Employees Compensation Commissions
HISTORY
The ECC is a government corporation. It is attached to the Department of Labor and Employment for
policy coordination and guidance.
It is a quasi-judicial corporate entity created to implement the Employees’ Compensation Program
(ECP). The ECP provides a package of benefits for public and private sector employees and their
dependents in the event of work-connected contingencies such as sickness, injury, disability or death.
As implementor of the Employees Compensation Program, ECC is mandated by law to provide
meaningful and appropriate compensation to workers. Its main functions are:
To formulate policies and guidelines for the improvement of the employees’ compensation program;
To review and decide on appeal all EC claims disapproved by the Systems; and
To initiate policies and programs toward adequate occupational health and safety and accident
prevention in the working environment
MISSION
1. To develop and implement effective OSH policies and programs for
the promotion of a healthy working population, safe working
environment and prevention of work-related contingencies;
2. To promptly provide workers and/or their dependents with
adequate benefits and services in the event of work-connected
injury, illness and death;
3. To manage a sound, strong, viable, and wisely invested State
Insurance Fund.

THE ECC. The Employees’ Compensation Commission (ECC)
was created in November 1, 1974 by virtue of Presidential
Decree (PD) 442 or the Labor Code of the Philippines and
became fully operational with the issuance of PD No. 626
which took effect on January 1, 1975. ECC is a quasi-judicial
corporate entity created to implement the Employees’
Compensation Program (ECP) that provides a package of
benefits for public and private sector employees and their
dependents in the event of work connected contingencies
such as sickness, injury, disability or death.
As implementor of the ECP, ECC is mandated by law to provide
meaningful and appropriate compensation to workers and its main
functions are:
To formulate policies and guidelines for the improvement of the
ECP;
To review and decide on appeal EC claims disapproved by the
Systems (SSS and GSIS); and
To initiate policies and programs toward adequate occupational
health and safety and accident prevention in the working
environment.
The ECC is attached to the Department of Labor and
Employment (DOLE) for policy and program coordination. As
such, the Secretary of Labor and Employment chairs the
seven-member Commission composed of the heads of the
Social Security System (SSS) and the Government Service
Insurance System (GSIS), the Chairperson of the Philippine
Health Insurance Corporation (PhilHealth), and the ECC
Executive Director, all ex-officio members, and two members
representing the employers’ and employees’ sectors
appointed by the President of the Philippines.
THE POWERS AND FUNCTIONS OF THE
COMMISSION.
Article 177 of P.D. 626, as amended, states the
twelve (12) powers and duties of the Commission
as follows:
1. To assess and fix the rate of contribution from all
employers;
2. To determine the rate of contribution payable by an
employer whose records show a high frequency of work
accidents or occupational diseases due to failure by the
said employer to observe adequate safety measures;
3. To approve rules and regulations governing the processing
of claims and the settlement of disputes arising therefrom as
prescribed by the System;
4. To initiate policies and programs toward adequate
occupational health and safety and accident prevention in
the working environment, rehabilitation and other related
programs and activities;
5. To make the necessary actuarial studies and
calculations concerning the grant of constant help
and income benefits for permanent disability or
death, and the rationalization of the benefits for
permanent disability and death and to upgrade
benefits and add new ones subject to the approval
of the President, provided such increases in
benefits shall not require any increases in
contribution;
6. To appoint the personnel of its staff, subject to the Civil
Service law and rules;
7. To adopt annually a budget of expenditures of the
Commission and its staff chargeable against the SIF;
Provided, that the SSS and the GSIS shall advance on a
quarterly basis the remittances of allotment of the loading
fund for the Commission's operational expenses based on its
annual budget as duly approved by the DBM;
8. To have the power to administer oath and
affirmation, and to issue subpoena duces tecum
in connection with any question or issue arising
from appealed cases;
9. To sue and be sued;
10. To acquire property, real or personal, which may be
necessary or expedient for the attainment of the purposes of
the law;
11. To enter into agreements or contracts for such services
or aids as may be needed for the proper, efficient and stable
administration of the program; and
12. To perform such other acts as it may deem appropriate
for the attainment of the purposes of the Commission.
COVERAGE.
The ECP covers only the formal sector workers, specifically
the paying members of the Social Security System (SSS) and
the Government Service Insurance System (GSIS) as well as
the members of the Judiciary, Philippine National Police,
Armed Forces of the Philippines and Bureau of Jail
Management and Penitentiary. Also covered are Filipino
seafarers compulsorily covered under the SSS. Land-based
contract workers are only subject to coverage under the ECP
if their employer, natural or juridical, is engaged in any trade,
industry or business undertakings in the Philippines.
BENEFITS.
The compensation which a claimant may receive for a work-connected
injury, sickness, disability or death are in the following forms:
Cash Income Benefit - for disability or death;
Medical and related services - for injury or sickness; and
Rehabilitation services (in addition to monthly cash income
benefit) for permanent disability.
To be more specific, the benefits given to the employee or his dependents are in the form
of:
Daily cash income benefit for temporary total disability (TTD);
Monthly cash income benefit for permanent total disability (PTD) on a lifetime basis;
Monthly cash income benefit for permanent partial disability (PPD);
Monthly cash income benefit for death, also on lifetime basis, except for benefit paid
to secondary beneficiaries, which is a monthly pension not to exceed 60 months but
not less than fifteen thousand pesos (P15,000.00);
Medical services, appliances and supplies for injury or sickness;
Rehabilitation services for permanent disability; and
Career's allowance for permanent disability.

