4. Location Recce
Before any photography can happen for my front cover and double page spread for my EXCLUSIVE, I will need to do a location recce. This is
important as I will need to note and take out any risk affect of the location before taking the image, so that it will be safety for me and the
model when doing the photoshoot.
Some of the potential risk that could of occurred are water on the tiles. It is important to make sure that the tiles have no water on them
because it could cause me or the model to slip over and cause injury to ourselves or damage to the camera. To overcome, this potential risk I
will have to make sure that I will need to dry to floor before taking any images.
Another, potential risk that have occurred when taking the image for my front cover and double page spread is check if there are no glass
object when taking the image. This is important because the glass object cause drop on the tiles. This is important as this caused damages
the tiles and therefore money would how to be spend in order to fix the problem. In addition, this could be a potential safety risk as broken
glass could cause injuries to myself and the model if we stood on it. A way to solve this problem is to pick up the broke glass and then to mop
the floor so that there are no tiny pieces of glass still on the floor. Then wait for the floor to dry so that no one will slip on the water.

The reason why I have chose to take the image in the
midday of the day is because I will have more time to
preparer for the photo shoot. Such as choosing out the
clothing or the makeup colours. In addition, the photoshoot
will be taken in midday because I am able to get the best
lighting for the image.

Permission of using the image
I have to make sure that I have gave my artist/model a form to fill out. This form is
important because the artists/model will have giving our their full permission of
taking their image and use it for the front cover and the double page spread. The
artist will also give their permission to use the image online as well. The artist will be
aware what clothes she will be wearing, what makeup will be used and also the
location of the photograph shoot. The reason why they form have to be fill in before
any action can be taken for the photo shot because this will be proof that the artist
gave the magazine full permission to use the image of themselves and therefore they
don’t have to cause any legal difficulties for the magazine, if they was any problem
which the artist have with the image that was used.
Areas of Assessment
When looking for a location for the photo shot for my magazine, their are serval
specific check that need to be looked at before they can go the photo shoot for the
magazine. Firstly, the risk assessment of the phot shoot is that they have to check if
the artists and the photographer are safe to take the image. Also they will have to
check for any potential hazards that could cause help to the artist and the crew for the
photo shot. They will have to check the uneven ground, running water, the weather
condition, if their any wires on the floor or if their any shape pieces on edges in the
room.

8. Location Image
When I am looking for a location that I should take the
image for the front cover and the double page spread. I
would need a place that it is accessible with the Canon
camera lighting , good lighting and also a white wall. So
that could edit the background of the photograph. I have
some planning where I have to check for any possible
risks to me and the model before taking the image. In
addition I would have to find out if risk to the camera if I
take the image within a location.
The lighting is an important part of the photo
shoot as it could make the image better as
will be easier to see. This is why I am taking
the image during the day time as the natural
light will come out and therefore improve the
image overall. This is why I am taking the
image within the kitchen, as it meet the need
that brief because it have white wall and also
there are three large glass doors that will
allow natural light in.

9. Hazards at the Workplace
Health and safety act 1974 is when all members of staff should be safe at work. This is important as the employers must check that is it a safe
working environment for the employees to work in so that the employees will be working within a place that is hazard free. This is important
as this regulation will provide the a person’s safety, health and welfare whilst in the work place. This will mean that the employers must
ensure that the employees surrounding are safe for them to work within their working environment. The most common hazard that could be
presented within the work place are the physical hazard. Some examples of a physical hazard are loud noise constantly, spills, areas that
could easily tipped over and more potential hazards. This is important as the employers must do a risk assessment of the building before
allow their employees to work in the building as they will have to discover all of the potential hazards that could occurred. This is why the the
employers and the employees should be aware of all of the risks so that they will be able to fix them so that their employees will be safe at
work.
My company will stick to these regulations and guidelines of this legislation for ‘EXCLUSIVE’ magazine as health safety executive will do a risk
assessment of the building of where the magazine are. This is important as both of the health safety executive and EXCLUSIVE magazine
team that search for the potential risk that could occurred within the building and how dangerous it is for the employees. This is important as
the publication will provide features within the building that will ensure the the employees to be safe within the building. This is important as
the company will have emergency exit so that the the employees are escape the building in case of an emergency such as fire. Another, safe
feature that the building must have is to have a fire alarm and button so that the fire alarm are able to detect the the fire when one is
occurring so that the employees are able to escape the building and therefore preventing any injuries of happening to the employees. This is
important as if the building do not proven these safety feature within the building, this wouldn’t ensure the safety of their employees as they
wouldn’t have a warning sign to tell them when a fire have started. Some of the employers will have to follow are some regulations in order
to ensure the safety of their employees. Some of the regulations that the employers must do free of charge are to safely train their staff to do
their job roles, also they have to provide the necessary protection clothing or shoes for the employees when working in a job role that
needed protection clothing or shoes. In addition, the employees will have to be aware of the ‘health and safety policy statement’ so that the
employees will have aware so that they will know their right in their company and the building. Also the health safety executive will inspect
will regularly inspect the building so that they will know if the employers are keeping up to the legislation and therefore ensuring the safety
of their employees.

