The genesis of the Exclusionary Rule can be traced in early 1900s. It was established to ensure
that law enforcement officers followed the law in collecting incriminating evidence. The
Exclusionary Rule was designed by the Supreme Court making it a court made rule. The rule is not
like other normal rules that are created by statutes passed by the legislative bodies. The essay will
outline how the Exclusionary Rulewas developed highlighting the various cases that proved pivotal
in its implementation. The essay will also outline the various limitations to the rule as well as the
general applicability of the rule in today s courts (Calabresi, 2003).
Before the development of the Exclusionary Rule, courts relied on every evidence presented by the
state in criminal cases. Admissibility of the evidence was dependent on its relevance irrespective of
the manner in which the evidence was collected. In 1914, the Supreme Court demanded that law
enforcement agencies must conform to the Fourth Amendment. In Weeks v. United Statesthe
Supreme Court ruled that evidence presented by the state was inadmissible. The basis of their
decision was based on the fact that evidence collected from Weeks was secured through a

Over the past decade there has been an epidemic on the rise. This epidemic is child obesity. We
spend millions of dollars each year trying to help or prevent the onset of obesity. Some of the
reasons are due to our youth consuming more processed foods and not being physically active.
