APANAY ELEMENTARY SCHOOL PARENT-TEACHERS ACCOCIAITON
CONSTITUTION AND BY-LAWS
PREAMBLE
We, the parents and teachers of the Apanay Elementary School, invoking the aid
and guidance of God, the Almighty, have voluntarily organized ourselves into an
association in order to attain common goals, promote general welfare and secure
unto ourselves at all time efficient and sincere participation, support and
cooperation in all the endeavors that we may take, abiding and upholding the
constitution of the Republic of the Philippines, all its laws and its duly constituted
authorities, do hereby ordain and promulgate this constitution and by-laws.
ARTICLE I
NAME AND DOMICILE
Section 1. NAME - The organization shall be known as Apanay Elementary School
Parents-Teachers Association herein referred to as AES-PTA;
Section 2. DOMICILE - The principal office of the association shall be at the
Apanay Elementary School (AES) Barangay Apanay, Alicia, Isabela.
ARTICLE II
OBJECTIVES
Section 1. To promote and work for the interest and welfare of the school
children who are enrolled in the Apanay elementary School in particular and the
association in general.
Section 2. To provide venue whereby opinions and grievances could be positively
aired and discussed thereby fostering harmonious relationship between the
parents and the teachers.
Section 3. To protect and support the school children in the pursuit of better
education, help in the development of their character, behavior, and values.
Section 4. To boost the morale of each member and encourage them to freely
exercise their rights and privileges as parent or teacher and encourage them to
actively participate in all the association’s undertakings.
Section 5. To assist in the preparation and implementation of improvement
projects and activities that the school may undertake for the benefit and welfare
its pupils in their pursuit for quality education.
Section 6. To initiate/conduct activities that will generate funds for the
sustenance of its operation and for the implementation of projects/ programs
that will be undertaken by the association.
Section 7. To provide forum for the discussion issues and their solutions related
to the total school program and to ensure the full cooperation of parents in the
efficient implementation of such programs.
Section 8. To adhere to all existing policies and implementing guidelines issued or
hereinafter may be issued by the Department of Education.
Section 9. To serve as support group and as a significant partner of the school
whose relationship shall be defined by cooperative and open dialogue to promote
the welfare of the school children.
ARTICLE III
MEMBERSHIP, RIGHTS AND DUTIES
Section 1, Members - Membership of the AES-PTA is limited to parents, or in their
absence the guardians of duly enrolled pupils and the teachers of AES.
Section 2. A guardian is hereby defined as an individual/institution to whom the
care and custody of the pupil has been entrusted.
Section 3. A member-teacher refers to homeroom advisers and subject teachers
of the AES.
Section 4. Rights and privileges of members - Every member shall have the
following rights and privileges:
a. The right to vote during the election of the association officers and on all
matters relating to the affairs of the association.
b. Be periodically informed of the financial status of the association, including
relevant information affecting the members thereof.
c. To examine all financial records or books of accounts of the association
during business hours.
d. To avail with the facilities and services of the association.
Section 5. Duties and responsibilities of members - A member shall have the
following duties:
a. To obey and comply with the constitution and by-laws of the association
and all other rules and regulations that may, hereinafter, be promulgated
by the Board of Directors.
b. To voluntarily pay the annual membership fee of One Hundred Pesos
(P100.00) as provided for under DepEd Order No. 54 s. 2009 regardless of
the number of children enrolled and all other reasonable contributions
and/or donations that the Board of Directors and the school authorities
may prescribe in consultation with the General Assembly. Provided: that
such contribution/donation is not inconsistent with the guidelines of the
Department of Education.
c. To extend assistance and full cooperation on all undertakings and activities
of the school especially on the maintenance works, cleaning and gardening
scheduled every last Friday of the month.
d. To safeguard the general interest of its members
e. To attend all meetings that may be called by the school administration
and/or the AES-PTA President.
ARTICLE IV
HOMEROOM PTA OFFICERS
Section 1. Within fifteen (15) days from the start of the current school year the
homeroom advisers of the different grade levels and their respective
parents/guardians shall organize the Homeroom PTA (HPTA) with the approval of
the school head/Principal.
