DOMESTIC VIOLENCE
Domestic violence encompasses behaviors used in a relationship by one of the parties,
mainly to control the other.
The people involved can be married or not, be of the same sex or not, living together,
separated or dating.
Tasks we can be victims of domestic violence.
Victims can be rich or poor, of any age, sex, religion, culture, ethnic group, sexual
orientation, background or common status.
WHAT IS IT?
For an APAV, the Crime of Domestic Violence must cover tasks and acts that are
wrongdoing and that are practiced in this context.

4. The wrongdoing of domestic violence is committed by anyone who inflicts physical or
psychological mistreatment, once or several times, on a spouse or ex-spouse, married true
or ex-married/an accepted, boyfriend/an or ex-boyfriend/an or begetter of common 1st
degree descendant, whether or not there is cohabitation.
The wrongdoing of domestic violence is also practiced by those who inflict physical or
psychological abuse, once or several times, on a person who is particularly defenseless due
to age, disability, illness, pregnancy or economic dependence, as long as he lives with him.
Based on this concept, we can also distinguish Domestic Violence between:
domestic violence in the strict sense (criminal acts included in workmanship. 152: physical
abuse; psychic abuse; threat; coercion; slander; defamation and sexual violations)
domestic violence in a broad sense that includes other violations in domestic contact
[violation of domicile or disturbance of private life; invasion of privacy (images; telephone

TYPES OF VIOLENCE
DOMESTIC VIOLENCE INCLUDES DIFFERENT TYPES OF ABUSE, SUCH AS:
emotional violence: any behavior by the partner that aims to make the other feel fearful or
useless. It usually includes behaviors such as: threatening children; hurting pets; humiliate
the other in the presence of friends, family or in public, among others.

can translate into behaviors such as: punching, kicking, strangling, burning, inducing or
preventing the partner from obtaining medication or treatments.

sexual violence: any behavior in which the partner forces the other to carry out sexual acts
that he/she does not want. Some examples: pressure or force the partner to have sex when
he doesn't want to; pressuring, forcing or trying to get the partner to have unprotected sex;
forcing the other to have relationships with other people.
financial violence: any behavior that attempts to control the partner's money without the
partner's desire to do so. Some of these behaviors can be: controlling the other's salary;
refuse to give money to the other or force him to justify any expenditure; threaten to
withdraw financial support as a form of control.
stalking: any behavior intended to intimidate or frighten another. For example: following the
partner to his/her place of work or when he/she goes out alone; constantly controlling each
other's movements, whether or not they are at home.
THE CYCLE OF DOMESTIC VIOLENCE
Domestic violence works as a roundabout system - the so-called Domestic Violence Cycle -
which generally has three phases:

This cycle is characterized by its continuity in rhythm, that is, by its successive repetition
over months or years, the phases of tension and appeasement may be less and less and the

ARE YOU BEING A VICTIM?
There are some questions that can help a person to understand if he is being a victim of
domestic violence wrongdoing, such as:
Are you afraid of your boyfriend's or girlfriend's temper?
Are you afraid of his/her reaction when you don't have the same opinion?
Does he/she constantly ignore her feelings?
Do you enjoy the things you say?
Do you seek to make fun of them or make them feel bad in front of their friends or other
people?
Has he ever threatened to harm you?
Has he/she ever hit, kicked, pushed or thrown an object at you?
Can't be with your friends and family because he/she is jealous?
Has he ever been forced to have sex?
Are you afraid to say "no" when you don't want to have sex?
Is he forced to justify everything he does?
Is he/she constantly threatening to reveal your relationship?
Have you ever been wrongly accused of being involved or having sex with other people?
Whenever he wants to go out, does he have to ask for permission?

The presence of one or more of these behaviors, mainly used to control other people, can
mean that you are a victim of physical, psychological or sexual violence in your relationship.
DOMESTIC VIOLENCE IS A CRIME.
THE WOMEN
Violence against women is a complex and multi-faceted phenomenon, which crosses social
classes, ages and regions, and has had reactions of non-reaction and passivity on the part
of women, putting them in search of informal and/or conformist solutions. , having been very
6. reluctant to take this type of conflict to the public space, where for a long time beat they were
silenced.
Each woman's reaction to her victimization situation is unique. These reactions should be
seen as psychological survival mechanisms that each trigger differently to support
victimization.
Many women do not consider the abuse they are subjected to, kidnapping, harm, an injury,
defamation or sexual coercion and rape by their spouses or partners as wrongdoings.
Women are, in most cases, in situations of domestic violence due to the dominance and
control that their aggressors exercise over them through a wide range of mechanisms, such
as: relational isolation; the exercise of physical and psychological violence; an intimidation;
the economic domain, among others.
Domestic violence cannot be seen as a fate that women have to passively accept. The
destiny of her own life belongs to her, she must decide it, without having to resignedly accept
the violence that does not fulfill her as a person.
THE CHILDREN
Children can be considered victims of domestic violence as:
witnesses of domestic violence: This includes witnessing or hearing the abuse inflicted on
the victim, seeing the physical signs after episodes of violence or witnessing the
consequences of this violence on the abused person;
instruments of abuse: An abusive parent may use children as a form of abuse and control;
victims of abuse: Children can be physically and/or emotionally abused by the abuser (or
even, in some cases, by the victim himself).

THE ELDERLY PEOPLE
The World Health Organization (WHO) characterizes violence against older people as:
"A single or repeated action, or lack of adequate response, that causes distress or
harm to an elderly person and that occurs within any relationship where there is an
expectation of trust."
Violence against older people has been classified into different types - physical violence;
psychological violence; sexual violence; economic or financial violence; negligence;
abandonment - these may appear alone or in combination.
