Different Types Of Contracts And Contracts
There are many different types of contracts and many different parts to a contract. Contracts are
formal agreements between people or businesses. There are seven elements to a contract. The first is
the offer which is the purposed deal. Next is the acceptance of the offer than consideration or
bargaining of the offer. Legality is the next which means is the contract for a lawful purpose. Next is
capacity are the parties adults of sound mind then consent of the contract. Lastly, writing some types
of contracts must be in writing to be enforceable. There are two contract rules for governing the sales
of goods and the sale of services. The Uniform Commercial Code (UCC) is the code used for the sales
of goods. The sales of services uses common law to govern these contracts. UCC was first published
in 1952, the drafters of this code wanted to facilitate the easy information and enforcement of
contracts in a fast paced world. There are nine articles to the uniform commercial codes. Article one
deals with the law of contracts and article nine deals with payment in security interest agreements. The
most important article is article two which deals with the sale of goods. Goods are anything movable,
except for money, securities and certain legal rights. Article two also states the rules for contract
formation such as the firm offers, shipments of goods and modification of terms. Article two states the
rule for contract repudiation and breach listing several

Columbus Day Pros And Cons
In modern day society, we often overlook key points in history. For example, Columbus Day, why do
we celebrate it? Well, from one s point of view, we celebrate this holiday for several reasons, one of
these reasons are because it recalls Christopher Columbus entry to the Americas on October 12, 1492.
This occasion is questionable on the grounds that the European settlement in the Americas prompted
the downfall of the history and culture, of the indigenous people groups. What are some of the pros
and cons from naming Columbus Day to Indigenous Day? That is what you will learn in this essay. To
start off, Indigenous People s Day, or Columbus Day, Which do you prefer? First off, why is it called
Columbus Day ? Well, as stated earlier, it was named after Christopher Columbus, who as we believe
today, discovered America. Many believe that it was him who founded the Americas, but really there
could ve been earlier settlers or even Native Americans who lived on those territories before
Columbus made his way there. What is a pro of having this day named after Columbus? A source I
found called www.scholastic.com stated, The holiday honoring Christopher Columbus s sighting of
America on October 12, 1492, is observed in the states of the United States and also in parts of
Canada, in Puerto Rico, and in some cities in Italy and Spain. Although Columbus was not the first
explorer to set foot in the Western Hemisphere, his landing at San Salvador Island in what is now the
Bahamas was very important. It opened the way for the settlement of America by Europeans. So,
basically we named this holiday after Columbus because it was assumed that he was one of the first to
see and discover the Americas. Another source titled www.osia.org stated Columbus Day celebrates
the beginning of cultural exchange between America and Europe. After Columbus, came millions of
European immigrants who brought their art, music, science, medicine, philosophy and religious
principles to America. From one s point of view, it may look like Columbus did many great things that
led to the development of America. But no one really knows what was at stake because of Columbus
decisions. A con relating to the naming of Columbus Day is in a

Theories Of Evolution Of Psychology
Ideas in psychology have been influenced by many fields of study ranging from philosophy to
physics. Evolutionary ideas, themselves, have had a substantial role in shaping psychological thought.
This paper will provide an overview of the influence of evolutionary thought on the field of
psychology along with a discussion of the range of societal implications associated with evolutionary
psychology. The influence of evolutionary ideas on psychology dates back to Charles Darwin, the man
who proposed The Theory of Evolution by natural selection. Evolution theory suggests that organisms
change with time to adapt to their environments. Those organisms best capable of surviving and
making adaptations to their environment will have the most ... Show more content on Helpwriting.net

The aforementioned influences eventually lead to the field of evolutionary psychology in which the
common view is that both physical and mental organs developed through natural selection. Biases in
how our brains perceive, process, and react to the world around us can either contribute to our survival
or to the reason we die out . Such biases affect our social behavior and status, sexual selection, and
gender relations (Wright, 2010). Presently, evolutionary psychology has become an interest in popular
culture which in turn influences the subject matter studied in this field. It provides plausible reasons
for an array of human behaviors which sparks interest. People want to know why men have aggressive
tendencies or why some will risk their lives to help those with no benefit to themselves. Survival of
the fittest has become a commonly used phrase and Charles Darwin is no secret. Evolutionary
psychology raises the idea that personality and behavior are mediated by evolutionary forces. This
notion can have both positive and negative implications for society. It can provide a reason for why
we love the people we love; but it can also provide an adaptive role for violent behavior. These ideas
provide a rationale for our ability to think and reason. It makes us question our motives in certain
situations like when we may act altruistically. This is reflected in society in many ways. For instance,
consider the number of

Role Of Weather In The Great Gatsby
It s More Than Just Rain or Snow In reality the weather and environment play a part in how people
interact with one another and in some cases it can even influence a person s mood. Therefore, weather
also plays a similar role in literature as it does in reality. The only difference is that in literature the
significance of weather impacts the story more and has much sub contextual meaning than what is just
portrayed on the surface level. Within different stories different types of weather can symbolize
different things. In the novel, The Great Gatsby by F. Scott Fitzgerald, Fitzgerald uses fog to serve as a
symbol for Gatsby s and Daisy s relationship. His choice for using fog as a symbol of their
relationship is because it obscures Gatsby s vision of the green light on Daisy s house which, for
Gatsby, it acts as a beacon letting him know where Daisy is. Also, it acts as a method of
foreshadowment. Realistically, fog obscures one s vision and it renders the viewer blind to what s
around them due to the fact that the fog encapsulates the person in a visual area that is generally only
immediately in front of you. For example, the purpose of a lighthouse is to ... Show more content on

could see Daisy was thwarted simply by fog. And if it wasn t for the fact that Daisy was right next to

Advancement of minorities in higher education has many barriers. As it relates to colleges and
universities, true ethical issues consistently remain dormant in some cases (Wolfe Freeman, 2013). For
example, Jackson (2001) stated that there is a small pool of qualified candidates to select from because
of the percentage of degrees being awarded. For example, 2011, approximately 13% of earned
doctorate were awarded to underrepresentation minorities (U.S. Department of Education, National
Center for Education Statistics, 2012). Therefore, with these limited numbers the potential candidates
are not available. Within my chosen field minorities involvement in agriculture remains limited. In
addition, recent demographic trends estimate that ethnic minority populations are steadily increasing,
and in some areas are reaching the tipping point to become the majority. For this reason, I am
primarily interested in bringing more awareness in agricultural and extension education that focuses
on diverse communities that are normally uninvolved in the opportunities in the agricultural industry.
My research interests focus on improving and maintaining a strong and valuable agricultural system

