Abstract: In recent years, the disclosure of secrets through cyber infiltration of America’s largest intelligence organization,
the National Security Agency (NSA), has raised the fears of veteran intelligence officials and close allies around the globe that
no institution or government is secure from those who roam the discrete halls of cyberspace. Although espionage has existed
since before the days of the Greek mythological Trojan horse, no one could have envisioned the sophisticated use of
espionage in today’s networked world. Espionage has been used for political and military intelligence and economic and
industrial pursuits with a lack of understanding of all of the impacts on our daily lives. In the context of foreign or international
law, espionage is sometimes characterized as lawless, without controls or regulation, and it rarely distinguishes between

Introduction
Earlier in this class, you explored several misperceptions about the field of intelligence. Movies and popular literature, along with personal experiences, all contribute to these misunderstandings.
A final misperception about intelligence is that intelligence is only gathered on actors outside the borders of the United States. However, an unfortunate reality is that threats to the United States do not all originate from outside the nation. In fact, many threats to this country come from within its borders.
To guard against the full range of threats, the U.S. must engage in domestic intelligence activities and collect information and intelligence within the country.
However, unlike many countries around the world, the U.S. does not have a dedicated domestic intelligence agency and the many approaches to collection are unique. There is also a strict need to preserve the civil liberties of United States citizens and maintain a critical balance between intelligence transparency and secrecy.
Domestic Intelligence
The United States is very unique in that it does not have a dedicated agency responsible for domestic intelligence. Instead, this mission is part of the overall goal of the IC and is implicitly and explicitly stated in the mission and objectives of the Office of the Director of National Intelligence (ODNI).
As you learned in earlier lessons, ODNI was established by the Intelligence Reform and Terrorism Prevention Act of 2004. Within that act, very specific authorities were granted to the Director of National Intelligence (DNI) that directly support the gathering of domestic intelligence (ODNI 2015).

Ensure that timely and objective national intelligence is provided to the President, the heads of departments and agencies of the Executive Branch, the Chairman of the Joint Chiefs of Staff and senior military commanders, and the Congress.

This assignment requires the student to conduct an analysis of Al Qaeda planned and actual
biennial attacks and patterns of operations that coincide with the U.S. national biennial
political campaigns. The analysis anticipates that the terrorist organization desires to carry
out attacks inside America and against Americans, as well as against American interests
abroad.
Your Role and Assignment:
For this project, you will assume the role of an Intelligence Analyst assigned to a State
Fusion Center. A Fusion Center is a collaborative effort of multiple agencies that provide
resources, expertise, and information with the goal of maximizing the ability to detect,
prevent, investigate, and respond to criminal and terrorist activity. Fusion centers conduct
analysis and facilitate information sharing to assist law enforcement and homeland security
partners in preventing, protecting against, and responding to crime and terrorism. State and
major urban area fusion centers serve as primary focal points for the receipt, analysis,
gathering, and sharing of threat-related information among federal, state, local, tribal, and
territorial (SLTT) partners. Fusion centers are located in states and major urban areas
throughout the country and are uniquely situated to enable law enforcement personnel to
gather and share threat-related information.
Given certain trend information, in your intelligence analyst role you have been tasked with
gathering specific information regarding specific past attacks by Al Qaeda. You will note the
majority of listed incidents appear to have occurred during the six months and in the
immediate eight week period preceding the biennial elections. Gathering and collecting
covers the acquisition of raw information through activities such as interviews of confidential
and other sources, surveillances, intercepts, forensics, and liaison relationships. Information
can be gathered from open sources and other more sophisticated sources. You are being
requested to use open sources for this assignment. Open source intelligence is publicly
available and accessible information appearing in electronic or print form and includes radio,
television, newspapers, journals, the internet, commercial databases, drawings, graphics,

1. Introduction
Although many countries all over the world are committing cyber espionage, the United States, Russia, and China
represent the most sophisticated cyber spying capabilities (Senate, 2014). A 2011 Report by the Office of the
National Counterintelligence Executive (ONCIX) suggested that the rise of cyberspace as a platform for
innovation and storage of trade secrets was greatly enhancing the risks faced by American firms. The report also
found that the United States remains the prime target for foreign economic collection and industrial espionage
by virtue of its global technological leadership and innovation (ONCIX, 2011).
Cyber espionage has also become an accepted and even preferred means of warfare. That is not to say that
cyber espionage will replace traditional means of warfare, but it is already affecting the nature of nation-state

