5. THE TANGERANG CITY GOVERNMENT HAS
CARRIED OUT LAND PROCUREMENT FOR
DEVELOPMENT FOR PUBLIC INTEREST WITH AN
AREA OF LESS THAN ONE HECTARE IN THE FORM
OF WIDENING THE GATOT SUBROTO ROAD AND
CONSTRUCTING AN OVERPASS ROAD.
CASE
THAT THE IMPLEMENTATION OF LAND PROCUREMENT
FOR PUBLIC INTEREST WITH AN AREA OF LESS THAN
ONE HECTARE CARRIED OUT BY THE TANGERANG CITY
GOVERNMENT FOR THE WIDENING OF GATOT
SUBROTO ROAD AND THE MAKING OF AN OVERPASS
IS CARRIED OUT BY RELINQUISHING LAND RIGHTS,
BUILDINGS, AND OBJECTS RELATED TO LAND. THE
LAND OBJECT AFFECTED BY THE ROAD WIDENING
PROJECT AND THE CONSTRUCTION OF THE GATOT
SUBROTO OVER PASS IS IN THE FORM OF PRIVATE
LAND.
6. BASICALLY LAND ACQUISITION CARRIED OUT BY THE TANGERANG CITY
GOVERNMENT IS DIVIDED INTO THREE STAGES, NAMELY;
CASE
(1) THE PRE-LAND ACQUISITION STAGE, WHICH INCLUDES THE PROJECT SOCIALIZATION
PROCESS AND LAND ACQUISITION PLAN
(2) THE STAGE OF LAND ACQUISITION (LAND ACQUISITION PROCESS), WHICH INCLUDES
THE PROCESS OF MEASURING, COLLECTING DATA ON BUILDINGS AND PLANTS AS WELL
AS DETERMINING COMPENSATION, PRICE DELIBERATIONS, PAYMENTS, LAND EXECUTION.
(3) THE POST-LAND ACQUISITION STAGE, WHICH INCLUDES PLANNED ACTIVITIES TO BE
CARRIED OUT AFTER LAND EXECUTION AND LAND USE BY AGENCIES REQUIRING LAND.
7. PLANNING
1.
ANALYSIS
- Identification of land, buildings, objects related therein and other inventories, which is carried out by the
Price Appraisal Team assisted by the Technical Implementer to carry out an inventory of the control use and
ownership of land or buildings.
- Identification includes:
1) Designation of boundaries,
2) Measurement of land parcels and building and counting or data collection of plants,
3) Mapping of plots of land, buildings and perimeter of land parcels,
4) Determination of land and building boundaries,
5) Mapping of use, utilization of land and buildings,
6) Data collection on the status of land and buildings,
7) Data collection control and ownership of land, buildings and plants,
8) Collecting data on evidence of control and ownership of land, buildings, plants and related objects.
8. 2. PREPARATION
ANALYSIS
- The socialization or counseling meeting regarding the road widening project development plan and the making of the Over
Pass, was conducted by the Price Appraisal Team in the presence of the Lurah, Camat, and the community affected by the
project.
- Government agencies, namely the Public Works Service through the Land Service, by requesting the consideration of the
Head of the National Land Agency of the Republic of Indonesia based on the predetermined Regional Spatial Plan, submitting a
proposal to the Mayor of Tangerang
- The contain of proposal are; development plan with a description, namely;
a). The aims and objectives of development,
b). Location and location of development,
c). The required land area,
d). Source of funding,
e). Environmental feasibility analysis of development planning, including the impact of development and its prevention and
control measures.
As for the location proposed for the development of public interest, technically the spatial layout cannot be moved to another
place or location.
9. 3. IMPLEMENTATION
ANALYSIS
Based on the consideration of the proposals submitted by the Government Agencies that require land for
public purposes, the Mayor of Tangerang decides as stated in the Decree dated January 7, 2008
Number 912/Kep.7.B-Din-Pthn/2008, including the determination of the location of the land acquisition
plan for widening of Jalan Gatot Subroto in Tangerang City with a length of 500 m and a width of 30
m.
10. 4.SUBMISSION OF RESULT
ANALYSIS
In order to carry out Land Procurement for Public Interest, especially the widening of Jalan Gatot
Subroto and the manufacture of Over Pass, the Tangerang City government formed an Activity
Management Team, this can be seen from the Letter of Assignment Number 800/84 A-Din.Ptn/2008,
dated January 8, 2008 which issued by the Regional Secretary of Tangerang City
11. CONCLUSION
IMPLEMENTATION OF LAND PROCUREMENT, WIDENING OF JALAN GATOT SUBROTO
AND MAKING OVER PASS ARE CARRIED OUT DIRECTLY BETWEEN GOVERNMENT
AGENCIES AND THE OWNER OF THE LAND OBJECT OR POWER OF ATTORNEY BY
RELINQUISHING THE RIGHTS TO LAND, BUILDINGS AND OBJECTS RELATED TO IT
WITH THE PRINCIPLE OF DELIBERATION.IN THIS CASE TANGERANG GOVERNMENT
HAS ITS OWN WAY TO DO LAND AQUISITION, BUT STILL IN LINE WITH THE
PLANNING, PREPARATION, IMPLEMENTATION, AND SUBMITION. SO IN SHORT
LAND AQUISITION PROCEDURE IN TANGERANG CITY IS VALID AND BASED ON LAW.
