PROGRAM
WHAT IS ECP?
It is a government program designed to provide a
compensation package to public and private employees or
their dependents in the event of work-related sickness,
injury or death.

commence?
An employees’ coverage shall take effect ON
THE FIRST DAY OF EMPLOYMENT.
Where to File your Claim on the ECP Benefits?
• For injury, disease or death due to work-related contingencies, the ECP
benefits can be claimed from the Employees’ Compensation Commission's
(ECC) administering agencies-
(nearest to the place of work or residence)
* Government Service Insurance System (GSIS)
-public sector workers or
* Social Security System (SSS)
- private sector employees,
How can you avail of EC benefits?
Step 1
In case of injury, sickness, or death, the employee or
his dependents or anybody on his behalf, shall notify
his/her employer within five (5) days from the
occurrence of the contingency.
How can you avail of EC benefits?
After notifying his employer, the employee, his
dependents or his employer on his behalf, must file an EC
claim with the System within three (3) years
Step 2
How can you avail of EC benefits?
Step 3
The System shall evaluate the claim upon submission of
the complete requirements , and the decision denying or
awarding compensation will be made promptly.
a. If approved by the System, compensation is
awarded to the employee
b. In case the claim is denied, a Motion for Reconsideration
(MR) may be filed with the system, attaching additional
proofs to support claim.
c. If the MR is likewise denied, an appeal may be filed with
the ECC
Where can you File an Appeal when your case
was denied by the ECC?
Appeal may be taken to the Court of Appeals within
15 days from receipt of the decision of the Commission.
If denied, an appeal may be brought to the Supreme
Court
WHEN CAN YOU FILE YOUR CLAIM?
Claims for compensation must be filed with the
Systems (GSIS/SSS), within three (3) years from the
time the cause of action accrued.
WHEN CAN YOU FILE YOUR CLAIM?
However when a claim for SSS or GSIS
disability or death benefits for the same contingency
has already been filed with the Systems, the three (3)
year prescriptive period will no longer apply. The
claim for the same benefits under the EC law shall
be considered as filed.
When is the Reckoning Date of the 3-year
Prescriptive Period starts?
- from last confinement or from the last
time the employee was unable to report for
work due to sickness , whichever is applicable.
Temporary Total Disability (TTD) / Sickness Benefit
for multiple confinements due to the same illness

From the time the employee lost his earning capacity
(terminated or separated due to an illness)

What Can You Claim?
LOSS OF INCOME BENEFIT
A. Temporary Total Disability/ Sickness Benefit
For a disability that prevents an employee from performing his
work for a continuous period not exceeding 120 days.
90% of the employee’s average daily salary credit as
determined by the Systems, which shall not be more than ₱ 200.00
per day
What Can You Claim?
Loss of Income Benefit
B. Permanent Total Disability (PTD)
- a monthly income benefit granted for disabilities,
such as, but not limited to, complete loss of sight of both eyes,
loss or function loss of limbs, brain injury resulting to imbecility
or insanity.
The amount of monthly income benefit for PTD shall be
determined by the Systems based on the average monthly salary
credit or average monthly compensation.
What can you claim?
•Permanent Partial Disability (PPD). A monthly income benefit
is granted for disabilities that result in physical loss (amputation)
or functional loss of a body part.
• A lump sum or a monthly pension for PPD shall be granted, the amount of
which shall be determined by the Systems based on the AMSC/AMC.
• The number of monthly pensions is based on the corresponding body part loss or
functional loss, as provided under Art. 193 of P.D. No.626, as amended and
EC schedule of compensation.
What can you claim?
• 2. Carer’s Allowance
• A supplemental pension of P575 per month for
pensioners in the private and public sector who suffer from
work-connected Permanent Partial and Permanent Total
Disabilities.
What can you claim?
• 3. Medical Benefits
• Include reimbursement of the cost of medicines for the
illness or injury, payment to providers of medical care,
hospital care, surgical expenses, and the costs of
rehabilitation appliances and supplies. The medical services
are limited to ward services of hospitals duly accredited by
the Department of Health (DOH).
What can you claim?
• 4. Death and Funeral Benefit
•A monthly pension granted to beneficiaries of an
employee who dies as a result of sickness or
injury arising out of or in the course of
employment.
•Funeral benefit of P30,000.00.
What can you claim?
• 5. Rehabilitation Services
• Include physical restoration services, skills training
for re-employment or new employment and
entrepreneurship training by partner hospitals and
training centers to enable the persons with work
related disability to become more productive.
Compensability of Illness or Sickness
For an occupational disease and the resulting disability or
death to be compensable, ALL of the following
CONDITIONS must be satisfied:
1. The employee’s work and /or the working conditions
must involve risk/s that caused the development of the illness.

