Thesis Statement and Outline
Acme Fireworks is a retail company that in its two years of
existence has remarkable performance. As a small business
entity, it has three specializations, namely: sales, putting on
ground related displays and aerial display in large scale of
fireworks. Presently, this sole proprietorship is run by its
founder and 15 other members at employee level. Today, the
company is facing a positive dilemma as its eminent growth has
caught the attention of other large companies who are especially
interested in its firework displays. The other side of Acme’s
dilemma is if it can keep these display tenders coming in, if it
needs to change from a sole proprietorship, how to sustain
future employees and if it’s valid enough or if its owner should
test other waters business-wise.
I. Introducing the History of Acme Fireworks Company
A. This company is founded on its owner’s passion for

1. The passion dates from childhood- children are often very
intrigued by fireworks. The sparkles caused by fireworks appear
magical and amuse them a lot.
2. Fireworks is also an essential/ integral part of various
celebrations such as birthdays, weddings, New Year and
anniversaries.
B. Examples of events commemorated by firework displays
and the effect brought out. This answers the fact that fireworks
are in a way influential to the society.
1. Firework Displays are today largely used on a daily bases
especially at a corporate level to emphasis adverts and during
various company related events and activities.
2. Explain how the Acme Fireworks has invested into this
market and the success that has eclipsed.
II. Determining the nature of contracts between Acme
Fireworks and the large interested companies.
A. Answering the question on laws that will govern these
contracts.
1. Defining common laws and UCC.Common laws these are
declared by a judge and aimed at groups at either legal or
custom levels. Uniform Commercial Code (UCC) on the other
hand refers to business laws aimed at regulating financial and
other business related contracts. The UCC is better explained by
its 9 articles that give it a detailed approach.
2. Deciding which set of laws best suit the case of Acme
Fireworks scenario.
B. Supporting details
1. Both are important
2. Both have a role to play. However, it is definite it’s the
UCC, but there is needs to give valid reason driving examples
from the companies involved settings.
III. Discussing whether Acme’s owner agreed to enter
contract ship with interested business.
A. The five essential elements of an enforceable contract.
1. The outlining of these elements and their definitions.
7. They include: Offer, capacity, legality, consideration and
acceptance.
2. Elaborating on the purpose of each of these elements.
B. Showing various scenarios
1. Where all elements were adhered to, what where the
outcomes? Where some were left out, were there consequences?
2. How the relevance of these elements vary based on nature of
a contract.
VI. Potential personal liability that Acme Fireworks may face
where spectator injuries are involved.
A. Explaining Fireworks from a chemical element perspective
1. Accepting that regardless of the beauty of the
firework displays, there are certain potential hazards.
2. Explaining potential person liability as negligence
consequences that result from not paying NIC (National
Insurance Contributions).
B. Statistical Analysis
1. Statistics on how often firework displays result in spectator
injuries. Use recent dates such as between 2008-2015.
2. How often has Acme Fireworks been faced with spectator
injury related cases? How did it deal with it? What are the
control measures put in place?

A. Pointing out the various employment types and defining each
briefly.
1. The role of these employment types and how they
relate to agency laws.
2. Stating the advantages and disadvantages of each
employment types to Acme Fireworks.
B. Applicability of the employment types
1. From a large company perspective and from a small company
such as Acme Fireworks perspective.
2. Suggestions on how Acme Fireworks can reduce possible
liabilities and maximize on benefits of various employment
types.

1. The various advantages and disadvantages of sole-

1. Advantages and disadvantages of partnership.
2. Reasons based on facts that suggest Acme Fireworks would
do better as a partnership than its current Sole- proprietorship
business status.
VII Conclusion
This part should sum everything up and should be around 100-
150 words. At this stage, I am yet to come up with a suitable
conclusion as at the brainstorming stage of my essay where new
ideas keep coming up. But I am sure by the draft paper level, an
appropriate conclusion will be in order.