The Dividend Policy Puzzle
INTRODUCTION
Dividend payout ratio has been an issue of interest in daily financial literature. An example, many
academicians and researchers have devoted their time to develop several theoretical models to provide
some insights into the dividend policy puzzle. Dividend theories are developed with some of empirical
support.
Dividends is a payments made by a corporation to its shareholder members. It is the portion of
corporate profits paid out to stockholders. When a corporation earns a profit or surplus that money can
be locate by two uses. Which it can either be re invested in the business that called retained earnings
or it can be distributed to all shareholders. There are two ways to distribute cash to shareholders, such
as share repurchases or give dividends. Many corporations retain a portion of their earnings and pay
the remainder as a dividend.
Dividend also has been analyzed for many decades, but it is not universally accepted explanation for
companies observed dividend behavior has been established. According to Brealey and Myers (2005)
described that dividend policy as one of the top ten most difficult unsolved problems in financial
economics. This description is consistent with Black (1976) who stated that:
The harder we look at the dividend picture, the more it seems like a puzzle with pieces that don t fit
together .
The study would be exciting to conduct a research regarding dividend payout ratios and even though
some studies should be conducted as

The Role of Romero vs. the Catholic Church: The Salvadoran Civil War The tragedies of the civil war
in El Salvador brought focus to the many issues of oppression, under representation, and inequality
apparent amongst the Salvadoran working class during the later twentieth century. The outbreak of the
war began much like civil wars in neighboring countries, consisting of the lower class demanding land
and policy reformations, as elites feared the uprisings would result in socialist geared politics that
jeopardized their status. Amidst the fighting between the two social classes, the Catholic Church, as a
whole, maintained a somewhat neutrality status and refused to publically support one group over the
other. Thus, much opposition to the ... Show more content on Helpwriting.net ...
Author Edward T. Brett argues that Romero had a very prophetic approach [that] was a highly
effective method of leadership during his three year tenure of office (Brett 717). He uses the term
prophetic to refer to the similar ways in which Romero preached his sermons to the underprivileged
campesinos in order to also publically represent them, much like Jesus preached to the poor to
represent the persecuted Christians. However, the term itself can be problematic because also like
Jesus, Romero was tormented by his fellow bishops for catering to the needs of the poor. Not all
bishops and clergymen at the time had captured the essence of liberation theology teachings and
feared they were too radical to preach to the campesinos. However, Romero believed that the equality
of Salvadorans was more important than their integration into the elite society. He focused many of his
preachings on the need to put an end to violence and determine a right from wrong. In Romero s last
sermon, just before he called for soldiers to refuse to obey orders, (Wood 27) he gave special attention
to the need to reinstall distinct human rights within a country in its own exodus (Romero 3) and that
both groups alike should call for, respect for the dignity of the person, hope for humanity s common
good, and the transcendence that look before all to God and only

Split brain patients lateralize functions in their brains to either side of the brains while intact brain
patients utilize both sides of their brains. A group of 20 subjects were tested, 10 split brain and 10
intact brain patients. We gave these subjects three exams, a vocabulary test, a logical reasoning task

American History And Its Impact On The West And Distant...
Unsurprisingly, many historic cultures have not been accurately studied in modernity. Due to personal
biases, incomplete data, or a multitude of other issues, incorrect perceptions about these collapsed
societies remain. However, modern studies are beginning to reveal the inaccuracies of those enduring,
false notions. It is valuable to compare misunderstandings to the historic reality in addition to
discovering why the past happened as it did. Although newer, more factual information will not erase
long taught misconceptions about collapsed societies like Jamestown, El Dorado, or the Norse
Greenlanders, it provides the chance to better understand historic events in an effort to help guide
decisions that could affect the near and distant future. Jamestown has a permanently secured place in
American history as the young country s first successful, permanent colony. When the Europeans
arrived in 1606 with 104 men and boys hoping to find their riches in the New World, they found a
largely empty landscape. Over the next few decades, the Jamestown people were able to thrive while
the native populations were dying because the colonists had more advanced technology, Christianity,
and European sensibilities. They were able to properly manage the empty, surrounding area, convert it
to farmland, and grow highly profitable tobacco that helped spur further growth in what would
become the US. However, it s reality tells a much different story. The first colonists arrived in March

Investing Formative Classroom Assessments
By my definition, a classroom assessment is a measuring tool used to guide instruction and learning
on subsequent lessons to follow. It s an opportunity to evaluate how well your students are
synthesizing information and applying it in the classroom. Keeley (2015) states that good assessment
practices are integral to informing teaching and learning, as well as documenting and measuring
student achievement. Examples of classroom assessments are broken into two categories; formative
and summative. Summative have been traditionally a go to for teachers with tests, quizzes, and
projects. Formative assessments are an informal evaluation or a checkpoint at which the teacher can
use observation or short surveys to understand where their students stand with the curriculum.
Formative assessments have become a huge component of my instruction practice. Our district
encourages the use of formative assessments rather than the traditional summative. Keeley (2016)
states that much of the weight has been shifted on the side of formative. I have used short surveys or

Realtor Ethics
A realtor is the designation accorded to a member of the National Association of Realtors (NAR).
NAR is the largest trade association of America. It has about 1 million members. The membership to
the association is voluntary therefore it contains many other group members apart from the realtors.
The idea behind the formation of this union is to utilize the land in a wise and best possible way.
The real estate professionals who are members of the NAR have to adhere to a code of ethics. The
code of ethics is inclusive of duties to clients, customers, public and other realtors. The main motive is
to promote the best interests of the client, be it the buyer, seller, landlord or tenant. The realtors are
expected not to mislead their clients in order to book higher profits. The realtor is entitled to represent