Who are covered under the Employees’
Compensation Program?
1.Private sector workers who are compulsory members
of the Social Security System (SSS) and sea-based
Overseas Filipino Workers (OFWs).

Philippines, elective government officials who are

When shall coverage of the employees

Program start?
1.Employees shall be covered starting on the
first day of their employment.
When is sickness or injury compensable
under the Employees’ Compensation
Program?
For the sickness and the resulting disability or death to be
compensable, the sickness must be the result of an
occupational disease listed under Annex “A” of the
Amended Rules on Employees’ Compensation with the
conditions set therein satisfied, otherwise, proof must be
shown that the risk of contracting the disease is increased
by the working conditions.
For the injury and the resulting disability or death to be
compensable, the injury must be the result of accident
arising out of and in the course of the employment.
Occupational and Work-Related Diseases Nature of Employment
Cancer of the epithelial lining of the bladder.
(Papilloma of the bladder).
Work involving exposure to benzidine or any part of
the salts; and auramine or magenta.
Occupational Hearing Loss Exposure in the workplace to harmful noise levels
in the higher frequencies.
Dermatitis due to irritants and sensitizers The use or handling of chemical agents which are
skin irritants and sensitizers.
. Ionizing radiation disease, inflammation,
ulceration or malignant disease of skin or
subcutaneous tissues of the bones or leukemia, or
anemia of the aplastic type due to xrays, ionizing
particle, radium or other radioactive substances.
Exposure to X-rays, ionizing particles of radium or
other radioactive substances or other forms of
radiant energy.
Poisoning All work involving exposure of the risk concerned.

What are the benefits under the
Employees’ Compensation Program?
The benefits are the following:

In case an employee dies, who shall receive
the income benefits to which he is entitled to?
His/her beneficiaries.
Who are the employees’
beneficiaries?
The beneficiaries shall be either primary or secondary,
and determined at the time of employee’s death.
The following beneficiaries shall be considered
primary:
a.The legitimate spouse living with the employee at the
time of the employee’s death until he remarries; and
The following beneficiaries shall be considered
secondary:
The legitimate parents wholly dependent upon the
employee for regular support;
The legitimate descendants and illegitimate children who
are unmarried, not gainfully employed, not over 21 years
of age, or over 21 years of age provided he is
incapacitated and incapable of self-support due to
physical or mental defect which is congenital or acquired
during minority.
Primary beneficiaries shall have priority claim to death
benefits over secondary beneficiaries. Whenever there
are primary beneficiaries, no death benefit shall be paid
to his secondary beneficiaries.
When shall EC claims be filed?
EC claims must be filed within a period of three
years from:
•In case of sickness, from the time the employee
was unable to report for work;
•In case of injury, from the time of the incident;
•In case of death, from the date of death.
Where are EC claims filed?
All EC claims may be filed by the claimant at
his option in the GSIS Regional Office (for the
public sector) or SSS Branch (for the private
sector) nearest to his place of work or
residence.
What are the benefits and Services
of the KaGabay program?
1.Physical restoration which refers to the provision of
physical or occupational therapy services to ODWs
including medical appliances.
2.Skills Training for re-employment so that the ODW can
acquire new skills but subject to the ODWs potentials and
residual functional capacity.
3.Entrepreneurial Training to accredited training institutions
to enable the ODW to set up home-based business.
Who is entitle to Funeral
Benefit?
A funeral benefit of Twenty Thousand pesos (P20,000.00) shall be paid upon the death of
a covered employee or permanently totally disabled pensioner to one of the following:
the surviving spouse; or
the legitimate child who spent for the funeral services; or
any other person who can show incontrovertible proof or proof of his having borne the
funeral expenses. (ECC Resolution No. 3682, July 21, 1987).
Funeral benefit was increased to Twenty Thousand Pesos (as provided under Executive
Order No. 167, dated
May 26, 2014, in relation to Board Resolution Nos. 14-06-29 and 14-06-30, both dated June 6,

On 26 May 2014, President Benigno Simeon Aquino III issued
Executive Order 167 which approved the increase of
Employees’ Compensation Funeral Benefit from Php10,000 to
Php20,000 for both the employees in the private and public
sectors and a 10% across-the-board increase in EC pension for
all EC permanent partial disability, permanent total disability
and survivorship pension in the private sector.
In 2017, the EC funeral benefit was further increased to
P30,000 by virtue of EXECUTIVE ORDER NO. 33 s. 2017 signed
by President Rodrigo Roa Duterte.
What is the ECC’s KaGabay
Program?
The Employees’ Compensation Commission Katulong at
Gabay sa Manggagawang may Kapansanan or KaGabay
Program is a special economic assistance program for
occupationally-disabled workers (ODWs) who lost
employment by reason of work-related sickness or injury.
What if my EC claim was denied
at the GSIS or the SSS?
He/she may file a request for reconsideration with
the GSIS or SSS main office. If still denied, the
claimant can write a letter of appeal to the
Employees’ Compensation Commission.