Section 2. The HPTA officers namely: President, Vice President, Secretary,
Treasurer, Auditor, Business Manager and Public Information Officer shall be
elected from among the parent/guardian-members by majority of those present
during the election. Provided, that present guardian/parent members shall
constitute a quorum.
Section 3. The homeroom adviser shall have direct supervision over the conduct
of election of the HPTA officers, which election shall be viva voce.
Section 4. Elected HPTA officers shall have a fix term of one (1) year unless
remove, disqualified of expelled prior to the expiration of his/her term.
ARTICLE V
BOARD OF DIRECTORS AND AES-PTA OFFICER
Section 1. The seven (7) elected HPTA Presidents and two teachers designated by
the school head/principal shall automatically compose the AES-PTA Board of
Directors.
Section 2. A teacher-member has a voting capacity but cannot be elected to any
executive position however, the President may appoint him/her as Assistant
Secretary.
Section 3. The Board of Directors shall elect from among themselves the
association’s Executive Officers namely: the President, Vice President, Secretary,
Treasurer, Auditor, Business Manager and Public Information Officer thirty (30)
days from the start of the school year.
Section 4. The school head who shall also act as the association’s adviser or
his/her designated representative shall preside over the election of the AES-PTA
officers.
Section 5. The term of office of the Board of Directors and its Executive Officers
shall be one (1) year from the date of election or until such time that a new set of
BODs and officers shall have been elected and qualified.
Section 6 In case of vacancy in the Bord of Directors because of incapacitation,
resignation or death, the vacancy shall be filled for the unexpired term of office by
a majority vote of the board from among the presidents of the HPTAs in a special
meeting called for the purpose.
Section 7. The powers and duties of the Board of Directors - The Board of
Directors shall have the following duties and powers:
a. They shall have the general charge in the formulation and implementation
of policies, rules, and guidelines of the association.
b. They shall formulate, promulgate, and approve plans, programs and adopt
resolutions toward the attainment of the objectives of the association.
c. They shall acquire, receive, hold and administer properties in the name of
the Apanay Elementary School.
d. They shall coordinate with the school officials in all AES-PTA activities.
e. The BOD shall turn over any completed project initiated by the association
to the School Administrator.
Section 7. The President - The President shall have the following duties and
powers:
a. The president shall be the Executive Officer of the association and
automatically becomes the Chairman of the Board of Directors.
b. Shall coordinate with the school officials in all AES PTA activities.
c. Shall exercise general supervision and control in the management of the
affairs of the association.
d. Shall call and preside in all meetings of the BOD and in the General
Assembly.
e. Shall be primarily responsible for the implementation of the policies, plans
and programs adopted by the BOD.
f. Shall exercise such powers and performs such duties inherent to his/her
position or as may be delegated by the Board of Directors.
Section 8. The Vice President - The Vice President shall have the following duties
and powers:
a. The Vice President shall automatically succeed in case of permanent
vacancy in the Office of the President.
b. Shall take the place of the President in case of temporary absence and
performs the powers and duties inherent to the Office of the President.
c. Shall exercise such powers and performs such duties inherent to his/her
position or as may be delegated by the Board of Directors.
Section 9. The Secretary - The Secretary shall have the following duties and
responsibilities:
a. Keeps minutes of the meetings of the BOD and the General Assembly in a
book provided for the purpose.
b. Shall act as official keeper of all documents, minutes and other records of
the association and receive letters of suggestions, inquiries and complaints
duly signed and submit to the board for deliberation.
c. Shall perform such other duties and responsibilities as may be assigned to
him/her by the President or the Board of Directors.
