Race and its Implications in the Criminal Justice System
Race has continually been an important issue within the United States and most predominantly the criminal justice system. Racial tension in America
is often thought of as being white versus black, even though that is not in fact the case. African–Americans view the system as favoring whites while
trying to keep them at the bottom. While whites claim that the criminal justice system is colorblind, blacks clearly do not feel this way; whites
underestimate the racial divide in the criminal justice system (Bikel, 2005). The highly publicized OJ Simpson case is well–known for being a case
more about race than murder. In the 1999 Gallup Poll, 74% of people said that OJ either "probably" or "definitely" committed murder. A black male

allocation, distribution of evidence. In the court of law, prosecution and defense counsels evaluate the quality of evidence. However, the law
enforcement collects, preserves and packages for the court room. Evidence must be in good–standing and accurate to the case. For an example, If there
was an armed robbery at a local gas station and the service clerk was shot and killed, the evidence they would use the gun, the police officers and
local detectives would find the type of gun that was used, see if blood is on the floor, fingerprints anywhere, and see if any bullets are around to

trial was an important issue. However, the television news media was not successful at determining whether O.J. was guilty or not. For this reason, the
O.J. Simpson trial is an excellent example of the Agenda Setting Theory. This paper will analyze the role the theory has in the murder trial. Television
news outlets support this theory by showing people the Simpson case was important through constant coverage, but was not successful at telling the
audience what to think on the issue.

The sock was important because it appeared to have blood stains on it. For the prosecution's case against Simpson, they had the blood stains
analyzed by the Department of Justice serologist Gary Sims. He testified in the case that the blood found on the socks were what he considered to
be "spatter stains or something along those lines" (Walraven, 1995). The blood was tested and was found to be a match for one of the murder
victims, Nicole Brown Simpson. To counter this evidence, the defense for O. J. Simpson called Herbert MacDonell to testify about the blood
stains that were found on the socks in Simpson's bedroom. The defense wan't trying to deny that the blood belong to Nicole, but rather how the
blood ended up on the sock in the first place. Based on his experience in the field of bloodstain pattern analysis, he was able to present an argument
that the blood stain was a result of a "compression transfer" (Walraven, 1995), rather than blood spatter, as the prosecution suggested. The
compression transfer is said to be the result of someone placing blood onto the sock using some sort of device, and then removing it from the
surface of the sock. The amount of blood present on one particular portion of the sock was also inconsistent with what you would find if spatter had
occurred. Additionally, based on an identical spot of blood forming on the opposite side of the sock from, it was argued that the blood could have
only come in contact with the sock while it was not being worn and in a relatively flat position. The theory of the sock was that the blood was planted

him, they must investigate. The investigation techniques LAPD used are used all over the world.

EVIDENCES
There were numerous evidences at the residence of Nicole Simpson. There were the bodies of both Nicole Simpson and Ron Goldman. There was a
large amount of blood of both victims. There were also shoe prints and other evidences. These evidences could tell the investigators how the and where
the victims were killed.
The importance of crime scene security is once again emphasized here. On the bodies and the scene, there may be trace evidence from the suspect.
These trace evidences could help the investigators learn about the suspect. There might be hair and clothe fibers transferred on to the victims by the
suspect. These trace evidences can tell what sex, age, and race of the suspect. If the scene was not protected well against contamination, some of
these trace evidences could be lost. The main evidences of this case are the bodies, blood, and the questionable bloody glove. The bodies were
searched thoroughly and removed. Then the scene was searched for more obvious evidences and processed. Then trace evidences were searched for
and collected. Since most of the evidences had blood on them, the were treated with extreme caution. The evidences were also collected in a paper bag
to prevent moisture build–up, hence ruining the evidences.

In an attempt to counter the racist claims of the defense, the jury was selected and was mostly African American females (Gaines 2001). The
district attorney of Los Angeles believed that an all white jury would be ineffective if Simpson were to be found guilty (Thernstrom & Fetter
1996). This outcome of the jury selection upset the Caucasian population because they felt as though the jury selection gave Simpson the upper
hand in the trial regardless of the fact that the jury was majority female. The defense counsel was able to control the jury, in a sense through
instilling in their minds that the LAPD was in fact racist. At the trial's conclusion approximately 83% of blacks believed that Simpson was guilty,
whereas only 37% of whites believed that Simpson was guilty (Thernstrom & Fetter 1996). These allegations also pushed the evidence collected
from the crime to be discredited as well. The second issue with the Simpson trial, is the collection of evidence from the crime scene. The crime scene

apartment. Both were stabbed to death before midnight on 12 June 1994. Brown had been stabbed multiple times in the head and neck with defence
wounds on her hands. Evidence found and collected at the scene and at Brown's ex–husband, Orenthal James (OJ) Simpson's home, led police to
suspect that Simpson was the murderer (People v. Simpson, 1995, 85; 86A; 102A; 112A). Simpson's lawyers convinced the Los Angeles Police
Department (LAPD) Simpson would turn himself in at 11am on 17 June. Simpson did not appear and the LAPD issued an all–points bulletin to arrest
him. Simpson was then broadcasted on television evading police in a car chase (Piper, 2014). At the preliminary hearing, Judge Kathleen
Kennedy–Powell ruled that there was sufficient evidence for Simpson to stand trial of two counts of first–degree murder (People v. Simpson, 1995, 12)
which later took place in the Superior Court (California) in front of Judge Lance Ito and a jury of twelve. The trial lasted nine months and Simpson
was acquitted (People v. Simpson, 1995, 234) as the prosecution failed to convince the jury that Simpson was proven guilty beyond reasonable doubt.

Racial tension in America is often thought of as being white versus black, even though that is not in fact the case. African–Americans view the system as favoring whites while trying to keep them at the bottom. While whites claim that the criminal justice system is colorblind, blacks clearly do not feel this way; whites underestimate the racial divide in the criminal justice system (Bikel, 2005). The highly publicized OJ Simpson case is well–known for being a case more about race than murder.
