Maqasid as-Shariah is very important subject in understanding the whole picture of Islamic law. Without the knowledge about maqasid as-Shariah, people will not be able to see the beautiful of Islam as it has been described in the Quran as the rahmah or mercy to the universe. Maqasid as-Shariah shows that every single law or regulations in the Islamic teaching are meant for the benefit of the whole universe since Islam was revealed to the universe. Shari'ah aims at the welfare of the people in this life and in the life hereafter, and for this purpose it has advised people to adopt such means and measures that may give advantage benefit/well-being to them and may ward off evil/injury/loss, from them.
Maqasid al-Shari'ah comprises those benefits/welfare/advantages behind the revelation of Islamic Laws.
It aims at the attainment of good, welfare, benefits, and warding off evil, injury, loss, etc. for the creatures. (All this in Arabic terminology can be stated as Masalih al-'Ibad.)
Many jurists have tried to explain the aims and objectives of Shari'ah upon which it is established.
Among the outstanding figures are the Malikite Abu Ishaq al-Shatibi, the Shafite al-'Izz ibn 'Abd aI-Salam, and the Hanbalite Ibn Qayyim al-Jawiziyyah.

Taqleed – following a specific legal school, has been a topic of extreme controversy. Amongst the leading figures to critically write on this subject extensively was Imam Ibn Qayyim al-Jawziyyah (RA). He proposes the argument that it is necessary for every Muslim to primarily adhere to the scripture, Qur’an and Sunnah. Hence, those who strictly follow a particular legal school are in fact preferring a madhab over scriptures, which is tantamount to those of following their fore fathers, as condemned in the Qur’an. Superficially, it appears to be a valid argument but is it necessarily true that following a legal school results in abandoning or preferring it over scriptures? What is the need of scholars of great calibre adhering to one of the legal schools in the first place? Is it possible for every person to distinguish between authentic and non-authentic Hadeeth? Published classroom materials form the basis of syllabuses, drive teacher professional development, and have a potentially huge influence on learners, teachers and education systems. Knowledge and skills frameworks, generally called competency frameworks, for ELT teachers, trainers and managers have existed for a few years now. The Qur’an was revealed over two periods which are known as Meccan
and Medinan.
Medinan period predominately contain ayahs of a political, social and legal
character.

12. Definition of Hadis
Definition: Hadith is the Prophet Muhammad's behavior whether it be a word, act, or
resolution (taqrir).
Hadith is the second source of Islamic law after the Qur'an.
Function of hadith:
• To clarify details of general statement in the Qur'an
• To make it specific and particular example: in Ibadah solat, puasa, zakat,
• To explain the instructions of the Qur’an
Shabbir opines that Hadith might be transmitted in the following three forms:
1. Qawl, which means all the sayings and the utterances of the Prophet Muhammad
2. F’al, which denotes the actions and daily practices of the Prophet Muhammad
3. Iqrar, which denotes the tacit approval on the part of the Prophet of acts done and
practices carried on by his followers.

Shabbir further states that Hadiths have been classified according to their
origin, degree of authority and reference to persons.
In respect of origin, the Hadiths are classified into kudsi and nabi Hadiths.
Kudsi generally denotes the Hadith, which had been uttered by Prophet under divine
inspiration.
Nabi denotes the Prophet’s uninspired opinion or judgment.
In respect of the degree of authority, to classify the Hadiths into the following:
1. Mutawatir (continuous), has an imperative character in that it bears a binding and
decisive personality.
2. Mashhoor (well known), have been derived from the knowledge of the majority but is
not universally adopted and has a lesser degree of legal enforcement in comparison with
mutawatir.
3. Ahad denotes those Hadith which are known to isolated individuals and have no value in
the sense of legal enforcement

4. Shohih hadith, hadith is narrated by Rawi fair, perfect memory, the chain is connected, no air illat, and not awkward. Illat
hadith in question is a vague illness that can tarnish the piety of a hadith
5. Hasan hadith, hadith is narrated by a narrator that is fair, but not so strong memory (hafalannya), connected to the chain,
and there is no awkwardness illat and substantially. Hasan hadith including hadith which are typically made effective arguments
for a case that is not too heavy or not too important
6. Dhoif hadith, hadith is that the loss of one or more conditions Shohih conditions or hadith hasan hadeeth. Dhoif hadith has
many kinds of types and degrees of difference from each other, due to a lot or at least the conditions Shohih or hasan hadith
are not met.

