Removal of name of pharmacist from register: The name of Pharmacist may be removed from register: If his name has been entered into the register by error. OR If he has been convicted of any offence in any professional respect which renders him unfit to be kept in the register. OR At a person employed by him to work under him, in connection with any business of pharmacy has been convicted of an offence or held guilty of any such infamous conduct, if such person is a registered pharmacist, he is liable to remove his name from register.

2.  The name of Pharmacist may be removed from register:
i. If his name has been entered into the register by error. OR
ii. If he has been convicted of any offence in any professional respect which
renders him unfit to be kept in the register. OR
iii. At a person employed by him to work under him, in connection with any
business of pharmacy has been convicted of an offence or held guilty of
any such infamous conduct, if such person is a registered pharmacist, he
is liable to remove his name from register. If the employed person is
registered pharmacist, his name may be removed from register If,
1. Convicted of offence or held guilty of infamous conduct. offence was
investigated by registered pharmacist himself.
2. If the repetition of similar offence or conduct during the period of 12
months.
3. The offence or infamous conduct continued over a long period.

3. 4. Any person employed by the registered pharmacist in connection with any
business of pharmacy, has been guilty of similar offence during the preceding
twelve months and that the registered pharmacist had knowledge of such
previous offence or infamous conduct; or
5. The offence is an offence under the Drugs and Cosmetics Act, and the
registered pharmacist did not use his intelligence to see that the provision of
this Act were being observed at his place of business by persons under his
control.
The order of Executive Committee directing removal of a name from
the Register should be confirmed by the State Pharmacy Council and it takes
effect only after three (03) months of the date of such confirmation.
The removal of name from the Register may either be Permanent or only for
a specific period of time.
The order of the Executive committee is subject to conformation by the State
Pharmacy Council and does not take effect until after 03 months from the
date of such confirmation.

4. Restoration of Name to the Register:
Pharmacist may go to the appeal to the State Government within 30 days.
The State Govt decision is final.
 Where an appeal against removal was made and rejected by State Government
the name can’t be restored unless confirmed by State Government
A person, whose name has been removed from the register is
required to surrender his certificate of registration to the Registrar of the
Pharmacy Council.

5.  Issue of duplicate certificates of registration:
• Where it is shown to the satisfaction of the Registrar that a
certificate of registration has been lost or destroyed, the Registrar
may, on payment of the prescribed fee, issue a duplicate certificate
in the prescribed form.
