Appendix: eRulemaking Authorities and Guidance (Open Government Directive) E-Government Act of 2002 (H.R. 2458/S. 803) Section 206 directs Federal Departments and Agencies to: Post to the Internet regulatory dockets using www.regulations.gov Accept electronic submissions to online dockets OMB Memorandum on Implementation of EO 13422 (amending EO 12866) & OMB Bulletin on Good Guidance Practices – April 2007 Agencies must use Regulations.gov to process public comments for economically significant guidance documents. Regulations.gov may also be used to process public comments for significant guidance documents. OMB Requirements Memorandum –March 2008 Requires Agencies to incorporate records management & archival functions into the design, development and implementation of information systems. Agencies must focus on the following areas: Provide cost-effective & consistent access to and dissemination of govt information Incorporate records management into capital planning & investment control process Simplify the activities, systems, processes of records creation, maintenance, & use Plan for lifecycle of information including the transfer of permanent records to the National Archive and Records Administration (NARA) 9
