แก่นายกรัฐมนตรี Lal Bahadur Shastri แต่ก็ถูกปฏิเสธ หลังจากที่มีการพัฒนาและทดสอบ
อาวุธนิวเคลียร์สาเร็จแล้วพบว่าคะแนนนิยมทางการเมืองของนาง Gandhi พุ่งสูงขึ้นอย่างมากจากที่
เคยตกต่าในช่วงปี 1973-1974 ก่อนการดาเนินโครงการอาวุธนิวเคลียร์ นอกจากนี้ยังเป็นที่ทราบ
กันดีว่ายุคของนาง Gandhi ถือเป็นยุคอานาจนิยมที่มีการประกาศภาวะฉุกเฉินทั่วทั้งอินเดีย แสดงให้
เห็นว่ากลไกตรวจสอบถ่วงดุลในขณะนั้นมีความอ่อนแอและส่งผลให้อานาจการตัดสินใจผูกขาดอยู่ที่
นายกรัฐมนตรีเพียงคนเดียว
สาหรับญี่ปุ่นแล้วกลไกทางการเมืองและกฎหมายภายในประเทศที่จากัดการพัฒนาโครงการ
อาวุธนิวเคลียร์ของญี่ปุ่ นนั้นมีสามประการ ประการแรกคือ the Three Non-nuclear Principles ซึ่ง
เป็นกฎเกณฑ์ที่ระบุว่าญี่ปุ่นจะไม่ครอบครอง ไม่ผลิต และไม่อนุญาตให้มีการแนะนาอาวุธนิวเคลียร์
ในประเทศ อย่างไรก็ตาม the Three Non-nuclear Principles ไม่ได้ถือเป็นกฎเกณฑ์ทางกฎหมาย
แต่สภาไดเอทแห่งชาติ (National Diet) ของญี่ปุ่นได้เสนอว่าเป็นเพียงการแสดงออกถึงเจตนารมณ์
ของรัฐบาลในการดาเนินนโยบายไม่แพร่ขยายอาวุธนิวเคลียร์ ดังนั้น the Three Non-nuclear Princi-
ples จึงไม่มีผลผูกพันทางกฎหมาย

ประการที่สองคือ the Basic Law on Atomic Energy ซึ่งได้ประกาศบังคับใช้เมื่อปี 1955
และถือเป็นกฎหมายที่ควบคุมจัดการให้การใช้พลังงานนิวเคลียร์เป็นไปเพื่อผลประโยชน์ของพลเรือน
เท่านั้น โดยบทบัญญัติที่ 2 ของกฎหมายดังกล่าวระบุว่า การวิจัย พัฒนา และใช้พลังงานนิวเคลียร์
จะต้องถูกจากัดเฉพาะวัตถุประสงค์เพื่อสันติและจะต้องถูกจัดการภายใต้ระบอบประชาธิปไตย2
กฎหมายนี้มีศักยภาพในการจากัดการพัฒนาอาวุธนิวเคลียร์ของญี่ปุ่ นในสองทางคือ 1)การ
เปลี่ยนแปลงและแก้ไขกฎหมายดังกล่าวจะต้องผ่านกระบวนการสภา ซึ่งเป็นการลดโอกาสในการ
แก้ไขและเปลี่ยนแปลงข้อความนอกเหนือจากที่กฎหมายระบุไว้ และ 2)กฎหมายได้กาหนดให้ก่อตั้ง
the Atomic Energy Commission ซึ่งเป็นองค์กรที่ประกอบด้วยภาคพลเรือน และต้องมีการรายงาน
เกี่ยวกับการใช้พลังงานนิวเคลียร์ให้คณะรัฐมนตรีรับทราบ
ประการที่สามคือ ตัวแสดงในการยับยั้ง (veto players) ในโครงสร้างทางการเมืองของญี่ปุ่น
กล่าวคือโครงสร้างทางการเมืองของญี่ปุ่นถูกออกแบบตามแนวคิด Ceteris paribus เป็นแนวคิดที่ให้มี
หลายตัวแสดงที่มีบทบาทยับยั้งทัดทาน ซึ่งการมีตัวแสดงยับยั้งหลายตาแหน่งจะเป็นการปิดโอกาสให้
นักการเมืองหรือรัฐบาลตัดสินใจพัฒนาโครงการอาวุธนิวเคลียร์เพื่อสนองผลประโยชน์เฉพาะตน3
อย่างน้อยที่สุดการมีอยู่ของตัวแสดงยับยั้งหลายตัวทาให้ญี่ปุ่นไม่สามารถเปลี่ยนแปลงนโยบายอย่าง
สุดขั้วโดยไม่มีการถกเถียงหรือการอภิปรายทางการเมือง และยังขยายเวลาให้ตัวแสดงในต่างประเทศ
ได้เข้ามาแสดงความเห็น โดยตั้งแต่ทศวรรษ 1950 ได้มีการเพิ่มขึ้นของตัวแสดงยับยั้งในหมู่นักวาง
นโยบายนิวเคลียร์ของญี่ปุ่ น จากเดิมที่นายกรัฐมนตรี Yasuhiro Nakasone ได้วางโครงสร้างกิจการ
นิวเคลียร์ในลักษณะพิระมิดที่นายกรัฐมนตรีมีอานาจเต็มในการรับผิดชอบและตัดสินใจในกิจการ
นิวเคลียร์ โดยในปี 1954 รัฐบาล Nakasone ได้ก่อตั้ง the Preparatory Council for the Use of
Atomic Energy และได้มีการผ่านกฎหมายหลายฉบับเพื่อเป็นส่วนหนึ่งในการดาเนินโครงสร้าง
กิจการอาวุธนิวเคลียร์ในปี 1955 อีกทั้งยังได้ก่อตั้ง the Atomic Energy Council และ the Science
and Technology Agency (STA) ด้วยหวังว่าจะมีโครงสร้างในลักษณะบังคับบัญชา (top-down)
และเป็นองค์การที่ใช้รัฐเป็นศูนย์กลาง (statecentric) แต่ Nakasone ก็ต้องผิดหวังเนื่องจาก
Matsutaro Shoriki ผู้ที่ Nakasone แต่งตั้งให้เป็ นประธานของ AEC และ STA ต้องการให้
ภาคเอกชนเข้ามามีส่วนร่วมอย่างเต็มที่ จึงเป็นจุดเริ่มต้นของตัวแสดงยับยั้งไม่ให้เกิดโครงการพัฒนา
อาวุธนิวเคลียร์ แต่เป็นการพัฒนาพลังงานนิวเคลียร์เพื่อผลประโยชน์ทางเศรษฐกิจแทน เช่น การดึง
บริษัท the Tokyo Electric Power Company (TEPCO) เข้ามามีส่วนร่วม หรือการสร้าง the Power