Although realtors are expected to avoid misstating the facts or hiding useful information it is not
obligatory for them to find out the defects in the property. Hence it is important to get the property
checked by a third party inspector.
In case the realtor seeks information from other realtors it is mandatory for them to disclose their
realtor status and clarify the nature of interest, whether it is personal or on the behalf of a client. The
realtors are not supposed to misrepresent the availability of access to a particular property. When
acquiring properties from their immediate families or friends the realtors have to disclose their true
position to the concerned parties.
You are entitled to know the financial fee or benefits that the realtors get on the basis of
recommending real estate products or services such as insurance or mortgage financing. The realtors
are expected to give equal services to every person regardless of their race, color, religion, sex,

The Future of Education in America
Public Policy Term Paper
The Future of Education in America We are now taking the lead because for too long the public school
system in Camden has failed its children , exclaimed Chris Christie, the standing Governor of New
Jersey. On the one hand, The New Jersey Public School System was awarded number 1 as the best
system in the nation by 2012 Education State Ranking (Morgan, 2011). Yet on the other, only 2
percent of the graduates from Camden High School scored high enough on the SAT s to be considered
college prepared. This blatant inconsistency echoes the hyper polarization of wealth and indigence
throughout not only the state of New Jersey, but also the country as a whole. In response to this crisis,
NJ s Governor Christie has proposed the Opportunity Scholarship Act, which would stimulate
competition between schools and in turn boost the quality of education. The act would create this
competitive open market by providing scholarship funds to eligible low income children who attend a
chronically failing school district in order for them to choose to attend an alternative public or non
public school. Before thoroughly examining Christie s OSA, it is necessary to zoom out and discuss
the importance and advantage of scholastic development. Education is the fundamental necessity to
realize the full extent of opportunity in The United States of America. In this country, we live in a
society that is politically democratic and economically capitalistic with

Alternative Energy Sources Of Fossil Fuels
Since the Industrial Revolution in 1760, the world has run on fossil fuels. Fossil fuels are critical to
global energy infrastructure due to their inherent advantages and generate significant economic value
as a result. However, the negative economic and environmental implications of fossil fuels demands a
permanent transition towards alternative energy. The world will continue to investigate alternative
energy sources and must commit to them to avoid long term environmental degradation. Ultimately,
fossil fuels are on the way out, but considerable work must be done before this forecast can be
realized.
Fossil fuels are an energy source derived from organic material that has decomposed over the course
of millions of years. Millennia ago, plants and animals died, quickly becoming buried under layers
upon layers of sedimentary material. The earth covering the remains of these organisms created a
unique environment of high pressure and high temperature, until they formed valuable hydrocarbons
which have countless applications for the energy industry (7). The main types of fossil fuels are oil,
natural gas, and coal, which each formed under a different set of conditions. Oil and natural gas are
primarily derived from compacted aquatic organisms, with natural gas simply being cooked longer
than oil has been. This differs from coal, which formed from primarily plants that were buried under
hundreds of layers of sediment (7).
Fossil fuels are not cherished by humans for simply

Analysis Of Where I m Calling From
Thesis Statement: In Narration and Interiority in Raymond Carver s Where I m Calling From,
Claudine Verley analyzes the narration in the short story and used it to deduce the character traits of
the story s protagonist.
Verley states that the setting in Where I m Calling From shows that Carver also struggled to overcome
a drinking problem. In the short story, there is no personal detail of the narrator. The narrator s name
remains a mystery, except for the fact that he is separated from his wife while at the same time he is
not interested in his girlfriend (Verley 91). Verley thinks that Carver decided not to share any details of
the narrator because he wants to escape his identity rather than reinforce it. Also, since there is no
equivalent life force in the narrator s existence, this shows that he remains alone at the end, and thus
making the claim that alcoholism is essentially inexplicable (Verley 91). There is an implicit
comparison between the narrator and J.P and the narrator is constantly reminded of his personal
adventures through Joe Penny s narration (Verley 91). Joe Penny is a man in his thirties and he is also
an alcoholic. In the story, the narrator empathizes with Joe Penny because he is just like him. Joe
Penny possesses an element that is in common with the narrator, an element that is beyond their
alcoholism and presence at the rehabilitation facility. Joe Penny was dropped off at a rehabilitation
center by his father in law and he tells a

Literary Devices Used To Protest War
When the word protest is brought up, everyone gets stereotypical and assumes it is violently,
especially when one is protesting war . Some people protest through writing. These writers protest
using different literary devices, such as imagery, irony, and structure. War has unique touch to
everyone s life who encounters this. Each individual deals with the effects of war in different ways.
The authors Stephen Crane, Wilfred Owen, Tim O Brien, and Kevin Powers express their feelings by
writing. Imagery is used to protest war, because it puts vivid images in the reader s head of just how
bad war really is. Stephen Crane describes in his poem Because your lover threw wild hands toward
the sky (Crane 2). This brings an image of someone s loved one standing in a field and when the bullet

In the short story ¨The Yellow birds written by Kevin Powers, the author uses structure to protest war.
He rambles on and on causing the reader to realize how confused and disoriented he was. For
example, ¨What are you gonna do?, but really it doesn t matter...until only the animals made you sad,
the husk dogs filled with explosives¨ (Powers). This sentence should be at least two seperate complete
sentences. Instead of him worrying about being grammatically correct, he uses stream of conscious to
show the thoughts rambling through the soldier s head. Tim O Brien, the author of The things they
carried, uses structure in his short story by using listing and parallel structure. He explains everything
a soldier needs during war, when listing these things it causes no emotion to the reader. For example,
¨Among the necessities... were can openers, pocket knives, heat tabs, wristwatches, dog tags,
mosquito¨ (O´Brien). When an author uses certain structure, it shows the reader that the author has no
emotion due to