Although the United States has a very strong and effective intelligence community, there are several unavoidable challenges that set back some of the processes and hinders the intelligence community from working to its full potential. The most important challenges that I see include flow of information, civil liberties and secrecy.
Since the United States does not have one large domestic intelligence agency that completes all intelligence-related tasks, it is much more difficult for them to be able to transfer information to the right people in a timely manner. I think it is very beneficial that we are able to have such a wide variety of intelligence agencies, each with a specific mission set so subject matter experts can focus on their mission to the best of their abilities, however, on the flip side, many of them have to jump through hoops to get additional information on certain subjects or track down the originator of a product. Having so many different agencies requires a lot more work to get a good flow of communication between the agencies and a lot of valuable information can be lost in the process.
Civil liberties always has and always will be a major challenge for the intelligence community. In order to do their job effectively, intelligence personnel need to be able to conduct surveillance around the clock. Especially in today’s world, people do not want their rights to private taken away, making this jobs very difficult for intelligence and law enforcement personnel. With the rise of domestic terrorism and homegrown extremists, the IC will continue to need increased access in to people’s lives and workplace in order to detect these criminals and prevent future activity.
Lastly, secrecy has been a major challenge to the IC because much of the information dealt with is classified and needs to remain a secret for national security concerns, however, people do not want information kept from there. It is difficult to determine what information should be released to the public to ensure their safety while at the same time, not disrupting an operation. I think the IC has done everything right so far in regards to these issues. There is really no way to fix these challenges while at the same time maintain the high level of national security that we have.

The Federal sureau of Investigation ( FBI ) conducts domestic counterintelligence and counterterrorism operations in addition to its role as the lead law enforcement agency in the country. hese three agencies have implemented sophisticated programs to capture, store, and analyze electronic communications. The Downstream program (formerly called PRISM) extracts data from the ervers of nine major American Intemet companies including AOL, Apple, Facebook, Google, Microsof, Paltalk, Skype, Yahoo, and YouTube to obtain direct access to audio, video, photographs, emails, ocuments, and connection logs for each of these systems. The Upstream program taps into the infrastructure of the Internet to capture the online communications of foreigners outside the United States ulile their communications are in transit. The leaders of the intelligence agencies argue that these programs are essential to fighting terrorism. The agencies can also provide a dozen or more examples of ow use of the data gathered by these programs has thwarted the efforts of terrorists around the world. he programs are authorized by Section 702 of the FISA Amendments Act which authorizes surveillance of any foreigner overgeas, provided the purpose is to obtain "foreign intelligence " The Act loosely efines "foreign intelligence" to mean any information that "relates to" the conduct of foreign affairs. This broad definition mears that the target being survelled need not be a terrorist. The target needs only be thought to have information that is relevant to the government's foreign intelligence objective-whatever that may be. he process of gathering foreign electronic communications necessarily means the incidental capture of many conversations involving an American (who may be here in the United States) and a foreign arget. They may well be having a totally innocent communication with a foreign triend, relative, or business partner who is not suspected of any wrongdoing whatsoever. The total number of Americans' ommunications "incidentally" collected since the inception of Section 702 is well into the millions. fection 702 also allows the government to pool all the messages it intercepts into a giant database and then search the database, including conversations involving Americans - without a warrant. The year is 2014. The Intelligence Community is ten years into its efforts to
implement the Intelligence Reform and Terrorism Prevention Act (IRTPA). While
change has been evident on many fronts, nothing was more closely identified with
intelligence reform than information sharing; ever since the 9/11 Commission
declared that “the biggest impediment to all-source analysis – to a greater
likelihood of connecting the dots – is the human or systemic resistance to sharing
information”1, the two had been inextricably linked. And while we were pushing
more electrons than ever before, dissatisfaction continued: in 2014, as in 2009,
no analyst in the IC had effective access to all information; analysts in many parts
of the Community complained that they couldn’t get operational traffic or law
enforcement information; we had little ability to do large scale processing of
foreign and domestic data sets; our non Federal partners were still dissatisfied
with the quality of information sharing. A dizzying array of directives had been
issued. Arbitration procedures had been established. And yet organizations
weren’t getting the information they claimed to “need.” Legitimate issues
coexisted with tripe. According to the critics, we still couldn’t connect those dots.
The reality, however, was far more complex: the only question was whether it
took a major intelligence failure to realize that fact.
This is the path we’re on. We will continue to hear claims that information sharing has
“barely improved since 9/11.” Such hyperbole is unmitigated nonsense. The robust sharing of
information between and among the key organizations has undoubtedly contributed to the fact
that we haven’t suffered a major attack. And by any objective standard, the level of sharing