Section 10. The Treasurer - The Treasurer shall have the following duties and
responsibilities:
a. Shall receive all money collections and issue corresponding Official Receipts
for every collection made.
b. Deposit all funds of the association in a reputable bank designated by the
Board of Directors.
c. Keep and shall have charge of the Book of Accounts of the association
which shall be open for inspection/scrutiny by any member of the AES-PTA.
d. Shall be the custodian of all properties, funds, and accounts of the
association. keep records and shall always have, true, correct, and detailed
statement of the receipts and expenditures and of the assets of the
association.
e. Shall submit to the president and to the Board of Directors quarterly
reports of the properties, funds, accounts, and financial standing of the
organization duly certified by the auditor, or in such time as may be
required by the President or the board.
f. Shall turn over all financial records, inventories, official receipts, and other
pertinent documents during the transition period after the new set of AES-
PTA officers shall have been elected and qualified.
g. Shall perform such other duties and responsibilities as may be assigned to
him/her by the President or the Board f Directors.
Section 11. The Auditor - The Auditor shall have the following duties and
responsibilities:
a. Shall make a detailed and periodic audit of all properties, funds and
accounts of the association.
b. Shall submit audit reports to the board after the examination and validation
of the treasurer’s report.
c. Shall perform such other duties and responsibilities as may be assigned to
him/her by the President or the Board pf Directors.
Section 12. The Public Information Officer - The Public Information Officer shall
have the following duties and responsibilities:
a. Shall take charge in disseminating information concerning the plans,
programs and activities of the association.
b. Shall be responsible in fostering good relationship of the association with
the school administration and the community.
c. Shall perform such other duties and responsibilities as may be assigned to
him/her by the President or the Board of Directors.
Section 13. The Business Manager - The Business Manager shall have the
following duties and responsibilities:
a. Shall discharge the function of transacting business for the association.
b. Shall conduct canvass on any purchase of supplies, materials, equipment
and services that will be needed by the programs, projects or activities that
will be implemented by the association.
c. Shall perform such other duties and responsibilities as may be assigned to
him/her by the President or the Board of Directors.
Section 14. Term of Office - Elected officers and members of the board of the
AES-PTA shall have a fix term of one (1) year unless removed, disqualified, or
expelled prior to the expiration of his/her term.
ARTCLE VI
STANDING COMMITTEES
Section 1. To ensure fraternal cooperation and smooth implementation of plans
and projects of the association, the following seven (7) committees shall be
created. Each committee shall be composed of a Chairman and two (2) members
who shall be appointed by the president and duly concurred by the Board of
Directors:
a. Committee on Finance - responsible for the sourcing out of funds needed
for the implementation of approved project/s and program/s and
monitoring allocations/disbursement of funds within budget limits. (Chair -
Treasurer)
b. Committee on Programs and Projects - responsible for the adoption,
formulation and implementation of programs, projects and activities that
will promote and protect the general welfare of the school children and the
members. (Chair - President)
c. Grievance Committee - responsible in the investigation and settlement of
internal disputes and assist in the presentation and settlement of the
association’s grievances with the school administration subject to the
pertinent provision of existing civil service laws. (Chair - Vice President)
d. Ways and Means Committee - responsible in sourcing out solutions,
resources and logistics needed for the implementation of projects and
activities of the association. (Chair - Business Manager)
e. Committee on External and Community Affairs - responsible in coordinating
with LGUs, NGOs and other institutions for whatever assistance that may be
needed by the association. (Chair - Public Information Officer)
Section 2. The heads of the committees shall preferably come from the members
of the Board of Directors.
ARTICLE VII
ELECTION COMMITTEE
Section 1. At the start of every school year, the school head shall immediately
create and convene a six (6) member Election Committee (ELECOM) for the
election of HPTA and AESPTA by designating the following:
a. Two (2) teachers one of whom shall be the chairperson and the other shall
vote only in case of a tie; and
b. Four (4) parent-members.
Section 2. The ELECOM shall have over all supervision over the conduct of the
elections of the AESPTA officers.
Section 3. The ELECOM may promulgate and issue additional guidelines relative
to the conduct of election provided however, that said guidelines are not
inconsistent with the existing school policies.