Critical Analysis Of David Lindsay Abaire s Good People
Everybody has a class no matter if your poor or rich. Examining the difference between Southie and
Chestnut Hill you can tell which class is poor and which class is rich. Through Good People , David
Lindsay Abaire argues that rich people and poor people has a different life styles. This can be seen
through his use of imagery, characterization and conflict. In this play, David Lindsay Abaire uses
imagery to shows what type of life style that Southie and Chestnut Hill has. Firstly, Southie has many
poor people and broken things around them. For example, Abaire shows how Southie s environment
looks by the narration of the play, The alley behind the Dollar store. There s a dumpster back there and
a rusty chair and a door labelled Dollar store (5). Another way, Chestnut Hill has many rich people
and many expensive things. For example, Abaire narrates about Mikes house in details, Lights up on a
beautiful home. The living room takes up most of the space. Up and left we may see part of a foyer
that leads to the front door. Doorways and corridors lead off to other parts of the house the kitchen, the
dining room, maybe we see a staircase that leads up to the bedroom (105). The author went into
details to show how rich Mike is. Again, Abaire is showing us that anyone from Southie will try their
luck to get more money. For example, Margret is playing bingo with her friends in a basement of a
church, Margaret, jean and Dottie are at a folding table in the basement of a

this Nazi influence was the Bund movement (MacMillan). The Bund movement was an Anti Semitic

Australian Way Of Life Essay
A lot of articles these days tell us all about the problems with our housing market, but none of them
offer any solutions. It s about time the people of Australia knew what the government, real estate
experts, and fellow Aussies think about our housing market. It s about time we knew how to fix this
problem, instead of repeatedly being told how bad it s getting. Aussies are concerned about the
housing market, and rightfully so, as one in five struggle to keep up with housing payments. In fact,
surveys show 70% of people are concerned they ll never own a home in their lifetime and 80% reckon
prices will keep rising in the future. Despite this, 3 quarters of Aussies still believe owning a home to

Traditional middle ring suburbs are the logical place to improve density, but governments have to
make sure they don t disrupt local communities. Mr Sukkar, who s portfolio includes housing
affordability, said this is because people have quite rightly bought in a suburb, partly because of the
character of that suburb and they don t want it to change. This is why local government provides
resistance to density increase. The Victorian Government is facing stiff opposition over a $185 million
plan to renew public housing estates. The Boroondara local council is an example of this, fighting a
plan to redevelop a site at Bills St, Hawthorn with four hundred units and towers up to twelve storeys
high. Mr Sukkar concluded that the best approach is to increase density near train and tram routes to
take pressure off traditional suburbs. He also urged governments to unlock more surplus land for
housing. There is no simple solution to our housing affordability problem, but it s in our government s
hands to do something. I urge them to make some moves to make housing affordable. If this is too
much to ask for them, then we should bring in a government that s up to the

Barium Sulfate Research Paper
Almost all of the barium consumed commercially is obtained from barite, which is often highly
impure. Barite is processed by carbothermal reduction (heating with coke) to give barium sulfide:
BaSO4 + 4 C → BaS + 4 CO
In contrast to barium sulfate, barium sulfide is soluble in water and readily converted to the oxide,
carbonate, and halides. To produce highly pure barium sulfate, the sulfide or chloride is treated with
sulfuric acid or sulfate salts:
BaS + H2SO4 → BaSO4 + H2S
Barium sulfate produced in this way is often called blanc fixe, which is French for permanent white.
Blanc fixe is the form of barium encountered in consumer products, such as paints.[5]
In the laboratory barium sulfate is generated by combining solutions of barium ... Show more content

The accidental discovery of this conversion many centuries ago led to the discovery of the first
synthetic phosphor.[4] The sulfide, unlike the sulfate, is water soluble. Sometime prior to the autumn
of 1803, the Englishman John Dalton was able to explain the results of some of his studies by
assuming that matter is composed of atoms and that all samples of any given compound consist of the
same combination of these atoms. Dalton also noted that in series of compounds, the ratios of the
masses of the second element that combine with a given weight of the first element can be reduced to
small whole numbers (the law of multiple proportions). This was further evidence for atoms. Dalton s
theory of atoms was published by Thomas Thomson in the 3rd edition of his System of Chemistry in
1807 and in a paper about strontium oxalates published in the Philosophical Transactions. Dalton
published these ideas himself in the following year in the New System of Chemical

Those Winter Sundays By Robert Hayden
In Class Essay #1: Those Winter Sundays
In the poem Those Winter Sunday s written by Robert Hayden, he writes about how in his childhood,
his father would generously warm the home and shine his shoes. As an adult, Hayden finds himself
regretting the lack of gratitude he had for his father s small generosities. The poem displays a great
description of the deep feelings the son has for his father and what his father sacrificed for them. As
the poem gradually progresses, the son realizes that he lacked in displaying his love and gratitude for
his father.
Robert Hayden concludes in his poem how the speaker s father would express himself in a personal
way. He was never affectionate; he just strived to make sure his family was warm and safe. Even after
his labor demanding job, he would still take care of his family and ask for nothing in return, allowing
the narrator to realize how ungrateful he may have been made out to be towards his father. ... Show

Hayden s father was a very seclu0ded man, who kept to himself. That was the way he went about his
everyday tasks. Robert Hayden did not fully appreciate and understand what his father was doing for
him due to his maturing adolescents. In the end, the father boldly brings out his opinions and thoughts
within the listed quote above. Towards the end of the poem, Hayden clearly reveals what the poem is
really all about. Throughout the poem it is portrayed as the father just being a hard worker, yet
towards the end, he is described as the man who never received the appreciation he deserved. After
reading the poem I feel as if the writer is holding onto something that cannot be changed. The narrator
needs to come to realization that what is done is done and his father did what he did to keep his family

Beta Blocker
Hi Shoaib,
Well written paper on beta blockers in controlling hypertension. In my experience, I had seen more
than 80% of patients are prescribed with antihypertensive drugs in their medical chart. A beta blocker
is one of the most common drugs in a geriatric setting especially atenolol. Beta blockers are the
standard of therapy for many cardiovascular conditions and it is the main line of treatment in
decreasing risk of stroke. According to Ladage, Schwinger, and Brixius (2013) beta blocker was more
effective in decreasing mortality and morbidity rate in acute coronary syndrome patients. Atenolol is a
water soluble and had longer half lives with non metabolized actions and excreted via the kidneys
(Ladage et al., 2013). The exercise capacity increases in patients who are on beta blockers, like
bisoprolol, nebivolol, carvedilol (Ladage et al., 2013). A recent meta analysis study showed patients
who are untreated with hypertension, they are at risk of developing chronic kidney diseases,
cardiovascular complications, and cerebrovascular complications (Butt Harvey, 2015). In one study,
mainly geriatric population who are taking atenolol had shown greater mortality rate and increase

