Proposed Changes to the Apprenticeship and Traineeship Act
Strengthen the requirements for training providers to consult with
employers throughout the training process
Strengthen the requirements around training contracts and training plans
Move the power of the Secretary to develop Vocational Training
Guidelines, to the Commissioner for Vocational Training
Increase maximum penalties for offences to align with other modern
legislative frameworks
Remove Craft and Completion Certificates and issue only one certificate
– Certificate of Proficiency upon successful completion

Remove the category of ‘trainee apprentice’ and register all apprentices
equally. (Trainee apprenticeships are apprenticeship arrangements in
which the employer does not undertake to employ the apprentice for the
whole term of the apprenticeship. The training contract was approved but
not registered).

Removal of the Vocational Training Review Panel – Complaints
Remove administrative burden by abolishing the Vocational Training Review
Panel and moving powers regarding the complaints processes to the
Commissioner for Vocational Training, and moving review functions to the
NSW Civil and Administrative Tribunal (NCAT)
Complaints will be referred to the Commissioner for Vocational Training who
will nominate a conciliator to endeavour to reach a mutually agreed resolution
to the complaint
If a resolution cannot be achieved the Commissioner will make a decision.
The Commissioner may seek advice from industry in determining the
complaint
Employers and apprentices and trainees retain the right of review and appeal
to NCAT

Removal of the Vocational Training Review Panel – Trade
Recognition
The Commissioner will determine the process for trade recognition
The process will be simplified for both the Department and the applicant
The trade recognition process will ensure quality training by introducing
options for the Commissioner for Vocational Training to require
independent assessment or further assessment of an applicant
An additional clause is being inserted in the Bill for trade recognition of
vocations requiring a Certificate of Proficiency for a trade licence