ARTICLE VII
MEETINGS AND QUORUMS
Section 1. The General Assembly - The General Assembly shall be composed of all
parents/guardians of school children, members of the Board of Directors and
officers of the AES-PTA, school head, homeroom advisers and subject teachers of
the Apanay Elementary School.
a. The General Assembly shall be convened by the School Head/Principal on
the last Friday of the first month of the current school year to inform the
members on any old/new policies, guidelines, memoranda, issuances, and
relevant information.
b. A Special General Assembly Meeting may be called through a resolution
passed by the Board of Directors or upon a written request signed by
majority of the total membership.
c. Fifty percent (50%) of the total membership of the General Assembly shall
constitute a quorum.
Section 2. The AES-PTA:
a. Officers and members of the Board of Directors of the AES-PTA shall have a
Regular Monthly Meeting every last Friday of the month at 1:00 in the
afternoon.
b. The AES-PTA President and/or the School Head/Principal may call for a
Special Meeting anytime as the situation warrants or upon receipt of a
written petition made by an officer or member of the BOD.
c. Fifty percent (50%) plus one (1) of the total membership shall constitute a
quorum during board meetings.
Section 3. The HPTA:
a. There shall be a regular monthly meeting cum civic action works every last
Friday of the month to start at 7:00 in the morning.
b. The HPTA President and/or the Teacher Adviser may call for a special
meeting of the HPTA officers or the general membership agreed upon by
the officers.
c. Fifty percent (50%) plus one (1) shall constitute a quorum for HRPTA
meetings.
ARTICLE VIII
FINANCIAL MANAGEMENT
Section 1. Cognizant of the need of the association to have adequate funds to
sustain its operations, the AES-PTA may collect voluntary contributions from
members and solicit donations from outside sources to finance programs and
projects geared towards the improvement of the school for the benefit of the
school children provided, that such programs and projects shall be in line with the
School Improvement Plan (SIP).
Section 2. The collection of funds by the PTA shall be subject to the following
conditions:
a. The contribution should be reasonable amount determined by the Board of
Directors.
b. Non-payment of contributions by a parent member shall not be a basis for
non-admission or non-issuance of clearance to a pupil.
c. The contribution shall be collected by the PTA Treasurer on a per parent-
member basis regardless of the number of his/her children enrolled.
d. No teacher or any school personnel shall be involved in such collection
activities.
Section 3. All collection of contributions or proceeds of fund-raising activities shall
be deposited in a reputable bank as determined by the Board of Directors.
Section 4. The AES PTA Treasurer or a duly authorized representative shall
undertake collections which shall be properly acknowledged by an official receipt.
Section 5. In no case shall any school official or personnel be entrusted with the
safekeeping and disbursement of collections made by the AES-PTA.
Section 6. All disbursements/bank withdrawals shall be accompanied by a
resolution of the Board of Directors indicating thereof the purpose for which such
disbursements/withdrawals are made.
Section 7, No cash advances shall be allowed without valid liquidation of previous
cash advances.
Section 8. The Book of Accounts and other financial records of the AES-PTA shall
be made available for inspection by the school head or appropriate AES-PTA
officer or their authorized representative at any time.
Section 9. The AES-PTA shall submit to the school head not later than November
30, a mid school year financial statement ending October 30 duly audited and
signed by the members of the Audit Committee.
Section 10. An annual financial statement signed jointly by the AES-PTA President,
Treasurer and Auditor shall be submitted to the school head not later than thirty
(30) days after the last day of classes. Provided, that said Financial Statement be
posted in the Bulletin Board and turned over to the incoming AES PTA officers for
subsequent presentation to the General Assembly in the ensuing school year.
ARTICLE IX
AMENDMENTS AND RATIFICATION
Section 1. Any amendment to or revision of this constitution and by-laws may be
proposed by the Board of Directors upon a 2/3 vote of its members.
Section 2. Any amendments hereof which may be adopted by the Board of
Directors shall be ratified by a 2/3 vote of the General Assembly within thirty (3)
days after its adoption.
