Intellectual Property Office – Who are we?
The most important slide!
https://www.gov.uk/guidance/exporting-your-intellectual-property#specific-country-guidance
What kind of IP do you own?
Patent – for new inventions
Design right – for the physical appearance and visual
appeal of products
Trade Mark – to show the brand origin of a
product
Copyright – a work of artistic expression
Trade Secret – undisclosed
information with commercial value
Why is IP important to the UK?
IP helps to reward innovation, creativity and imagination
The UK exported £13.1bn and imported £9.3bn in
intellectual property services in 2015, resulting in a
trade surplus of £3.8bn (ONS IT IS)
IP is often a company’s most important and valuable
asset. But it is often under protected.
IP Awareness in the UK
IP Baseline Survey
• Only 5% of UK businesses have an overall IP
management policy in the UK
• Only 14% know that disclosure of an invention before
filing will invalidate a patent
• Only around 15% of UK businesses have registered a
trade mark overseas and only 9% registered a patent.
IP Awareness Overseas
:What British businesses tell us
• Around 1 in every 4 UK businesses operating
overseas cite IP as one of their biggest concerns
( )UKTI Business Barriers Survey
• The territorial nature of IP rights is not well
understood
• ‘ ’Nor is the first to file system
• Some IP systems can be really complex and
difficult to navigate
• Routes for enforcing rights overseas are complex
and alleged infringers have home player
advantages
• Backlogs and quality issues for registering
IP rights
• Trade mark squatting and patent trolls
• Online piracy and fraud
• Counterfeit and fake goods, H&S issues,
fake food
• Copyright in the 21st century, film, books,
web and orphan works
• Changes following exit from EU
So what are the big IP issues?
They are different in different markets but the key themes are:
1.Know before
you go: IP rules
and regimes
around the world
vary significantly
The 3 things to be most aware of
2. IP is territorial:
IP rights granted in
one jurisdiction
usually only provide
cover within that
same jurisdiction
3. It’s a first to file
system in most of the
world: So act fast or
miss out !
