For Drivers
Drug and alcohol prohibitions
• Do not consume alcohol:
– While performing safety-sensitive functions
– During the 4 hours
before performing
safety-sensitive
functions
– In any company Vehicle at any time
– during the 8 hours following an accident, or until
a post-accident test is
completed

Drug and alcohol prohibitions
• You may not:
– Report for duty or remain on duty
to perform safety-sensitive
functions with an alcohol
concentration
of 0.04 or greater
– Refuse to take a breath alcohol
test

• You may not:
– Use any drug, except by doctor’s prescription
– Test positive for any illegal drugs
– Refuse to take a required test
– Have an adulterated or substituted test
speciment

• Driver must be notified of test prior to testing
• Driver must submit to testing
before performing
any safety-sensitive
function

• Company must receive a verified negative test
result before driver can operate a company
vehicle.

Post-accident testing
• Alcohol testing is required when:
– There is a fatality
– The driver receives a
citation within 8 hours
• and any vehicle involved
must be towed
• and any person involved in the accident receives an
injury requiring treatment away from the scene

citation within 32 hours
• and any vehicle involved
must be towed
• and any person involved in the accident receives an

• Driver must remain available for testing after an
accident
• Driver must refrain
from consuming
alcohol for 8 hours
after the accident or
until a test is
performed

Random testing - Alcohol
• The alcohol testing rate is 10 percent of the
average number of driver positions
• A driver may only be tested for alcohol
during, just before, or just after performing
safety-sensitive
functions

• The drug testing rate is 50 percent of the
average number of driver positions
• Drug testing may be
performed at any time
the driver is at work

• Selection must be made by a scientifically
valid method:
– Random number table
– Computer based
random number
generator

• Random tests are unannounced
• Testing dates will be spread reasonably
throughout the year
• When notified, the driver must
immediately proceed to the testing site

Reasonable suspicion testing
• Driver must submit to alcohol and/or drug
test when supervisor or company official has
reasonable suspicion
to believe the driver
is using alcohol
and/or drugs

• Alcohol testing:
Observations must be
made during, just before,
or just after the driver
performs safety-sensitive
functions

• Drug testing: Any time reasonable suspicion
exists while the driver is on duty

Return-to-duty
and follow-up testing
• A driver who fails an alcohol or drug test must
undergo a return-to-duty test with an alcohol
result of less than 0.02 and/or a negative drug
test
• A driver is subject to at least six unannounced
follow-up tests in the first 12 months after the
failed test
• Follow-up testing can be conducted for up to
60 months

in a private setting

– Identification
– Explanation of testing procedure
– Completion of testing form

– If you’re under .02 BAC, you’re good
– Sign & date the form
– If you’re over .02…
• Confirmation test
– Follow tech’s instructions

• Integrity of specimen is crucial
• All handling and storage must be tracked
– Custody control form

– Wash hands
– Select wrapped/sealed container
– Provide specimen

• Collector must inspect specimen for
tampering
– Unusual color
– Foreign objects
– Unacceptable temperature
• If there are signs of tampering a new
collection must be done with observation

• Collector must follow specific procedure when
preparing specimen for testing
– Check box for split specimen
– Split the specimen
– Secure lids/caps on containers
– Seal bottles
– Driver must initial & date the seals

• Lab tests for five substances:
1. Marijuana
2. Cocaine
3. Amphetamines
4. Opiates
5. Phencyclidine
(PCP)

• If initial test is positive confirmation test is
performed
• Only samples confirmed positive are reported
as positive
• If test is positive MRO will discuss with driver

• All drug and alcohol records must be kept in a
secure location with controlled access
• All drivers must
request their
records in writing

• All CDL holders who operate a
commercial motor vehicle are subject
to part 382

– Essentially, if you are on the road and under dispatch
• Prohibited driver conduct
– No alcohol in Vanquish vehicles
– No drug use. Period.