Section 3. The amended copies of this constitution and by-laws must be
distributed to members at least three (3) days prior to the date of General
Assembly ratification and approval.
ARTICL X
EFFECTIVITY
Section 1. This constitution and by- laws shall take effect immediately upon
ratification and approval by a 2/3 vote of the General Assembly.

APANAY ES CONSTITUION AND BY LAWS COPIED

  • 1. APANAY ELEMENTARY SCHOOL PARENT-TEACHERS ACCOCIAITON CONSTITUTION AND BY-LAWS PREAMBLE We, the parents and teachers of the Apanay Elementary School, invoking the aid and guidance of God, the Almighty, have voluntarily organized ourselves into an association in order to attain common goals, promote general welfare and secure unto ourselves at all time efficient and sincere participation, support and cooperation in all the endeavors that we may take, abiding and upholding the constitution of the Republic of the Philippines, all its laws and its duly constituted authorities, do hereby ordain and promulgate this constitution and by-laws. ARTICLE I NAME AND DOMICILE Section 1. NAME - The organization shall be known as Apanay Elementary School Parents-Teachers Association herein referred to as AES-PTA; Section 2. DOMICILE - The principal office of the association shall be at the Apanay Elementary School (AES) Barangay Apanay, Alicia, Isabela. ARTICLE II OBJECTIVES Section 1. To promote and work for the interest and welfare of the school children who are enrolled in the Apanay elementary School in particular and the association in general.
  • 2. Section 2. To provide venue whereby opinions and grievances could be positively aired and discussed thereby fostering harmonious relationship between the parents and the teachers. Section 3. To protect and support the school children in the pursuit of better education, help in the development of their character, behavior, and values. Section 4. To boost the morale of each member and encourage them to freely exercise their rights and privileges as parent or teacher and encourage them to actively participate in all the association’s undertakings. Section 5. To assist in the preparation and implementation of improvement projects and activities that the school may undertake for the benefit and welfare its pupils in their pursuit for quality education. Section 6. To initiate/conduct activities that will generate funds for the sustenance of its operation and for the implementation of projects/ programs that will be undertaken by the association. Section 7. To provide forum for the discussion issues and their solutions related to the total school program and to ensure the full cooperation of parents in the efficient implementation of such programs. Section 8. To adhere to all existing policies and implementing guidelines issued or hereinafter may be issued by the Department of Education. Section 9. To serve as support group and as a significant partner of the school whose relationship shall be defined by cooperative and open dialogue to promote the welfare of the school children. ARTICLE III
  • 3. MEMBERSHIP, RIGHTS AND DUTIES Section 1, Members - Membership of the AES-PTA is limited to parents, or in their absence the guardians of duly enrolled pupils and the teachers of AES. Section 2. A guardian is hereby defined as an individual/institution to whom the care and custody of the pupil has been entrusted. Section 3. A member-teacher refers to homeroom advisers and subject teachers of the AES. Section 4. Rights and privileges of members - Every member shall have the following rights and privileges: a. The right to vote during the election of the association officers and on all matters relating to the affairs of the association. b. Be periodically informed of the financial status of the association, including relevant information affecting the members thereof. c. To examine all financial records or books of accounts of the association during business hours. d. To avail with the facilities and services of the association. Section 5. Duties and responsibilities of members - A member shall have the following duties: a. To obey and comply with the constitution and by-laws of the association and all other rules and regulations that may, hereinafter, be promulgated by the Board of Directors. b. To voluntarily pay the annual membership fee of One Hundred Pesos (P100.00) as provided for under DepEd Order No. 54 s. 2009 regardless of the number of children enrolled and all other reasonable contributions
  • 4. and/or donations that the Board of Directors and the school authorities may prescribe in consultation with the General Assembly. Provided: that such contribution/donation is not inconsistent with the guidelines of the Department of Education. c. To extend assistance and full cooperation on all undertakings and activities of the school especially on the maintenance works, cleaning and gardening scheduled every last Friday of the month. d. To safeguard the general interest of its members e. To attend all meetings that may be called by the school administration and/or the AES-PTA President. ARTICLE IV HOMEROOM PTA OFFICERS Section 1. Within fifteen (15) days from the start of the current school year the homeroom advisers of the different grade levels and their respective parents/guardians shall organize the Homeroom PTA (HPTA) with the approval of the school head/Principal. Section 2. The HPTA officers namely: President, Vice President, Secretary, Treasurer, Auditor, Business Manager and Public Information Officer shall be elected from among the parent/guardian-members by majority of those present during the election. Provided, that present guardian/parent members shall constitute a quorum. Section 3. The homeroom adviser shall have direct supervision over the conduct of election of the HPTA officers, which election shall be viva voce.