What reasons did he have for leaving his home country and why did he choose the U.S. as his new home? He stated that he wanted to leave the Philippines for a better life and more opportunities. He had grown up as the youngest of nine children and was very poor, but was able to study medicine and become a medical doctor specializing in ophthalmology. He heard that the U.S. was encouraging medical professionals to work there especially if they were fluent in English. According to our reading "Filipinos in America," (Lee 2015) the Philippines was a colony of the U.S. from 1898-1945 and English was taught in the education system (Lee, p. 90). Plus, many Filipinos then and still today dream about immigrating to the United States to improve their educational and financial opportunities. Dr. Villanueva came to the U.S. after the 1965 Immigration and Nationality Act abolished national quotas but limited immigration from Asia to educated professionals. When I asked if he felt that he experienced discrimination, Dr. Villanueva said yes, many times, but overall he is glad that he immigrated because his children had so many more opportunities in the U.S. Often, people still think that he is a foreigner or can't speak English. There have been a few occasions that people directed racial slurs at him, but he has not experienced any physical harm.
Dr. Villanueva seems to fit much of the data on Asian Americans that we studied in this class. However, I noticed some ways that he did not. Abstract: In recent years, the disclosure of secrets through cyber infiltration of America’s largest intelligence organization,
the National Security Agency (NSA), has raised the fears of veteran intelligence officials and close allies around the globe that
no institution or government is secure from those who roam the discrete halls of cyberspace. Although espionage has existed
since before the days of the Greek mythological Trojan horse, no one could have envisioned the sophisticated use of
espionage in today’s networked world. Espionage has been used for political and military intelligence and economic and
industrial pursuits with a lack of understanding of all of the impacts on our daily lives. In the context of foreign or international
law, espionage is sometimes characterized as lawless, without controls or regulation, and it rarely distinguishes between
economic and security based cyber espionage. Through empirical analysis this paper explores the treatment of espionage
under various legal systems including those countries and regions considered the most advanced at cyber espionage, the
United States, the United Kingdom, Russia and China. To provide greater insight into the different perspectives of cyber
espionage from a legal standpoint, this paper distinguishes the law of national intelligence collection from the criminal laws
of economic/industrial espionage on the domestic front. The purpose of this research is to analyze the development of cyber
espionage as a preferred means of contemporary warfare, as well as a tool for economic and political intelligence. The paper
concludes by responding to the challenges faced by nation-states in the development of an effective legal system governing
espionage at the domestic and international level.

Although many countries all over the world are committing cyber espionage, the United States, Russia, and China
represent the most sophisticated cyber spying capabilities (Senate, 2014). A 2011 Report by the Office of the