10. Legal and Ethical Issues- Water Mark
Watermark:
The definition of the watermark is when a faint design, pattern and the manufacture name
that would be visible or associated with the manufacture. This is important because people
won’t have the rights to use these images and claim it as their own, as the company will have
the right to sue the person. Some watermark would have the copyright symbol, which mean
the image will be protected by the intellectual property, as they will have the right to sue the
person.
If someone what to watermark an image through their official website of

packages. There are three different package on their website, that someone can purchase.
One the official website, the basic package cost $0 per month. This package has 5 photo is

On Adobe Photoshop, I have decided to create my own
watermark images for the images that will be features in my
magazine. This is important as other people could take these
images without permission from the magazine ort the model in
the image.
This is why have designed my own watermark from these
images because other people could copy these images because
it show the ownership of the image on the watermark. In
addition, this is a good way to advertise the magazine as on the
magazine it have stated that EXCLUSIVE has official ownership
of the image. Moreover, it has sated that my image is copyright
because of the copyright symbol on the watermark. This reason
why I have decided to put the watermark across the page
instead of on top of the page, is because no one would be able
to use this image. This is important as they are unable to crop
out the watermark on the image as it is big and across the main
image. One example, for the double page spread, the
watermark is diectly across the image, with the copyright
symbol and the name of my magazine, EXCLUSIVE.

11. Legal and Ethical Issues-Production
Before the magazine would be allow to be publish and released to the public, the magazine have a reasonability to everyone to check for any
legal and ethical issues. This is important as this could cause offensive to some people or the company could get into a legal battle because they
have done the checks before they have released the magazines. There are two main companies that would normally handle with complaints
from the public. These companies are called The IPSO (Independent Press Standards Organisation) and ASA ( Advertising Standards Authority).
These companies are only use in the UK.
Legal Issues
Copyright- this is a type of intellectual property, which will
allow a print, publish, film, music or something have a legal
right or exclusivity to a person or a company. This mean if
anyone uses the material without permission, then the
person or the company have the legal right to sue them. This
is important as if a person or company use the item with
copyright and haven’t asked to use, they will breaking the
copyright laws and therefore they could face criminal charges
such as paying an expensive fine. This is why it is important to
gain the permission from the owners before using the item.
Privacy- Everyone are able to have a privacy within their life,
this is why it is important for the Editors are not able to
publish anything before the person/people give them consent
before hand. This is why people are not allow to take pictures
of the a person/ people in public or within a private place
without their consent to do so. This is why the magazine will
gain the permission of the people that they want to be in
their magazine before taking a photo of the.
Seditous Libel- Seditous Libel is when some have written
something that could seem to be offensive or to challenge the
views of the government. This is important as this could
damage the reputation of the government and therefore it
could make them look like less respectable or less powerful.
Criminal Libel- Criminal Libel is when someone is publish,
spoken or a written statement about person/ people that
could damage their reputation or image of person. This is
important as these allegation could stick with them for life
and therefore it could ruin their life such as stop getting jobs.
Ethical Issues
Discrimination- the definition of discrimination is when they someone is treated
different because of their race, ethnicity, gender, class, disability and someone
who have any physical or metal health. This will mean a person’s race, ethnicity,
gender, class, disability and someone who have any physical or metal health
must be included within the articles unless if it relate to the story .
Children- When people are taking pictures of children for brand, there are some
regulation that they have to follow. The children must be able to do their normal
school hours before allowing to take pictures of them. In addition, the they
should be any photograph taken in the school without their school’s permission
of the authorities schools . Moreover, children who are under 16 are not allow
to be interview or photographed without their parents or guardians consents.
The editors are not allow to use materials of the children that the parents or the
guardians are not happy with. In addition, the editors are not allow to release
any information about the child’s private life .
Accuracy- the information that is released to the publication must be accurate.
The information must not have any misleading information in the article. This
could include of images, information and interviews . In addition, the headline
must support the test in the article or interview as this could be misleading to
the readers. However, if something that have release a misleading statement or
information to the public, the publication must correct their mistake. Therefore,
the publisher must handle with the situation properly by releasing a public
apology to the person. This could mean that they wouldn’t be allow to publish
potential facts or potential rumour to the public.
Harassment- to gain the information, the journalists are not allow to intimidate,
harass or keep on pursuit the person/ people for information. The journalists
are not allow to keep on questioning, ringing or take pictures of the person
when the person said that they said to keep away from them. They are not able
to stay on their property when they have asked them to go away when the
journalists want some information. This is why the editors must make sure that
these regulation are enforced and therefore this will mean that these materials
are not from harassment but from people who are willing to give the journalists
the information.