2. The disease was contracted as a result of the
employee’s exposure to described risks;
3. The disease was contracted within a period of
exposure and under such factors necessary to contract it;

4. There was no deliberate act on the part of employee
to disregard the safety measures or ignore established
warning or precaution.
When is sickness considered compensable?
If the same is included in the ECC’s List of Occupational
Diseases and the conditions for its compensability are met.
If the conditions were not satisfied and/or the claimed ailment
is not included in the list,
* proof must be shown that the risk of contracting the
disease is increased by working conditions.
INCREASED RISK
If the illness is caused or precipitated by factors
inherent in the employee’s nature of work and working
conditions.
It does not include aggravation of a pre-existing illness.
Claimant must show proof of work-connection. The
degree of proof required varies on a case to case basis.
WORK-RELATED INJURIES
• For the injury and the resulting disability or death to be
compensable
-the injury must be the result of an accident arising
out of and in the course of employment
WORK-RELATED INJURIES
• The injury or the resulting disability or death sustained by
reason of employment are compensable regardless of the
place where the incident occurred, if it can be proven
that, at the time of the contingency, the employee was
acting within the scope of employment and
performing an act reasonably necessary or incidental
to it.
Injuries or death resulting from any of the
following shall also be compensable:
1. Injuries or death resulting from an accident which happened
at the workplace.
EXCEPT when the disability or death was caused by the
employee’s
* Intoxication
* willful intention to injure or kill himself or another , or
notorious negligence
Injuries or death resulting from any of the
following shall also be compensable:
2. Injuries resulting from an accident which happened while the
employee is performing his official function.
3. Injuries resulting from an accident which happened outside
of the workplace but while the employee is performing an
order from his superiors.
-Bureau/Travel Order, locator pass, or a pass for official business
Injuries or death resulting from any of the
following shall also be compensable:
• 4. Injuries resulting from an accident which happened
while going to or coming from the place of work.
• Provided that the act of the employee in going to, or coming
from, the workplace must have been a continuing act; that
he had not been diverted therefrom by any other activity ,
and he had not departed from his usual route to or from ,
his workplace.
Injuries or death resulting from any of the
following shall also be compensable:
• 5. Injuries resulting from an accident which happened
while ministering to personal comfort.
• 6. Injuries resulting from an accident while the employee
is inside the BFP shuttle bus, fire truck, ambulance, rescue
vans, and other BFP service vehicles.
7. Injuries resulting from an accident which occurred
during a BFP sponsored activity.
8. Death of an employee due to assault
- when the same occurred in the course of performance of
official functions
Motive of assault need not be established if the covered
employee sustained injury while he was at the assigned or designated
workspaces;
Motive is important in cases where the covered BFP employee
was on vacation leave, off-duty, or was at home when the incident
happened.
EXCEPTING CIRCUMSTANCES
No compensation shall be allowed in the following:
1. Intoxication
2. Notorious negligence
3. Willful Intent to Injure Oneself or another
MEDICAL SERVICES
The following are not included:
1. Extra charge for more comfortable accommodations such as private and
semi-private rooms.
2. Personal Comfort or convenience such as charges for the use of telephone,
radio or television.
3. Private duty nurses
Processing of EC Medical Reimbursement with
Previous PhilHealth and/or HMO Benefits
After the allowable HMO and/or PhilHealth benefits, if any,
have been completely exhausted for a particular confinement or
consultation, only out of the pocket expenses of the employee with
work- related sickness or injury shall be the subject of claim for EC
medical reimbursement.

XII. EC LOGBOOK/NOTICE REQUIREMENT
… Provincial …, all City and Municipal fire stations shall keep an
EC Logbook to record chronologically the sickness, injury or death of
their personnel, dates, places and nature of contingency and
absences.