Although the United States has a very strong and effective intelligence community, there are several unavoidable challenges that set back some of the processes and hinders the intelligence community from working to its full potential. The most important challenges that I see include flow of information, civil liberties and secrecy.
Since the United States does not have one large domestic intelligence agency that completes all intelligence-related tasks, it is much more difficult for them to be able to transfer information to the right people in a timely manner. I think it is very beneficial that we are able to have such a wide variety of intelligence agencies, each with a specific mission set so subject matter experts can focus on their mission to the best of their abilities, however, on the flip side, many of them have to jump through hoops to get additional information on certain subjects or track down the originator of a product. Having so many different agencies requires a lot more work to get a good flow of communication between the agencies and a lot of valuable information can be lost in the process.
Civil liberties always has and always will be a major challenge for the intelligence community. In order to do their job effectively, intelligence personnel need to be able to conduct surveillance around the clock. Especially in today’s world, people do not want their rights to private taken away, making this jobs very difficult for intelligence and law enforcement personnel. With the rise of domestic terrorism and homegrown extremists, the IC will continue to need increased access in to people’s lives and workplace in order to detect these criminals and prevent future activity.
Lastly, secrecy has been a major challenge to the IC because much of the information dealt with is classified and needs to remain a secret for national security concerns, however, people do not want information kept from there. It is difficult to determine what information should be released to the public to ensure their safety while at the same time, not disrupting an operation. I think the IC has done everything right so far in regards to these issues. There is really no way to fix these challenges while at the same time maintain the high level of national security that we have.

The year is 2014. The Intelligence Community is ten years into its efforts to
implement the Intelligence Reform and Terrorism Prevention Act (IRTPA). While
change has been evident on many fronts, nothing was more closely identified with
intelligence reform than information sharing; ever since the 9/11 Commission
declared that “the biggest impediment to all-source analysis – to a greater
likelihood of connecting the dots – is the human or systemic resistance to sharing
information”1, the two had been inextricably linked. And while we were pushing
more electrons than ever before, dissatisfaction continued: in 2014, as in 2009,
no analyst in the IC had effective access to all information; analysts in many parts
of the Community complained that they couldn’t get operational traffic or law
enforcement information; we had little ability to do large scale processing of
foreign and domestic data sets; our non Federal partners were still dissatisfied
with the quality of information sharing. A dizzying array of directives had been
issued. Arbitration procedures had been established. And yet organizations
weren’t getting the information they claimed to “need.” Legitimate issues
coexisted with tripe. According to the critics, we still couldn’t connect those dots.
The reality, however, was far more complex: the only question was whether it
took a major intelligence failure to realize that fact.
This is the path we’re on. We will continue to hear claims that information sharing has
“barely improved since 9/11.” Such hyperbole is unmitigated nonsense. The robust sharing of
information between and among the key organizations has undoubtedly contributed to the fact
that we haven’t suffered a major attack. And by any objective standard, the level of sharing

I conducted a 10 minute interview with my neighbor "Dr. Villanueva" who immigrated to the U.S. over 45 years ago at the age of 26. I asked him about his push and pull factors. What reasons did he have for leaving his home country and why did he choose the U.S. as his new home? He stated that he wanted to leave the Philippines for a better life and more opportunities. He had grown up as the youngest of nine children and was very poor, but was able to study medicine and become a medical doctor specializing in ophthalmology. He heard that the U.S. was encouraging medical professionals to work there especially if they were fluent in English. According to our reading "Filipinos in America," (Lee 2015) the Philippines was a colony of the U.S. from 1898-1945 and English was taught in the education system (Lee, p. 90). Plus, many Filipinos then and still today dream about immigrating to the United States to improve their educational and financial opportunities. Dr. Villanueva came to the U.S. after the 1965 Immigration and Nationality Act abolished national quotas but limited immigration from Asia to educated professionals. When I asked if he felt that he experienced discrimination, Dr. Villanueva said yes, many times, but overall he is glad that he immigrated because his children had so many more opportunities in the U.S. Often, people still think that he is a foreigner or can't speak English. There have been a few occasions that people directed racial slurs at him, but he has not experienced any physical harm.
Dr. Villanueva seems to fit much of the data on Asian Americans that we studied in this class. However, I noticed some ways that he did not. What you need to do For a planar truss, every node has 2 degrees of freedom, the e1 and e2 directions. Therefore, for every planar truss problem, the total number of degrees of freedom (DOF) in the structure is equal to 2 times the number of nodes. We will consider the first degree of freedom for each node as the component acting in the e1 direction. So for any given node, i, the corresponding degree of freedom is (2·i)-1. For the same node, i, the corresponding value for the second degree of freedom, the component in the e2 direction, is 2-i. This numbering notation can be modified for a space truss.