Contract Challenges:
When a contract about copyright have be made and signed,
it is not allow to be broken or also don’t allow to or
reorganise. This will mean that the company will have the
own the logo of their company and also they are allow to to
make different changes to the magazine legally. This will
mean that if the magazine want to make any changes to the
logo or the information in the magazine, they will be in
legal trouble as they have broken the contract. The reason
why the magazine will be in legal trouble as the magazine
has plagiarised the company’ work.
Copyright
The company will have to conduct a researched into
several legal area before creating their magazine. This is
important as wouldn’t want to be in legal trouble when
using a content or images what were copyright but didn’t
know about it . This is important as we would have to
gain permission from the founder or the inventors of the
images or information if the magazine are allow to use it.
This is why the magazine will have to contact them in
order to a tempt to get their permission. If this process
does not happen, the magazine could face legal action
such as a fine which will be between £5,000 to £50,000.
this is why is it important to gain the permission from the
founder and the inventors and also prove that the
permission have be gained by making them to sign a
contract.

When publishing a magazine , it is important to follow the regulation
which will ensure the people’s personal information and data such as
their telephone number or their home address won’t be publish to the
public. This is why it is important for the magazine to protect the
person/people identity so that they could be viewed in a negative light
and therefore it could damage their reputation. This would be a legal
issue as the magazine shouldn’t be allow to release any information is
privative to the person/people.
In addition, when subscribing to a magazine such as Q magazine, the
consumer will have to put in their personal detail such as their bank
detail into the system. This is important as the company will have to
know their personal detail and their banking detail protected. This is
important because if the consumers’ details are not protected, other
people are allow to steal money from the consumers and therefore the
trust between the magazine company and their consumer will be
broken. This could cause a decrease profit as less people will trust the
magazine to subscribe online to their magazine.
Overall, it is important to consider the contract
challenges, privacy and copyright when creating my
magazine. This is important as if I don’t follow these
legal and ethical issues, this could affect the
magazine’s reputation, their consumer’s lives and also
affect the businesses’ financial state of when creating
the magazine and paying off the fines.
This is why all of the content and images that is
included in the magazine will be made from our own
or will gain permission from the founder and make
them sign a contract before publishing the magazine
with the copyright content and image in. this is
important as ,my magazine will also gain copyright on
their own content and images that will be included in
the magazine. On example of where my magazine will

allow to use these items as it will be breaking the trademark rule. The step of make a design to have a trademark are firstly someone will
checking if the design will qualifies as a trademark. Afterward, the person will apply to register for design as a trademark and after the apply
they will find out if their design will be trademark or not. This is important as the person are allow to objected with their decision once it
have came through.

so that no one are able to copy or use the logo for their

issue until the trademark have been improve as it will
ensure that no one will have a idea to copy the logo once it
have been released when it is trademark proof. This is why
my magazine will pay for itself for a trademark when it
needed so that no person or companies so that the
EXCLUSIVE’s logo will be owned by EXCLUSIVE and therefore
no one will have the right to use the logo. The trademark
will ensure that everything in the magazine and the logo
will have the legal right to the publication and therefore no
one can use the magazine and the logo for their own use.

When creating and designing my magazine, I will have to be aware of the Editors’ Code of
Practice. this is highlighted the procedures that I am allow to do and the procedures that I
am not allow to do. The Editors’ Code of Practice will highlight all of the legal and ethical
issues of what their employee shouldn’t do when researching for their information. This
is important ad they will be respectful for everyone emotional and personal space when
finding out information. This will mean that the magazine will have a good reputation as
they will be following all of the regulation of the Editors’ Code.

When I was creating the magazine, I read through the Editors’ Code of Practice , which help
me to create my magazine to a professional standard. This is was my magazine has ‘sets the
framework for the highest professional standards’. This will highlight that if my magazine is
made to this standard, I will attract more readership to my magazine and therefore it will be
recognised within the UK and globally. This will mean that our readers, will expect that the
magazine will have accurate and also high quality information. Also they will expect our
magazine to guarantee them with a good experience of when reading our magazine.

