Our September claims club concentrates on industrial deafness claims and puts the new Highways Code of Practice under the spotlight.
In June 2015 the ABI reported a flood of industrial deafness claims and concerns over the level of claimant costs. Where are we now a year on?
Mark Hart, Senior Actuary at Zurich, discusses the prevalence and severity of noise induced hearing loss claims. In addition our own Nick Parsons, the Forum of Insurance Lawyers representative on the NIHL working party, gives his insight.
The much vaunted new Highways Code of Practice is due to take effect in September. Will it mark a sea change in the approach to highways claims or is it business as usual?
We also look at how authorities have been preparing for the new Highways Code of Practice.

[Oil & Gas White Paper] Getting Ahead of the Game: adopting best practices in...Schneider Electric
Burgeoning energy exploration is driving the construction of pipeline systems for hydrocarbon transportation. For a variety of reasons, including renewed scrutiny on safety by regulators, this is also driving new practices and standards for leak detection.
Computational pipeline monitoring (CPM) systems use real-time information from the field – such as pressure, temperature, viscosity, density, flow rate, product sonic velocity and product interface locations – to estimate the hydraulic behavior of the product being transported and create a computerized simulation. With it, controllers can be alerted to abnormal operating conditions that might signal the existence of a pipeline leak. Different CPM methodologies provide different leak detection capabilities, so different methods, or a combination of methods, might be better applied to different operations.
Selection of the right CPM for a given company or given pipeline relies on the thorough evaluation of several factors, including pipeline characteristics, business objectives, additional risk factors and special safety concerns, such as proximity to environmentally sensitive or urban areas. New standards and industry initiatives provide tools to assist in this evaluation, ensuring the pipeline industry continues to provide efficient, effective and safe hydrocarbon transportation.
BlueScape AB 617 Update, The Community Air Protection Program Draft Blueprint...BlueScape
This webinar is an update to BlueScape’s presentation on March 22, 2018. On June 7, 2018, the Air Resources Board (ARB), released the Draft Community Air Protection Program Blueprint. ARB requests that comments on the Blueprint be submitted by July 23rd, 2018. The Blueprint builds on ARB’s previous Concept Paper, containing detailed information on identification and selection of Communities; criteria for emission reduction programs; statewide rulemaking actions, tools and resources; and, Air Monitoring Plan requirements.
Communities have been self-recommending to the Air Districts. The Community Identification process closes by June 29, 2018. One of the main concerns of industry is likely to be how effectively these Communities will collect monitoring data, visualize and analyze potential impacts, and work with the regulatory agencies to make and implement appropriate emission reduction decisions.
AB 617 is a fast-developing program with potentially far-reaching consequences in California. The program is expected to be approved by the ARB Board by fall 2018 and launched by year-end. This webinar will update you on current AB 617 Program developments:
- Summary of important elements in ARB’s Draft Blueprint document;
- Expected Year 1 target Communities List in three major Air Districts;
- AB 617 activities & schedule update, at the State and Air District levels;
- Community governance, and the role of agencies and industries;
- Description of Air Monitoring Plan requirements and expected technical developments;
- Update on Community Funding Grants and other funding resources; and
- Data analysis and visualization; a demonstration on how communities could use monitoring and emissions data to assess emission reductions.
James Westbrook can be reached at jwestbrook@bluescapeinc.com or 877-486-9257. Please contact us for any questions or support you need to work with the air agencies and communities to respond to the developing regulations and requirements under AB 617, and if you have an air quality impact analysis needs.

The U.S. Environmental Protection Agency (EPA) Computational Toxicology Program integrates advances in biology, chemistry, and computer science to help prioritize chemicals for further research based on potential human health risks. This work involves computational and data driven approaches that integrate chemistry, exposure and biological data. We have delivered public access to terabytes of open data, as well to a large number of publicly accessible databases and applications, to support the research efforts for a large community of scientists. Many of our contributions to science are summarily described in research papers but to date we have not optimized our contributions to inform altmetrics statistics associated with our work. Critically missing from altmetrics is access to our numerous software applications and web service accesses, as well as the growing importance of our experimental data and models (e.g ToxCast, ExpoCast, DSSTox and others) to the scientific and regulatory communities. This presentation will provide an overview of our efforts to more fully understand, and quantify, our impact on the environmental sciences using a combination of our measurement approaches and available altmetrics tools. This abstract does not reflect U.S. EPA policy.

Memorandum Of Association Constitution of Company.pptseri bangash
www.seribangash.com
A Memorandum of Association (MOA) is a legal document that outlines the fundamental principles and objectives upon which a company operates. It serves as the company's charter or constitution and defines the scope of its activities. Here's a detailed note on the MOA:
Contents of Memorandum of Association:
Name Clause: This clause states the name of the company, which should end with words like "Limited" or "Ltd." for a public limited company and "Private Limited" or "Pvt. Ltd." for a private limited company.
https://seribangash.com/article-of-association-is-legal-doc-of-company/
Registered Office Clause: It specifies the location where the company's registered office is situated. This office is where all official communications and notices are sent.
Objective Clause: This clause delineates the main objectives for which the company is formed. It's important to define these objectives clearly, as the company cannot undertake activities beyond those mentioned in this clause.
www.seribangash.com
Liability Clause: It outlines the extent of liability of the company's members. In the case of companies limited by shares, the liability of members is limited to the amount unpaid on their shares. For companies limited by guarantee, members' liability is limited to the amount they undertake to contribute if the company is wound up.
https://seribangash.com/promotors-is-person-conceived-formation-company/
Capital Clause: This clause specifies the authorized capital of the company, i.e., the maximum amount of share capital the company is authorized to issue. It also mentions the division of this capital into shares and their respective nominal value.
Association Clause: It simply states that the subscribers wish to form a company and agree to become members of it, in accordance with the terms of the MOA.
Importance of Memorandum of Association:
Legal Requirement: The MOA is a legal requirement for the formation of a company. It must be filed with the Registrar of Companies during the incorporation process.
Constitutional Document: It serves as the company's constitutional document, defining its scope, powers, and limitations.
Protection of Members: It protects the interests of the company's members by clearly defining the objectives and limiting their liability.
External Communication: It provides clarity to external parties, such as investors, creditors, and regulatory authorities, regarding the company's objectives and powers.
https://seribangash.com/difference-public-and-private-company-law/
Binding Authority: The company and its members are bound by the provisions of the MOA. Any action taken beyond its scope may be considered ultra vires (beyond the powers) of the company and therefore void.
Amendment of MOA:
While the MOA lays down the company's fundamental principles, it is not entirely immutable. It can be amended, but only under specific circumstances and in compliance with legal procedures. Amendments typically require shareholder