Corporate Governance Convergence Practice in Japan
Corporate governance convergence practice in Japan Introduction In recent years, there are a number
of literatures with regard to the debatable and inevitable convergence in the corporate governance
practices (Yoshikawa Rasheed, 2009). In general, corporate governance convergence relate to the
models of corporate governance, in which merge in practices and theoretical views especially at
national or multinational level (West, 2009). West (2009) also stated that the completely convergence
which represent the differences between various countries would disappear and a universal corporate
governance would be used widely in the end. However, Hansmann and Kraakamn (2001) claimed that
the corporate laws and practices are all converging ... Show more content on Helpwriting.net ...
For example, the European Commission (EU) provides particular governance such as increasing of
shareholder s rights and better discourse for enhancement of corporate governance in European Union
(Aguilera Cuervo Cazurra, 2009). Basically, the convergence of corporate governance is seen as
increasing the isomorphism in the governance practices of public corporation from different country
(Yoshikawa Rasheed, 2009: p389). However, Yoshikawa et al. (2009) argued that such the definition
is quite general. There are several researches show that the clearer definition which divides the
convergence into two categories: Convergence in form and Convergence in function . Convergence in
form means the increasing of homogeneity in legal framework and institutions. Convergence in
function states that the different nations might have various rules and institutions, yet it could still
operate the similar functions such as guaranteeing fair disclosure and responsibility of managers.
(Gilson cited in Yoshikawa Rasheed, 2009: p389). Khanna et al. (2006) also divided the convergence
into de jure convergence and de facto convergence (Yoshikawa Rasheed, 2009). If there were two
countries which adopt similar corporate governance laws, it is called de jure convergence between
these two countries. Therefore, de facto convergence relate to the two countries whose actual practices

Introduction
Charges of workplace discrimination is said to be at an all time high. During the 2015 fiscal year the
U.S. Equal Employment Opportunity released information that claims there were more than 89,000
charges filed for workplace discrimination. One of the top ten charges is said to be retaliation, which
had an estimate 39,757 cases in 2015, which is 44.5 percent of all charges filed. Retaliation is said to
be in violation of the Title VII of the Civil Rights Act of 1964, For the purpose of this research paper I
will provide the understanding of both Acts, while also taking a case that deals with to provide the
basis of the case, the findings, and the outcome of the charges.

United States Code (Pub. L. 88 352) Volume 42.The basis of the act Title VII is to prevent
employment discrimination against race, color, religion, sex and national origin. Title VII prohibits an

Charles Darwin s Natural Selection Theory
Darwin did not publish his theory of evolution by natural selection until 1859. He was not the first,
however, to develop a theory of evolution. As scientists developed an increasing interest in the natural
world, it became evident to many influential thinkers of the late eighteenth century, such as the Comte
de Buffon and Jean Baptiste Lamarck that species changed gradually over time. While these prior
scientists had ideas on evolution, their theories were often misguided and failed to threaten the status
quo of society to any significant degree. Darwin s theory of evolution by natural selection, however,
created a greater controversy. Not only did Darwin provide a functioning method of change backed up
by copious amounts of scientific support, ... Show more content on Helpwriting.net ...
What set Darwin apart from his predecessors, however, was his theory of natural selection. Natural
selection is differential survival and reproduction. Those individuals that are best suited for their
environment will have the best chance of being preserved in the struggle for life and will survive to
produce offspring similarly characterised. Not only was his theory inspired by observations made
while he was on the HMS Beagle, Darwin was heavily influenced by Thomas Malthus and his An
Essay on the Principle of Population. Malthus states that population, when unchecked, increased in a
geometrical ratio, and subsistence for man in an arithmetical ratio. Since resources are limited, a
struggle for existence would inevitably ensue as individuals competed over available resources. There
must be a strong and constantly operating check on population from the difficulty of subsistence. In a
struggle for survival, those individuals most fit for their environment would outcompete those less fit.
Malthus essay became essential for Darwin s understanding of natural selection. Furthermore,
variation in individuals, Darwin determined, was largely due to random chance. Darwin did not
believe, like Lamarck, that evolutionary change had an end goal in mind. Evolution did not always
select for the most complex organism. This idea threatened the Christian world. If variation was
random and there was no force directing evolution towards a specific goal, there was no room for
God. Natural selection was seen as a threat to religion. There was limited room for divine intervention
in Darwin s theory. Darwin himself, starting out as a firm believer in the supernatural, grew to be an
atheist by his death. However, despite protests by theologians, there was a significant amount of
empirical evidence backing up natural selection. For more than 10 years, Darwin

A few states call the SCHIP program by the term Children s Health Insurance Program .
The Affordable Care Act also known as Obamacare provides opportunities to boost and strengthen
children s healthcare coverage (Rudawitz, 2014). ACA requires states to improve coverage for
children by transitioning coverage for all children up to 133% Federal Poverty Line (FPL) to Medicaid
(Rudawitz, 2014). With enrollment increasing the CHIP program will need additional funding. If the
funding is reauthorized the program will have enhanced funding from 2016 2019. According to
Rudawitz the future of CHIP reauthorization will have important implications for children s coverage.
Funding for CHIP reauthorization will be challenging and more research will need to highlight
obstacles to coverage as well as changes in coverage between CHIP and the Marketplace to
understand the consequences tied to CHIP reauthorization.
CHIP focuses on low income children in working families who earn too much to qualify for Medicaid
but not enough to be able to purchase health insurance coverage on their own. CHIP s supporters
recognize the value of investing in children s coverage to make sure that all children have access to
medical care they need to grow up to become healthy and productive adults. CHIP has been
enormously successful, helping to reduce the number of low income uninsured children by a
remarkable 67.9%. (Shapiro, April 2016). The CHIP program gives families the