  • 5. Section 4. Elected HPTA officers shall have a fix term of one (1) year unless remove, disqualified of expelled prior to the expiration of his/her term. ARTICLE V BOARD OF DIRECTORS AND AES-PTA OFFICER Section 1. The seven (7) elected HPTA Presidents and two teachers designated by the school head/principal shall automatically compose the AES-PTA Board of Directors. Section 2. A teacher-member has a voting capacity but cannot be elected to any executive position however, the President may appoint him/her as Assistant Secretary. Section 3. The Board of Directors shall elect from among themselves the association’s Executive Officers namely: the President, Vice President, Secretary, Treasurer, Auditor, Business Manager and Public Information Officer thirty (30) days from the start of the school year. Section 4. The school head who shall also act as the association’s adviser or his/her designated representative shall preside over the election of the AES-PTA officers. Section 5. The term of office of the Board of Directors and its Executive Officers shall be one (1) year from the date of election or until such time that a new set of BODs and officers shall have been elected and qualified. Section 6 In case of vacancy in the Bord of Directors because of incapacitation, resignation or death, the vacancy shall be filled for the unexpired term of office by
  • 6. a majority vote of the board from among the presidents of the HPTAs in a special meeting called for the purpose. Section 7. The powers and duties of the Board of Directors - The Board of Directors shall have the following duties and powers: a. They shall have the general charge in the formulation and implementation of policies, rules, and guidelines of the association. b. They shall formulate, promulgate, and approve plans, programs and adopt resolutions toward the attainment of the objectives of the association. c. They shall acquire, receive, hold and administer properties in the name of the Apanay Elementary School. d. They shall coordinate with the school officials in all AES-PTA activities. e. The BOD shall turn over any completed project initiated by the association to the School Administrator. Section 7. The President - The President shall have the following duties and powers: a. The president shall be the Executive Officer of the association and automatically becomes the Chairman of the Board of Directors. b. Shall coordinate with the school officials in all AES PTA activities. c. Shall exercise general supervision and control in the management of the affairs of the association. d. Shall call and preside in all meetings of the BOD and in the General Assembly. e. Shall be primarily responsible for the implementation of the policies, plans and programs adopted by the BOD.
  • 7. f. Shall exercise such powers and performs such duties inherent to his/her position or as may be delegated by the Board of Directors. Section 8. The Vice President - The Vice President shall have the following duties and powers: a. The Vice President shall automatically succeed in case of permanent vacancy in the Office of the President. b. Shall take the place of the President in case of temporary absence and performs the powers and duties inherent to the Office of the President. c. Shall exercise such powers and performs such duties inherent to his/her position or as may be delegated by the Board of Directors. Section 9. The Secretary - The Secretary shall have the following duties and responsibilities: a. Keeps minutes of the meetings of the BOD and the General Assembly in a book provided for the purpose. b. Shall act as official keeper of all documents, minutes and other records of the association and receive letters of suggestions, inquiries and complaints duly signed and submit to the board for deliberation. c. Shall perform such other duties and responsibilities as may be assigned to him/her by the President or the Board of Directors. Section 10. The Treasurer - The Treasurer shall have the following duties and responsibilities: a. Shall receive all money collections and issue corresponding Official Receipts for every collection made.