driver will be tested

– Return-to-duty

Drugs and alcohol

  • 2. Drug and alcohol prohibitions • Do not consume alcohol: – While performing safety-sensitive functions – During the 4 hours before performing safety-sensitive functions – In any company Vehicle at any time – during the 8 hours following an accident, or until a post-accident test is completed 2a
  • 3. Drug and alcohol prohibitions • You may not: – Report for duty or remain on duty to perform safety-sensitive functions with an alcohol concentration of 0.04 or greater – Refuse to take a breath alcohol test 2b
  • 4. Alcohol and drug prohibitions • You may not: – Use any drug, except by doctor’s prescription – Test positive for any illegal drugs – Refuse to take a required test – Have an adulterated or substituted test speciment 2d
  • 5. Pre-employment drug testing • Driver must be notified of test prior to testing • Driver must submit to testing before performing any safety-sensitive function 3a
  • 6. Pre-employment drug testing • Company must receive a verified negative test result before driver can operate a company vehicle. 3b
  • 7. Post-accident testing • Alcohol testing is required when: – There is a fatality – The driver receives a citation within 8 hours • and any vehicle involved must be towed • and any person involved in the accident receives an injury requiring treatment away from the scene 4a
  • 8. Post-accident testing • Drug testing is required when: – There is a fatality – The driver receives a citation within 32 hours • and any vehicle involved must be towed • and any person involved in the accident receives an injury requiring treatment away from the scene 4c
  • 9. Post-accident testing • Driver must remain available for testing after an accident • Driver must refrain from consuming alcohol for 8 hours after the accident or until a test is performed 4e
  • 10. Random testing - Alcohol • The alcohol testing rate is 10 percent of the average number of driver positions • A driver may only be tested for alcohol during, just before, or just after performing safety-sensitive functions 5a
  • 11. Random testing - Drugs • The drug testing rate is 50 percent of the average number of driver positions • Drug testing may be performed at any time the driver is at work 5c
  • 12. Random testing • Selection must be made by a scientifically valid method: – Random number table – Computer based random number generator 5d
  • 13. Random testing • Random tests are unannounced • Testing dates will be spread reasonably throughout the year • When notified, the driver must immediately proceed to the testing site 5e
  • 14. Reasonable suspicion testing • Driver must submit to alcohol and/or drug test when supervisor or company official has reasonable suspicion to believe the driver is using alcohol and/or drugs 6a
  • 15. Reasonable suspicion testing • Alcohol testing: Observations must be made during, just before, or just after the driver performs safety-sensitive functions 6b
  • 16. Reasonable suspicion testing • Drug testing: Any time reasonable suspicion exists while the driver is on duty 6c

Return-to-duty and follow-up testing • A driver who fails an alcohol or drug test must undergo a return-to-duty test with an alcohol result of less than 0.02 and/or a negative drug test • A driver is subject to at least six unannounced follow-up tests in the first 12 months after the failed test • Follow-up testing can be conducted for up to 60 months 7a

  • 20. Drug testing procedures • Testing is done by analyzing a urine sample • Integrity of specimen is crucial • All handling and storage must be tracked – Custody control form 9a

  • 23. Drug testing procedures • Collector must inspect specimen for tampering – Unusual color – Foreign objects – Unacceptable temperature • If there are signs of tampering a new collection must be done with observation 9d
  • 24. Drug testing procedures • Collector must follow specific procedure when preparing specimen for testing – Check box for split specimen – Split the specimen – Secure lids/caps on containers – Seal bottles – Driver must initial & date the seals 9e
  • 25. Drug testing procedures • Lab tests for five substances: 1. Marijuana 2. Cocaine 3. Amphetamines 4. Opiates 5. Phencyclidine (PCP) 9f
  • 26. Drug testing procedures • If initial test is positive confirmation test is performed • Only samples confirmed positive are reported as positive • If test is positive MRO will discuss with driver 9g
  • 27. Retention of test results • All drug and alcohol records must be kept in a secure location with controlled access • All drivers must request their records in writing 10
