TELECOMMUNICATIONS LIBERALIZATION IN THE CZECH REPUBLIC

IPR Protection
While China has made progress in intellectual property laws and regulations due to WTO membership, enforcement remains inconsistent, especially at the local level. For small businesses, infringement by false students, untrustworthy employees, and other companies is a major risk. The government provides little protection, so small businesses must detect infringement themselves and find trustworthy partners. Unless a small business can hire private enforcement like larger multinationals, operating in China means being prepared to deal with infringement on one's own.

China represents a huge potential market for US agricultural and food products, with over 1.3 billion consumers and double-digit GDP growth in recent years. However, China is made up of many diverse regional markets with varying tastes and levels of development. To succeed, companies must carefully target specific consumer segments like the growing middle class in emerging second-tier cities or wealthier coastal urban populations, rather than viewing China as a single homogeneous market. Branding and an understanding of Chinese preferences will also be important to win over consumers.

This was a presentation by Ian Wishart, an experienced patent attorney, who is also a director of an insurance company that specializes in insuring against the costs and consequences of intellectual property infringement litigation. Mr Wishart presented his paper to Ideas North West in Accrington on the same occasion that I gave my paper on IP enforcement without going bust. In this paper he discussed some of the policies that his company can arrange.

Competition Law in High Technology Industries - Insights for Australia
Digital disruption is blowing a Schumpeterian gale of creative destruction throughout the global economy. These winds of change are delivering substantial increases in consumer welfare. The glowing glass screen of a smartphone enables us to access the library of all human knowledge. We can order any imaginable good or service; literally at our fingertips.
Yet competition challenges are arising. Firms bearing the brunt of digital disruption are seeking regulatory protection. Those firms riding the winds of change are achieving concerning levels of global market power. Global debate is occurring regarding the extent to which regulatory intervention is appropriate. The resulting level of political concern is partly evidenced by the inclusion of digital technology in Australia’s Harper Competition Review.
This paper considers unique competition issues raised by high technology industries with a particular focus on software-driven digital platforms. This paper argues that Australian competition law strikes an appropriate balance between preserving competition and promoting innovation, but continued prioritisation of high technology markets by Australian regulators and policy-makers is justified. High technology markets are as susceptible to anti-competitive behaviour as any other markets and, in some areas, particularly so.
As part of this analysis, this paper considers global trends and recent developments, particularly in the United States and European Union. In that context, this paper considers how modern competition law is now seeking to address complex questions of dynamic efficiency, innovation markets and cross-border e-commerce. This paper seeks to identify insights for Australian competition law and policy in light of the recent Harper Competition Review. Finally, this paper concludes with a number of observations, including future challenges in regulating digital platforms.

The UK YORUBA Trade Mark Registration
In Nov 2015 a British private limited company registered the words YORUBA and Yoruba as UK trade marks for a wide range of goods and services. Nobody seems to have objected to the registration at the time. On 23 May 2021, another UK incorporated company called The Culture Tree protested vociferously. Many others around the world joined in. It appears that the registered proprietor has agreed to assign the registrations to The Culture Tree which has removed one objection. But should it have been possible to register the name of a nation of 70 million at all? What should be done to prevent issues of this kind in future?

IP After Brexit
Here are the slides of a presentation that I gave to the Barnsley Business Village on 19 Feb 2021. Unlike my earlier presentations, this was designed for business owners. I discussed what was meant by IP, why monopolies such as patents and exclusive rights such as copyrights were difficult to reconcile with the concept of a single market, the need for the approximation of laws and unitary IP rights and the arrangements made in the withdrawal agreement to continue to protect in the UK intellectual assets that were protected by EU intellectual property rights.

IP After Brexit
On 26 Jan 2020, I have a talk over Zoom on "IP after Brexit". My slides are already on Slideshare. These are supplemented by this handout which covers:

- The statutory instruments made in anticipation of our exiting with a withdrawal agreement
- The withdrawal agreement
- The European Union (Withdrawal Agreement) Act 2020
- The Trade and Cooperation Agreement
- The European Union (Future Relationship) Act 2020.
These notes track every legislative change to the requirement in the withdrawal agreement. I also discuss changes to the law not effected by the withdrawal agreement and consider future development of our IP law.
How Brexit has changed IP Law
At 23:00 on 31 Dec 2020 EU law ceased to apply to the UK including the Regulations establishing the EU Trade Mark, the Community Design and many other rights. A priority in the negotiations for the UK's withdrawal from the EU was the continued protection of the brands, designs and other intellectual assets that been protected by such rights. The withdrawal agreement entered in Jan 2020 provided for EU trade marks, Community designs, Community plant vaieties, database rights and supplementary protection certificates. This presentation considers the relevant provisions of the withdrawal agreementn and the statutes and secondary legislation which implemnted it. Such legislation is now bearing a great part of the UK's IP infrastructure.
The Supreme Court Rules on FRAND
The UK Supreme Court ruled on several appeals relating to FRAND (fair, reasonable and non-discriminatory) licensing of standard essential patents (SEPs). The Court found that UK courts have jurisdiction to grant injunctions for infringement of UK patents, determine global FRAND licensing terms as a condition to avoid injunctions, and that Birss J's methodology was consistent with EU competition law and industry practice. While injunctions are usually appropriate, the rulings could cause implementers to leave the UK market rather than accept worldwide FRAND licenses set by UK courts.
