How to Enforce your Intellectual Property Rights without Going BustJane Lambert
These are the slides of a presentation that I gave to Leeds Inventors Group in Leeds on the 15 Jan 2014 and IP North West in Accrington on 16 Jan 2014. As ever it is necessary to distinguish between "intellectual property" (the laws that protect investment in branding, design, technology and works of art and literature such trade marks, registered designs, unregistered design rights, patents and copyrights) from "intellectual assets" (the objects of such protection such as trade names, logos, designs, inventions, novels, films, computer programs and websites). Except for bootlegging, counterfeiting and piracy (certain infringements of rights in performances, trade marks and copyrights on an industrial scale) infringement of intellectual property rights is not an offence in this country. Thus it is up to each intellectual property owner to enforce his or her rights in the civil courts. Unfortunately civil litigation in England and Wales can be very expensive and the party that loses the litigation usually has to pay the party that succeeds, A survey by IPAC Ithe Intellectual Property Advisory Committee) in 2003 compared the cost of litigation in England and Wales with the cost in France, Germany, the Netherlands and the USA and found that the UK and the USA were the most expensive countries. Costs in France, Germany and the Netherlands ranged from 10,000 to 50,000 euros whereas in England it cost over £1 million to bring an action in the High Court and between £150,000 and £250,000 in the County Court. Costs in the USA were comparable but there the losing party did not usually have to pay the lawyers' fees of the successful party. Thus, the UK was the most expensive and risky country of the developed world to bring an enforcement action. This appears to have had a dampening effect on innovation in that the number of European patent applications from the UK has trailed not just the USA and Japan but also France, Germany and even the Netherlands and Switzerland which have much smaller populations. Over the last 10 years HM government has tried to reduce the cost of dispute resolution. The Patents Act 2004 enabled IPO examiners to give advisory opinions on whether a patent was valid and whether it has been infringed. In 2010 new rules were introduced to limit the recoverable costs of litigation in the Patents County Court to £50,000. In Oct 2012 a new small claims track was introduced in the Patents County Court. The costs of litigation in the UK for small and medium enterprises is now comparable to those in continental Europe. The final change came in Oct 2013 when the Patents County Court was replaced by IPEC (the Intellectual Property Enterprise Court). HM government has also negotiated an agreement with all the EU member states except Italy and Spain by which the EPO will issue a European patent for all their territories as though they were one country (unified patent) and for disputes to be decided by a single Unified Patent Court in Paris,

Love is an eternal topic, but what is love? As far as I am concerned, love is the most mystical emotion in our heart which makes us feel happy, satisfied or sad. Love is also the sincere emotion springing from heart as the boiled water spilling out of the kettle. Without love, our life will be gloomy and insignificant; without love, the world is wilderness. Love is as necessary in our life just as the thread in the quilt. Of course, there are a lot of kinds of love, such as parental love, fraternal love, romantic love, and so on. Parental love is the most unselfish and greatest love in the world. We never know the love of parents until we become parents ourselves. I still remember one story about a squab and a hunting dog. While the hunting dog was attacking the squab, the mother bird flew down from the tree without hesitation to protect her baby and the parental love made the dog gave in eventually. Animals can do this, not to speak of us human beings. Our parents gave us life and brought us up; they taught us to be good men and took care of us without any complaint. This is parental love which will protect and support us forever. A true friend is the one who overlooks our failures and tolerates our successes. When we meet difficulties, our friends will never look on with folded arms. This is friendship which is a golden blossom between true friends. It is said that the love story itself is not important; the importance is that one is capable of love. For instance, Jack promised Rose that he would never give her up. Another

example is that Wale tried hard to protect Eve with clumsy behaviors but genuine heart. This is romantic love which is like a rose, bringing us happiness and sorrow. Above all, if life is a quilt, love should be a thread. It can hardly be seen, but it really exists. Without it, life becomes meaningless.
First of all, love is put one's heart and soul into her shoes. If you love someone, you will do everything for her; you will think on her side. You will reject all the temptations that can make you live better, just because you don’t want to hurt her. Secondly, love is forgiveness. No matter what the other one do to you, you will forgive her at last. You won’t treat her eye for eye. Although what she has done hurts you so much, you won’t do the same thing to, because you love her. Thirdly, love is growing old together. The outside word is so colorful, but what you want is to grow old with her together and treasure every minute with her. What’s more, you will leave a place for her forever in your deep heart, even she has passed away.
Love is a kind of emotion that everyone has. It is around us. If we pay attention, we will find it. So, do not lose the faith to believe the existence of love. It is the feeling that every can feel by heart.

2. 1.Though I can speak five languages and talk intelligently on dozens of subjects, if I don’t have enough love to keep from gossiping or putting down others, I’m not just making so much useless noise, I’m being downright destructive.
3. 2. And though I read the Bible regularly and even know parts of it by heart, and though I pray daily and have a lot of faith and other spiritual gifts, if I don’t have enough love to sometimes sacrifice some of my personal desires for others’ sakes, then all of my “spirituality” amounts to nothing.
4. 3. And though I work two jobs to provide for my family, and though I give to charity and volunteer for every community project that comes up, if I don’t show love and kindness to those I live and work with, all my hard work and self-sacrifice are worthless.
5. 4. Love has a long, hard, frustrating day at the office, yet doesn’t get snappy and short-tempered. Love is happy for the other guy when he gets all the breaks. Love doesn’t have to drive the flashiest car, live in the biggest house, or have all the latest gadgets. Love doesn’t always have to be the boss or have the last word.
6. 5. Love isn’t rude or crude, isn’t selfish, and doesn’t gripe, guilt-trip, or pressure others to get what it wants. Love is too busy being concerned about the needs of others to spend much time worrying about its own. Love doesn’t freak out when things don’t go its way. Love is quick to believe the best about people and slow to believe the rest.
7. 6. Love hates to hear gossip and instead wants only to talk about others’ good qualities and the good that they’ve done. Love knows that what it listens to, watches, or reads will affect its attitudes and actions and thereby have an effect on others, so it’s careful about how it spends its time.
8. 7. Love is flexible, takes everything in stride, and can handle whatever comes its way. Love is always ready to give others the benefit of the doubt and looks for the best in them. Love wants to see others reach their full potential and does all it can to make that happen. Love never runs out of patience, even with those who are slow to get with the program or do their share. Love doesn’t keep looking at its watch when others are talking.
9. 8. Love never fails. I fail others, and others can fail me. We all can be mistaken, misguided, or confused at times. Our words and deeds often fall short, and our bright ideas don’t always play out the way we want or expect them to.
10. 9. We’re frail, fallible, and often foolish, and our understanding of the world we live in, not to mention the world to come, is only partial at best.
11. 10. But when God’s Spirit of love lives in us, that changes everything.
12. 11. We’re really just children when it comes to practicing real love, but God can help us outgrow our childish ways.
13. 12. Without Him we’re clueless when it comes to love and the other things that matter most in life, but when we live in His kingdom—the kingdom of Heaven that Jesus said is even now within us—we can see things as He does, get our priorities straight, pull out the stops, and live and love to the full.
14. 13. There are lots of nice things in life and lots of good things, but none are as good or as important as love!
15. All the best things in life come packaged in a ribbon of risk. You untie the gift, you assume the risk, and equally, the joy. Parenthood is like that. Marriage is like that. Friendship is like that. In order to experience life in the full sense, you expose yourself to a bottomless pit of vulnerability.
