Character Profile.
James Gardiner is a Marine Engineering Surveyor. He is an independent expert in the Marine Engineering field
predominately dominating matters involving Foreign Going ships, Ports and vessels. This includes Oil/Gas
offshore installations; machinery failure investigation; propulsion and ship component integrity and failure.
He is a graduate of the International Institute of Marine Surveying MIIMS (UK). James holds a National Maritime
Operations Certificate - Coxswain in both Marine/Celestial Navigation and Engineering. James is a former
student of the Australian Maritime Collage, Launceston Tasmania. He holds a Diploma in Marine Surveying and
certified by the Australian Maritime Collage in the specialized fields of Ship Structure, Naval Architecture and
Stability, Marine Engineering and Ship Safety Classification [IMO] Surveying [Lloyds Maritime Collage Accredited
UK]. He is a trade qualified Marine Technician and member of the Forensic Engineers Society of Australia. James
is also a foreign going Flag State Marine Engineering Surveyor and statutorily appointed as a Marine Inspector in
Australian Port Waters.
Commonly James consults to Occupation Health and Safety firms in the [OH&S] private sector in marine risk
management; to Australian and International marine engineering/surveying firms on technical [failure related
matters], and to Port Authorities in Marine O.H &S.
He provides independent advice to multi-national industry leaders in the offshore/foreign going maritime
industry in [OH&S]. He has advised existing participants in the oil/gas, and the geotechnical drilling sector in
areas including assessing Job Safety Analysis [JSA], Standard Operating Procedures [SOP] and Work Safety
Methods [WSM] regarding offshore gas and oil platform installations in Australia, and throughout South East
Asia.
James provides his services to Flag State Marine Safety Agencies in the foreign going sector, covering all
Australian States and Territories. My expertise is also in the following fields; Vessel survey International
Maritime Organization [IMO] - safety compliance, Foreign going - General Average marine insurance
claims[Lloyds], Cargo handling equipment, damage cargo and marine engineering claims in excess $80Mill USD
+, Foreign Going Vessel statutory surveys and Australian Maritime Safety Authority [AMSA] audits on foreign
flagged vessels on approach to all Australian Ports.
James has attended these ports [by land and sea], worked ashore and aboard foreign goings vessels
alongside various foreign going ports throughout Australia, including but not limited to; Port Kembla, Port

2. From a Marine Engineering and Surveying perspective, he has worked aboard a variety of vessel classes
including; Multi-Purpose Self loaders, Roll On/Roll Off, Cruise liner Class, Offshore Supply Vessels [OSV] –
Oil and Gas, Panamax, Container and Combo -Heavy lift Ships.
James has attended port facilities operated by various stevedoring, and port operators including; Patricks,
DP World, Woodside - King Bay Supply Base, and Hutchison. Advising foreign going fleet managers,
technical superintendants, port operators and port authorities in area’s including Occupational Health and
Safety [OH&S] and investigated minor and catastrophic (fatal) incident (s) that have occurred at sea and
within these ports.
He has been trained in, and instructs in the field of SOLAS – [Safety of Life at Sea] foreign going, bridge
management, and the utilization/deployment of LSA (s) aboard commercial and foreign going vessels.
Due to the nature of his work in the OH&S and maritime sector, James has been involved in the utilization of
rapid response air and sea assets, in such incidents involving; domestic/recreational and commercially
operated passenger ferries, and foreign going vessels. He commonly utilizes Port Authority vessels,
Volunteer Marine Rescue vessels [VMR], regulatory marine rescue vessels, ship tender vessels and various
State Police Force assets and vessels.
As an independent consultant he is a statutorily appointed Marine Inspector having compiled over 130
maritime engineering/safety investigations and surveys, assisting Marine Safety Agencies and State Work Safe
Authorities in both formal Prosecutions and deceased inquests on behalf of Australian and European Maritime
bodies. He has given evidence in chief and been cross examined in various courts and Coronial Inquests
throughout Australia over this period.
His experience for undertaking assignments includes training, research and technical diagnostic experience
in the fields of Ships Cranes and Marine Cargo Surveying including Break Bulk [BB], Containerized and Out-
of-Gauge [OOG] freight handling.
He has extensive experience in surveying and in the investigation of shore based crane failures, and ships
crane failures in the offshore supply vessel (OSV), containerized freight and in the oil/gas industry.
He has specific experience regarding mobile cranes includes; the operational lifting of vessels ashore, including
dumb barges and Jack-Up platform barges in excess of 100 (T). He has conducted out of water marine hull
commercial surveys, ultrasonic testing and, non destructive inspections [NDT] utilizing mobile cranes supported
by outriggers.
James is trained and experienced in the [Foreign Going sector] includes conducting marine safety and
engineering survey inspections, and Australian Maritime Safety Authority [AMSA] audits on foreign flagged
vessels on approach to all Australian Ports to regulatory [IMO] standards.
James also lectures in the field of marine survey engineering and safety in South East Asia [Malaysia] in the
Oil and Gas Industry. As a Marine Engineering Lecturer throughout Australia, and South East Asia in the Oil
and Gas Industry, he is a highly experienced Technical Course facilitator in this specialized field.
James is also engaged as an advisor to various Federal, and State Government Departments and
Multinationals within Australia and South East Asia, in the Gas and Oil Installation and OSV Sectors.
He commonly advises, and provides both oral and written expert opinions to instructing Solicitors, and
Counsel in litigation both in Australia and overseas. James is also an advisor to various Marine Safety
Agencies within Australia. He is a Member of the International Institute of Marine Surveyors (MIIS) and of
the Forensic Engineers Society of Australia (FESA).