Enkidu And The Creation Of Gilgamesh
Enkidu is created for the sole purpose of distracting Gilgamesh. The Akkadian creation myth sets
mankind as a servant to the gods. Servant might not be the right term, though. Man was created less to
serve the gods, more to serve their will. This is not to demean man, but to bring man to an almost
godlike level without the belittling the gods. If man is more than just a servant to the gods, if he is a
necessary part of their primary goal, then man becomes a critical part in the system. Someone who is
part man and part god, however, would be occupy a much different role in the Summarian world view.
More than a simple servant, yet less than master, a partial god would be self serving. Acting as the
masters of their own fate, they would have ... Show more content on Helpwriting.net ...
Why then have the gods deemed it necessary to make Enkidu a guardian of nature? Returning tothe
idea that man is meant to serve the gods, what service does this do? This seems to hint that Enkidu is
self serving. He does what is right by his own terms: defending his family and habitat. A sense of
purpose, beyond what the gods prescribe, is a decidedly non human attribute.
Once Enkidu is corrupted by the outside world, he is unable to return, not because nature rejects him,
but because he rejects nature. This behaviour is patently non godlike, as it is a fundamental separation
from origin. The gods are defined by their creation and background. Enkidu is also mortal, which is
another attribute that excludes him from being a god. Enkidu was created in response to a request for
an equal of Gilgamesh. The gods seem to think this is a perfectly reasonable request because it is
granted without any further complications. Aruru, goddess of creation, then shapes a being out of clay,
granting it life, and qualities comparable to the gods.
This is not to say that Enkidu is a god, simply that the gods are reference points in his creation. The
more interesting part of Enkidu s creation is the material he is made of. In the original Akkadian
creation myth mankind was made from the blood of Kingu, god of unskilled labour and toil, and clay
from the earth. The gods are made of the mixing of fresh and salt water. This is an exceptionally
important difference, because it means that the

  • 2. Different Types Of Contracts And Contracts There are many different types of contracts and many different parts to a contract. Contracts are formal agreements between people or businesses. There are seven elements to a contract. The first is the offer which is the purposed deal. Next is the acceptance of the offer than consideration or bargaining of the offer. Legality is the next which means is the contract for a lawful purpose. Next is capacity are the parties adults of sound mind then consent of the contract. Lastly, writing some types of contracts must be in writing to be enforceable. There are two contract rules for governing the sales of goods and the sale of services. The Uniform Commercial Code (UCC) is the code used for the sales of goods. The sales of services uses common law to govern these contracts. UCC was first published in 1952, the drafters of this code wanted to facilitate the easy information and enforcement of contracts in a fast paced world. There are nine articles to the uniform commercial codes. Article one deals with the law of contracts and article nine deals with payment in security interest agreements. The most important article is article two which deals with the sale of goods. Goods are anything movable, except for money, securities and certain legal rights. Article two also states the rules for contract formation such as the firm offers, shipments of goods and modification of terms. Article two states the rule for contract repudiation and breach listing several ... Get more on HelpWriting.net ...
  • 3. Columbus Day Pros And Cons In modern day society, we often overlook key points in history. For example, Columbus Day, why do we celebrate it? Well, from one s point of view, we celebrate this holiday for several reasons, one of these reasons are because it recalls Christopher Columbus entry to the Americas on October 12, 1492. This occasion is questionable on the grounds that the European settlement in the Americas prompted the downfall of the history and culture, of the indigenous people groups. What are some of the pros and cons from naming Columbus Day to Indigenous Day? That is what you will learn in this essay. To start off, Indigenous People s Day, or Columbus Day, Which do you prefer? First off, why is it called Columbus Day ? Well, as stated earlier, it was named after Christopher Columbus, who as we believe today, discovered America. Many believe that it was him who founded the Americas, but really there could ve been earlier settlers or even Native Americans who lived on those territories before Columbus made his way there. What is a pro of having this day named after Columbus? A source I found called www.scholastic.com stated, The holiday honoring Christopher Columbus s sighting of America on October 12, 1492, is observed in the states of the United States and also in parts of Canada, in Puerto Rico, and in some cities in Italy and Spain. Although Columbus was not the first explorer to set foot in the Western Hemisphere, his landing at San Salvador Island in what is now the Bahamas was very important. It opened the way for the settlement of America by Europeans. So, basically we named this holiday after Columbus because it was assumed that he was one of the first to see and discover the Americas. Another source titled www.osia.org stated Columbus Day celebrates the beginning of cultural exchange between America and Europe. After Columbus, came millions of European immigrants who brought their art, music, science, medicine, philosophy and religious principles to America. From one s point of view, it may look like Columbus did many great things that led to the development of America. But no one really knows what was at stake because of Columbus decisions. A con relating to the naming of Columbus Day is in a ... Get more on HelpWriting.net ...
  • 4. Theories Of Evolution Of Psychology Ideas in psychology have been influenced by many fields of study ranging from philosophy to physics. Evolutionary ideas, themselves, have had a substantial role in shaping psychological thought. This paper will provide an overview of the influence of evolutionary thought on the field of psychology along with a discussion of the range of societal implications associated with evolutionary psychology. The influence of evolutionary ideas on psychology dates back to Charles Darwin, the man who proposed The Theory of Evolution by natural selection. Evolution theory suggests that organisms change with time to adapt to their environments. Those organisms best capable of surviving and making adaptations to their environment will have the most ... Show more content on Helpwriting.net ... The aforementioned influences eventually lead to the field of evolutionary psychology in which the common view is that both physical and mental organs developed through natural selection. Biases in how our brains perceive, process, and react to the world around us can either contribute to our survival or to the reason we die out . Such biases affect our social behavior and status, sexual selection, and gender relations (Wright, 2010). Presently, evolutionary psychology has become an interest in popular culture which in turn influences the subject matter studied in this field. It provides plausible reasons for an array of human behaviors which sparks interest. People want to know why men have aggressive tendencies or why some will risk their lives to help those with no benefit to themselves. Survival of the fittest has become a commonly used phrase and Charles Darwin is no secret. Evolutionary psychology raises the idea that personality and behavior are mediated by evolutionary forces. This notion can have both positive and negative implications for society. It can provide a reason for why we love the people we love; but it can also provide an adaptive role for violent behavior. These ideas provide a rationale for our ability to think and reason. It makes us question our motives in certain situations like when we may act altruistically. This is reflected in society in many ways. For instance, consider the number of ... Get more on HelpWriting.net ...