A principle (asl), means root, origin, source, principle

Qur'an and the Sunnah to the new case

Uruf- “ Adat”. Uruf often refers to three different types of legal
categories: 1) the way common people maintain order, 2)engage in
social interactions, or 3)conduct business locally
Maslahah Mursalah- the considerations which secure the benefit or
prevents harm but is in harmony with the aims and objective of the
Shariah.
These objectives consist in protecting the five essential values and
principles (Al Dharuriyat) of the Shariah which include, the right to
religion, the right to life, the right to property, the right to mind and
the right to community (offspring)

Uruf literally a custom, practice or usage by

Uruf is means a local custom which is not
in conflict with the Qur'an or the Sunnah

Must represent a common and recurrent phenomenon
Must not violate nass that is the definitive principles of the law

30. FIQH METHOD
Definition
fiqh rules may be arguments to a problem,if the method is a strengthened by
evidences from the Al Quran or Sunnah. If the problem has evidences in Islamic
law, then the problem can be made as a reference but in the event of a problem
occurring, there is no mentioned evidences or discussed, so the method can be
arguments for the problem
There are five rule of fiqh
1. Matters are determined by Intentions
Definition
• Every action or thing should be started with the intention. Good intention will be
rewarded, and bad intention, but as long as the act not be done, it is not a sin.
• Intention is not just a pronouncement but should be done with sincerity and to
control the passions themselves.

32. 2) Certainty is not overruled by doubt (Al-yaqinu la yazulu bish-shakk)

Dari Abbad bin Tamim dari pamannya berkata : “Bahawasanya ada seseorang yang mengadu
kepada Rasulullah bahawa dia merasakan seakan-akan kentut dalam solatnya. Maka Rasulullah
bersabda : “Janganlah dia batalkan solatnya sampai dia mendengar suara atau mencium bau.” (HR.
Bukhari : 137, Muslim : 361)

33. • There are two things that confidence and suspicion .
Confidence
Confidence is a feeling in heart when he have confidence because there is something
relevant or strong evidence.
Suspicion
something doubt in heart when do not have evidence or inconclusive evidence.
• Therefore, when there is a confuse between confidence and doubt, then confidence will
be taken
• Islam teaches us to be trying to avoid something that may cause suspicion. This is
because doubt can cause confusion in many instances, it can bring trouble to us.

Hadis daripada Abu Hurairah yang diriwayat oleh Bukhari dan Muslim :

Terjemahan : Sesungguhnya kamu diutus untuk memudahkan dan bukan diutus untuk
menyusahkan.
• When there is a difficulty or hardship or difficulty (the accepted
Islamic law) in the performance of God's commandments then enabled

• There is no burden in religion (Islam).
• “Allah menghendaki kamu beroleh kemudahan dan ia tidak
menghendaki kamu menanggung kesukaran”(Surah Al-Baqarah:185)

This method means that custom, urf or familiarity of a place that can be a
source of law in determining the specific laws that there are no explicit
resources existing Islamic law.
What Muslims see or think is right, it is also right in the sight of Allah swt.
Hadis :”Apa –apa yang dipandang baik oleh kaum muslimin maka ia
dianggap baik disisi Allah sementara apa-apa yang dipandang
buruk oleh kaum muslimin itu maka ia diangggap buruk oleh Allah.”(HR
Bukhari)