  • 8. b. Deposit all funds of the association in a reputable bank designated by the Board of Directors. c. Keep and shall have charge of the Book of Accounts of the association which shall be open for inspection/scrutiny by any member of the AES-PTA. d. Shall be the custodian of all properties, funds, and accounts of the association. keep records and shall always have, true, correct, and detailed statement of the receipts and expenditures and of the assets of the association. e. Shall submit to the president and to the Board of Directors quarterly reports of the properties, funds, accounts, and financial standing of the organization duly certified by the auditor, or in such time as may be required by the President or the board. f. Shall turn over all financial records, inventories, official receipts, and other pertinent documents during the transition period after the new set of AES- PTA officers shall have been elected and qualified. g. Shall perform such other duties and responsibilities as may be assigned to him/her by the President or the Board f Directors. Section 11. The Auditor - The Auditor shall have the following duties and responsibilities: a. Shall make a detailed and periodic audit of all properties, funds and accounts of the association. b. Shall submit audit reports to the board after the examination and validation of the treasurer’s report. c. Shall perform such other duties and responsibilities as may be assigned to him/her by the President or the Board pf Directors.
  • 9. Section 12. The Public Information Officer - The Public Information Officer shall have the following duties and responsibilities: a. Shall take charge in disseminating information concerning the plans, programs and activities of the association. b. Shall be responsible in fostering good relationship of the association with the school administration and the community. c. Shall perform such other duties and responsibilities as may be assigned to him/her by the President or the Board of Directors. Section 13. The Business Manager - The Business Manager shall have the following duties and responsibilities: a. Shall discharge the function of transacting business for the association. b. Shall conduct canvass on any purchase of supplies, materials, equipment and services that will be needed by the programs, projects or activities that will be implemented by the association. c. Shall perform such other duties and responsibilities as may be assigned to him/her by the President or the Board of Directors. Section 14. Term of Office - Elected officers and members of the board of the AES-PTA shall have a fix term of one (1) year unless removed, disqualified, or expelled prior to the expiration of his/her term. ARTCLE VI STANDING COMMITTEES Section 1. To ensure fraternal cooperation and smooth implementation of plans and projects of the association, the following seven (7) committees shall be created. Each committee shall be composed of a Chairman and two (2) members
  • 10. who shall be appointed by the president and duly concurred by the Board of Directors: a. Committee on Finance - responsible for the sourcing out of funds needed for the implementation of approved project/s and program/s and monitoring allocations/disbursement of funds within budget limits. (Chair - Treasurer) b. Committee on Programs and Projects - responsible for the adoption, formulation and implementation of programs, projects and activities that will promote and protect the general welfare of the school children and the members. (Chair - President) c. Grievance Committee - responsible in the investigation and settlement of internal disputes and assist in the presentation and settlement of the association’s grievances with the school administration subject to the pertinent provision of existing civil service laws. (Chair - Vice President) d. Ways and Means Committee - responsible in sourcing out solutions, resources and logistics needed for the implementation of projects and activities of the association. (Chair - Business Manager) e. Committee on External and Community Affairs - responsible in coordinating with LGUs, NGOs and other institutions for whatever assistance that may be needed by the association. (Chair - Public Information Officer) Section 2. The heads of the committees shall preferably come from the members of the Board of Directors. ARTICLE VII ELECTION COMMITTEE
  • 11. Section 1. At the start of every school year, the school head shall immediately create and convene a six (6) member Election Committee (ELECOM) for the election of HPTA and AESPTA by designating the following: a. Two (2) teachers one of whom shall be the chairperson and the other shall vote only in case of a tie; and b. Four (4) parent-members. Section 2. The ELECOM shall have over all supervision over the conduct of the elections of the AESPTA officers. Section 3. The ELECOM may promulgate and issue additional guidelines relative to the conduct of election provided however, that said guidelines are not inconsistent with the existing school policies. ARTICLE VII MEETINGS AND QUORUMS Section 1. The General Assembly - The General Assembly shall be composed of all parents/guardians of school children, members of the Board of Directors and officers of the AES-PTA, school head, homeroom advisers and subject teachers of the Apanay Elementary School. a. The General Assembly shall be convened by the School Head/Principal on the last Friday of the first month of the current school year to inform the members on any old/new policies, guidelines, memoranda, issuances, and relevant information. b. A Special General Assembly Meeting may be called through a resolution passed by the Board of Directors or upon a written request signed by majority of the total membership.