During the creation and the designed of my magazine, the Editors’ Code
will be the main forces as, it will reveal to us what to do or not to do when
gaining or publishing information to the general public. Some of the
Editors’ Code that the magazine must follow is on the left hand side. The
editor of the magazine will check through all of the information on the
magazine and check id it followed the code before it is released to the
public. This is important as if an information didn’t follow the Editors’
Code, the Editor must change the information so that it will fit within the

If the public want to complaint about the magazine, they are able to go

spelling are not correct, this will make the magazine seem unprofessional
to the general public and therefore less people will want to buy the

a complaint
Complaints Procedure:
1. Initial assessment – When the complaint have been received, the complaint put be
place within a category so that they are able to determined what code that the
company have broken. This is important as the for the IPSO do have to write back to
explain the person why the complaint have or hadn’t fallen into any of the category.
2. Referral to the publication - Once, it have been determined that the complaint have
breach one of the code , IPSO will sent the complaint to the head of the publication
and also explain the problem that have occurred. The complaint will have to be sort
out within 28 days by the editors. This will have to go through a process that will
solved the complaint.
3. The investigation - If the publication have not resolved the complaint after 28 days .
The Complaints Committee will get involved and write a letter to the publication and
tell tem that complaint that happen will have to be response to as soon as possible.
4. Adjudication by the Complaints Committee –If the editor still haven’t response d to
the complaint, the Complaints Committee id the Editor’s Code have been breach by
the complaint and therefore they will publish their findings.
5. Remedies- Afterward, the Complaints Committee will finally determine if the
complaint have breach any codes from the Editor’s Code . Therefore the publication
will have to go through a legal process that will be reviewed by the judge which is
known as adjudication or make correct their error and resolved the complaint.
6. Anonymity and publication of decisions – The complaint will go through step 2 to
step 5 again. However, if the person who complaint is unhappy with the process and
the outcome by the choices that Complaints Committee . The person will have to
contact the Complaints Reviewer so that they can review the complaint again.

One way that a famous newspaper have breach the Editors'
Code of Practice is when they have published two images on
their paper and online form at a private event. This is
important as the Daily Mirror published two images of HRH
Prince Henry of Wales and his then girlfriend Cressida Bonas
when they were at Royal Albert Hall during a private event. The
photographs were taken by a member of the audience and
then use the image for social media. This mean that they didn’t
expect to be photograph as the event were private and also
didn’t expect these pictures to be used on the newspaper. This
mean that the Daily Mirror has breach Clause 3 (Privacy) of the
Editors' Code of Practice, as the images was not take in a
control environment and also it was not taken within a places
where they thought they want take photographs in. the reason
why the images was taken is because Prince Harry is apart of
most famous family in the world (the British Royal Family),
which mean that he will always attract the media attention and
therefore magazines or newspapers will do anything in order
get a pictures of him to use so that their publication will be
more popular within the public.
As a result of their complaint the Daily Mirror removed the two images with the content of the articles as well from the Daily Mirror’s official. In
addition, Prince Harry and Cressida Bonas received a public apology from the Daily Mirror from their website and also from their printed
formed of the newspaper. The statement that the Daily Mirror have received to the public about their mistake are ‘On 14 February 2014 we
published in the paper and online two photographs of Prince Harry and Cressida Bonas, taken by audience members and put up on social media
whilst they were attending a performance at the Royal Albert Hall. We accept that the event was private and apologise to them both for
publishing the photographs.’ This mean that the Daily Mirror has accepted responsible from their mistake.

Peter Andre complaint about Heat Magazine after they
have made fun of Katie Price’s disabled son, Harvey.
This is important as Harvey suffer with a rare condition
called septo-optic dysplasia and some of septo-optic
dysplasia are blindness, growth hormone deficiency and
it will cause him to gain weight. Heat magazine breach
the Editors’ Code the Clause 6 (Children) and Clause 12
(Discrimination). This is important as the content of the
information involved a child to be viewed in a negative
way and also the information was discriminate against is
disability and also the affect that it will have on him.
This is important as Harvey Price didn’t chose to be
famous as he come from a famous family and therefore
he didn’t chose to be targeted for negative publicity
because of his disability . This is important as Heat
magazine produce a 50 free stickers of an image of
Harvey’s face and a speech bubble , which have stated
“Harvey wants to eat me!”. This mean that Heat
magazine discriminated against Harvey because of the

investigation into the matter, it was concluded that Heat magazine breach Clause 6 (Children) and Clause 12 (Discrimination) of the Editors’ Code . This means
that Heat magazine discriminated against vulnerable child as they are body shaming a child, who couldn’t help his weight. The resolved of the Heat
magazine’s mistake is they have publicly apologise to Harvey, Katie and Peter for their mistake and also any ‘embarrassment and distress caused’ by
publishing an apology, which have the heading of ‘Harvey- sorry’. In addition, Heat magazine decided to donated money to a charity that Katie and her family
is apart for years. The charity is called The Vision Charity.

When creating my magazine I would have to follow the guideline of the production and also t assess evaluate all of the
risk that could of occurred when the photo shoot is happening. In addition I would have to evaluate the legal and
ethical issue that should or shouldn’t be allow to be publish to the public.

Therefore I have found a location that I will found all of the possible risk that will be easy to identify and solved before
the day of the photo shoot.
