2. RIGHT TO EDUCATION
ACT (RTE) 2009 STATES:
Every child between the age of 6 to 14
years has the right to free and compulsory
education. This is stated as per the 86th
Constitutional Amendment Act via Article
21A.

3. ‘FREE EDUCATION’ MEANS THAT NO CHILD SHALL BE
LIABLE TO PAY ANY KIND OF FEE OR CHARGES OR
EXPENSES WHICH MAY PREVENT HIM OR HER FROM
PURSUING AND COMPLETING ELEMENTARY EDUCATION.

5. Right of the children
to free and
compulsory education
till the completion of
elementary education
in the neighbourhood
school.
A non admitted child
to be admitted in the
class of appropriate
age.
For eg:
If a child of 8 years
never admitted to
school before, due to
some reasons then
he/she will be admitted
to class appropriate to
his/ her age i.e 3rd
class.

6. • LAYS DOWN NORMS AND
STANDARDS RELATED TO;
Pupil Teacher Ratio (1:25 for primary
&1:30 for secondary classes),
Building and infrastructure,
School working days (200 days/year for
primary and 220days/year for
secondary),
Teacher working hours etc.
7. Appointment of Appropriately trained teachers
i.e teachers with requisite entry and academic
qualification .
. It prohibits:
1. Physical punishment and mental harrasment
2. Screening procedure for admission of Children
3. Capitation fee
4. Private tution by teachers
5. Running of schools without recogination
No expulsion or detention policy should be
followed till the completion of elementary
education

8. • IT PROVIDES FOR DEVELOPMENT OF CURRICULUM IN
CONSONANCE WITH THE VALUES ENSHRINED IN
CONSTITUTION FOR ALL ROUND DEVELOPMENT OF CHILD,
BUILDING ON THE CHILD’S KNOWLEDGE, POTENTIALITY
AND TALENT , MAKING CHILD FREE OF FEAR, TRAUMA
AND ANXIETY THROUGH A CHILD FRIENDLY AND CHILD
CENTRED LEARNING PROCEDURE.
• 25 % OF RESERVATION IS ENSURED FOR THE WEAKER
SECTIONS IN ALL ‘SPECIFIC SCHOOLS’ AND PRIVATE
UNAIDED SCHOOLS AND RESERVATION NORMS FOR THE
GOVERMENT AIDED SCHOOLS ARE TO BE FOLLOWED.

9. IMPLEMENTATION AND FUNDING
Education in the indian constitution is a
concurrent issue and both centre and state can
Legislate on the issue.
The states lacks financial capacity to deliver
education of appropriate standards in all the
schools for universal education. Therefore
central goverment have to subsidize the states.
In april 2010 central goverment agreed to the
sharing for implementation of law in ratio 65:35

10. PRESENT STATUS OF IMPLEMENTATION OF RTE
ACT 2009
OUT OF SCHOOL CHILDREN: The no. of
out of school children Of age
group 6-14 years decreases. The
highest proportion of out of
school children is in east zone
and lowest in the south zone.

11. PUPIL TEACHER RATIO: There should be
atleast 1 trained and qualified teacher for
every 30 students. Currently national
average is 1 teacher for every 34 students
but in states like bihar ,madhya pardesh ,
west bengal there is 1 teacher for 60
students.
Half of the schools in arunachal pardesh,
assam ,meghalaya do not have drinking
water facilities.
Many of the schools do not have seprate
washrooms for girls.

12. Ignorance among teachers and
guardians for the provision of the act.
Private schools are not supporting and
declining the admissions under RTE act
and approached the supreme court on
the validity of Act.
Shortage of skilled and qualified
teachers.
Quality education is being questioned.

13. SHORTCOMINGS OF RTE ACT 2009
Criticised for being hastily –drafted,
not Consulting many groups active in
education , not considering quality of
education , infringement on rights of
private and religious minority schools.

14. Admission according to age but no
facility for bridge courses : It stipulates
that the child should assigned class according to
age regardless to the level of learning which is a
good step to save wasted years .But there are no
provisions for the bridge courses ti equalize
pupil on the learning scale.
Failure of no detention policy: It is one of the
major loooholes of this act. It is to ensure that
detention would not let them to drop out of
school but it distorts the whole idea of assesing
learning outcomes.

15. Exclusion of children below 6 years and
above 14 years of age: The act allows only
children of 6-14 years of age to get
priviliges. Critics argue that 0 to 6 years is
considered to be delicate and formative in
child’s upbringing and stopping at the age
of 14 means leaving tge task half a way
because next 4 years of adoloscence are
equally critically in children’s maturing
process.

16. Barier for orphans: The act provide admission
of children without any certification. However
some states continues pre- existing practices
and ask for income and birth certificates,
BPL cards etc which orphans are not willing
ti provide. On the basis of which schools are
not admitting these children .

17. Status of poor kids in private schools: The
RTE Act 2009 opens the door of private
schools for weaker sections. A kid from
weaker section would be suddenly exposed
to a diffrent living standard. A question
arises here, will they be treated with equal
dignity by the school administration and
peers?? Moreover, Is education totally
free?? What about other expenses books ,
uniform?
There is an acute shortage of trained
teachers.

RTE ACT lays norms and standards related to Pupil Teacher
Ratio.
RTE ACT mandates special provisions for special cases.
RTE ACT ensures quality and qunatity of teachers.
RTE ACT ensures zero tolerance against discrimination and
harassment.
RTE ACT focuses on all round development of children.
RTE ACT focuses on improving learning outcomes to
minimise detention.
RTE ACT is justiciable and provides inclusive space for all.
