from the employer if, as determined by DOLE, an imminent danger
situation exists.

determination and without fear of reprisal, implement a work stoppage

All employers, contractors or subcontractors, if any, shall
submit to DOLE all safety and health reports, and
notifications suchasbutnotlimited to:

• annual work accident/injury exposure data report
(AEDR).
All establishments, projects, sitesandall other placeswhereworkisbeing
undertaken shall have the following free welfare facilities in order to
ensurehumane workingconditions:
a) Adequatesupplyofs

b) Adequatesanitaryandwashingfacilities;
c) Suitablelivingaccommodation for workers,a

All employers, contractors or
subcontractors, if any, shall comply
with other occupational safety and
health standards a

the 1g78 DOLE Occupational Safety
andHealth Standards, a
samended.
The total cost of implementing a duly
approved OSH program shall be an
integral partof theoperations cost.
It shall be separate pay item in
construction and in all contracting or
subcontractingarrangements.

WORKERS' RIGHT 0 R E T U R NUNSAFE W O R K N The worker has the right of refusal to work without threat or reprisal from the employer if, as determined by DOLE, an imminent danger situation exists. N A s a preventive measure, the safety officer may, following his/her own determination and without fear of reprisal, implement a work stoppage or suspend operations inc a s e sof imminent danger. N The employer or safety officer cannot require the workers to return to work where there is a continuingimminent danger.
  • 16. N Workers a n d their representatives shall h a v e the right t o report accidents, dangerous occurrences, and hazards to the employer, to DOLE and to other concerned competent government agencies. Reporting of accidents to DOLE may be made through any m e a n s of communication, including t he D O L E hotline, whichever i s most convenient to the worker. T h e s a m e m a y b e reported to the nearest DOLE Regional, Field, Provincial or Satellite Office having jurisdiction over theplaceoftheincident.

W O R K E R S ' RIGHT T O P E R S O N A LP R O T E C T I V E E Q U I P M E N T (PPE) Every employer, contractor or subcontractor, if any, s h a l l p r o v i d e his/her w o r k e r s , FREE OF CHARGE, P P E for any part of the body that may be exposed to hazards of causing injury or impairment in the function of any part of the body through absorption, inhalation orphysical contact.

S A F E T YS I G N A G E ANDD E V I C E S All establishments, projects, sites and all other places where work i s being undertaken shall have safety signage a n d devices to warn the workers and the public of the hazards in theworkplace. S a f e t y s i g n a g e a n d d e v i c e s s h a l l b e p o s t e d in prominent positions a t strategic locations in alanguageunderstandabletoall.
  • 19. U Theestablishment shall submit acopy of the OSHprogram to theDOLE Regional, Provincial, Field or SatelliteOfficehaving jurisdiction overtheworkplace. N The company shal! review and evaluate the OSH program at least once a year or a snecessary, to ensurethatitsobjectives aremettowards animprovedsafety andhealthperformance. N A duly signed company commitment to comply OSH requirements together with the company OSH program using the prescribed template shall be considered approved upon submission E X C E P T for Construction SafetyandHealthProgramwhichshallneedapproval byDOLEprior toconstruction. N O S H programs in the p r e approved template m a y be modified by D O L E a s neces s ary based on existing laws, rules a n d regulations, a n d other i s s u a nc e s or upon validation of the program during inspection.

O C C U P A T I O N A L S A F E T Y A N DH E A L T HR E P O R T S All employers, contractors or subcontractors, if any, shall submit to DOLE all safety and health reports, and notifications suchasbutnotlimited to: R E P O R T • annual medical report (AMR), • OSHcommittee report • employer's work accident/injury report(WAIR), and • annual work accident/injury exposure data report (AEDR).
  • 34. All establishments, projects, sitesandall other placeswhereworkisbeing undertaken shall have the following free welfare facilities in order to ensurehumane workingconditions: a) Adequatesupplyofs a f edrinkingwater; b) Adequatesanitaryandwashingfacilities; c) Suitablelivingaccommodation for workers,a sm a ybeapplicable s u c h a sinconstruction, shipping, fishingandnightworkers; d) Separate sanitary, washing and sleeping facilities for all gender, a s m a ybeapplicable; e) Lactation station except those establishments a sprovided for under D O L EDepartment OrderNo. 4 g y; f) Ramps,railingsandthelike;and g) Other workers' welfare facilities a s m a y be prescribed by the O S H standards andother issuances.
  • 35. All employers, contractors or subcontractors, if any, shall comply with other occupational safety and health standards a s provided for in the 1g78 DOLE Occupational Safety andHealth Standards, a samended.
  • 36. The total cost of implementing a duly approved OSH program shall be an integral partof theoperations cost. It shall be separate pay item in construction and in all contracting or subcontractingarrangements.
  • 37. E M P L O Y E R ’ S RESPONSIBILITY ANDLIABILITY T h e employer, project owner, contractor, or subcontractor, if any, a n d a n y person w h o m an a g e s , controls o r supervises the work being undertaken shall be jointly and solidarily liable for compliance with occupational safety a n d health standards including the penalties imposed for violation thereof a s provided for in this Rules.
  • 38. -- Department Order No. 18g, Series of 2017 and the manual on execution of judgments shall govern the procedures in the conduct of inspection, mandatory conference, Issuance of order andexecution thereof. INCENTIVES T OE M P L O Y E R S ANDW O R K E R S There shall be established package of incentives under s u c h rules a n d regulations a s m a y b e promulgated b y the D O L E to qualified employers and workers to recognize their efforts towards ensuring compliance with O S H a nd general labor standards s u c h a s O S H training packages, additional protective equipment, technical guidance, recognition awardsandother similar incentives.
