Advocacy and the
Royal Commission into
Youth Detention and Child Protection
ABC 4 Corners - “Australia’s Shame: The
Brutalisation of Children Behind Bars”
Treatment in Don Dale
Royal Commission
• Commissioners White and Gooda
• Time frame – initially 6 months, extended
• Community consultations
• TORs – failures of Youth Justice and Child
Protection systems
• Leave to appear
Evidence
• Breach of International Human Rights
– Havana Rules, Beijing Rules
– Don Dale facility – aged, adult prison – not appropriate for
children
– focus on security risk, maintaining ‘good order’ of the centre
rather
• Majority of detainees (60-70%) held on remand - av. 6-8 weeks
• Cross over from child protection to youth justice
• Many young people with complex needs and vulnerabilities
• CP and YJ systems – often cause of further harm
• Little investment in early intervention and prevention
Advocacy
• Research – evidence based solutions
• Critique legislation, policies, directives
• Alternative models
– New Zealand
– Scotland, UK
– USA
– Norway, Germany
Advocacy
• Youth workers – Don Dale
– Social and para legal support
• Research building on existing knowledge
• Interns, legal analysis, public health
• Submissions to RC
– Application for leave to appear
– Called to give evidence
Establishing Credibility
• Research is key - know your stuff !
• Offer solutions and ways forward
• Be persistent
• Clear consistent messages
• Use your reputation and connections
• Identify key ‘decision makers’
• From 1980s, Missouri closed large
institutions replaced with small facilities
with therapeutic approaches
• Three years after discharge, 70 per cent
of young people no further contact
justice system
• Australia 74 per cent of young people
return to youth detention within 12
months
• Missouri’s youth facilities small, home-
like, based in local communities
• approach is therapeutic and
developmental rather than correctional.
9
Best Practice Models: Missouri
Best Practice Models: Scotland
• Youth Justice and Care and Protection matters are dealt with by Children’s
Hearing Panels
• Panel members role is ‘life changing decision maker’ make binding
decisions for the sole purpose of improving the well-being of children and
young people
• Strongly values the voices of children and young people (i.e. they are
included in the recruitment process of the panel members)
• Continuous fall in referrals to the Reporter for both offending and
care and protection. There was a fall of 78% of referrals on offence
grounds from 2006/07 to 2012/13 (Scottish Children’s Reporter
Administration, 2013)
10
Best Practice Models: New
Zealand The Oranga Tamariki Children and
Young Person’s Well-being Act 1989
places the wellbeing of children and
young people at the forefront of all
decision making processes.
The new Ministry Oranga Tamariki has
five core services:
•Prevention
•Intensive Intervention
•Care and Support
•Youth Justice
•Transition service
The new department has a single point of
accountability for all children to ensure a
coherent and complete response to
meeting the needs of children and their
families
What do we want
to achieve?
“That all children and young people live with loving families and communities where they
are safe, strong, and connected. With these supportive networks, children and young people
are able to realise positive long term health, emotional, education, social and economic
outcomes.”

  • 1. Advocacy and the Royal Commission into Youth Detention and Child Protection
  • 2. ABC 4 Corners - “Australia’s Shame: The Brutalisation of Children Behind Bars”
  • 4. Royal Commission • Commissioners White and Gooda • Time frame – initially 6 months, extended • Community consultations • TORs – failures of Youth Justice and Child Protection systems • Leave to appear
  • 5. Evidence • Breach of International Human Rights – Havana Rules, Beijing Rules – Don Dale facility – aged, adult prison – not appropriate for children – focus on security risk, maintaining ‘good order’ of the centre rather • Majority of detainees (60-70%) held on remand - av. 6-8 weeks • Cross over from child protection to youth justice • Many young people with complex needs and vulnerabilities • CP and YJ systems – often cause of further harm • Little investment in early intervention and prevention
  • 6. Advocacy • Research – evidence based solutions • Critique legislation, policies, directives • Alternative models – New Zealand – Scotland, UK – USA – Norway, Germany
  • 7. Advocacy • Youth workers – Don Dale – Social and para legal support • Research building on existing knowledge • Interns, legal analysis, public health • Submissions to RC – Application for leave to appear – Called to give evidence

  • 9. • From 1980s, Missouri closed large institutions replaced with small facilities with therapeutic approaches • Three years after discharge, 70 per cent of young people no further contact justice system • Australia 74 per cent of young people return to youth detention within 12 months • Missouri’s youth facilities small, home- like, based in local communities • approach is therapeutic and developmental rather than correctional. 9 Best Practice Models: Missouri
  • 10. Best Practice Models: Scotland • Youth Justice and Care and Protection matters are dealt with by Children’s Hearing Panels • Panel members role is ‘life changing decision maker’ make binding decisions for the sole purpose of improving the well-being of children and young people • Strongly values the voices of children and young people (i.e. they are included in the recruitment process of the panel members) • Continuous fall in referrals to the Reporter for both offending and care and protection. There was a fall of 78% of referrals on offence grounds from 2006/07 to 2012/13 (Scottish Children’s Reporter Administration, 2013) 10
  • 11. Best Practice Models: New Zealand The Oranga Tamariki Children and Young Person’s Well-being Act 1989 places the wellbeing of children and young people at the forefront of all decision making processes. The new Ministry Oranga Tamariki has five core services: •Prevention •Intensive Intervention •Care and Support •Youth Justice •Transition service The new department has a single point of accountability for all children to ensure a coherent and complete response to meeting the needs of children and their families
  • 12. What do we want to achieve? “That all children and young people live with loving families and communities where they are safe, strong, and connected. With these supportive networks, children and young people are able to realise positive long term health, emotional, education, social and economic outcomes.” 12

Editor's Notes

  1. Punishment included denial of basic needs – food, water, access to toilets, a proper bed. Young people were held in isolation units for up to 23 hours a day . One child held in the BMU for 17 days without knowing when he might get out