  • 12. c. Fifty percent (50%) of the total membership of the General Assembly shall constitute a quorum. Section 2. The AES-PTA: a. Officers and members of the Board of Directors of the AES-PTA shall have a Regular Monthly Meeting every last Friday of the month at 1:00 in the afternoon. b. The AES-PTA President and/or the School Head/Principal may call for a Special Meeting anytime as the situation warrants or upon receipt of a written petition made by an officer or member of the BOD. c. Fifty percent (50%) plus one (1) of the total membership shall constitute a quorum during board meetings. Section 3. The HPTA: a. There shall be a regular monthly meeting cum civic action works every last Friday of the month to start at 7:00 in the morning. b. The HPTA President and/or the Teacher Adviser may call for a special meeting of the HPTA officers or the general membership agreed upon by the officers. c. Fifty percent (50%) plus one (1) shall constitute a quorum for HRPTA meetings. ARTICLE VIII FINANCIAL MANAGEMENT
  • 13. Section 1. Cognizant of the need of the association to have adequate funds to sustain its operations, the AES-PTA may collect voluntary contributions from members and solicit donations from outside sources to finance programs and projects geared towards the improvement of the school for the benefit of the school children provided, that such programs and projects shall be in line with the School Improvement Plan (SIP). Section 2. The collection of funds by the PTA shall be subject to the following conditions: a. The contribution should be reasonable amount determined by the Board of Directors. b. Non-payment of contributions by a parent member shall not be a basis for non-admission or non-issuance of clearance to a pupil. c. The contribution shall be collected by the PTA Treasurer on a per parent- member basis regardless of the number of his/her children enrolled. d. No teacher or any school personnel shall be involved in such collection activities. Section 3. All collection of contributions or proceeds of fund-raising activities shall be deposited in a reputable bank as determined by the Board of Directors. Section 4. The AES PTA Treasurer or a duly authorized representative shall undertake collections which shall be properly acknowledged by an official receipt. Section 5. In no case shall any school official or personnel be entrusted with the safekeeping and disbursement of collections made by the AES-PTA.
  • 14. Section 6. All disbursements/bank withdrawals shall be accompanied by a resolution of the Board of Directors indicating thereof the purpose for which such disbursements/withdrawals are made. Section 7, No cash advances shall be allowed without valid liquidation of previous cash advances. Section 8. The Book of Accounts and other financial records of the AES-PTA shall be made available for inspection by the school head or appropriate AES-PTA officer or their authorized representative at any time. Section 9. The AES-PTA shall submit to the school head not later than November 30, a mid school year financial statement ending October 30 duly audited and signed by the members of the Audit Committee. Section 10. An annual financial statement signed jointly by the AES-PTA President, Treasurer and Auditor shall be submitted to the school head not later than thirty (30) days after the last day of classes. Provided, that said Financial Statement be posted in the Bulletin Board and turned over to the incoming AES PTA officers for subsequent presentation to the General Assembly in the ensuing school year. ARTICLE IX AMENDMENTS AND RATIFICATION Section 1. Any amendment to or revision of this constitution and by-laws may be proposed by the Board of Directors upon a 2/3 vote of its members. Section 2. Any amendments hereof which may be adopted by the Board of Directors shall be ratified by a 2/3 vote of the General Assembly within thirty (3) days after its adoption.
  • 15. Section 3. The amended copies of this constitution and by-laws must be distributed to members at least three (3) days prior to the date of General Assembly ratification and approval. ARTICL X EFFECTIVITY Section 1. This constitution and by- laws shall take effect immediately upon ratification and approval by a 2/3 vote of the General Assembly.
