2. Definition
 It is defined as the breach of duty caused by omission
to do something which a reasonable man guided by
those considerations which ordinarily regulate the
conduct of human affairs would do or doing
something which a prudent man would not do

4. Medical Negligence
In order to achieve success in an action for negligence,
the consumer must be able to establish to satisfaction
of the court that,
1. Doctor owed him a duty to conform to a particular
standard of professional conduct
2. The doctor was derelict and breached the duty
3. The patient suffered the actual damage
4. The doctor’s conduct was direct or proximate cause of
damage

 Wrong diagnosis and treatment
 Gross ignorance
 Gross carelessness or neglect for patient’s life
 Cause injury to or death of the patient by a rash and
negligent act amounting to culpable homicide under
SECTION 304-A of Indian Penal Court