  • 6. Role Of Weather In The Great Gatsby It s More Than Just Rain or Snow In reality the weather and environment play a part in how people interact with one another and in some cases it can even influence a person s mood. Therefore, weather also plays a similar role in literature as it does in reality. The only difference is that in literature the significance of weather impacts the story more and has much sub contextual meaning than what is just portrayed on the surface level. Within different stories different types of weather can symbolize different things. In the novel, The Great Gatsby by F. Scott Fitzgerald, Fitzgerald uses fog to serve as a symbol for Gatsby s and Daisy s relationship. His choice for using fog as a symbol of their relationship is because it obscures Gatsby s vision of the green light on Daisy s house which, for Gatsby, it acts as a beacon letting him know where Daisy is. Also, it acts as a method of foreshadowment. Realistically, fog obscures one s vision and it renders the viewer blind to what s around them due to the fact that the fog encapsulates the person in a visual area that is generally only immediately in front of you. For example, the purpose of a lighthouse is to ... Show more content on Helpwriting.net ... As it relates to colleges and universities, true ethical issues consistently remain dormant in some cases (Wolfe Freeman, 2013). For example, Jackson (2001) stated that there is a small pool of qualified candidates to select from because of the percentage of degrees being awarded. For example, 2011, approximately 13% of earned doctorate were awarded to underrepresentation minorities (U.S. Department of Education, National Center for Education Statistics, 2012). Therefore, with these limited numbers the potential candidates are not available. Within my chosen field minorities involvement in agriculture remains limited. In addition, recent demographic trends estimate that ethnic minority populations are steadily increasing, and in some areas are reaching the tipping point to become the majority. For this reason, I am primarily interested in bringing more awareness in agricultural and extension education that focuses on diverse communities that are normally uninvolved in the opportunities in the agricultural industry. • 9. The Dividend Policy Puzzle INTRODUCTION Dividend payout ratio has been an issue of interest in daily financial literature. An example, many academicians and researchers have devoted their time to develop several theoretical models to provide some insights into the dividend policy puzzle. Dividend theories are developed with some of empirical support. Dividends is a payments made by a corporation to its shareholder members. It is the portion of corporate profits paid out to stockholders. When a corporation earns a profit or surplus that money can be locate by two uses. Which it can either be re invested in the business that called retained earnings or it can be distributed to all shareholders. There are two ways to distribute cash to shareholders, such as share repurchases or give dividends. Many corporations retain a portion of their earnings and pay the remainder as a dividend. Dividend also has been analyzed for many decades, but it is not universally accepted explanation for companies observed dividend behavior has been established. According to Brealey and Myers (2005) described that dividend policy as one of the top ten most difficult unsolved problems in financial economics. This description is consistent with Black (1976) who stated that: The harder we look at the dividend picture, the more it seems like a puzzle with pieces that don t fit together . • 10. Oscar Romero and the Role of the Catholic Church in El... The Role of Romero vs. the Catholic Church: The Salvadoran Civil War The tragedies of the civil war in El Salvador brought focus to the many issues of oppression, under representation, and inequality apparent amongst the Salvadoran working class during the later twentieth century. The outbreak of the war began much like civil wars in neighboring countries, consisting of the lower class demanding land and policy reformations, as elites feared the uprisings would result in socialist geared politics that jeopardized their status. Amidst the fighting between the two social classes, the Catholic Church, as a whole, maintained a somewhat neutrality status and refused to publically support one group over the other. Thus, much opposition to the ... Show more content on Helpwriting.net ... Author Edward T. Brett argues that Romero had a very prophetic approach [that] was a highly effective method of leadership during his three year tenure of office (Brett 717). He uses the term prophetic to refer to the similar ways in which Romero preached his sermons to the underprivileged campesinos in order to also publically represent them, much like Jesus preached to the poor to represent the persecuted Christians. However, the term itself can be problematic because also like Jesus, Romero was tormented by his fellow bishops for catering to the needs of the poor. Not all bishops and clergymen at the time had captured the essence of liberation theology teachings and feared they were too radical to preach to the campesinos. However, Romero believed that the equality of Salvadorans was more important than their integration into the elite society. He focused many of his preachings on the need to put an end to violence and determine a right from wrong. In Romero s last sermon, just before he called for soldiers to refuse to obey orders, (Wood 27) he gave special attention to the need to reinstall distinct human rights within a country in its own exodus (Romero 3) and that both groups alike should call for, respect for the dignity of the person, hope for humanity s common good, and the transcendence that look before all to God and only ... • 12. American History And Its Impact On The West And Distant... Unsurprisingly, many historic cultures have not been accurately studied in modernity. Due to personal biases, incomplete data, or a multitude of other issues, incorrect perceptions about these collapsed societies remain. However, modern studies are beginning to reveal the inaccuracies of those enduring, false notions. It is valuable to compare misunderstandings to the historic reality in addition to discovering why the past happened as it did. Although newer, more factual information will not erase long taught misconceptions about collapsed societies like Jamestown, El Dorado, or the Norse Greenlanders, it provides the chance to better understand historic events in an effort to help guide decisions that could affect the near and distant future. Jamestown has a permanently secured place in American history as the young country s first successful, permanent colony. When the Europeans arrived in 1606 with 104 men and boys hoping to find their riches in the New World, they found a largely empty landscape. Over the next few decades, the Jamestown people were able to thrive while the native populations were dying because the colonists had more advanced technology, Christianity, and European sensibilities. They were able to properly manage the empty, surrounding area, convert it to farmland, and grow highly profitable tobacco that helped spur further growth in what would become the US. However, it s reality tells a much different story. The first colonists arrived in March and by ... Get more on HelpWriting.net ...
  • 13. Investing Formative Classroom Assessments By my definition, a classroom assessment is a measuring tool used to guide instruction and learning on subsequent lessons to follow. It s an opportunity to evaluate how well your students are synthesizing information and applying it in the classroom. Keeley (2015) states that good assessment practices are integral to informing teaching and learning, as well as documenting and measuring student achievement. Examples of classroom assessments are broken into two categories; formative and summative. Summative have been traditionally a go to for teachers with tests, quizzes, and projects. Formative assessments are an informal evaluation or a checkpoint at which the teacher can use observation or short surveys to understand where their students stand with the curriculum. • 17. The Future of Education in America Public Policy Term Paper The Future of Education in America We are now taking the lead because for too long the public school system in Camden has failed its children , exclaimed Chris Christie, the standing Governor of New Jersey. On the one hand, The New Jersey Public School System was awarded number 1 as the best system in the nation by 2012 Education State Ranking (Morgan, 2011). Yet on the other, only 2 percent of the graduates from Camden High School scored high enough on the SAT s to be considered college prepared. This blatant inconsistency echoes the hyper polarization of wealth and indigence throughout not only the state of New Jersey, but also the country as a whole. In response to this crisis, NJ s Governor Christie has proposed the Opportunity Scholarship Act, which would stimulate competition between schools and in turn boost the quality of education. The act would create this competitive open market by providing scholarship funds to eligible low income children who attend a chronically failing school district in order for them to choose to attend an alternative public or non public school. Before thoroughly examining Christie s OSA, it is necessary to zoom out and discuss the importance and advantage of scholastic development. • 18. Alternative Energy Sources Of Fossil Fuels Since the Industrial Revolution in 1760, the world has run on fossil fuels. Fossil fuels are critical to global energy infrastructure due to their inherent advantages and generate significant economic value as a result. However, the negative economic and environmental implications of fossil fuels demands a permanent transition towards alternative energy. The world will continue to investigate alternative energy sources and must commit to them to avoid long term environmental degradation. Ultimately, fossil fuels are on the way out, but considerable work must be done before this forecast can be realized. Fossil fuels are an energy source derived from organic material that has decomposed over the course of millions of years. Millennia ago, plants and animals died, quickly becoming buried under layers upon layers of sedimentary material. The earth covering the remains of these organisms created a unique environment of high pressure and high temperature, until they formed valuable hydrocarbons which have countless applications for the energy industry (7). The main types of fossil fuels are oil, natural gas, and coal, which each formed under a different set of conditions. Oil and natural gas are primarily derived from compacted aquatic organisms, with natural gas simply being cooked longer than oil has been. This differs from coal, which formed from primarily plants that were buried under hundreds of layers of sediment (7). Fossil fuels are not cherished by humans for simply ... The narrator s name remains a mystery, except for the fact that he is separated from his wife while at the same time he is not interested in his girlfriend (Verley 91). Verley thinks that Carver decided not to share any details of the narrator because he wants to escape his identity rather than reinforce it. Also, since there is no equivalent life force in the narrator s existence, this shows that he remains alone at the end, and thus making the claim that alcoholism is essentially inexplicable (Verley 91). There is an implicit comparison between the narrator and J.P and the narrator is constantly reminded of his personal adventures through Joe Penny s narration (Verley 91). Some people protest through writing. These writers protest using different literary devices, such as imagery, irony, and structure. War has unique touch to everyone s life who encounters this. Each individual deals with the effects of war in different ways. The authors Stephen Crane, Wilfred Owen, Tim O Brien, and Kevin Powers express their feelings by writing. Examining the difference between Southie and Chestnut Hill you can tell which class is poor and which class is rich. Through Good People , David Lindsay Abaire argues that rich people and poor people has a different life styles. This can be seen through his use of imagery, characterization and conflict. In this play, David Lindsay Abaire uses imagery to shows what type of life style that Southie and Chestnut Hill has. Firstly, Southie has many poor people and broken things around them. For example, Abaire shows how Southie s environment looks by the narration of the play, The alley behind the Dollar store. There s a dumpster back there and a rusty chair and a door labelled Dollar store (5). Another way, Chestnut Hill has many rich people and many expensive things. For example, Abaire narrates about Mikes house in details, Lights up on a beautiful home. The living room takes up most of the space. Up and left we may see part of a foyer that leads to the front door. Doorways and corridors lead off to other parts of the house the kitchen, the dining room, maybe we see a staircase that leads up to the bedroom (105). The author went into details to show how rich Mike is. Again, Abaire is showing us that anyone from Southie will try their luck to get more money. As scientists developed an increasing interest in the natural world, it became evident to many influential thinkers of the late eighteenth century, such as the Comte de Buffon and Jean Baptiste Lamarck that species changed gradually over time. While these prior scientists had ideas on evolution, their theories were often misguided and failed to threaten the status quo of society to any significant degree. What set Darwin apart from his predecessors, however, was his theory of natural selection. Natural selection is differential survival and reproduction. Those individuals that are best suited for their environment will have the best chance of being preserved in the struggle for life and will survive to produce offspring similarly characterised. Not only was his theory inspired by observations made while he was on the HMS Beagle, Darwin was heavily influenced by Thomas Malthus and his An Essay on the Principle of Population. Malthus states that population, when unchecked, increased in a geometrical ratio, and subsistence for man in an arithmetical ratio. Since resources are limited, a struggle for existence would inevitably ensue as individuals competed over available resources. There must be a strong and constantly operating check on population from the difficulty of subsistence. In a struggle for survival, those individuals most fit for their environment would outcompete those less fit. Malthus essay became essential for Darwin s understanding of natural selection. Furthermore, variation in individuals, Darwin determined, was largely due to random chance. Darwin did not believe, like Lamarck, that evolutionary change had an end goal in mind. Evolution did not always select for the most complex organism. This idea threatened the Christian world. If variation was random and there was no force directing evolution towards a specific goal, there was no room for God. Natural selection was seen as a threat to religion. There was limited room for divine intervention in Darwin s theory. Darwin himself, starting out as a firm believer in the supernatural, grew to be an atheist by his death. However, despite protests by theologians, there was a significant amount of empirical evidence backing up natural selection. For more than 10 years, Darwin ... Get more on HelpWriting.net ...

This seems to hint that Enkidu is self serving. He does what is right by his own terms: defending his family and habitat. A sense of purpose, beyond what the gods prescribe, is a decidedly non human attribute. Once Enkidu is corrupted by the outside world, he is unable to return, not because nature rejects him, but because he rejects nature. This behaviour is patently non godlike, as it is a fundamental separation from origin. The gods are defined by their creation and background. Enkidu is also mortal, which is another attribute that excludes him from being a god. Enkidu was created in response to a request for an equal of Gilgamesh. The gods seem to think this is a perfectly reasonable request because it is granted without any further complications. Aruru, goddess of creation, then shapes a being out of clay, granting it life, and qualities comparable to the gods.
